Resolution Directing Members of the Code Enforcement Office to Inspect Premises in
Respect to Improper Ground Water or Surface Water Disposal Connections
At a regular meeting of the Town Board of the Town of Wappinger, Dutchess County,
New York, held at Town Hall, 20 Middlebush Road, Wappingers Falls, New York, on February
8, 2010.
The meeting was called to order by Christopher Colsey, Supervisor, and upon roll being
called, the following were present:

The following Resolution was introduced by Councilman Bettina and seconded by
Councilman Paoloni.
WHEREAS, the Town of Wappinger maintains and operates municipal wastewater and
sewer infrastructure; and
WHEREAS, the Town of Wappinger distributes a significant portion of its sewer to Tri -
Municipal for which a fee is paid on volumetric usage; and
WHEREAS, the usage increases dramatically during and immediately following storms
which may have a correlation to an improper ground water or waste water disposal connections;
and
WHEREAS, the Town Code Enforcement Officials have limited authority to control
improper ground water or waste water disposal connections, such as sump pumps connected to
the municipal waste line; and
WHEREAS, the Town Supervisor reviewed this proposal with the Town Engineer and
Town Water and Sewer Consultant prior to the presentation of this resolution to the Town Board;
and
WHEREAS, the Town Board discussed this issue as part of the January 25, 2010 regular
meeting agenda; and
WHEREAS, the Town Board finds it in the best interest of the Town to direct the Town
Code Enforcement Officials to inspect for improper ground water or waste water disposal
connections during the initiation of a municipal title search process or permit application for
which a plumbing modification is required; and
WHEREAS, the Town Board further finds it in the best interest of the Town to provide
educational communications regarding the effects of improper ground water or waste water
disposal connections to residents through bulletins within their sewer and water billings, and to
real estate and title firms through direct mailings.
NOW, THEREFORE, BE IT RESOLVED, that the Town Board has considered the
aforementioned proposals for the purpose of alleviating influx and infiltration concerns that
adversely affect wastewater treatment expenses and hereby adopts the aforementioned effective
immediately.
BE IT FURTHER RESOLVED, that the Town Code Enforcement Officials are hereby
directed to notify all local real estate and title firms to provide advice as to the newly adopted
policy in an effort to minimize any impact that may result from the correction of any improper
ground water or waste water disposal connections. Further, the Town Code Enforcement
Officials are hereby directed to amend any permit or municipal search applications to clearly
provide language in respect to the newly adopted policy.
BE IT FURTHER RESOLVED, that the Town Board hereby authorizes and directs the
Town Supervisor and Town Water & Sewer Department to include notifications within the
regular billings of this newly adopted policy regarding improper ground water or waste water
disposal connections.
