On July 21, 1992, the New York District of the u.S. Army Corps of Engineers received a request for a Department of the Army jurisdictional determination for the above referenced project. This request was made by Mark A. Day, as consultant for Elizabeth Laufer. The site consists of approximately 56.4 acres, in the Town of Wappinger, Dutchess County, New York. The proposed project involves the construction of a golf driving range to be called Wappinger Golf Park. In the letter received on July 21, 1992, your office submitted a proposed delineation of the extent of the wetlands on the site. A site inspection was conducted by representatives of this office on July 12, 1993, in which it was agreed that changes would be made to the delineation and that the modified delineation would be submitted by the applicant. On September 10, 1993, this office received t?e modified delineation. Based on the material submitted and the observations of the representatives of this office during the site visit, it has been determined that the drawing entitled "Special Use Permit - Wappinger Golf Park", prepared by Barger, Day & Oswald, dated July 8, 1993, and last revised August 19, 1993, appears to be an accurate depiction of the extent of the waters of the United States on the subject site. This drawing indicates that there is one principal wetland area on the project site. The wetland runs basically down the center of the property and is approximately 34.5 acres. Additional waters of the United States on site include a stream that runs along the southwest border of the property. These waters of the United States are considered to be above the headwaters. This determination regarding the delineation shall be considered valid for a period of three years from the date of this letter. If the activities proposed for the site involve such discharges, authorization from this office may be necessary prior to the initiation of the proposed work. The extent of such discharge of fill will determine the level of authorization that would be required. If any questions should arise concerning this matter, please contact Brian A.
