RESOLUTION AUTHORIZING SUPPORT FOR IMPROVEMENT OF
THE SPROUT CREEK BRIDGE
At the regular meeting of the Town Board of the Town of Wappinger, Dutchess County,
New York, held at Town Hall, 20 Middlebush Road, Wappingers Falls, New York, on the 281h
day of June, 2004, at 7:30 p.m.
The meeting was called to order by Joseph P. Paoloni, Deputy Supervisor, and upon roll
being called, the following were present:

The following Resolution was introduced by Mr. Bettina and seconded
by Ms. McCarthy
WHEREAS, Route 82 in Dutchess County serves as a vital commercial traffic corridor
connecting the Towns of Wappinger, Fishkill and East Fishkill; and
WHEREAS, it has come to the attention of the Town Board of the Town of Wappinger
that the bridge that crosses Sprout Creek on N.Y.S. Route 82 has a posted weight limit of 18,000
pounds which precluded its use by a variety of tandem axle tractor trailer and semi -tractor trailer
combinations, including fire protection equipment, cranes, snowplows, oil delivery vehicles,
dump trucks and other vital commercial traffic; and
WHEREAS, as a result of the weight restrictions on Sprout Creek Bridge, traffic must be
diverted from the state highway over local roads that are generally less suitable for commercial
traffic; and

WHEREAS, on May 18, 2004, Royal Carting Service Co., by its attorneys, corresponded
with N.Y.S. Senator Stephen M. Saland, N.Y.S. Assemblyman Patrick R. Manning as well as
representatives of the New York State Department of Transportation to improve the Sprout
Creek Bridge to allow for vital commercial traffic exceeding the current weight limit of 18,000
pounds. A copy of said correspondence is annexed hereto and made a part hereof as Exhibit
"A"• and
WHEREAS, the Town of Wappinger is committed to ensuring that vital roadways
within its jurisdiction are safe for commercial traffic to travel upon; and
WHEREAS, the Town of Wappinger wishes to support and concur with the letter dated
May 18, 2004 that was submitted on behalf of Royal Carting Service Co. in furtherance of its
request to improve the Sprout Creek Bridge to support commercial, public service and safety
traffic.
NOW, THEREFORE, BE IT RESOLVED, as follows:
The recitations above set forth are incorporated in this Resolution as if fully set
forth and adopted herein.
2. The Town Board of the Town of Wappinger in its capacity as the governing body
of the Town of Wappinger, does hereby support and concur with the letter dated May 18, 2004
written on behalf of Royal Carting Service Co. seeking improvement and enhancement of the
Sprout Creek Bridge in order to allow it to support commercial, public service and safety traffic.

and Director Dennison:
Please be advised that we represent Royal Carting Service
Co. This letter follows telephone conversations I had with Helen
Fuimarello, District Coordinator for Senator Saland's office:, on
April 26, 2004, and with Charles Marshall, Legislative Director
for Assemblyman Manning on May 12, 2004.
Those conversations concerned the improvement and
enhancement of bridge number "State of New York D.P.W. 8453 B-1,
19331 that crosses the Sprout Creek on New York State Route 82,
approximately 300 feet north of All Angels Hill Road (Dutchess
County Route 94), hereafter the "Bridge" .2 At that point, the
Sprout Creek serves as a boundary between the Towns of Wappinger
and East Fishkill.
'This number appears on a medallion next to the Bridge at its southwest corner. Also, the
nearest mile marker for the Bridge is: 82 8201 1019.
'The Bridge is two lanes and about sixty feet in length. The main offices and truck depot
for Royal Carting Service are located on Route 82, approximately 700 feet north of the Bridge.

Route 82 serves a main commercial traffic corridor that
traverses virtually the entirety of Dutchess County. It is a
particularly vital connector between the Towns of Fishkill,:
Wappinger and East Fishkill.
The Bridge has a "posted" weight limit of "18,000 pounds".3
This limitation eliminates a variety of tandem axle tractor
trailer and semi -tractor -trailer combinations, as well as certain
fire protection equipment, cranes, snowplows, oil delivery
vehicles, dump trucks, redi-mix delivery vehicles, and other
vital and important safety and commercial traffic, including as
you might surmise, refuse and recycling collection vehicles.
My client has been advised by a uniformed officer of the New
York State Police that his Department has directed vigorous
enforcement of the posted weight restrictions. The result is
that traffic must be diverted from the state highway over local
roads that, depending on the particular destination, adds
multiple miles for various travel.'
We believe this matter has an elevated importance since
certain safety equipment, (fire engines, water tankers, selected
police and "EMS" vehicles) are not able to pass over the Bridge
safely given its weight limitation. Similarly, snowplows loaded
with salt or sand will exceed the weight limit. This is
essential traffic that concerns the safety and well-being of all
the members of our community.
We also believe this is an economic issue as it affects a
main artery for commercial traffic through our County. Traffic
is now being diverted over County or local roads that are
generally less suitable for this kind of traffic.
3The posted weight limit appears on signs on either side of the Bridge. We have no
information as to what the actual weight "rating" of the Bridge is.
'Royal Carting has instructed all of its drivers (except those operating vehicles within the
Bridge's posted weight limits) to utilize alternate routes to and from its depot on Route 82.

The purpose of this letter is to respectfully request your
assistance toward prompt consideration and implementation of
improvement and enhancement of the Bridge so that it will be able
to support the commercial, public service and safety traffic that
has traditionally traversed it. These vehicles should not be
forced to utilize the local neighborhoods for daily or emergency
travel.
I would be happy to meet with you to discuss this matter
further, and to participate in any other appropriate way toward
the improvement of the Bridge.
