Supervisor Smith called the meeting to order at 8:00 P.M. Present: ,.. Constance Smith, Supervisor Joseph Ruggiero, Councilman Vincent Bettina, Councilman fir,, June Visconti, Councilwoman Elaine H. Snowden, Town Clerk Others Present: Albert Roberts, Attorney to the Town Jay Paggi, Engineer to the Town Graham Foster, Highway Superintendent Absent: Robert Valdati, Councilman The Supervisor asked all to join in the Pledge of Allegiance to the Flag. MINUTES The Minutes of the Regular Meeting of July 22, 1996 and Special Town Board Meeting of August 5, 1996, having previously been forward to the Board Members, were now placed before them for their consideration. COUNCILWOMAN VISCONTI stated that there was an error on page 7. It should of stated that a minimum of $100,000 previously had to be kept in the Capital Fund for Highway. The Town Board amended the minimum to $50,000. COUNCILWOMAN VISCONTI moved that the above stated minutes as submitted by the Town Clerk be approved as corrected. Seconded by Mr. Bettina Motion Unanimously Carried REPORTS OF OFFICERS Reports for the month of July were received from the Supervisor/Comptroller, Town Justices, Receiver of Taxes, Acting Building Inspector, Zoning Administrator, and Dog Control Officer. Seconded by Mr. Ruggiero Motion Unanimously Carried The first item for the Boards consideration is correspondence from Michael Hirsch, 11 Roberts Road regarding the pedestrian easement used for children to walk from Blackthorn Loop to the Spookhill Playground. It directly borders his property. For several years, the easement has flooded and overgrown, resulting in water run off into his back yard, which floods half of his back yard. Mr. Hirsch is requesting the Town to fix the easement with a pipe, top soil and seed. COUNCILWOMAN VISCONTI moved to authorize Supervisor Smith to refer this to Mr Holt of the Recreation Department and have him report back to the Board. Seconded by Mr. Ruggiero Motion Unanimously Carried Next is correspondence from Victor Fanuele of 12 Wildwood Drive with concerns regarding the lot across the street from his home being used as a dump for leaves and brush. At one time people would dump the leaves and brush away from the road out of sight. The past few years, they have been dumping adjacent to the road making the area unsightly. He is requesting a NO DUMPING sign be place along this section of the road. COUNCILWOMAN VISCONTI moved to refer this request to Mr. Foster, Highway Superintendent, and report back to the Board. Seconded by Mr. Ruggiero Motion Unanimously Carried Correspondence from Sloper-Willen Community Ambulance Service, informing the Town that it has recently added a fourth Advanced Life Support ambulance and crew to service the residents of its ambulance district. This ambulance will be in service during the peak hours of 10AM to 6PM, 7 days a week. Page 2 082696.RGM COUNCILWOMAN VISCONTI moved to accept the correspondence and place it on file. Seconded by Mr. Bettina Motion Unanimously Carried Correspondence from Edward Schaller of 1 Wendy Road regarding P' the STOP signs at the intersection of Russ Place. Mr. Schaller informed the Board that since the STOP signs were erected he has taken an official survey and during a one hour period he found twenty-six out of twenty-eight cars did NOT stop. Also during that same period he observed a Wappingers Central School Bus making a left turn from Wildwood Drive onto Wendy Road WITHOUT STOPPING. Mr. Schaller demands the Town do one of two things; either enforce the STOP signs at the intersection of Wildwood Drive and Russ Place/Wendy Road, or remove them. COUNCILWOMAN VISCONTI moved to authorize Supervisor Smith send a letter to Mr. Schaller, informing him that we are enforcing our laws, as we do all our laws on our books, and we will ask E the police to patrol the area more frequently. �•r Seconded by Mr. Bettina Motion Unanimously Carried Correspondence from Adil Antia of 4 Maxwell Place regarding the an ongoing problem which he has when ever it rains. The water collects in a large puddle near his pool and he must set up a pump to collect the water. This takes care of the surface water, but the ground water continues to seep under the pool area and gradually lifts/floats the pool liner. Then when the ground dries up, the liner settles down. The company that installed the pool informed him the only way to prevent this is to dig a curtain drain around the perimeter of the back yard so that the water is channeled away from the pool to the street. He is requesting the Town to set up this curtain drain for him so that the problem does not reoccur when ever there is a bad storm. Seconded by Mr. Bettina Motion Unanimously Carried Correspondence from the Zoning Board of Appeals Vice -Chairman Al Lehigh, requesting permission for himself and Gerald diPierno to attend the New York Planning Federation Annual Conference to be held at the Hotel Syracuse, Syracuse, New York, September 29, 1996 to October 2, 1996. COUNCILWOMAN VISCONTI moved to approve the request for Mr. Lehigh and Mr. diPierno to attend the New York Planning Federation Conference at the Hotel Syracuse, September 29 to October 2, 1996, and their legitimate expenses be a Town charge. COUNCILWOMAN VISCONTI moved to approve the Software License Agreement with the County and authorize the Supervisor to sign. Seconded by Mr. Bettina Motion Unanimously Carried The following requests were submitted for approval by Ralph Holt, Chairman of the Recreation Department. A Purchase Order for $2,600, payable to Robert D. Stobo for backhoe work to place pea gravel under the playground equipment at all of the playgrounds. COUNCILWOMAN VISCONTI moved to table this request pending a status report from Mr. Friedman, of the Recreation Committee. Seconded by Mr. Bettina Motion Unanimously Carried Next is a check from Friends of Parks in the amount of $300 which represent the approval of a grant for the acquisition of a gas grill for the use in the playgrounds and parks. Permission is needed to deposit the check in the B-7310.4 account. COUNCILWOMAN VISCONTI moved to allow the deposit of the $300 check from in the B-7310.4 account. Seconded by Mr. Ruggiero Motion Unanimously Carried The last request from Mr. Holt is for a Purchase Order payable to Pine Plains Ford Tractor, Inc. for $1,518, for the repair of the 1979 Ford 445 TL Loader. Three estimates were received, Pine Plains being the lowest. COUNCILWOMAN VISCONTI moved to approve the Purchase Order payable to Pine Plains Ford Tractor, Inc. for $1,518 for the repair of the Loader, based on the recommendation of Mr. Holt. Seconded by Mr. Bettina Motion Unanimously Carried Page 5 082696.RGM Next is a report from Dare Fitzpatrick, of CAMO Pollution Control, regarding the trucking of water to the Fleetwood facility. Trocillito Brothers Inc. of Marlboro, New York has been contacted to truck the water. At the present time they are hauling three 6,000 gallon loads per week at a cost of $150 per load. At the Towns request, Mr. Fitzpatrick investigated the possibility of using a Town of Wappinger Highway Department .,40 truck for the purpose of hauling water. The New York State Water Sanitary Code would not allow this for the reason that a bulk water hauling company must be licensed and inspected by the New York State Health Department. This was confirmed with Mr. O'Connor of the Dutchess County Health Department. COUNCILWOMAN VISCONTI moved to accept the report from CAMO Pollution Control and place it on file. Seconded by Mr. Ruggiero Motion Unanimously Carried Correspondence from Congresswoman Sue Kelly, thanking Supervisor Smith for contacting her and requesting her assistance in securing funds for the Fleetwood Water District in the Town of Wappinger. Ms. Kelly has asked a member of her district staff to contact our office and begin the process of identifying existing sources of funding to assist the community. Ms. Kelly appreciates this matter being brought to her attention, and wishes to be kept informed of the infrastructure needs of the community. SUPERVISOR SMITH informed the Board that she had also written to Mr. Pataki and Mr. Saland and they all responded, including a personal phone call from Senator Daniel Patrick Moynihan. COUNCILWOMAN VISCONTI moved to accept the correspondence and place it on file. Seconded by Mr. Bettina Page 6 Motion Unanimously Carried 1 6, 082696.RGM A response from Joseph DiPalo, Chief Operating Office of Medicus regarding the delays that were experienced by the Town Employees for random drug testing. Due to the large numbers of area businesses that utilize their facilities, the delay was due to a mechanical breakdown of a technical piece of equipment at their Lagrange facility, resulting in clients being referred to the Wappinger site. Effective immediately, Medicus will dedicate one nurse to our account and require this individual to process our employees as they arrive. An alternate week notification policy will also be utilized which should improve response time. COUNCILWOMAN VISCONTI moved to accept the correspondence and place it on file. COUNCILWOMAN VISCONTI moved to authorize the return of the above escrow funds, based on the recommendations of Donald Close, Zoning Administrator, and Mark Liebermann, acting Building Inspector. Seconded by Mr. Bettina Motion Unanimously Carried Several Reports were submitted by Jay Paggi, Engineer to the Town. The first report concerns the Wappinger Sewer Transmission/Treatment Improvement Phase 3A and the SRF financing. Mr. Paggi attended the 1996 Workshop for the New York State Environmental Facility Corp. State Revolving Fund. Wappinger is on the Intended Use Plan for 1997 for $40 Million for Phase 3A. We have made preliminary application to the SRF Page 7 082696.RGM for the $40 Million, and presented a preliminary Project Schedule and Cost Estimate to them. The tentative Schedule calls for $20 Million to be received in short term funding in April 1997. At the seminar, all the revisions that have taken place in the program since our inclusion for Phases I and II .J were discussed. None of them are significant except for the fact that 50 % interest subsidy is still maintained up to September 30, 1998. We will be securing long term financing in July of 1998, and therefore, should fall under the 50% interest subsidy umbrella. The dates the schedules and amounts are all subject to approval by both the Town Board and the State Controllers Office. COUNCILWOMAN VISCONTI moved to accept the report and place it on file. Seconded by Mr. Bettina Motion Unanimously Carried The second report concerns the Tri -Muni Flows. Mr. Paggi is in receipt of the Tri -Muni flows for May 1996. He had previously sent correspondence on May 31, 1996 regarding a memo from Michael Tremper. In that letter it stated that our meter for May 13, 1996 - May 31, 1996 averaged 221,000 GDP. On the recent chart of Tri -Municipal, it appears that they averaged 301,000 GDP for the same period. This is over a 36% difference, and NOT acceptable. A meeting has been set up for Thursday September 5th with Mr. Horowitz the new Engineer. He will update the Board on the outcome. COUNCILWOMAN VISCONTI moved to accept the correspondence and place it on file pending an update. Seconded by Mr. Ruggiero Motion Unanimously Carried The third report concerns a Progress Meeting/Phase 3A that Mr. Paggi attended on July 23, 1996. Mr. Paggi went over all the items that were discussed and related that a general comment was made that all work is on schedule. COUNCILWOMAN VISCONTI moved to accept the report and place it on file. Seconded by Mr. Ruggiero. Motion Unanimously Carried The last report concerns the water connection to the Dutchess Medical Arts Building. Mr. Paggi prepared a sketch for the connection of the building to the Wappinger Park Water District. The drawing and specification should be transmitted to Eileen Platt, Building Manager after the appropriate escrow accounts are established. When they deposit the necessary escrow account with the Town, $750 should also be included for inspection services during construction. COUNCILWOMAN VISCONTI moved to authorize the Supervisor to send the Medical Arts Building an invoice for $1,864.75 and authorize the release of plans upon receipt of payment. Seconded by Mr. Ruggiero Motion Unanimously Carried Notification of intent to renew a liquor license was received from the K of C [Club 4065] Route 82 and notice of intent to apply for a liquor license was received by the Outback/Empire-I L.P. d/b/a/ Outback Steakhouse 1255 Route 9. COUNCILWOMAN VISCONTI moved to accept the notification of intent to renew the liquor license from the K of C [Club 4065] Route 82, and the notice of intent to apply for a liquor licence from Outback/Empire-I L.P. d/b/a Outback Steakhouse 1255 Route 9, and place them on file without comment. Mr. Curran is requesting the Town to review the list. If the municipality is interested in purchasing one or more of these parcels prior to the tax auction, to contact his office for further information. COUNCILWOMAN VISCONTI moved to accept the correspondence and place it on file. Seconded by Mr. Bettina Motion Unanimously Carried A request from Thomas Logan, Assessor for permission to attend the Dutchess County Assessors Association meeting on September 9, 1996. These meeting are held at the DC Cooperative Extension Center at Route 44 in Millbrook in the AM of the first Monday of each month with the exception of July and August. COUNCILWOMAN VISCONTI moved to approve the request from Thomas Logan to attend the Dutchess County Assessors Association meeting on September 9, 1996 and the first Monday of each month, Page 10 082696.RGM with the exception of July and August, and his legitimate expenses to be a Town charge. Seconded by Mr. Bettina Motion Unanimously Carried Next is a request from Ann Buckley, Comptroller to approve a Purchase Order for $806.92, payable to Healy International Trucks, Inc. No Purchase Order was issued. Audit and Control, John Green advised this be brought to Town Board attention so the charges can be paid. COUNCILWOMAN VISCONTI moved to approve the above Purchase Order in the amount of $806.92 payable to Healy International Trucks, Inc., as requested by Ann Buckley, Comptroller. Seconded by Bettina Motion Unanimously Carried Next is are two reports from Jay Paggi, Engineer to the Town. The first is an update on the Airport Soccer Field/Recreation Project. On August 23, 1996, informal bids were received and opened for the above referenced project. Four bids were received and opened. Black Top Maintenance was the apparent low bidder with a bid of $17,066.98 which as you know, is $2,000 higher than the amount available for this project. We recommend that the bid be awarded to Black Top Maintenance, with the removal of one item of the contract, to bring the total bid to $15,000. COUNCILWOMAN VISCONTI moved to award the bid for the Airport Drive Recreation Project to Black Top Maintenance as low bidder for $15,000, based upon the recommendation of Jay Paggi, Engineer to the Town. Seconded by Mr. Bettina The second report concerns the Sewer Main Replacement on All Angels Hill Road. As reported at the July 17 Workshop, the 800' of existing sewer main on the west side of All Angels Hill Road to the South of Kent Road is in danger of eminent collapse. Page 11 082696.RGM Two alternative methods were looked at to replace this line. The first method was physically installing a 8" pipe and one (1) manhole in the existing ditch line. To do this, we analyzed the cost of replacement of 800' of 8" PVC, including hooking up the existing lateral connections. In analyzing the site he noticed that the pipe is located on the west side of All Angels Hill Road. This easement also has in it an existing water main and utility line. Therefore, replacement of the line would be rather difficult. He also noticed that the residents have planted numerous shrubs and trees in the easement that would need to be removed to replace the pipe. Mr. Paggi requested Attorney to the Town Al Roberts to render an opinion whether or not the trees would have to be replaced upon completion of construction. He indicated in all likelihood, we would not have to replace them. Therefore two options have been prepared. The first would cost $118,000. The second alternative for replacing the pipe is to Insituform the pipe. The total cost would be $100,000. Mr. Paggi recommends that the Town pursue the second option using the Insituform method and authorize the preparation of the appropriate Map, Plan and Report. COUNCILWOMAN VISCONTI moved to authorize Mr. Paggi, Engineer to the Town to prepare the Map, Plan and Report, at a cost of $2,000 using option II. Seconded by Mr. Bettina Motion Unanimously Carried. COMMITTEE REPORTS COUNCILMAN RUGGIERO had no reports at this time. COUNCILMAN BETTINA had no reports at this time. COUNCILWOMAN VISCONTI had no reports at this time. SUPERVISOR SMITH spoke on the vandalism problem the Town is experiencing. Last week vandals defaced Spook Hill Recreation Area, Home Depot, Hollowbrook, Robinson Lane and Grossman's. Page 12 082696.RGM Cameras did capture some of the action at Spook Hill Recreation but they were very dark, and the pictures were sent to the local enforcement officials for further study. There was some discussion among the members of the Board and it was suggested that sensor lights be installed to deter the vandalism. m" Mrs. Visconti suggested getting some proposals to have the sensor lights installed on all the town recreation areas. Back in July Supervisor Smith placed an ad in the Southern Dutchess news indicating the Town was seeking Volunteers to serve on the Conservation Advisory Committee. Mr. Scott LeRoy responded and would like to be appointed. The following Resolution was offered by COUNCILWOMAN VISCONTI who moved its adoption. RESOLVED, that Scott LeRoy be appointed to the Town of Wappinger Conservation Advisory Council, and IT IS FURTHER RESOLVED, that the said Scott LeRoy is hereby appointed to the said Conservation Advisory Council for a two year term which will expire on the 1st day of June, 1998. fir.. Seconded by Mr. Bettina Motion Unanimously Carried BONDS & LETTERS OF CREDIT Mr. Close submitted his report for the month of July on the subdivisions, the amount, expiration dates and call up dates. Seconded by Mr. Ruggiero Motion Unanimously Carried At this time, Supervisor Smith informed the Board that she had been notified that a resident had been soil mining on Robinson Lane, which is illegal. The resident had been warned to stop. and he was still taking soil. The Board questioned Mr. Roberts if the town had any other recourse to enforce this. Mr. Roberts said he would have to check into this. Seconded by Mr. Ruggiero Motion Unanimously Carried RESOLUTIONS Next for the Boards consideration is to direct the Assessor Thomas Logan to prepare the Benefit Assessment Rolls for all the Water and Sewer Improvement Areas and Districts. The following Resolution was offered by COUNCILWOMAN VISCONTI who moved its adoption and seconded by Mr. Ruggiero RESOLUTION DIRECTING ASSESSOR TO COMPLETE ASSESSMENT ROLL FOR FLEETWOOD SEWER DISTRICT The Town Assessor is hereby authorized and directed to prepare an assessment roll for the FLEETWOOD SEWER DISTRICT in accordance with the following standards: 1. All property within the benefit area shall be assessed. 2. The formula for such assessment shall be as follows: a. A single family house on a lot of less than two acres - one benefit unit. The following Resolution was offered by COUNCILWOMAN VISCONTI who moved its adoption and authorized the Town Clerk to sign. Although bid forms and specifications were given out to five firms, only two bids were received, the lowest being Mount Kisco Chevrolet with a bid of $50,262. Mr. Foster recommends the bid be awarded to Mount Kisco Chevrolet, they being the lowest bid. Mr. Incoronato questioned the recent purchase of a used Van for the Animal Control Officer at a cost of $13,000. Why did it not go out to Bid. SUPERVISOR SMITH informed Mr. Incoronato because this was an emergency situation, the old vehicle was no longer safe, the Town did not have to go out to bid. Albany was called, everything has been documented. Victor Fanuele was also recognized by the chair. Last year several drains were installed at Wildwood Drive. His complaint, the job has not been completed. He wishes to have someone clean up the area in front of his house and put some top �r soil down, so he can plant some seed. Mr. Foster said he would stop by the next day at 9:00 A.M to meet with him and walk the site. NEW BUSINESS COUNCILMAN RUGGIERO presented a petition signed by the residents Page 33 •:4••• of Dorothy Heights regarding the level of noise created at the Home Depot located in the Imperial Plaza. The noise caused by the constant paging of employees and the phone ringing at all hours of the night over the loud speaker, together with the horn noise caused by the loading vehicles when backing up are situations without question in violation of the peace and quiet requirements of a residential neighborhood. The noise level is such that it disrupts their sleep and aggravates their daily life. The noise level is intolerable and must be stopped. The are petitioning the Town of Wappinger to enforce the noise ordinance. Although Home Depot is in the jurisdiction of the Village the residents would like the Town of Wappingers to intervene on their behalf. COUNCILMAN RUGGIERO moved to authorize Supervisor Smith forward the petition to the Mayor of the Village with a letter, and a carbon copy to Home Depot, on behalf of the residents of Dorothy Heights. Seconded by Mrs. Visconti Motion Unanimously Carried SUPERVISOR SMITH received the contract for the defensive driving course for the employees who drive Town vehicles. The course is $30 and will be held on September 17th and 18th from 8:45 AM to 3:30 PM.
