The Reorganizational Meeting of the Town Board of the Town
of Wappinger was held on January 4, 1993, at the Town Hall,
20 Middlebush Road, Wappingers Falls, Dutchess County, New
York.
Supervisor Smith opened the Meeting at 7:00 P.M.
Present:

Supervisor Smith opened the Meeting at. 7:00 P.M.
The Meeting began with all joining in the Pledge of Allegiance
to the Flag.
The Supervisor confirmed the appointment of Robert Valdat.i as
Deputy Supervisor and Deborah Hongach as Confidential Secretary.
The Town Clerk confirmed the appointments of Gladys Ruit and
Sandra kosakowski as Deputy Town Clerks.
The Highway Superintendent confirmed the appointment of
Glenn T. Heady as Deputy Highway Superintendent.

RESOLVED, that the following persons be and they hereby -

RESOLVED, that, the pay scale for the employees hired by
the Town of Wappinger Highway Department will be in accordance
with the C.S.E.A. Contract, and
BE IT FURTHER
RESOLVED, that all of such Highway Department employees
engaged on an hourly basis shall be paid every Friday throughout
the year 1993, with 51 pay periods during such year consistent
with the amended schedule in accordance with a signed C.S.E.A.
Contract, retroactive to January 1, 1993, with the first payday
WWI to be January 15, 1993.

22. DESIGNATING COURT OFFICERS FOR THE
TOWN OF WAPPI'GER JUSTICE COURT

The following Resolution was offered by C'OU'NCILWOMAN VISCONTI
who moved its adoption:
RESOLVED, that all individuals hereinafter designated
by the Town Board as Court Officers as such title is defined by
the Uniform Justice Court Act have all those powers accorded
to Court Officers by Law during such time they are actually
serving in such capacity, and
BE IT FURTHER RESOLVED, that the Town Justice) of the Town
shall designate and schedule the days and evenings such
individuals shall serve as Court Officers, and
BE IT FURTHER RESOLVED, that one Court Officer be
designated for each session of Court unless the Town Justices
determine that more than one be designated for ani one session,
and
BE IT FURTHER RESOLVED, that the Court Officers shall be
compensated at the hourly rage of $8.20 for time actually
served, and
BE IT FURTHER RESOLVED, that Armed Court. Officers shall be
compensated at the hourly rate of $11.47 for time actually
served at sessions of Court i;here their services are required,
and
BE IT FURTHER RESOLVED, that the Town Justices shall submit
to the Town Comptroller on a weekly basis the names and hours
served, and that the Town Comptroller be empowered to issue
remuneration consistent with the foregoing from funds
appropriated for Justice Court, and
BE IT FURTHER RESOLVED, that, the following individuals be
designated as Court Officers for the year 1993:

is fixed nd established at a maximum hourly rate of $15.75 per
hour, per Contract with the Dutchess County Sheriff, and

The following Resolution was offered by COUNCILMAN MILLS who
mored its adoption:
RESOLVED, that the pay scale for all presently employed
part-time clerical employees engaged to perform services for
the Town Board and/or its Officers, Officials and _Agencies,
be and the same hereby is fixed and established at a minimum
hourly rate of S1.25 to a maximum hourly- rate of $8.40 per
hour, and
BE IT FURTHER RESOLVED, that the part-time hourly rate for
any subsequent Part -Time Clerical employee engaged by any
Official or Agency Department Head shall be established at the
minimum hourly rate, or if otherwise fixed and established,
shall be subject. to the approval of the Town Board, and
BE IT FURTHER RESOLVED, that the pay scale for all
presently employ -ed part-time laborers and maintenance men,
other, than Highway Personnel, engaged to perform, services for
the Town Board and/or its Officers, Officials and Agencies, be
and the same hereby is fixed and established at a minimum
hourly- rate of $4.25 to a maximum hourly- rate of $8.93 per
hour, and
BE IT FURTHER RESOLVED, that all such extra part-time
clerical employees and Laborers and Maintenance men, other than

of the Town of Wappinger that there are now or may be in the
future, funds and monies, except proceeds of loans and monies

to the Town which are or which may be in excess of the amount
required for immediate expenditure to pay current expenses and
obligations, and
WHEREAS, it, is or it may be to the advantage of the Town
to deposit and/or invest all or part of such funds in special
■e time deposit accounts, or in certificates of deposit issued b;,
banks or trust companies located and authorized to do business
in this State, short term obligations of the United States of
America and/or he State of New York, and
WHEREAS, it appears that the Temporary Deposit and/or
investment of such excess and surplus funds may be beneficial

WHEREAS, subdivision 10 of Section 29 of the Town Law
requires that the Supervisor of each Town prepare and file with
the Town Clerk within 30 days after the expiration of each
fiscal year, an annual financial report accounting for all
monies received and disbursed by her, together with the
certificates or certificate of the bank or trust company where
Town monies are deposited, showing the amount of such monies
on deposit with said bank or trust company, and cause a
certified copy of such report to be published in the official
newspaper, and
WHEREAS, in lieu of preparing the report required by
Subdivision 10 of Section 29 of 'Town Law, the Town Board may
determine, by resolution, that. the Supervisor shall submit
to the Town Clerk within 60 days after the close of the fiscal
year, a copy of the report to the State Comptroller required by
Section 30 of the General Municipal Law and the Town Clerk shall
cause a summary of such report to be published within 10 days
after receipt thereof in a form approved by the State
Comptroller in the official newspaper.
NOW, THEREFORE IT IS HEREBY
RESOLVED, that in lieu of preparing the report required by

SUPERVISOR SMITH offered the following Resolution and moved
its adoption:
WHEREAS, it has become apparent that the Equalization rate
as set by the New York State Board of Equalization and
Assessment, for Towns is critically flawed; and
WHEREAS, the Equalization rate is both unfair to towns in
its overvaluation of vacant land and is based on hopelessly
outdated sales and assessment figures, and
WHEREAS, the Equalization rate is computation of tiital
importance to Towns and are deserving of the highest
accuracy since:
a. it is the factor by which the real property- tax burden
is apportioned supposedly equally among municipalities
and
b. is recognized by statute as prima facie evidence of
the level at which each municipality assesses its
real estate for purposes of assessment reduction in
court proceedings, and
WHEREAS, revision of the Rate through traditional means
my take Years and will cost taxpayers tremendous sums,
NOW, THEREFORE, BE IT RESOLVED that our State Legislators
take steps to require the State Board of Equalization and
Assessment to immediately revise its Equalization rates;
and
to impose an interim set of such rates at an appropriate
level until valid rates can be computed and imposed; and
to repeal., or at least, limit, the roll of equalization
rates in assessment reduction proceedings as the same is
set forth in the Real Property Tax Law, and
for such other measures as will bring equity to this unfair
and intolerable situation.
