A Special Meeting of the Town Board of the Town of Wappinger was
held on December 12, 1994 at the Town Hall, 20 Middlebush Road,
Wappingers Falls, New York.
Supervisor Smith called the Meeting to order at 6:45 P.M.
Present:

The Supervisor asked all to join in the pledge of Allegiance at
the commencement of the Meeting.
The Supervisor scheduled the meeting for December 12, 1994 for
the purpose of; Setting a Public Hearing for Wappinger Sewer
Transmission for December 27, 1994; Approve DiNonno Escrow
Refund; Comptroller transfer Request.
The first item for the Boards consideration was to set a Public
Hearing for Wappinger Sewer Transmission for December 27, 1994.
Map Plan and Report prepared by Joseph Paggi was forwarded to
the Town Board Members prior to the Special Town Board Meeting.
COUNCILWOMAN VISCONTI moved to accept the Map Plan and Report
and place it on file.

The following Resolution was offered by COUNCILWOMAN VISCONTI,
who moved its adoption and Seconded by Mr. Valdati
IN THE MATTER of the Improvement of Sewer System in the Town of
Wappinger, Dutchess County, New York, in the area of the Town
outside of the Village of Wappingers Falls known as the
Wappinger Sewer Transmission/Treatment Improvement Area, and the
Maximum Amount Proposed to be Expended Therefor.

ORDER CALLING PUBLIC HEARING
WHEREAS, pursuant to proceedings heretofore had and taken in
accordance with the provisions of Article 12-C of the Town Law,
the Town Board of the Town of Wappinger, Dutchess County, New
York, has established the Wappinger Sewer Transmission/Treatment
Improvement Area in Said Town and has authorized the
construction and installation of various sewer improvements to
serve a benefited area in said Town outside the Village of
Wappingers Falls, including, but not limited to, the
construction of transmission facilities, to be used in
combination with existing sewer trunk lines, for the purpose of
delivering sewage within Phase One and Phase Two of the
Improvement Area to the existing Tri -Municipal Pumping Station
located in the Village of Wappingers Falls for further
transmission through existing and proposed facilities to the
Tri -Municipal Wastewater Treatment Facility, and the
construction of an addition to the Tri -Municipal Wastewater
Treatment Facility, for the purpose of treating sewage
generated, initially, from Wappinger Sewer Improvement Are No.
1. and the Rockingham Farms sewer District with future expansion
that will, ultimately, treat sewage generated from the entire
Wappinger Sewer Transmission/Treatment Improvement Area, in
accordance with a map, plan and report relating thereto, at a
maximum estimated cost of $17,020,000; and
WHEREAS, it now appears that in order to complete the
aforesaid improvement an additional $2,600,000.00 must be
expended therefor and that the maximum estimated cost thereof is
now determined to be $19,620,000.00; and
WHEREAS, it is now desired to call a public hearing on the
question of increasing the maximum amount proposed to be
expended for the improvements to be constructed in the Wappinger
Sewer Transmission/Treatment Improvement Area, in the manner

described above, and to hear all persons interested in the
subject thereof, concerning the same, in accordance with the
provisions of Section 209-q(5) of the Town Law;
NOW THEREFORE, IT IS HEREBY ORDERED, by the Town of
Wappinger, Dutchess County, New York, as Follows:
Section 1. A public hearing will be held at the Town Hall,
20 Middlebush Road, in Wappingers Falls, New York, in said Town,
on the 27th day of December, 1994 at 7:00 o'clock P.M.,
Prevailing Time, on the question of the increase in the maximum
amount proposed to be expended for the construction of
improvements to the Wappinger Sewer Transmission/Treatment
Improvement Area in the Town of Wappinger, Dutchess County, New
York in the manner described in the preambles hereof, and to
hear all persons interested in the subject thereof, concerning
the same, and to take such action thereon as is required or
authorized by law.
Section 2. The Town Clerk is hereby authorized and directed
to cause a copy of the Notice of Public Hearing to be published
once in Southern Dutchess News, the official newspaper, and also
to cause a copy hereof to be posted on the sign board of the
Town, such publication and posting to be made not less than ten,
nor more than twenty days before the date designated for the
hearing.
The question of adoption of the foregoing order was duly put
to a vote on roll call, which resulted as follows:

with the increase in the maximum amount to be expended for the
Wappinger Sewer Transmission/Treatment Improvement Area.

was received from Philip J. DiNonno.
COUNCILWOMAN VISCONTI moved to approve the return of Escrow in
the amount of $4,330.70 to Philip J. DiNonno based on the
recommendation of Herb Levenson, Zoning Administrator.

Highways. Mr. Foster had only received (2) quotes. The quote
from Ira D. Conklin & Sons for $5,521.00, being the lowest.
Mr. Foster informed the Board that the tanks are made of
double wall epoxy coated steel.

$5521.00 payable to Ira Conklin & Sons, for the purchase of
underground storage tanks.

The Special Town Board Meeting reconvened at 7:02 P.M. with all
Board members present.
Another request was received from Comptroller Ann Buckley to
r.. borrow $306,243.00 from A Fund to pay Camo Pollution Control
back fees for water and sewer contract charges. These monies
will be paid back to A Fund from various districts as soon as
taxes are collected. It is necessary to borrow these funds for
2 reasons: (1) $110,167.00 was relevied on Tax bills and (2)
$196,076.00 has not been billed yet. This is the last 3 months
of 1994, October, November and December, which will be billed in
January of 1995.

the depletion of the Fund Balance

property for recyclables, etc.

Mrs. Smith explained that the reason for the increase was due to

Supervisor Smith asked if there were any questions or comments
from the Audience. Mr Clyde Hairston of 24 Hilltop Drive asked
about Surplus Funds. Mrs Smith explained the fund balance has
been depleted. John Bezentko of 5 Edgehill Drive spoke. He is
a tenant, how much longer will he be a tenant. Mrs Smith
explained that his system will be part of the Tri -Muni by
December, 1995.
Mr. Hairston of 24 Hilltop also wanted to know how the rates
will effect him. Mrs. Smith explained, as more people use the
system, the rates will go down.
Mark Baldino of 7 Davis Drive asked if there would be any

decrease when the project is completed. Mr. Paggi answered yes.
Councilwoman Visconti explained how the question of rates is
determined. Each year there is a Budget presented for the cost
of 0 & M. It is them divided by the amount of homes that are
benefited. This is how the rates are determined.

Supervisor Smith asked if there were any questions or comments

Tom Colemen of 50 Martin Drive asked how safe will the new plant
be. Mr. Tremper of Camo Pollution explained the construction
and its safety. Jeff Theiss of 36 Martin Drive asked if the
Rates would go up every year. Mrs. Smith said hopefully no, we
can not predict at this time. New regulations every year, and
we must upgrade the system.
Ken Somers, 49 Top 0 Hill asked what the time frame for Capital
fees was. Mrs. Smith informed him, 20 years.

A Public Hearing was held by the Town Board of the Town of
Wappinger on December 12, 1994 at the Town Hall, 20 Middlebush
Road, Wappingers Falls, New York on the proposed Local Law
amending Local Law #9 of 1985, Local Law #9 of 1987 and Local
Law #6 of 1993 with respect to the establishment of Water Rates
for The Central Wappinger Improvement Area.
Supervisor Smith opened the Hearing at 7:41 P.M.
Present:
Constance Smith, Supervisor
Joseph Ruggiero, Councilman
Robert Valdati, Councilman
Joseph Incoronato, Councilman
June Visconti, Councilwoman
Elaine H. Snowden, Town Clerk
Others Present:
Albert Roberts, Attorney to the Town
Joseph Paggi, Engineer to the Town
Ann Buckley, Comptroller
The Town Clerk offered for the record the Affidavit of Posting
and Publication duly signed and notarized. (These Affidavits
are attached hereto and made part thereof of the Minutes of this
Meeting).
The Water rate shall be increased from $16.00 per quarter to
$25.00 per quarter for any usage up to and including 2500 cubic
feet.
Supervisor Smith asked if there were any comments or questions
from the audience
Mr. Lindstrom of 52 Kent Road felt that raising rates this way
penelizes users. He felt their is no incentive to save Mr.
Lindstrom feels that the water usage should be brought down to
1600 cubic feet and based on usage. Mr. Paggi explained that
this must be done gradually. If you lower the revenue to much
your will fall short. Mr. Tremper informed the audience, that
many of the costs are set.
Mr. Incoronato reminded the residents, that this was just a
Public Hearing, to vote on the rates and the Board was looking

for input.
Mr. Slacin of 91 Edgehill drive asked to have Fund Balance
explained. Mrs. Smith explained that the Fund Balance is the
money left in the fund at the end of the year. It is illegal
to have large amounts of money left in the fund. Our fund
balance is now depleted, that is the reason for the increases.
There were no other Comments or questions.
COUNCILMAN INCORONATO moved to close the Public Hearing,
seconded by Mr. Valdati and Unanimously Carried.
The Hearing closed at 8:00 P.M

Supervisor Smith asked if there were any questions or comments

Mrs. Thomas of 35 Mocassin Drive addressed the Board. She
claims to be on a very strict budget, and had to take a salary
cut, she would like to work out some sort of an arrangement
to pay over a longer period of time. Mrs. Smith recommended
that Mrs. Thomas write a letter to the Town Board, and they
j would get back to her.
There were no other comments.
COUNCILWOMAN VISCONTI moved to close the Public Hearing,
seconded by Mr. Incoronato and Unanimously Carried.
