Public Comments
The first resident to speak was Mary Schmalz. She spoke in reference to Resolution
2010-80. She would like to see a study done to see how much it would cost to get the pool back
into operation. She also suggested a comparison be done as to how much it costs to run the
summer swim program. One pool has already been closed on All Angels Hill Road about 30
years ago. Other towns have their swimming areas. Before the pool is filled in, she would like
the study to be considered because it would benefit the whole Town.
Her other concern had to do with the reviewing of the Town bills. She feels that all of the
Town bills should be in the packets for the public to review, even those that have been paid.
Supervisor Colsey clarified that any public item is available through a FOIL application.
The next resident to speak was Gary Lindstrom. He spoke in reference to the Agenda
item about senior housing. He noted that there are other towns that provide senior housing, but
there is nothing in the Town of Wappinger. Many residents would like to go on living in
Wappinger and need homes that are one level, with no up -keep and no grounds to take care of. It
seems that, when people talk senior housing, they are only concerned with the low cost end of it.
He is in support of some kind of growth for senior housing in Wappinger. Mr. Lindstrom has
brought this up in the past and wished to bring it up again as there is a new Council Member.

VII. Discussions
A. Personnel Manual Update - David Wise/ Colsey
Supervisor Colsey opened the discussion at 7:10 PM. David Wise, the Town's appointed
attorney for personnel issues, briefly summarized the progress of the Town of Wappinger
Personnel Manual. He reminded the Board to keep in mind that the purpose of the handbook is
to set forth rules and guidelines on labor management relations. Supervisor Colsey added that
they also had the Town's workers compensation carrier and liability insurance carrier look at it.
Supervisor Colsey closed the discussion at 7:11 PM.
B. Town Underground Storage Tank Report (Enviro Clean) - Joe Jordan/Colsey
Supervisor Colsey opened the discussion at 7:11 PM. Joe Jordan, principal of Enviro
Clean Services, LLC, was present to discuss the report with the Town Board. In July 2009, Mr.
Jordan was hired to perform the NYSDEC petroleum bulk storage audit on tanks located on
facilities within the Town of Wappinger. He presented the findings of the audits for the Town of
Wappinger Highway Dept, Camwath property and Town of Wappinger Town Hall to the Board
and fielded question from the Board. Supervisor Colsey discussed the estimates and proposals.
Councilman Paoloni asked for clarification on purchasing procedures and what needs to go out to
bid. Al Roberts, Town Attorney, explained the procedures. The Board agreed to move forward
with the $850 expense. The Board then discussed the expenses for removing boilers. There is
roughly $90,000 in a fuel tank replacement fund. Discussion followed. Councilman Paoloni
asked again about the bid process to make sure that this project would not need to go out to bid.

Mr. Roberts clarified that this would need to have three written bids, but would not cross the
threshold that would require formal bidding. Supervisor Colsey closed the discussion at 7:57
PM.
C. CDBG Update - Donna Bolner, DC Legislature/Colsey
Supervisor Colsey opened the discussion at 7:57 PM. Donna Bolner, Dutchess County
Legislator, was present to address the Board on this issue. She notified the Board that the
Community Development Block Grant that was submitted for handicapped baseball fields and
improvements at the Robinson Lane complex was one of the nine grants that were granted. The
field will be ADA compliant. It will allow handicapped participants from 5-18 years of age to
participate and play baseball. Some resurfacing and improvements to dug outs will be needed.
Councilman Bettina questioned if this was only for Robinson Lane and only for ages 5-18. Ms.
Bolner replied that it is only for Robinson Lane because that is where the application was applied
for. But once the field is established, it can be used for seniors or veterans as well as for
handicapped people. Supervisor Colsey explained that the Challenger League was started by
Bettina Briccetti as a Girl Scout project. There are now four teams. Former Supervisor
Ruggiero applied for this grant in the past, but it was not approved. After several attempts, the
Town got the grant this year. There are certain materials that have to be used for these fields.
Currently, the Challenger games are played on dirt fields. Councilman Beale asked about the
time frame for the upgrades to the field. He would like to have something in the spring.
Supervisor Colsey stated that it could be started in the spring. Rob Wilson, President of Little
League, confirmed that it could definitely be done in the spring. Councilman Beale would like
some kind of announcement to be made on opening day of Little League. Supervisor Colsey
closed the discussion at 8:06 PM.
VIII. Re -Zone Applications
A. Property. NYS Route 9D, Tax Map No. 6057-04-964107
Supervisor Colsey opened the discussion at 8:06 PM. Luigi D'Agostino, Attorney at
Law, representing Guiseppe D'Agostino, the rezoning applicant, spoke to the Board about this
topic. The applicant would like to bring an assistant -living, senior housing or 55 plus housing
development to Wappinger. Councilman Bettina noted the need to refer this to the Planning
Board. He advised Mr. D'Agostino the proper steps that need to be taken for rezoning
applications. Al Roberts, Town Attorney, noted that the applicant does not have a proposed site
plan. The applicant would need a proposed site plan for the Planning Board to review.
Supervisor Colsey noted that there is a proposal for a similar project right next to this property.
Discussion followed pertaining to the availability of water and sewer and the possible scope of
the project. Supervisor Colsey closed the discussion at 8:18 PM.
B. Property. All Angels Hill Road. Tax Map No. 6257-02-630770
Supervisor Colsey opened the discussion at 8:26 PM. Richard O'Rourke was on
hand to represent the rezoning applicants for this property. This rezone application was
originally submitted in 2008. Mr. O'Rourke was joined by Dan Zalinski and Jim
Fitzpatrick of Toll Brothers and Frank Buyakowski, managing member of Contrail LLC.
Mr. O'Rourke described the parcel and the nature of the application. Councilman Bettina
noted that the Planning Board will take a look at this and make a recommendation to the
Town Board. Discussion followed about the possibility or legality of restricting
residency for this property only to permit Town of Wappinger seniors. Councilman
Paoloni asked who would make up the difference between market value on these homes
and the price that these homes would be sold for as affordable housing units. Mr.
Zalinski commented that the developer would have to pick up the difference. Mr.
O'Rourke continued with the presentation. Supervisor Colsey noted that Legislator
Incoronato was present and would like to comment. Mr. Incoronato noted that this is a
meritorious proposal. He cited reasons of why he feels that it is. Discussion followed.

IX. Resolutions
RESOLUTION: 2010-76
Resolution Authorizing Change Order No. 3 for the Highway Garage HVAC Project
WHEREAS, the Engineers to the Town, Morris Associates Engineering Consultants,
PLLC, have approved Change Order No. 3 to the Contract for the Town of Wappinger Highway
Garage HVAC Project, as per letter dated January 19, 2010, a copy of which has been provided
to the Town Board in advance of this resolution.
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The recitations above set forth are incorporated in this Resolution as if fully set forth
and adopted herein.
2. The Town Board hereby approves Change Order No. 3 in the amount of Nine
Hundred Forty -Eight Dollars and 75/100 ($948.75), dated December 30, 2009, for the
Town of Wappinger Highway Garage HVAC Project Contract between the Town of
Wappinger and Airflow Air Conditioning, Refrigeration & Heating, Inc., resulting in a
new contract sum in the amount of Two Hundred Fifty -Seven Thousand, Four Hundred
Twenty -Two Dollars and 75/100 ($257,422.75), for the reasons and associated costs set
forth in the letter dated January 19, 2010, from Morris Associated Engineering
Consultants, PLLC.

RESOLUTION: 2010-77
Resolution Appointing Member to the Town of Wappinger Zoning Board of Appeals
WHEREAS, the Town of Wappinger has constituted a five (5) member Zoning Board of
Appeals to oversee matters related to area and use variances, as well as interpretations, in accordance
with the Town of Wappinger Town Code; and
WHEREAS, members of the Zoning Board are appointed for a term of five (5) years; and
WHEREAS, a vacancy on the Zoning Board of Appeals existed due to the expiration of the
five (5) year term occupied by Howard Prager, Jr., effective December 31, 2008; and
WHEREAS, an oversight occurred where Howard Prager, Jr. was re -appointed as the
Chairperson of the Zoning Board of Appeals, but was not formally re -appointed to the Board; and
WHEREAS, the Town Board hereby appoints Howard Prager, Jr. to fill the vacancy to
December 31, 2013.
THEREFORE, BE IT RESOLVED, that Howard Prager, Jr. is hereby appointed as a
member of the Town of Wappinger Zoning Board of Appeals for a term of five (5) years, to expire
December 31, 2013.

Resolution Authorizing the Town Highway Superintendent to Seek Bids for Highway
Supplies and Services
WHEREAS, the Town of Wappinger Highway Superintendent requested permission to
seek bids for Highway services and supplies in a letter dated January 25, 2010, as provided to the
Town Board in advance of this resolution
NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town of
Wappinger hereby authorizes the Town Highway Superintendent to seek bids respective to
"Highway supplies and services, i.e. road aggregates, oil, gas, grate frames, catch basins, spring
bulk pickup and recycle center hauling, etc." for fiscal year 2010.

Resolution Authorizing the 2008 Town -Wide Audit Report Document to be Filed with the
Town Clerk
WHEREAS, the Town of Wappinger is annually audited by an independent accounting
firm; and
WHEREAS, the "Town of Wappinger, New York, Financial Statements, as of and for
the Year ended December 31, 2008" audit document had been reviewed at the regularly
scheduled meeting of January 25, 2010, and a copy of such provided to the Town Board in
advance of the meeting; and
WHEREAS, modifications were made to the document for the purpose of accuracy and
clarity, and such modifications were provided to the Town Board in advance of this resolution.
NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town of
Wappinger hereby authorizes the Town Clerk to place on file for public review the "Town of
Wappinger, New York, Financial Statements, as of and for the Year ended December 31, 2008"
audit report document.

RESOLUTION: 2010-80
Resolution Authorizing the Removal of the Swimming Pool and Swing Set at Carnwath
Farms
WHEREAS, the Town Board is the custodian of all Town owned properties; and
WHEREAS, the Town has been notified through its insurance carrier (Zurich) that a

recent risk management survey has determined the existing swimming pool and swing set at
Carnwath Farms creates an unacceptable risk and must be removed to maintain site insurance
coverage; and
WHEREAS, a copy of the insurance carrier memo was delivered to the Recreation
Department, with copy to the Town Board, via memo from the Town Supervisor dated January
20, 2010; and
WHEREAS, a personal inspection by the Town Supervisor shows the swing set to have
several areas of rust initiated holes in the main structure and the swimming pool is partially filled
by untreated water, and there are no records of maintenance or treatment since the purchase of
the property; and
WHEREAS, the swing set may be removed by the Parks and Maintenance Department,
with the metal to be recycled; and
WHEREAS, the swimming pool may be deconstructed by the Town Highway
Department, and filled with resources from said department
NOW, THEREFORE, BE IT RESOLVED, that the Town Board hereby authorizes the
Carnwath Farms swing set to be completely removed by the Parks and Maintenance Department
prior to April 1, 2010, and for such components to be recycled.
BE IT FURTHER RESOLVED, that the Town Board hereby authorizes the Carnwath
Farms swimming pool to be completely removed by the Town Highway Department prior to
April 1, 2010, and for such area to be completely filled through the use of Town resources.

Resolution in Support of a Joint Applicant with Other Municipalities to the New York
State Department of State's 2009-2010 Local Government Efficiency Grant Program for
the Purposes of Seeking Funding for a General Efficiency Planning Grant to Enter into a
Study of Regional Collaboration and Shared Services with the Intent to Achieve Cost
Savings and Economies of Scale
WHEREAS, the current economic crisis at state and local levels makes collaboration and
shared services a high priority and necessity for continued operations, especially when such
efforts and initiatives lead to cost savings, economies of scale and reduced burdens on the
taxpayer; and
WHEREAS, the Town of Wappinger, in the County of Dutchess, has an interest in
studying how a regional approach to service delivery would lead to savings and other efficiencies
yet to be demonstrated and has participated in several meetings to discuss the issue of shared
services, given current and projected needs; and
WHEREAS, Mid Hudson Pattern for Progress (MHPP), the regional planning agency,
has facilitated meetings in which the Town of Wappinger has been represented to explore
regional collaboration among neighboring municipalities in which reducing costs through
collaboration and sharing has emerged as a top priority; and
WHEREAS, the Town Supervisor, Christopher J. Colsey, has requested that the Town of
Wappinger be authorized to submit a grant application to the New York State Department of
State's 2009-2010 Local Government Efficiency Grant Program for multi -municipal, general
efficiency planning grant, and for the Town of Wappinger to commit to share equally among
participating municipalities, the ten (10%) percent required cash match.
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The recitations above set forth are incorporated in this Resolution as if fully set
forth and adopted herein.
2. The Town Board hereby authorizes the Town Supervisor, Christopher J. Colsey,
on behalf of the Town of Wappinger, to apply for a grant from the New York
State Department of State for the Local Government Efficiency Grant Program in

the General Efficiency Planning Grant category for the purpose of funding a study
of cost savings and economies of scale resulting from shared services.

to execute any and all other documents required in connection with such
application subject to the review and approval thereof by the Attorney to the
Town, Albert P. Roberts, for the purposes of form and content.

WHEREAS, the Town of Wappinger maintains and operates municipal wastewater and
sewer infrastructure; and
WHEREAS, the Town of Wappinger distributes a significant portion of its sewer to Tri -
Municipal for which a fee is paid on volumetric usage; and
WHEREAS, the usage increases dramatically during and immediately following storms
which may have a correlation to an improper ground water or waste water disposal connections;
and
WHEREAS, the Town Code Enforcement Officials have limited authority to control
improper ground water or waste water disposal connections, such as sump pumps connected to
the municipal waste line; and
WHEREAS, the Town Supervisor reviewed this proposal with the Town Engineer and
Town Water and Sewer Consultant prior to the presentation of this resolution to the Town Board;
and
WHEREAS, the Town Board discussed this issue as part of the January 25, 2010 regular
meeting agenda; and
WHEREAS, the Town Board finds it in the best interest of the Town to direct the Town
Code Enforcement Officials to inspect for improper ground water or waste water disposal
connections during the initiation of a municipal title search process or permit application for
which a plumbing modification is required; and
WHEREAS, the Town Board further finds it in the best interest of the Town to provide
educational communications regarding the effects of improper ground water or waste water
disposal connections to residents through bulletins within their sewer and water billings, and to
real estate and title firms through direct mailings.
NOW, THEREFORE, BE IT RESOLVED, that the Town Board has considered the
aforementioned proposals for the purpose of alleviating influx and infiltration concerns that
adversely affect wastewater treatment expenses and hereby adopts the aforementioned effective
immediately.
BE IT FURTHER RESOLVED, that the Town Code Enforcement Officials are hereby
directed to notify all local real estate and title firms to provide advice as to the newly adopted
policy in an effort to minimize any impact that may result from the correction of any improper
ground water or waste water disposal connections. Further, the Town Code Enforcement
Officials are hereby directed to amend any permit or municipal search applications to clearly
provide language in respect to the newly adopted policy.
BE IT FURTHER RESOLVED, that the Town Board hereby authorizes and directs the
Town Supervisor and Town Water & Sewer Department to include notifications within the
regular billings of this newly adopted policy regarding improper ground water or waste water
disposal connections.

New Business
A. Councilman Beale New Business
Councilman Beale stated that there have been concerns from potential Association of
Towns Conference attendees due to the amendment of the Resolution at the last Meeting. The
concern is that, since meals and mileage have been removed, they can no longer afford to attend.
These attendees are taking time off of work to attend. He asked how many attendees have signed
up and what the total cost is. Supervisor Colsey answered that there are 8 people attending and
the cost is $195 per night, for two nights at the Hotel. The cost for registration is $100 per
person. He went on to note that the list of attendees includes: three Town Board Members, two
ZBA Members and one or two Planning Board Members. The total is approximately $4000.
Councilman Beale stated that he would like to include meals and mileage. Discussion followed.
Councilman Paoloni noted that, although mileage and meals were taken out, parking was still
reimbursable. Supervisor Colsey replied that parking was not included. The Board was very
clear in what was to be included and that was registration and hotel costs only. Discussion
followed.

Resolution Approving Recognition Agreement with International Brotherhood of
Teamsters Local 445
WHEREAS, a majority of full-time and permanent part-time employees employed at the
Town of Wappinger Town Hall ("Town Hall employees") have signed authorization cards with
respect to representation by Local 445; and
WHEREAS, the Town desires to voluntarily recognize Local 445 as the exclusive
collective bargaining representative of various Town Hall employees subject to specific terms
and conditions; and

WHEREAS, Local 445 and the Town wish to enter into a Recognition Agreement to set
forth their mutual understanding with respect to the Town's voluntary recognition of Local 445.

Wappinger approves the Recognition Agreement in the form attached to this Resolution
BE IT FURTHER RESOLVED, that Town Supervisor Christopher Colsey is
authorized to execute the Recognition Agreement on behalf of the Town.
