A Special Meeting of the Town Board of the Town of Wappingger
was held on April 10, 1995 at the Town Hall, 20 Middlebush Road,
Wappingers Falls, New York.
Supervisor Smith called the Meeting to order at 7:02 P.M.
Present:
Constance Smith, Supervisor
Joseph Ruggiero, Councilman
Joseph Incoronato, Councilman
June Visconti, Councilwoman
Elaine H. Snowden, Town Clerk
Others Present:
Al Roberts, Attorney to the Town
Graham Foster, Highway Superintendent
The Supervisor scheduled the Meeting on March 27, 1995 to
consider the Senior Citizen Tax Exemption.
At the Start of the Special Meeting, Supervisor Smith
Presented several other items for the Boards Consideration.
MRS. SMITH notified the Board of the resignation
of Herb Levenson from the position of Zoning Administrator, and
the resignation of Connie Nascarella from the position of Data
Entry Operator I. Mrs. Smith also informed the Board she had a
candidate for the position of Entry Operator I, Frances Chyou.
Frances is also a Town Resident.
COUNCILWOMAN VISCONTI moved to accept the resignation of Herb
Levenson as Zoning Administrator and Connie Nascarella as Data
Entry Operator I.
Seconded by Mr. Incoronato
Motion Unanimously Carried
SUPERVISOR SMITH also requested the authorization from the Board
to appoint Frances Chyou for the vacant position of Data Entry
Operator I at a salary of $13,000.00. The position to start
Monday, April 17, 1995.
COUNCILWOMAN VISCONTI moved to authorize the Supervisor to hire
Frances Chyou to fill the vacant position of Data Entry Operator
I at a salary of $13,000.00

Ralph Holt, Chairman of Recreation requests permission to obtain
a Purchase Order in the amount of $2,500.00 payable to Crop
Production Services, for bulk fertilizer for all the recreation
areas.
COUNCILWOMAN VISCONTI moved to approve the Purchase Order in the
amount of $2,500.00 payable to Crop Production Services for bulk
fertilizer for all the recreation areas as requested by Ralph
Holt.
Seconded by Mr. Incoronato

Cheryl Hait, of the Justice Court was served with papers in
regard to a DWI proceeding. At this time, authorization is
needed for Attorney to the Town, Al Roberts to represent her.
COUNCILWOMAN VISCONTI moved to authorize Attorney to the Town
Al Roberts to represent Cheryl Hait on this proceeding.

A Public Hearing having been held on a proposed Local Law
Amending previous Local Laws on Senior Citizens Tax Exemptions,
on April 10, 1995, the matter was placed before the Town Board
for their consideration.
COUNCILMAN VALDATI moved to adopt Local Law #2 of 1995 as
follows:
BE IT ENACTED by the Town Board of the Town of Wappinger,
Dutchess County, New York as follows:
SECTION 1: Section 2(b) of Local Law No. 1 of 1967, as
amended by Section 2 of Local Law No. 5 of 1977, Local Law No. 2
of 1980, Local Law No. 8 of 1983, and Section 2(b) of Local Law
No. 4 of 1986, Local Law No. 3 of 1991, and Local Law No. 11 of
1992 is further amended to read as follows:
Section 2(b): The income of the owner or the combined

income of the owners of the property shall not and may not
exceed the sum of seventeen thousand five hundred ($17,500.00)
dollars for the income tax year immediately preceding the date
of making the application for exemption. The income tax year
shall mean the twelve month period for which the owner or owners
filed a federal personal income tax return, or if no such return
is filed, the preceding calendar year. Where title is vested in
either the husband or wife, their combined income may not exceed
such income. Such income shall include social security and
retirement benefits, interest, dividends, net rental income,
salary or earnings, and the net income from self-employment, but
shall not include a return of capital gifts or inheritances.
Rental income and self-employment shall not be reduced by an
allowance for depreciation.
SECTION 2: Section 2(c) of Local Law No. 8 of 1983, Local Law
No. 4 of 1986, Local Law No. 3 of 1991 and Local Law No. 11 of
1992 is hereby amended to read as follows:
Section 2(c): If the income of an eligible property owner

or the combined income of the owners of the property exceeds the
sum of $17,500.00 for the income tax year immediately preceding
the date of making the application for tax exemption and is not
greater than $24,999.99, said owner shall be entitled to a
partial exemption as follows:

Section 3: This Local Law shall take effect immediately
upon filing as provide by Municipal Home Rule and shall be
applied retroactively from January 1, 1995.

Amending Previous Local Laws Providing for Partial Tax
Exemptions for Senior Citizens Over 65 Years of Age
Supervisor Smith opened the Meeting at 7:00 P.M.
