The examination was made, and the report prepared, in accordance with Article 3 of the General lfunicipal Law. We request that the report be studied by all officials of the Town. Your attention is called to Section 35 of the General Municipal Law, as amended by Chapter 441 of the Laws of 1960, which requires you to publish a notice to the effect that the report has been received, filed in your office and is available for public inspection. This law also requires that you file in your office the news- paper's affidavit of publication, together with the enclosed form, certifying that it is a newspaper having general circulation in the Town . Filing of report of examination and notice thereof. 1. A report of such ex~nination ~hall be made and shall be filed in the office of the state comptroller and in the office of the clerk of the municipality or district. An additional copy thereof shall be filed with the chief fiscal officer of the municipality or district, except that in the case of a school district, such additional copy shall be filed in the office of the chairman of the board of trustees, the president of the board of education or the sole trustee, as the case may be. When so filed, each such report and copy thereof shall be a public record open to inspection by any interested person. 2. (a) Within ten days after the report of any such examination is filed with the clerk of the municipality or district, he shall give pub- lic notice thereof in substantially the following form: "Notice is hereby given that the state comptroller has caused the fiscal affairs of (name of municipality or district) for the period beginning on ................. and ending on................., to be examined, and that the report of such exronination has been filed in my office where it is available as a public record for inspection by all interested persons." (b) In municipalities, the clerk shall cause notice to be published at least once in the official newspaper, or if there be no official news- paper, in a newspaper having general circulation in the municipality. 1!l districts, except common school districts, the clerk shall cause such notice to be published in a newspaper having general circulation the district. If there be no newspaper having general circulation in such municipality or district, the clerk shall post such notice conspicuously in ten public places in the municipality or district. In a common school district which maintains a home school, the clerk shall post such notice on the front door of the schoolhouse. In a comnon school district which does not maintain a home school, the clerk shall post such notice con- spicuously in at least five public places in the district. (Underscoring added) (c) The clerk of every municipality and district shall file in his office proof of publication or posting of notices pursuant to this section. (d) In each school district subject to the jurisdiction of a district superintendent, under the provisions of Article Fourteen of the Education Law, such district superintendent shall ascertain that the public notice required by this subdivision has been published or posted, as the case may be. 30 The clerk shall present the report of the examination to the governing body of the municipality or district for its consideration at the first meeting thereof held after the filing of the report of the clerk. NOTE: Chapter 441 of Laws of 1960 provides that proof of publication shall be filed in the office of the Clerk of the MUnicipality or District. Do not send it to the State Comptroller.
