A Special Meeting of the Town Board of the Town of Wappinger was
held on September 13, 1993, at the Town Hall, 20 Middlebush
Road, Wappingers Falls, Dutchess County, New York.
Supervisor Constance Smith called the Special Meeting to order
at 6:47 P.M.
Present:

The Supervisor asked all to join in the Pledge of Allegiance to
the flag at the commencement of the Meeting.
Supervisor Smith sent out notices to the Town Board and the News
Media on September 7, 1993, for the purposes of: (1)
Authorization for the Town Assessor to workup the Benefit
Assessment Rolls; (2) Authorization of the Highway
Superintendent to go forward with Town .Road striping; (3) Voting
by the Town Board for the Amendment to the Disaster Plan
according to OSHA; (4) Approval of Construction Change Orders in
regards to a (Water Main crossing under Route #9) and unexpected
encounters with respect to Sanitary Sewer Installation both,
Pillari Brothers & G.A.L., Inc.
The first order of business on the Agenda was the authorization
for the Town Assessor, Tom Logan, to prepare the Benefit
Assessment Rolls for all Town Sewer and Water Districts.

The Town Assessor is hereby authorized and directed to
prepare an Assessment Roll for the Central Wappinger Water
Improvement Area District in accordance with the following
standards:
1. All property within the benefit area shall be assessed.
2. The formula for such assessment shall be as follows:
a. A single family house on a lot of less than two
acres - one benefit unit. Where acreage over two acres - .2
benefit unit for each acre or part thereof over two acres.
b. Vacant residential land less than two acres - .8
benefit unit.
c. Residential acreage in excess of two acres - .8
benefit unit for the first two acres, .2 benefit unit for each

Authorization for the Town Highway Superintendent, Graham
Foster, to go forward with the road striping was presented to
the Town Board.
Supervisor Smith remarked that she has a Purchase Order in the
amount of $8,500.00 (up to that amount) for the striping of the
Town roads. According to Town Policy, we must have
Authorization from the Town Board to implement it.
MR. MILLS moved to approve a P.O. and authorize the Town Highway
Superintendent, Graham Foster, to go forward with the road
striping.

An Amendment to the Disaster Plan was presented to the Town
Board for approval. Supervisor Smith stated that this is an
Amendment to the Disaster Plan which the Town of Wappinger has
to have in place according to OSHA. The Amendment was sent to

the Fire Inspector, Mark Liebermann, for his opinion. He then
presented it to the Fire bureau.
Mr. Liebermann and the Fire Bureau have agreed that the
Amendment was suitable and that the Town of Wappinger should
adopt the Plan.
MRS. VISCONTI moved to approve the Amendment to the Disaster
Plan.

Supervisor Smith remarked that the New York State Police located
in Fishkill, New York, have acquired two generators from the
military, one of which will be used when the new Emergency
Services Building is erected in the future which will be their
new location. The second generator was given to the Troop "K"
division of the New York State Police.
James Bedore, Project Engineer, for the Wappinger Sewer
Transmission/Treatment Improvement Area presented several items
pertaining to project Change Orders which require Town Board
approval. The first item (Item A) is regarding a "8" Ductile
Water Main within Cased Crossing No. 2, Phase 1, Contract No. 1
with Pillari Brothers, Contracting Company. Mr. Bedore stated
that due to increased material and labor cost and length of pipe
required for Item A, the new price is $14,460.00, therefore,
additional approval is required. (The Town Board had originally
authorized $7,200.00 for said work).
MRS. VISCONTI moved to approve Pillari Brothers Change Order No.
1 for the amount of $14,460.00 for additional labor and pipe
length for Item A.

Mr. Bedore next presented Change Order No. 2, which is also
regarding Phase 1, Contract 1 - Pillari Brothers. He stated
that while constructing the boring pit for cased crossing No. 2,
they uncovered an uncharted 24" New York State Department of
Transportation storm sewer pipe. The storm drain was so old
that it did not appear on any of the maps used. Hence, they
were required to relocate the face of the boring pit four (4')
feet farther west which will increase the casing length from
145' to 149'. This additional casing length and appurtenances
will result in an increase of $2,758.60.
MRS. VISCONTI moved to approve Pillari Brothers Change Order No.
2 for additional cost of pipe length and appurtenances in the
amount of $2,758.60.

Mr. Bedore further presented GALS Change Order No. 1 - regarding
24" uncharted storm drain and structure in the amount of Change
Order $766.82.

amount of $766.82.

Change Order No. 2, also under GALS, was presented to the Board.
In estimating the amount of rock to be encountered for
installation of 30" and 24" sanitary sewer along Myers Corners
Road, 250 C.Y. was used. The final yardage is 440.65 C.Y. or an
increase of 190.65 C.Y. above the estimated quantity. This will
result in an additional $19,065.00 above the contract.
MRS. VISCONTI moved to approve GALS Change Order No. 2 in the
additional amount of $19,065.00 above the contract.

Change Order No. 3, was presented to the Board. Rock removal by
blasting was estimated at 150 C.Y. The final yardage is 176.25
C.Y. or an increase of 26.25 C.Y. above the estimated quantity.
This will result in an additional $1,050.00 above the contract.
Change Order No. 4 regarding manhole No. 3 was relocated in the
field. This results in an increase of 12.50' of 30" sanitary
sewer above the contract amount. The increase price of
$1,312.50.
MRS. VISCONTI moved to approve, both GALS Change Order No. 3 in
the amount of $1,050.00; and Change Order No. 4 in the amount of
$1,312.50.

Mr. Paggi remarked that when the contract is finalized at the
end of the month (September), Paggi & Martin will give a final
report on the following items: Item 2.01 - E (30" 8'-10' Depth
2' _ $210.00); Item 2.01 - B (24" 0'-8' Depth 14.5'
$1,015.00); Item 2.01 - C (24" 8'-10' Depth 1' _ $72.00); Item
5.01 (Foundation Stone - 500 CY = $9,500.00); Item 6.01 (R.O.B.
Gravel - 500 CY = $7,500.00); Item 9.01 (Asphalt Cone. - 230 SY
$10,350.00)
Mr. Paggi further remarked that when the project was originally
estimated in March of 1990, it was estimated at $400,600.00 and
the low bid which was awarded to GALS was $365,000.00+.
Mr. Paggi mentioned that the Town Board keep in mind a proposal
from the General Contractors (Ameri-Tech, Construction &
Development Corporation) of an estimate of $8,300.00 to extend
the trunk line from the east side of Route 9 to the west side of
Route 9.

The contractors (Ameri-Tech, Construction & Development
Corporation) would suggest that the cost of additional piping
and possibly a pump station would be more than offset by the
benefit that the Town could derive by generating additional tax
revenue from the valuable an still yet undeveloped properties
e
which need the sewer to be able to become developed parcels.
Mr. Paggi commented that the Town Board does not have to make a
decision right now, but just to keep the proposal in mind and
that it would save money in the future.
Supervisor Smith suggested that it would be discussed further at
a future Work Shop Meeting.
Supervisor Smith stated that at this time she wished to make an
official notation that the next Town Board Meeting would be
changed to Wednesday, September 29, 1993, instead of Monday,
September 27, 1993, due to the fact that the professionals will
not be available.
Mrs. Visconti moved to close the Special Meeting, seconded by
Mr. Wallace and unanimously carried.
