UNFINISHED BUSINESS NEW BUSINESS ADJOURNMENT The Regular Meeting of the Town Board of the Town of Wappinger was held on August 28, 1995 at the Town Hall, 20 Middlebush Road, Wappingers Falls, New York. Supervisor Smith called the Meeting to order at 7:40. P.M. Present: ., Constance Smith, Supervisor Joseph Ruggiero, Councilman Robert Valdati, Councilman Joseph Incoronato, Councilman June Visconti, Councilwoman Elaine H. Snowden, Town Clerk Others Present: Albert Roberts, Attorney to the Town Joseph E. Paggi, Engineer to the Town Graham Foster, Highway Superintendent The Supervisor asked all to join in the Pledge of Allegiance to the Flag at the commencement of the Meeting. MINUTES The Minutes of the Regular Meeting of July 24, 1995 having previously been forwarded to the Board Members, were placed before them for their consideration. COUNCILWOMAN VISCONTI moved that the above stated minutes as submitted by the Town Clerk be and they are hereby approved. Seconded by Councilman Ruggiero Motion Unanimously Carried At this time COUNCILMAN VALDATI moved to correct the Minutes of May 22, 1995 PAGE 14, to indicate PHASE I of EVERGREEN ESTATES (METZGER) Bond Reduction only. Seconded by Mrs. Visconti Motion Unanimously Carried REPORTS OF OFFICERS Reports for the month of July were received from the Supervisor/Comptroller, Town Justices, Receiver of Taxes, Building Inspector, Zoning Administrator and Dog Control officer Page 1 950828.RGM for (June & July). COUNCILMAN INCORONATO moved to accept the above stated reports and place them on file. Seconded by Mr. Ruggiero Motion Unanimously Carried In reading the Zoning Administrators Report, Mr. Incoronato noticed one complaint against a pickup truck parked on 9D that sits on the shoulder of the road advertising apartments for rent in Chelsea Ridge. It is a traffic hazard. Mrs. Smith informed Mr. Incoronato that the truck had been sited, and the police are watching it closely. PETITIONS AND COMMUNICATIONS The following Tax Certioraris were served on the Town of Wappinger: Three Company Inc.; Vinco Realty Corp.; Three Star Anodizing Corp.; The United States Life Insurance Co. in the City of NY; (2) Michael Schnorr; Brack Construction Co.; Marshfield Enterprises Inc.; Cresthill Industries; First Fidelity Bancorp; Nelson Construction Inc.; Cranberry Hills Assoc.; Also, an Amended Cranberry Hills Assoc. COUNCILWOMAN VISCONTI moved to referred the above stated Tax Certioraris to Emanuel Saris, Attorney to the Town, appointed to handle Tax Reviews, to defend on behalf of the Town. Seconded by Mr. Incoronato Motion Unanimously Carried Next is an application from William Knight, President of Knight Aircraft Corporation for the Autumn Warbirds Airshow to be held at the Dutchess County Airport on October 7th and 8th of 1995. COUNCILMAN VALDATI moved to approve the application from William Knight, President of Knight Aircraft Corporation for the Autumn Warbirds Airshow to be held at the Dutchess County Airport on the 7th and 8th of October, 1995. COUNCILMAN VALDATI moved to approve the request from Susan M. Phillips, for the use of ten voting machines for August 25, 1995. Seconded by Mrs. Visconti Motion Unanimously Carried Notice of intent to renew liquor licenses was received from (1) Shine Tone, Inc., d/b/a Dynasty Restaurant (2) Las Mananas Inc., d/b/a La Fonda del Sol, 100 Old Route 9, Wappingers Falls, NY. COUNCILWOMAN VISCONTI moved to accept the notices of intent to renew liquor licenses from Shine Tone, Inc., d/b/a Dynasty Restaurant and Las Mananas Inc., d/b/a La Fonda del Sol, and place them on file without comment Seconded by Mr. Incoronato Motion Unanimously Carried Because of a failing septic system, a request was received from John Burke, 62 Fenmore Drive for authorization to connect to the Wappinger Sewer Improvement Area No. 1. The Department of Health had inspected the sewage disposal system and observed that the system was undergoing failure and had no objections to their connecting to the Wappinger Sewer Improvement Area No. 1. COUNCILWOMAN VISCONTI moved to authorize Mr. Burke of 62 Fenmore Drive to connect to the Wappinger Sewer Improvement Area No. 1, based on the recommendation of Daniel O'Connor, P.E. of the DEC. Seconded by Mr. Ruggiero Page 3 Motion Unanimously Carried 950828.RGM Next is a Memo from Supervisor Smith regarding the drainage problem that Mr. William Quimby is experiencing at 36 Theresa Boulevard. Mr. Quimby feels the problem did not exist until the Town installed a drainage pipe. Whenever it rains hard, the water sweeps over the drainage grate and washes away his driveway. Jay Paggi, Engineer to the Town looked into the problem and advised Mr. Foster Highway Superintendent to place a blacktop berm around the catch basin to better capture the runoff prior to it entering Mr. Quimby's driveway and install some Item No. 4 fill at the end of Mr. Quimby's driveway that has washed away. COUNCILWOMAN VISCONTI moved to authorize Mr. Foster to place blacktop berm around the catch basin, and install Item No. 4 fill at the end of Mr. Quimby's driveway. Seconded by Mr. Ruggiero Motion Unanimously Carried Next is correspondence from Joseph A. Egitto, of the firm of Wolfson, Greller, Reisman & Egitto, Attorneys, representing the Mid -Hudson Castle Ltd., owners of the former Castle Health and Nightclub located on Route 376. As you know, there presently exist certain restrictions affecting the property which arose out of a prior owner's planned use. In light of the Town Boards's recent passage of new zoning amendments, which affect the property, the aforementioned restrictions no longer apply, and should be removed of record. Mr. Egitto is requesting, on behalf of his client, to have these restrictions removed as they are no longer in accord with the new zoning amendments. COUNCILMAN VALDATI moved to formally affirm that this property would have all of the rights of that area, Conservation Commercial, and they can proceed with their site plan. Seconded by Mrs. Visconti. Motion Unanimously Carried Page 4 950828.RGM COUNCILMAN RUGGIERO moved to authorize Supervisor Smith to execute a Declaration releasing the Restrictions of Record for the Mid -Hudson Castle, Ltd., as requested by Mr. Egitto, Attorney representing Mid -Hudson Castle, Ltd. Seconded by Mrs. Visconti Motion Unanimously Carried Emanuel Saris, Attorney appointed for tax reviews, requesting permission from the Town Board to engage McGrath, Basciani and Associates, Inc., to prepare a preliminary appraisal to settle the Cedar Hill Development Corp. Tax Review. Further settlement negotiations may be warranted following completion of a preliminary appraisal. If a settlement cannot be reached preparation of a full appraisal will be required for purposes of the tax certiorari trial. COUNCILMAN VISCONTI moved to authorize Emanuel Saris, attorney for tax reviews to engage McGrath, Basciani and Associates, Inc., to prepare a preliminary appraisal of the Cedar Hill Development Corp. property in question. Seconded by Mr. Incoronato Motion Unanimously Carried Next is correspondence from Anthony Ruggiero, of the Interagency Purchasing Cooperative. Although participation is voluntary with no fees or charges, membership is a prerequisite in order to participate in the cost savings offered by the IPC. The following Resolution was offered by COUNCILMAN VALDATI who moved its adoption and seconded by Mrs. Visconti. INTERAGENCY PURCHASING COOPERATIVE RESOLUTION WHEREAS, it is in the public interest for government entities to obtain goods and services of maximum quality at the most economical price; and WHEREAS, all participating government entities would benefit from a program designed to purchase those items that are in common use under the umbrella of a cooperative single -bid procedure; WHEREAS, THE INTERAGENCY PURCHASING COOPERATIVE, (comprised of: Page 5 950828.RGM Dutchess County BOCES, Dutchess Community College, and the Wappingers Central School District) has initiated a COOPERATIVE SINGLE -BID PROCEDURE which affords other government entities accessibility to its bid solicitations; and WHEREAS, THE COOPERATIVE (IPC) would not be bound to any greater degree than at present when bids are taken, and would include said entities in selected bid specifications thereby affording them opportunity for cost savings at no additional cost burden to said Cooperative (IPC)) or municipal entity; NOW THEREFORE, BE IT RESOLVED the named government entity, Town of Wappinger hereby agrees to participate in the cooperative bidding with the Interagency Purchasing Cooperative of commodities/services requested and approved by the appropriate fiscal officer; Under this agreement, it is understood and agreed that each participating entity will make its own separate purchase agreement with selected bidders, that each entity shall only be liable to the successful bidder for materials/supplies/services contracted for by such entity, without any liability for purchases contracted for by any other participating entity, and each bid winner shall be required to bill each participating entity directly for purchases contracted by it. It is further understood that in the event of any dispute between participating entities and the bid winner arising after a contract of purchase has been executed, such dispute shall be handled by and between the affected parties with said parties holding harmless the Cooperative (IPC), and be it further RESOLVED, that the specifications as prepared by the Interagency Purchasing Cooperative designated agency and made available to the participating entity under this agreement by accepted for purchase at the lowest responsible bid price recommended by the Interagency Purchasing Cooperative (IPC); however, each entity has the right to reject all or part of the designated agency recommendation for the local bid award; and be it further RESOLVED, that the invitation to bid will be advertised by the DESIGNATED AGENCY in the POUGHKEEPSIE JOURNAL in accordance with the provisions of Section 103 of the General Municipal Law. Seconded by Mrs. Visconti Motion Unanimously Carried Next is a request from Frank Gildea Executive Director of Sloper-Willen for assistance in obtaining signs on Middlebush Page 6 950828.RGM Road (County Route 93) warning drivers that emergency vehicles could be exiting the Emergency Services Building. Mr. Gildea suggests that signs be posted on both sides of the building and say, "Caution, Emergency Vehicle Exit." il COUNCILMAN VALDATI moved to authorize Supervisor Smith send a letter to DPW in support of signs for the Emergency Services Building as requested by Mr. Gildea. Seconded by Mrs. Visconti Motion Unanimously Carried At this time, COUNCILMAN INCORONATO questioned Supervisor Smith on the total cost of construction for the Emergency Services Building, the current rent income and the mortgage payments. SUPERVISOR SMITH said she is gathering all this information together, and will report to the Board. Correspondence was received from Joseph W. Grogan, PE Dutchess County Department of Public Works in response to a letter he received from Highway Superintendent Graham Foster in which concern was expressed about the phasing of the traffic signal light at Ketcham High School and County Route 93 (Myers Corners Road). Mr. Grogan explained that this particular signal is owned and operated by the Wappingers School District. They applied to the County to erect the signal and were given permission to do so. The concern expressed by Mr. Foster had previously been noted by a resident of Erwin Drive who called it to the attention of the school district in April 1989. The matter was fully addressed by Robert Hintersteiner, P.E., who designed this signal for the school district and established the phasing. Mr. Hintersteiner is a recognized expert in traffic signal design. It is Mr. Hintersteiner's opinion that the signal phasing is proper. There is no accident (history due to this signal phasing) to warrant further investigation. COUNCILMAN RUGGIERO disagreed with Mr. Grogan's response, and Page 7 950828.RGM consulted Mr. Roberts, Attorney to the Town as to the next step that should be taken on this matter. Mr. Roberts suggested calling in another expert. Also, because the light is owned and operated by the Wappingers School District, a suggestion was made to petition the school with their concerns. COUNCILWOMAN VISCONTI moved to authorize Supervisor Smith to send a letter to Mr. Marmillo, Superintendent of Schools, with a request to change the light. Seconded by Mr. Valdati Motion Unanimously Carried A request from Patricia Maupin, Receiver of Taxes, for permission to establish another business checking account with Fleet Bank, Middlebush Road, for the School Tax collection. The current checking account is interest bearing for Realty Taxes. As the school district has not authorized Mrs. Maupin to collect interest on the School Taxes, the money must be separate. COUNCILMAN VALDATI moved to authorize Patricia Maupin, Receiver of Taxes, to establish a non-interest bearing business checking account, for the deposit of the School Taxes. Seconded by Mrs. Visconti Motion Unanimously Carried A Memo was received from Ralph Holt, requesting permission to spend up to $3,000.00 to hook up to the Town water line which runs to the back of the barn property on Elizabeth Terrace. The funds will be used to purchase the materials needed for the project from N. & S. Supply. The labor would be done by the Recreation Maintenance & Highway Department. The water that is currently at the site is well water and is heavily sulfured and undrinkable. The funds for this project are in the A-7110.4 account of the Recreation Budget. COUNCILMAN VALDATI moved to authorize Ralph Holt to spend up to $3,000.00 to hook up to the Town water line which runs to the Page 8 back of the barn property on Elizabeth Terrace. Seconded by Mrs. Visconti 950828.RGM Motion Unanimously Carried After the vote, Mr. Incoronato questioned the Board as to the quality of the water, and how many people would benefit by hooking up to the Town water line. There was some discussion and it was decided before any action was taken, CAMO sample the water and report back with their findings. COUNCILWOMAN VISCONTI moved to rescind the above recommendation and table, pending sampling of water by CAMO. Seconded by Mr. Incoronato Motion Unanimously Carried A memo from Bernie Reimer, Recreation Director, regarding his application to Youth Bureau Funding. COUNCILWOMAN VISCONTI moved to table Mr. Reimer's memo regarding his application to Youth Bureau Funding to a workshop. Seconded by Mr. Ruggiero Motion Unanimously Carried Correspondence from Chelsea Fire District advising the Town Board of the reappointment of Yvonne M. Tompkins to the Town Fire Prevention Bureau. COUNCILMAN VALDATI moved to accept the correspondence and place it on file. Seconded by Mrs. Visconti Motion Unanimously Carried The next order of business is a report from Al Roberts, Attorney to the Town, on the Beverly/Houghtaling dispute. Mr. Roberts feels this clearly a "neighbor" problem and would request he be permitted to discuss the matter further with the Town Board before any action is taken. COUNCILMAN INCORONATO moved to table Mr. Roberts report on the Beverly/Hoghtaling matter to a workshop. Seconded by Mrs. Visconti Page 9 950828.RGM Motion Unanimously Carried The following correspondence was received from Isaac D. Rubin, Co -Chairperson, Neighborhood Watch of Michael Drive. Dear Mrs. Smith: On behalf of the Neighborhood Watch Group of Michael Drive, I would like to thank you once again for the barrier blocking the cul-de-sac at the end of Michael Drive. The barrier has been in place long enough for us to evaluate the situation. The barrier has done even more good than we expected. Last summer the situation at the cul-de-sac was grim. This summer it is considerably improved (some 4 wheel drive vehicles still come through) and the traffic, noise, hooliganism, dealing, etc. in the neighborhood have gone down appreciably. We would like to keep the barrier in place as long as the cul-de-sac is empty of houses. In winter, the snow plows cleared the neighborhood without problems, as they did for years before the cul-de-sac was created. There is a fire hydrant in front of the last house on Michael Drive ( No. 16), thus the one at the very end of the street past the barrier appears to be of no use till houses are built in the cul-de-sac. We appreciate your concern for keeping up the quality of life in Wappingers Falls in general and our neighborhood in particular. Sincerely, Isaac D. Seconded by Mr. Incoronato Motion Unanimously Carried Jay Paggi, Engineer to the Town went over his report on the cost of the relocation work for the Wappinger Sewer Transmission Treatment Improvement Area Phase II Contract No. 2. Project and a revised Cost Estimate from Camo Pollution for Temporary Generator Hookup for the Rockingham Farms Water Treatment Plant. Central Hudson has removed their wires and will re -install them after one (1) month (September 15, 1995) at a quoted price of $1,500.00. NYNEX has relocated the phone line and will re -install onto the new poles when required. The quoted cost for NYNEX work is $600.00. Because the Rockingham Farms Water Treatment Plant controls are not equipped with a quick Page 10 950828.RGM disconnect or a manual transfer switch for the use of an auxiliary power generator, the estimated cost from Camo Pollutions to transport, purchase and install wire, install underground conduit, provide electrical hookup per electrical code, monitor all phased and electrical hookups, disconnect wire and all appropriate conduits, rehook Central Hudson Power and assure proper operation of the system, is $3,500.00. Also to protect the generator from vandalism and possibly some serious injury by children trespassing in that area, temporary fencing will be installed at an estimated cost of $800.00. The generator will be required to operate 24 hours per day for the entire 30 day period. To provide for the delivery of fuel, fuel costs and all required daily servicing for the equipment over that extended period of time, the estimated cost is $160.00 per day. COUNCILWOMAN VISCONTI moved to accept Mr. Paggi's report and place it on file. Seconded by Mr. Incoronato Motion Unanimously Carried Next is correspondence from Arlene Burke of 4 Scott Drive regarding the infestation of Rats in her yard, when the Town performed dredging of the drainage ditch that runs through the back of her property. Mrs. Burke is requesting restitution from the Town in the amount of $333.44 to cover the cost of damage created by the rodents and for the services of an exterminator. COUNCILMAN RUGGIERO moved to refer the above claim submitted by Mrs. Burke to Marshall and Sterling, Town Insurance Agent. Seconded by Mr. Incoronato Motion Unanimously Carried A memo from Graham Foster, Highway Superintendent with a request for the return of a road opening permit that was issued to Karen Burke in the amount of $500, but never used, since the road did not have to be cut. Page 11 950828.RGM COUNCILMAN VALDATI moved to approve the return of $500.00 to Karen Burke for the road opening permit that was issued, but never used, based on the recommendation of Graham Foster, Highway Superintendent. Seconded by Mrs. Visconti Motion Unanimously Carried The last piece of correspondence is also from Mr. Foster. He would like to complete the water line connection to the Highway Department and in order to do complete the water line, is requesting the Town Board give Jay Paggi, Engineer to the Town permission to write up the Specs. Once they are written up, Mr. Foster can obtain 3 quotes to complete the necessary work. COUNCILWOMAN VISCONTI moved to authorize Jay Paggi, Engineer to the Town to write up Specs for the water connection line to the Highway Department. Seconded by Mr. Valdati Motion Unanimously Carried Next is an item that was brought to Mr. Incoronato's attention regarding the removal of several desks from the Schlathaus House. Supervisor Smith informed Mr. Incoronato that the Town was authorized to put them out to Bid There were no Bids. They were then authorized to donate them to an organization or discard them. They were to be discarded at the Spring cleanup. Due to an oversight, they were never discarded. When Councilwoman Visconti showed some interest in obtaining some second hand desks, Supervisor Smith recalled the above mentioned desks. Mrs. Visconti went to look at them and $150.00 was agreed upon for the desks. The value that the Town Board placed on the desks was "no value". Mr. Roberts, Attorney to the Town indicated that what had been done was done correctly and legally. Mr. Incoronato commented, no individual can make that decision. Mr. Roberts indicated yes, that was correct, but Page 12 950828.RGM the Town Board had already placed the value of the desks, that being, "no value", and all had been done within the guidelines of Town Law. COMMITTEE REPORT L COUNCILMAN RUGGIERO had no Committee Reports at this time. COUNCILMAN VALDATI an update on the tank situation at the Highway Department. Mr. Foster informed Mr. Valdati there is nothing new at this time. The wells from the adjoining properties are still being monitored. Mr Valdati also spoke with Doug Warren. Mr. Warren wrote to DOT a year ago regarding the conditions at 9D and Montclair Townhouses and has not had a response yet. Mr. Valdati contacted Mr. Saland and Mr. Miller to intercede on this matter. They assured him they would. He also wrote to Mr. Mignogna the Traffic Engineer of DOT. There seems to be a problem with Speed signs. The Speed limit goes from a reasonable speed of 35 MPH at the intersection of Hughsonville and 9D then goes to 45MPH shortly after Ketchamtown Road. If the Board has some thoughts on this we should request lower speed limits on 9D as we have done in other areas. Mrs. Smith informed the Board that Mr. Schouten had written a second letter to DOT regarding the dangerous condition that exists, perhaps a letter from the Town is also in order to follow up. Also invite members of DOT to attend one of our workshops. Mr. Incoronato said he had received a call from Jean Gunsch and she informed him that a traffic study is underway and the results will be out shortly. WHEREAS, the Town Superintendent of Highways has been requested by the County of Dutchess to participate in the regional County Highway Snow and Ice Control Program within the boundaries of the Town, and WHEREAS, and logically, an earlier or sooner response factor can be provided by Town units and personnel within the locale thereby benefiting the overall safety and welfare of town residents and local community interest, and WHEREAS, such participation by the Town in removing snow designated County Highways, and by sanding and salting or otherwise treating them for the purpose of maintaining highway safety and accessibility for emergency services, is specifically authorized by Article 6, Section 135 of the New York State Highway Law, now, therefore, be it RESOLVED, that the Town Highway Superintendent be and is herein authorized to perform such work as is found necessary, at hourly rates as agreed upon by the Town and the County for the renting and hiring of such equipment for the Winter season 1995-1996. Seconded by Mr. Incoronato Motion Unanimously Carried The Introduction of the proposed Local Law enacting new Regulations on Flood Damage Prevention and to set a Public Hearing was now placed before the Board. The following Resolution was moved by COUNCILWOMAN VISCONTI and seconded by Mr. Incoronato. WHEREAS, the Town Board has recently received a recommendation from the New York State Department of Environmental Conservation to adopt a Local Law designed to comply with the flood plain management requirements of the National Flood Insurance Program; and WHEREAS, the Town Board has determined that it is in the best interest of the public health, welfare and safety of the people of the Town of Wappinger to adopt said Local Law. NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: 1. The Town Board hereby introduces for adoption Local Law # of the Year 1995 in the form annexed hereto. 2. COUNCILMAN RUGGIERO moved to authorize Jay Paggi, Engineer to the Town to prepare plans, to go out to Bid, and proceed with land acquisitions for the Spookhill Road project and report back to the Board at each stage. Seconded by Mr. Valdati Motion Unanimously Carried COUNCILMAN Ruggiero moved to authorize Attorney to the Town Al Roberts proceed with necessary grading easements and land acquisitions for the Spookhill Road project. Seconded by Mr. Incoronato Motion Unanimously Carried Correspondence from Don Keller for authorization to have his automobile repainted, because of rust. The auto is in good running condition and he would like to get it repainted before winter sets in. Mr. Keller presented one (1) estimate, $1,200.00. There was some discussion and Mrs. Smith agreed with the Board members, according to Town Policy, Mr. Keller must present two (2) more estimates to the Board before final Page 33 950828.RGM approval can be made. At this time Supervisor Smith introduced the President of the Wappinger United Soccer Club Ray Suarez, along with his assistant Mr. Kennedy. Mr. Suarez went over some proposed projects for the completion of the Soccer fields. The first game would be September 9, 1995. Mr. Suarez went over a few items that should be completed in order to make best use of the field. The Club, with the Boards approval proposes to assume full responsibility for the cost of building a permanent structure to be used for storage and concession stand. At the same time, to approve additional funds for the remaining items. SUPERVISOR SMITH reminded the Board that $110,000.00 had been appropriated for the Soccer fields, and Bids came in for $84,000.00. We are well within our range. COUNCILMAN VALDATI moved to approve $8,000.00 for the completion of the Soccer Field as requested by Mr. Suarez. Seconded by Mr. Ruggiero Motion Unanimously Carried Another item to be approved for the Soccer Complex is for fencing to separate the parking lots from the fields at a cost of $6,500.00-7,000.00. COUNCILWOMAN VISCONTI moved to approve $6,500.00-7,000.00 for fencing separating the parking lot from the field. Seconded by Mr. Incoronato Motion Unanimously Carried Mr. Paggi recommended the Town Board approve a change order on items 1 and 2 for $8,000 on the proposed projects for completion now, while the contractor is still working on the Soccer Complex. COUNCILMAN RUGGIERO moved to approve a change order Number #1 items 1 and 2 for $8,000.00 of the proposed projects in order for the contractors to complete the fields at the Soccer Page 34 Complex. Seconded by Mrs. Visconti 950828.RGM Motion Unanimously Carried Mr. Paggi would also like to walk the fields with the members of the soccer club and the contractor and schedule it for acceptance. SUPERVISOR SMITH informed the Board that the Soccer Club would supply the Town with a certificate of insurance naming the town harmless. Mr. Suarez announced the Dedication, with the Boards approval, would be held September 30, 1995 at 9:00 A.M. COUNCILMAN INCORONATO had questions on the Tri -Muni Overruns. Mrs. Smith announced that a Special Meeting would be set up to discuss this issue, with Mr. Paggi in attendance with all his figures. COUNCILMAN INCORONATO on Bombs away Litigation. Mrs. Smith said this issue could not be discussed now it would be discussed at Executive Session. COUNCILMAN INCORONATO on the yellow flyers still being tossed out to residents driveways. They are in violation. Mr. Roberts stated, that this issue would also be discussed at Executive Session. COUNCILWOMAN VISCONTI on the Water Ban. Supervisor Smith announced that everyone is honoring the Water Ban. Fleetwood has the worst problem. She has requested Camo go to all the vacant houses and turn off the laterals. Water is being trucked into Fleetwood, which is costly, we are looking into the possibility of constructing another well. COUNCILWOMAN VISCONTI on the parking lot for Town Hall. Mr. Foster, explained that he had patched the bad spots, but nothing could be done until later in the season, he did send the Board a written report. Page 35 950828.RGM COUNCILMAN RUGGIERO, regarding speed limits and surveillance of Kent Road that was discussed at the last Board Meeting. He received Literature from Customs Signals Company of Albany, as to cost. He is doing more research, and questions the legality of prosecution from electronic surveillance and would like to this discuss this at a workshop. Mrs. Smith agreed. One last item for the Boards consideration is a request from Mr. Scott Leroy for a refund of $25.00 for a CO Search that was never initiated. COUNCILMAN INCORONATO moved to authorize the refund of the $25.00 to Mr. Leroy, based on the recommendation of Don Keller, Building Inspector. At this Time SUPERVISOR SMITH went over a calendar of events for September and October. September 10th, Community Day: September 14, Dedication of the Emergency Services Building: October 7th, the Air Show.
