Dear Mr. Fanuele,
The proposed subdivision involves a Town of Wappinger parcel on the north side of
Maloney Road. The aim is to subdivide the existing single parcel, which currently has
three (3) existing dwelling units on it, into three separate lots. The dwelling units on each
of the proposed lots do not meet the front yard setback requirements for the R-40 Zoning
district. These dwelling units were built in 1923, 1950 and 1959, so their location and
construction pre-dates zoning. Therefore, it is my determination that no area Variances
are required for any of the existing dwelling units on the three proposed lots.

meet the requirement of Section 240-18.D(3), dealing with satisfying minimum setback
requirements on dry land. The dwelling units in question were built in 1923, 1950 and
1959, so their location and construction pre-dates zoning. Therefore, it is my
determination that no area Variances are required for any of the existing dwelling units on
the three proposed lots.
