ADJOURNMENT REMINDER: PUBLIC HEARINGS START AT 6:50 P.M. 032497.RGM The Regular Meeting of the Town Board of the Town of Wappinger was held on March 24, 1997 at the Town Hall, at 20 Middlebush Road, Wappingers Falls, New York. Supervisor Smith called the Meeting to order at 7:30 P.M. Present: Constance Smith, Supervisor Joseph Ruggiero, Councilman Robert Valdati, Councilman Vincent Bettina, Councilman June Visconti, Councilwoman Elaine H. Snowden, Town Clerk Others Present: Albert Roberts, Attorney to the Town Jay Paggi, Engineer to the Town Graham Foster, Highway Superintendent Ann Buckley, Comptroller The Supervisor asked all to join in the Pledge of Allegiance to the Flag. MINUTES The Minutes of the Regular Meeting of February 24, 1997 and Special Meeting of March 10, 1997 having previously been forwarded to the Board Members, were now placed before them for their consideration. COUNCILWOMAN VISCONTI moved that the above stated Minutes as submitted by the Town Clerk be and they are hereby approved. Seconded by Mr. Bettina Motion Unanimously Carried REPORTS OF OFFICERS Reports for the month of February were received from the Town Justices, Supervisor/Comptroller, Building Inspector, Recreation Committee Report for 1996. The Supervisors Annual Report was filed with Mrs. Snowden, Town Clerk on February 27, 1997 also. COUNCILWOMAN VISCONTI moved to accept the reports and place them on file. Seconded by Mr. Ruggiero Motion Unanimously Carried At last months Town Board Meeting, Mr. Valdati indicated that the Board had deemed it desirable to have all Department Heads in attendance at the Town Board Meetings, and noticed that only Mrs. Buckley was present. Supervisor Smith went on to explain that she would remind the Department �rw Heads in writing. PETITIONS & COMMUNICATIONS A petition was received from homeowners residing on Russell Road requesting street lights be installed. They feel that street lights would be a safety feature on their road. 1 032497.RGM COUNCILWOMAN VISCONTI moved to authorize Supervisor Smith obtain the costs and notify residents to confirm if they wish to spend the money. Seconded by Mr. Valdati Motion Unanimously Carried Correspondence was received from Steven Stroh, (to the Receiver of Taxes) in regard to the deteriorating condition of the Oakwood Knolls Sewer Plant. According to Mrs. Smith, Michael Tremper of CAMO is taking care of this problem. Mr. Foster reminded the Town Board that there is a large generator at the Oakwood Sewer Plant, and if we are going to demolish the plant we should consider bringing the generator to the Town Hall for emergency purposes. COUNCILWOMAN VISCONTI moved to accept the correspondence and place it on file. Seconded by Mr. Valdati Motion Unanimously Carried Correspondence was also received from Scott Taylor, Minister of the Mid - Hudson Christian Science Church with a request that their land be included in the Town's Tri -Municipal plan as soon as possible. COUNCILMAN RUGGIERO moved to accept the correspondence and place it on file. Seconded by Mrs. Visconti Motion Unanimously Carried Correspondence from Mary Delulio and Veronica Brown of Peters Road requesting consideration of early entry into the Tri -Muni Sewer System. Both residents have resided in the area for over 25 years and have had to put up with the many problems that arise from having a septic system. COUNCILMAN BETTINA moved to accept the correspondence and place it on file. Seconded by Mrs. Visconti Motion Unanimously Carried Correspondence from Mr. & Mrs. Robert Bugbee of Larissa Lane, which is located in Serenity Mission, regarding the installation of sewers. They recently checked with the Town and were told that at present, Serenity Mission development was not included. Many of the homes were built twenty to twenty five years ago, and the septic tank drain fields are breaking down. They would appreciate any help from the Town on this matter. Engineer to the Town Jay Paggi went on to explain that Serenity Mission was in option four, Shale Drive, and he has been telling these people, in an interim report, if they are in the Edgehill exclusion, they were being studied as a alternate in the plan presently in front of the Town Board. Mrs. Visconti said she 011 " 032497.RGM would contact the Bugbees and explain, perhaps it would be easier and less costly for them to put in a new septic system at this time. COUNCILWOMAN VISCONTI moved to table and she will report back to the Board. Seconded by Mr. Ruggiero Motion Unanimously Carried A letter of resignation was received from Dawn Idema, Assessors Aide for the Town of Wappinger, effective March 7, 1997. COUNCILWOMAN VISCONTI moved to accept the resignation of Dawn Idema and place it on file. Seconded by Mr. Ruggiero Motion Unanimously Carried Correspondence from Linda Nguyen, Secretary Zoning Board of Appeals with the Zoning Boards recommendation regarding accessory apartments. The Zoning Board would like to include that the owner who is applying for the accessory apartment own the building and live in it for at least two to five years. The intent of this addition is to help the residents of the Town of Wappinger and not to become a magnet that will attract new residents because of our lenient accessory apartment regulations. COUNCILMAN VALDATI moved to have a workshop on the Zoning Boards recommendations with Dan Wery, Zoning & Planning Board members in attendance. Seconded by Mr. Bettina Motion Unanimously Carried Several requests from Ralph Holt, Recreation Chairman. The first is permission to run a bridge program at Schlathaus Park (house) for the Town Citizens. The program would run from 9-12 one morning a week using the facilities at Schlathaus. There would be no cost for the program as the needed resources at Schlathaus are already there. COUNCILWOMAN VISCONTI moved to approve Mr. Holt's request to run a bridge program at Schlathaus Park for the Town Citizens. Seconded by Mr. Ruggiero Motion Unanimously Carried Mr. Holt also requests permission to obtain a P.O. in the amount of $3,248.00, payable to Miracle Recreation for the purchase of a 8 ft. High 16 ft. long stainless steel slide for Robinson Lane. Three quotes were received. Although the price of the slide from Miracle Recreation is the most expensive, we feel that their slide has better safety features, their material is of a higher standard and they provide ground preparation for surface treatment. Miracle 3 032497.RGM Recreation is local and over the years they have provided us. The funds to come out of Recreation 7310.2B account. COUNCILWOMAN VISCONTI moved to authorize a P.O. in the amount of $3,248.00, payable to Miracle Recreation for the purchase of a stainless steel slide for Robinson Lane. Seconded by Mr. Ruggiero Motion Unanimously Carried Recreation also requests permission to obtain P.O. in the amount of $1,034.00, payable to Miracle Recreation for the purchase of one (1) bleacher frame with side and back rails. Three quotes were received, Miracle Recreation being the lowest. The funds to come out of Recreation 7310.2B account. COUNCILWOMAN VISCONTI moved to authorize a P.O. in the amount of $1,034.00, payable to Miracle Recreation for the purchase of one (1) bleacher frame with side and back rails, they being the lowest quote. Seconded by Mr. Valdati Motion Unanimously Carried Recreation is planning on using the facilities at Roy C. Ketcham High School for a back up (rain site) for the West Point Jazz Concert to be held June 19, 1997 from 7:00 to 10:00 P.M. The school is requesting that a certificate of insurance be forwarded to them naming the Wappinger Central School District as "additional named insured". Mr. Holt requests approval for this certificate to be sent to Roy C. Ketcham High School, Myers Corner Road. COUNCILWOMAN VISCONTI moved to authorize a certificate of insurance naming Wappinger Central School as "addition name insured" for the West Point Jazz Concert for June 19, 1997 (rain site). Seconded by Mr. Valdati Motion Unanimously Carried The last request from Mr. Holt, is permission for several members of the Recreation Committee to attend the New York State Recreation & Park Society annual conference, from May 3rd to May 9th in Lake Placid, New York. Those wishing to attend are, Mr. diPierno, Miss Gutzler, Mrs. DeLisa and Mrs. Roe. COUNCILMAN VALDATI moved to approve the request from Mr. Holt for Mr. diPierno, Miss Gutzler, Mrs. DeLisa and Mrs. Roe to attend the New York State Recreation and Park Society Conference and their legitimate expenses be a Town charge. Seconded by Mrs. Visconti Motion Unanimously Carried 4 032497.RGM Several reports from Engineer to the Town, Jay Paggi. The first report concerns a call Mr. Paggi received from Mrs. Riccobono of 80 Widmer Road regarding the current drainage situation in front of her house. She asked that he come look at it. Mr. Paggi explained that he would need authorization from the Board prior to making a field investigation, and advised her that he would make this request to the Town Board. Highway Superintendent, Graham Foster informed the Board that Mrs. Riccobono also contacted him, and he informed her that there was nothing he could do, and suggested that she speak with Mr. Paggi, because it is in the area where the new road is going through, and if he were to go out now, he would be wasting blacktop because the contractor would be ripping out within a month. We should take it into consideration as part of the project. Mr. Paggi informed the Board that the only drainage work that was included in that project was the addition of one Catch Basin in front of Mr. Berberich's driveway on the east side of the road. Perhaps some blacktop or swales can get rid of the water. COUNCILMAN RUGGIERO moved to authorize Engineer to the Town, Jay Paggi investigate and report back to the Board. Seconded by Mrs. Visconti Motion Unanimously Carried Next is a request for a change order for the Capuano resident on Drew Court. Mrs. Capuano lives on Drew Court, and her backyard faces out to Old Hopewell Road. The Capuano's granted an easement to the Town of Wappinger for drainage purposes in order to facilitate the construction of the Rockingham Drainage Improvements. The area has been cleared by the contractor in anticipation of construction of the pipe. When the clearing was done, it became obvious to Mrs. Capuano that the areas immediately to the west of her property and the roadway in the extreme southwest corner of her property was quite visible. She called Mr. Paggi's office to request that the fence be constructed along the northerly right-of-way of Old Hopewell Road and her westerly property line to connect the fence and make it continuous. The total footage that would be added is approximately 80' across the westerly property line and 56' along the northerly edge of Old Hopewell Road for a total of 136'. At the contractor unit price of $25 per foot, this would equal approximately $3,400.00. This would be a Change Order to the contract, if approve by the Board. COUNCILMAN RUGGIERO moved to approve the Change Order for $3,400.00 to provide additional fencing for the Capuano residence as requested by Engineer to the Town, Jay Paggi. Seconded by Valdati 5 032497.RGM Motion Unanimously Carried The next report concerns the Hindu Samaj Temple on Brown Road.. As previously discussed with Mr. Ricotta, Building Inspector, the sewer lateral for Hindu Samaj Temple has been experiencing infiltration. Mr. Paggi requested that the Certificate of Occupancy for the building and/or hookup to sewer main not be allowed until this infiltration is identified and repaired. The sewer lateral at that point must be tested for infiltration and exfiltration. A recent field inspection indicated that the lateral is still experiencing substantial infiltration. The Certificate of Occupancy should not be issued until the above is straightened out. COUNCILWOMAN VISCONTI moved to accept the report and place on file Seconded by Mr. Valdati Motion Unanimously Carried Next is a Memorandum from Mr. Paggi to Mr. Foster, Highway Superintendent and Attorney to the Town Al Roberts concerning Old Troy Road. Mr. Paggi prepared a base map drawn showing the takings necessary to perform the Highway improvement. Prior to making the final touches to the acquisition maps he wishes to meet with them to discuss the final dimension. Mr. Valdati requested to know at what point in time the easterly guard rail would be repaired. Mr. Foster informed Mr. Valdati that this was one of the projects that he had proposed several years ago for the SHIPS program to allocate the funds to purchase property from Mrs. Reese to move that road over, but we never did. The only thing to be done is pull the rail out, weld another piece on the end of it and try to drive it in. There is no bank, nothing to hold the guard rail. Mr. Foster said he would look at it again, to see what he can do. It erodes away every year. COUNCILWOMAN VISCONTI moved to accept the report and place it on file. Seconded by Mr. Valdati Motion Unanimously Carried Mr. Paggi also submitted a copy of the survey map prepared for Robinson Lane/Lindsey Court. As you can see, the trees are approximately 12' off the edge of the pavement and T behind the property line. Pins have been staked in the field for the Board to review. COUNCILWOMAN VISCONTI moved to accept the survey map prepared by Mr. Paggi, and place it on file. Seconded by Mr. Valdati Motion Unanimously Carried On Wednesday, February 19, 1997 Mr. Paggi submitted, and initially presented the Phase 3A Interim Map, Plan and Report, to the members of D 032497.RGM the Town Board. He was requested to provide an analysis of the Phase 3A areas being considered for removal from the project, more specifically, the effect on the total cost per benefit unit. COUNCILWOMAN VISCONTI moved to accept Mr. Paggi analysis of the areas being considered from the project and the cost per benefit unit, and place it on file. Seconded by Mr. Bettina Motion Unanimously Carried As instructed, Mr. Paggi contacted Joseph Marcogliese of the NYSDEC regarding the Montclair Condominiums and their potential for inclusion in the WSSTI Phase 3A. A year ago we attended a meeting at Mr. Marcogliese's office relative to the work they needed to do at their treatment facility to make sure that it remains in compliance. A sampling was analyzed, and it was determined that the plant was in compliance with the permit, and running fairly well. To this date, the plant is still in compliance with this permit, and therefore, Mr. Marcogliese finds no basis for urging or requiring them to join the centralized sewer system. In a related matter, Mr. Marcogliese asked if we were pursuing and following up with the funding of Phase 3A from the Environmental Bond Act. I mentioned that we were, and are aware that the application forms were going to be made available in the April time frame. COUNCILWOMAN VISCONTI moved to accept the correspondence and place it on file. Seconded by Mr. Bettina Motion Unanimously Carried In a letter to the Town Board on February 21, 1997 Mr. Paggi provided an economic analysis of all areas being considered for removal from Phase 3A. In a subsequent meeting on February 24, 1997 the Town Board requested further clarification of the data provided, and a discussion of what application it may or may not have. In general, the actual cost per benefit unit increase for a given combination of options will be less than the sum of their cost differentials. Also requested by the Town Board in the same meeting was a total cost per benefit unit for all proposed areas, including all options, sub -areas, etc., and excluding non. This alternative would cost $961.00 per benefit unit with 3056 total units being served. If Montclair Condominiums only is removed from this scenario, the total cost increases to $1,074.00 per benefit unit. COUNCILWOMAN VISCONTI moved to accept the Mr. Paggi's report and place it on file. Seconded by Mr. Bettina ti 032497.RGM Motion Unanimously Carried A memorandum from Mr. Paggi's office informing the Town Board that his office received two letters relevant to funding under the Environmental Bond Act Phase 3A. The first, is a letter from Assemblyman Joel Miller to Stephen Bobarakis of the NYSDEC, requesting a formal application for funding on behalf of the Town of Wappinger. Although redundant, this will help ensure that we receive our application as soon as they are made available. The second letter is from John P. Cahill, acting commissioner of the NYSDEC. It announces a meeting on Wednesday, March 12, to discuss the scoring criteria to be used for the ranking of proposed projects, as well as the application process itself. The letter also states that another set of meetings will be held sometime in late March, to provide additional details on each of the Bond Act programs. COUNCILWOMAN VISCONTI moved to accept the memorandum from Mr. Paggi's office and place it on file. Seconded by Mr. Bettina Motion Unanimously Carried Mr. Paggi also submitted a copy of his meeting notes from the February 19, 1997 Town Board Workshop, Phase 3A Sewer meeting. Mr. Paggi requested the Board to review the notes and contact his offices for any discrepancies. COUNCILWOMAN VISCONTI moved to accept Mr. Paggi's notes from the Town Board Workshop of February 19, 1997, and place it on file. Seconded by Mr. Bettina Motion Unanimously Carried The next report concerns providing service to the Castle Point Recreation area. After much deliberation it was decided to provide service to the recreation parcel underground from an existing pole approximately 1,100 feet north of the site. A trench will be dug adjacent to the existing roadway approximately 24' of the edge of pavement. The ditch would be dug and back- filled by the Highway Department, and the cable would be provided and laid by Central Hudson. COUNCILWOMAN VISCONTI moved to accept the report and place it on file. Seconded by Mr. Bettina Motion Unanimously Carried The next report concerns the February 10, 1997 Draft Engineer's Map, Plan & Report for the Proposed Combined Wappinger Water Improvement Area. This draft report was written in direct response to concerns regarding the Fleetwood Water District and other areas of the Town that require water service. The report was drafted at a level of detail that was not that of a final E:3 032497.RGM report. Since that time, Attorney to the Town, Al Roberts, has voiced a number of concerns and questions regarding the structure of the Improvement and how it should be assessed against various properties within the proposed Improvement. It is the recommendation of Mr. Paggi, that the Town schedule meetings with Bond Council and the Department of Audit and Control, to determine what the final outcome of the Improvement should be, and that we then modify the report to be consistent with their requirements. COUNCILWOMAN VISCONTI moved to table this report to the April 2nd workshop at 6:30 P.M. Seconded by Mr. Bettina Motion Unanimously Carried A memorandum to Graham Foster, Highway Superintendent, Michael Tremper, CAMO Pollution Control, and Daniel O'Connor, P.E., DCHD with a copy of a proposed Combined Sanitary Sewer and Water Trench in both dry soil conditions and wet soil conditions. The Town is considering extension of central sewer and water facilities, some of which are located on the same streets. Coordination of the utilities in the same trench could result in a considerable cost saving for the Town. Mr. Paggi requests that it be reviewed by all, and advise him with their comments. Supervisor Smith informed the Board that an answer was received from CAMO today. COUNCILWOMAN VISCONTI moved to table to the April 2nd workshop with Mr. Rothman to discuss the whole project. Seconded by Mr. Bettina Motion Unanimously Carried The last report from Mr. Paggi concerns the Montclair Condominiums. As requested, he spoke to Dan O'Connor of the Dutchess County Health Department regarding the issue of their inclusion in the proposed Phase 3A of the Wappinger Sewer Transmission/Treatment Improvement. Mr. O'Connor stated that he had no new information on the treatment facility and/or its operation to offer at this point in time. He did indicate, however, that it was his opinion that the proper disposition of the plant would be to have it abandoned and have it connected into the Town's Centralized sewer system. Mr. O'Connor stated that he would attend a meeting with the Town Board and the residents, to discuss the same, if requested. COUNCILWOMAN VISCONTI moved to accept the correspondence and place it on file. Seconded by Mr. Bettina Motion Unanimously Carried E 032497.RGM A memorandum was received from Matthew Rudikoff Associates for the proposed Action on the Wastewater Treatment Plant Expansion for the Town of Wappinger Phase 3A Sewer Improvement. Also submitted was the Figure A Site Location Map, referred to on page 2 of the Negative Declaration. This was omitted from the Circulation of February 10, 1997. COUNCILWOMAN VISCONTI moved to accept the memorandum and place it on file. Seconded by Mr. Valdati Motion Unanimously Carried COUNCILMAN VALDATI made a motion to contact the Montclair Board, informing them of possible sewer inclusion and invite them for discussion of estimated costs. Seconded by Mr. Ruggiero Motion Unanimously Carried Attorney to the Town, Al Roberts, submitted several reports for the Town Boards consideration. The first, is a draft list of sample parcels which will be used to determine the impact of benefit assessments for Tri -Municipal Phase 1 and 2, Phase 3A and the Combined Water Project. Engineer to the Town, Jay Paggi, and Mr. Roberts, have selected these parcels as a cross section of the parcels within each of the proposed districts. COUNCILWOMAN VISCONIT moved to accept the report and place it on file. Seconded by Mr. Ruggiero Motion Unanimously Carried The second report from Mr. Roberts concerns the proposed combined Water Improvement Area. In reviewing his file regarding the acquisition of the Atlas Water Company, he noted that the purchase was not made by the "Town," but rather by the North Wappinger Water District, the Wappinger- Cranberry Improvement Area, and the Myers Corners II Water District. To extend the water supply beyond the geographical boundaries of the above three districts/improvement areas would require a reapportionment of the cost in the form of "buy -in" charges for the new areas or the creation of tenant districts. It would be improper (if not technically illegal) to expand the area to be serviced by Atlas without the expansion areas paying their fair share of the acquisition costs. The proposal may be technically sound from an engineering point of view, but poses many difficulties in complying with the technical aspects of municipal funding of capital projects. As he indicated to Mr. Adams, the draft is acceptable to him, however he would like to insert a clause or paragraph making it perfectly clear that any additional costs or expenses occasioned by any upgrading of the proposed system by the Waste Water Authority will be paid for by the Waste Water Authority, including soft costs such as engineering fees, attorneys' fees, financial advisor's fees, etc. COUNCILWOMAN VISCONTI moved to table this item to a workshop also. The specific purpose of the meeting was to meet with S.T. Environmental Services, Inc., to discuss the transition of the operation and maintenance of the facilities from Mid -Hudson Pollution Control. Seconded by Mr. Bettina Motion Unanimously Carried Correspondence from Michael Dunagan, Chairman of the Tri -Municipal Sewer Commission, informing the Town Board that at the monthly meeting of the Tri -Municipal Sewer Commission on February 4, 1997, the Commission voted to waive all penalties incurred by the Town of Wappinger for excessive Early Entry flows. The penalties are waived for the 4th Quarter of 1996 through the completion of construction. COUNCILWOMAN VISCONTI moved to accept the correspondence and place it on file. Seconded by Mr. Bettina Motion Unanimously Carried Mr. Dunagan, Chairman of Tri -Municipal Sewer Commission is also in receipt of correspondence from Attorney to the Town, Al Roberts, with respect to the Tri -Municipal metering of the Town of Wappinger flow. Mr. Dunagan wished to clarify several items. Dr. Kumar did investigate the two meters involved along with representatives from the Town of Wappinger. The 11 032497.RGM Minutes of the November 1996 meeting indicate that Dr. Kumar did indeed report to the Commission that the Commission meter, if anything, was reading lower than the Town of Wappinger meter. Dr. Kumar advised that the meter readings do not vary beyond accepted standards. Dr. Kumar also stated that during times of extreme flooding,the surge tank at the pump station might backup and adversely influence the meter reading. Be advised that the new flow regulator has been installed at the pump station. Consequently, the occasion of any backup of water to the meter is now highly improbable, if not impossible. Seconded by Mr. Bettina Motion Unanimously Carried Mr. Dunagan's February 19, 1997 response to Al Roberts, Attorney to the Town, in regard to the Tri -Municipal Sewer Commission, with the Town of Wappinger Completion of Phase 1 and 2 Wappinger Expansion. In early Fall, they indicted they expected the contractor to complete the project by December of 1996, based on his progress as of September of 1996. However, the supplier of the entire instrumentation system did not deliver the same until December of 1996, rather than October, as indicated in his purchase order. Under the Circumstances, we did not consider it wise to accept the contract until such time as the instrumentation system was not only installed, but properly operating. Mr. Dunagan met with Jay Paggi, Engineer to the Town, and verbally advised him that the Plant will be accepted no later than March 1, 1997. The contract completion date is April of 1997. Mr. Paggi also informed the Board that we are going out to bid for the final connection for Rockingham. COUNCILWOMAN VISCONTI moved to authorize Supervisor Smith to contact Mr. Dunagan for a status report regarding the date of completion. Seconded by Mr. Bettina Motion Unanimously Carried Michael Dunagan, Chairman of the Tri -Municipal, also informed the Town Board that he has been advised by Jay Paggi, Engineer to the Town, that Town of Wappinger 1.0 MGB Phase I/II Plant Expansion is substantial complete. All that remains are punchlist items for the site and instrumentation, submittal of "As -Built" drawings, O&M manuals and some operating training. Seconded by Mr. Bettina Motion Unanimously Carried Correspondence was received from Roger Akeley, Commissioner, Dutchess County Planning Department with their review and recommendations on Barnside Construction rezoning application. After considering the proposed action in the context of countywide intermunicipal factors, the Department finds that the Board's decision involves a matter of some concern, and offered the following comments: Allowing the zoning of a subdivided portion of this parcel to be changed to Highway Business creates the appearance of spot zoning, as there are no other H -B zones in the immediate area. Since the only other commercial zone contiguous to this property is Conservation Commercial, this would seem to be a more justifiable option. Zoning this parcel H -B would also allow other commercial operations on this site in the future, including self -storage warehousing and motor vehicles sales (with special permit). In addition, the proposed commercial use may not be appropriate for this location due to the high speed nature and limited site distance of this section of NYS Route 376, especially if heavy concrete trucks would be pulling in and out of this site. The Town should consider other zoning classifications or more suitable locations for this use. The Department recommends that the Board rely upon its own study of the facts in this case with due consideration of the above comments. Also submitted were the Planning Board recommendation to the Town Board in favor of rezoning Barnside construction on Route 376 from R-40 to Highway Business. At this time Thomas Snell of 1302 Route 376, was recognized by the Board. Mr. Snell resides across the street from the Barnside property, and expressed his concern on trucks coming in and out. He is not opposed to the rezone, but would prefer the building be placed further back from the road, and lower. Also submitted is the Suggested Transfer of Fund Balance as follows: HIGHWAY Balance of $277,123.00 should be applied to 1998 taxes ($80,000.00 of last years balance was applied to 1997 taxes). Seconded by Mr.Valdati Motion Unanimously Carried Jim Jeffreys, Consultant of Northeast Computer Services with his report on the current status of the computer system at the Town Hall. In reviewing the system a number of items have come up that he would ask the Town to consider: (1) The Court is desperately in need of the new equipment. He would not wait for the OCA grants. He has been patching the computers in the court together by cannibalizing the old PC's. Please consider moving forward to upgrade their hardware now before something serious malfunctions. (2) The Aptiva computer in the Building, Planning and Zoning Departments is still running Novel Net Ware and a number of programs that the three departments use. Even with the introduction of the new server, workstations and Permit program (from SEG), the department personnel will still need to access the old data for at least a year. The Aptiva 14 032497.RGM 15 computer was to be integrated, as another workstation, since that won't be happening and recommends that the Town consider purchasing a replacement unit. (3) Power fluctuations in the building have caused and can cause problems with computers. Since all the equipment is new, he urges the Town to consider protecting the new equipment with un -interruptible power supplies. To cover all the PC's, would cost $3,150.00. Most of the hardware and software was planned for in this years budget and with these changes is $54,150.00. The breakdown is a follows: $ 12,650.00 for new computer (including all the court equipment) and UPS's, $26,500.00 for the permit software and training from SFG and $15,000.00 to cover the cost of hardware installation and other software training. Installation is moving along as planned. Training for Windows 95 and other Windows related products has started. The next step is Excel and interoffice communications. Hardware for the Justice Court will cost $8,300.00, and there is a potential of $7,500.00 Grant coming back from OCA. The Town has met every requirement that OCA has requested. The service has been backed up with UPS's for a nominal fee of $175 per station (18) or $3,150.00. Mr. Jeffreys also proposes purchasing another work station for the Building, Planning and Zoning Department. The Total Cost is $57,950.00 of which $54,570.00 is budgeted, a difference of $3,380.00. When asked where the funds would come from, Comptroller Ann Buckley replied A1680.4, which is a computer line item. Town of Wappinger. After lengthy negotiations, he and Assessor, Tom Logan wholeheartedly support reducing the assessment in the above referenced matter from $425K to $229K for tax years 1995, 1995, and 1996. This settlement would be in the Town's best interest, in that it would most likely exceed end determination found at trial. In addition the stipulation of settlement would save extensive appraisal fees and costs of litigation. COUNCILWOMAN VISCONTI moved to accept the recommendations of Mr. Saris, and Mr. Logan, and reduce the assessment for the above referenced matter from $425K to $290K for the tax years 1994, 1995, and 1996. Seconded by Mr. Valdati Motion Unanimously Carried A Maintenance Aid Certification for 1995 for the Town of Wappinger, was received from Ree Slater, State Aid Rep. of the New York State Office of Real Property Service. Section 1573 of the Real Property Tax Law authorizes payment of state assistance to municipalities who maintain systems of improved real property tax administration which meet standards established by the State Board of Real Property Services, and the Town of Wappinger has met those standards and is eligible for assistance based on its 1995 Final Assessment Roll. On February 26, 1997, Truck #11 lost it's brakes and had to be towed in. It was taken apart and the parts were taken to Automotive Brakes for repair. If the calipers had been repairable we would have stayed well under $300 limit without a prior Purchase Order. We were notified that the calipers could not be repaired and needed to be replaced, which escalated the repair over $300. This is another example of why the $500 Purchase Order limit was much more realistic for the Highway Department. When dealing with heavy equipment $300 does not go very far. The first concerns the increase of Summer Program Fees. Our summer program carries a significant expense tab. The present policy of charging $15 for the first family member and $10 for each additional member recovers approximately 1/5 of the cost. We recognize at this time that to recover the total cost of the program is neither feasible nor an action we would recommend. We do feel, however, that an increase to $30 for the first family member and $20 for each additional family member is a needed change. Our contact with the parents when registering their children is one of surprise. We supervise the activity of their children 25 hours a week for seven weeks. This stipend is meant to cover incidental expenses such as mileage, etc. In order for Recreation to remain consistent with other Town Boards, Mr. Holt proposes the following: 1. The stipend be paid on a monthly basis and not tied to meetings since a lot of our work is done during the month i.e. visiting parks, planning etc. 2. When a recreation member takes part in a significant piece of work, he or she be paid an additional $25 (Example; preparation for Halloween Party, Concert, Christmas Party, where the amount of time and expense (mileage etc.) is considerable. We understand that the additional payment would be consistent with what presently exists with th other Town Boards. If approved, we would incorporate this additional portion into the 1998 plan. There should be funds in the present 1997 budget to cover the first request. COUNCILMAN BETTINA moved to leave the stipend at $20, with no increase. Seconded by Mrs. Visconti Motion Unanimously Carried SUPERVISOR SMITH informed the Board that she received a call from East Fishkill Recreation and they would like the Town of Wappinger to donate $300 towards the basketball program, due to the increase in rent for the use of the school. She asked to have the request in writing and when she does, she will refer to Mr. Holt to research the request and report back to us. SUPERVISOR SMITH received a letter from Mr. Greg Sarno, regarding the Dana Place Drainage. She conferred with Mr. Foster, and he said the Highway Department would do the Dana Place Drainage, but only the portion for which the Town is responsible. Mr. Foster would need to be authorized to spend $50K for the Dana Place Drainage COUNCILWOMAN VISCONTI moved to authorize Graham Foster, Highway Superintendent, to spend $50K for the Dana Place Drainage. NEW BUSINESS Mr. Bettina has been contacted by his constituents. Because they are no longer receiving the Southern Dutchess Newspapers free of cost, they wish to be notified by mail, regarding any meetings pertaining to their districts. Also, notify the Councilperson in that district. Motion Unanimously Carried At this time, the Town Board discussed the concept of holding a second monthly Town Board Meeting with Minutes, which would allow them to exercise voting on questions after discussion. Mrs. Snowden, Town Clerk reminded the Town Board that these Minutes would not be verbatim or in depth. If you want it in depth some other arrangements would have to be made, because we are not equipped. I have an office to run and do many other things besides the Minutes. Phones, counter, etc. It's stop and go continuously. You see how long it takes Florence to get the Minutes out already. SUPERVISOR SMITH suggested that we should try it once and see how it works out, and then go from there. Mrs. Snowden requested a format and no conclusive directions were determined by the Town Board. SUPERVISOR SMITH said at the last Public Hearing the residents were given several options as what the wished to do as far as raising the rates.. Fred McGinnis of Ketch Circle was recognized by the Board and stated he is opposed to these rates. At the last Public Hearing Mike Tremper of CAMO Pollution was requested to get proposals for the trucking of water for Fleetwood. It has been done. He has not received anything back yet.
