ADJOURNMENT 090897.RGM The Bi -Monthly Meeting of the Town Board of the Town of Wappinger was held on September 8, 1997 at the Town Hall, 20 Middlebush Road, Wappingers Falls, New York. Supervisor Smith Called the Meeting to order at 7:30 P.M. Present: Constance Smith, Supervisor Joseph Ruggiero, Councilman Robert Valdati, Councilman Vincent Bettina, Councilman (arrived after Pledge) Elaine H. Snowden, Town Clerk Others Present: Albert Roberts, Attorney to the Town Jay Paggi, Engineer to the Town Graham Foster, Highway Superintendent Absent: June Visconti, Councilwoman The Supervisor asked all to join in the Pledge of Allegiance. INTERNAL DEPARTMENTAL BUSINESS The first item for the Boards consideration is a request for a Budget Transfer from Graham Foster, Highway Superintendent, in the amount of $10K from account 5142.1 to account 5140.1. This transfer is necessary due to the April 1st storm which caused an enormous amount of brush brought to the Highway Department. Mr. Foster found it necessary to employ more men on Saturdays, and the monies will be used for the remainder of the year for chipping brush and the mowing of the Town. COUNCILMAN RUGGIERO moved to approve the Budget Transfers of $10K from account 5142.1 to account 5140.1 as requested by Graham Foster. Seconded by Mr. Bettina Motion Unanimously Carried A request for the return of Escrow Funds in the amount of $3,416.74 from Robert J. Gray, P.E. on behalf of his client BGHKR Mid Hudson Pollution Control, Inc. COUNCILMAN RUGGIERO moved to authorize the return of the above Escrow in the amount of $3,416.74, payable to Robert J. Gray, P.E., on behalf of BGHKR, Mid Hudson Pollution Control, Inc., upon the recommendation of the Zoning Administrator, Donald Close. Seconded by Mr. Valdati Motion Unanimously Carried At a recent Town Board Meeting, Mr. Nick Johnson requested the Town Board to consider STOP signs on Gabriella and Joel Place. The Board requested Graham Foster, Highway Superintendent to inspect the area and return back with his recommendation. Mr. Foster inspected the intersections 1 090897.RGM and offers the following: The two intersection in question are Gabriella where it intersects Dorett Lane and Dorett where it intersects Joel Place. In general the traffic is low volume, and mostly local in this area. There is adequate site distance to see oncoming cars. The area has existed, as is, for 25 to 30 years with few if any incidents. For these reasons, Mr. Foster would not recommend these intersections for full stop control, however since the question has been raised, it may be wise to identify who has the right of way. This can be accomplished by installing yield signs on Gabriella where it intersects Dorett Lane and Dorett where it intersects Joel Place. This should clarify the situation. COUNCILMAN RUGGIERO moved to accept the correspondence from Mr. Foster and place it on file. Seconded by Mr. Bettina Motion Unanimously Carried At this time Councilman Valdati wished to address the topic of Montclair Townhouse. He attended a yearly meeting of the Montclair Townhouse Association. As you know we were trying to get something done about the dangerous conditions in regard to the entrance of Montclair. A traffic light was not possible, because it was not a Town Road. The residents asked Mr. Valdati if he would propose a mini feasibility study of the acceptance of Alpine Drive as a Town Road. They also wished to know, if they decided they want to be part of the 3A sewer phase, what would their cost be. Mr. Paggi informed Mr. Valdati that we have those numbers and could make that a separate option. COUNCILMAN VALDATI moved to authorize Engineer to the Town, Jay Paggi, and Attorney to the Town, Al Roberts, with the help of the Highway Superintendent, to perform a mini feasibility study of Alpine Drive for acceptance as a Town Road, and move to authorize Mr. Paggi to provide the cost of the 3A sewer phase be included as an option for Montclair. Seconded by Mr. Ruggiero Motion Unanimously Carried At last months meeting, Mr. Roberts provided correspondence from Hon. Carl S. Wolfson regarding approximately $290 in unclaimed bail monies. The Board chose to table any decision at that time. Mr. Roberts went on to explain, that the unclaimed bail monies have to be forfeited to the Comptroller, and in order to do that, he must bring a motion to Supreme Court. He wanted to wait until there was at least $500. COUNCILMAN RUGGIERO moved to leave as it is temporarily, and table. Seconded by Mr. Bettina Motion Unanimously Carried �A 090897.RGM WORKSHOP The first item on the workshop, is Mr. Cohen, with his follow up to answer any questions on the Metlife Voluntary Permanent Life Program that he presented to the Town Board at last months meeting. COUNCILMAN VALDATI moved to authorize Mr. Cohen to present his Metlife Voluntary Permanent Life Program to the Town Employees so they can make there own decision. Seconded by Mr. Ruggiero Motion Unanimously Carried SUPERVISOR SMITH introduced the following resolution for acceptance. The following resolution was offered by COUNCILMAN RUGGIERO and seconded by Mr. Bettina WHEREAS, New York State Real Property Tax Law S485 -B, as amended, allows municipalities to offer partial abatement from real property taxes from new industrial and agricultural construction, and WHEREAS, in accordance with the statute as amended, the County of Dutchess has enacted a Local Law No. 5 of 1996 which establishes as Industrial and Commercial Incentive Board, pursuant to S485 -B of the Real Property Tax Law; and WHEREAS, the Town of Wappinger is an active voting member of said Board, which is constituted for purposes of applying the tax abatement provisions for 5485-B to each township within the County; and WHEREAS, the County's duly formed Industrial and Commercial Incentive Board has requested the Town of Wappinger to make recommendations as to the conditions which should prevail within the borders of the Town of Wappinger for application of S485 -B in the areas of (a) geographic coverage, (b) exemption threshold, © appropriate exemption schedule, and (d) appropriate commercial and industrial categories entitled to exemption; NOW, IT IS HEREBY RESOLVED that the following shall constitute the Town Board's comment and recommendations to the County's Industrial and Commercial Incentive Board: 1. The appropriate geographic area for S485 -B coverage shall be the entire Town of Wappinger so long as the uses entitled to exemption constitute permitted uses in the zoning districts where new development and construction is proposed. 2. In the Town of Wappinger, the exemption shall apply only to capital investments in excess of $50,000. 3. The SIC categories entitled to exemption within the Town of Wappinger should be those identified upon Appendix A annexed hereto. Motion Unanimously Carried A Memo was received from Dare Fitzpatrick of CAMO Pollution Control, Inc. regarding the Tree damage at 5 Mohawk Drive, owned by Mr. Godwin. On, Friday, August 29, 1997 CAMO Pollution Control, Inc., received a call from the Town of Wappinger regarding a tree limb hitting the house at 5 Mohawk Drive. Mr. Fitzpatrick responded to the call and found that a limb from a tree, which appears to be on Town of Wappinger Water Plant property, had indeed fallen and hit the corner of the house. The limb caused damage to a small portion of the gutter on the back of the house. The owner also believes that the limb has caused some damage to the siding of the house. CAMO personnel cleaned up the downed limb on Friday afternoon. Mr. Fitzpatrick would like the Town Board to authorize Engineer to the Town, to survey and lay out the property line from Mohawk Drive to Iroquois Drive so this tree and any other tree that may cause future damage can be located within the proper owner's boundaries. After this is done, the appropriate measures can be taken with the trees. COUNCILMAN VALDATI moved to authorize Jay Paggi, Engineer to the Town survey the property to determine if the tree is on Town or private property and if it is on Town property authorize Highway Superintendent to hire a contractor to remove tree. Seconded by Mr. Ruggiero Motion Unanimously Carried COUNCILMAN VALDATI moved, if determined that it is our tree, to authorize Supervisor Smith to contact the Town's Insurance company and get an estimate for damages sustained to homeowners property. Seconded by Mr. Ruggiero Motion Unanimously Carried Mr. Paggi suggested that the trees on Iroquois and other trees that are abutting residential property be looked at also. There was some discussion on the Town easements as to responsibility. Recreation, Water, or the Town. COUNCILMAN RUGGIERO moved to hold a workshop on establishing responsibilities for certain easements in the Town. Public Administration 9100 Executive, legistativ* and general government 090897.RGM Next is a letter from Yvonne Tompkins, Secretary for Chelsea Fire District, requesting the Town to consider changing the names of two road in Chelsea. One is to relocate the Market Street sign back to the corner of North Street. From the beginning of Chelsea, Market Street has gone from River Road South to the beginning of River Road North, which begins at the corner of North Street. The second is to change the name of Broadway which starts at Liberty Street and runs west to intersect with Market Street to continue on as Chelsea Road. The reason for this request is the confusion emergency ambulance services had during the past few months trying to locate the emergency. Mr. Foster, Highway Superintendent reminded the Board that both roads in question are County Roads, and we have never accepted them. A Local Law would have to be established to change signs. COUNCILMAN BETTINA moved to authorize Supervisor Smith to write to the County to maintain that area, and set up a meeting with the County Engineer to determine what course of action to take, and send a carbon copy to Chelsea Fire District. Seconded by Mr. Ruggiero Motion Unanimously Carried Correspondence from Steve Curran informing the Town that Dutchess County is in the process of acquiring title to certain parcels in the Town for nonpayment of taxes. Mr. Curran is requesting the Town to review his list, and if the Town is interested in purchasing one or more of the parcels prior to the tax auction, to contact his office. COUNCILMAN RUGGIERO moved to accept the correspondence and place it on file. Seconded by Mr. Valdati Motion Unanimously Carried At this time, COUNCILMAN VALDATI questioned Mr. Close, Zoning Administrator, on the status of the Greer Toyota Parcel. Mr. Close responded that it has been postponed for 60 days. Also, the status of the Communication Tower on Wheeler Hill. Mr. Close responded, it is going to be dismantled by the owner. COUNCILMAN RUGGIERO had spoken to Supervisor Smith, on a suggestion that a resident presented to him on Oakwood Sewer Plant that is going to be dismantled. Its a nice piece of property, and wondered if we could take the money that was to revert back to the original homeowners, and use it to clean up the property and turn it into a mini park. COUNCILMAN RUGGIERO moved to authorize Attorney to the Town, Al Roberts, and Engineer to the Town to look into the feasibility of turning the property into a mini park. til Seconded by Mr. Bettina 090897.RGM Motion Unanimously Carried COUNCILMAN RUGGIERO moved to authorize Mr. Roberts, Attorney to the Town to prepare an opinion on the condemnation of lands, with a broad time frame also. Seconded by Mr. Valdati Motion Unanimously Carried COUNCILMAN VALDATI, on Wheeler Hill Road. He questioned Mr. Foster, Highway Superintendent on the status of Wheeler Hill Road. The widening and the moving of utility poles. Mr. Foster responded that he is trying to work with Greystone to see if they will allow us to do it on their property. There was no other Business to come before the Board. COUNCILMAN BETTINA moved to close the Town Board Meeting, seconded by Mr. Ruggiero and Unanimously Carried.
