RM122892 The Regular Meeting, and also the Year End Meeting of the Town Board of the Town of Wappinger was held on December 28, 1992, at. the Town Hall, 20 Middlebush Road, Wappingers k Falls, Dutchess County, New York. E Supervisor Smith opened the Meeting at 7:00 P.M. Present: Constance Smith, Supervisor James Mills, Councilman Robert Valdati, Councilman June Visconti, Councilwoman Robert, Wallace, Councilman Elaine H. Snowden, Town Clerk Others Present: Albert Roberts, Attorney Joseph E. Paggi, Jr., Engineer Herbert Levenson, Zoning Administrator Ann Buckley, Comptroller The Supervisor asked all to join in the Pledge of Allegiance to the Flag at the commencement of the meeting. The Minutes of the Regular Meeting of November 23, 1992, it having previously been forwarded to the Board Members, were placed before them for their consideration. Mrs. Visconti noted that some items addressed at that meeting were not included in the Minutes presented. The specific items were the Truett. Drainage problem and authorization to expend $3,100 to Alpine Development to up size the piping of their sanitary system to accommodate future Town access through their site to the Wappinger Sewer Transmission Line. Mrs. VISCONTI moved to table acceptance of the November 28, 1992 Minutes, pending research of the specific items that were not included in those Minutes. rrr Seconded by Mr. Wallace Motion Unanimously Carried Reports were received from the Town Justices, Supervisor/ Comptroller, Receiver of Taxes, Building Inspector, Zoning V $0 RM122892 Administrator, Dog Control Officer and Sloper-Willen Ambulance Service, Inc. MRS. VISCONTI moved to accept the Reports and place them on file. Seconded by Mr. Wallace Motion Unanimousl Carried Mrs. Visconti questioned some of the items on the Zoning Administrator's report that were pending with Attorney for two ,years. It was agreed that they would review these with him at a later date. PETITIONS & COMMUNICATIONS --- Notice of Intent to file application for a liquor license was received from Glen F. lubista Associates for The Dugout located at 299 New Hackensack Road, in the Town of Wappinger. MRS. VISCONTI moved to accept. the Notice of Intent. from Glen F. Kubist.a Associates for The Dugout and place it on 00 file with no comment. Seconded by Mr. Wallace Motion Unanimously Carried A communication was received from Laurence Keefe, P.E. New York State Department of Health, re Approval of Completed Works Ardmore Hills Water District Booster Pumping Station, Water Tank, Emergency Generation and Appurtenances. MRS. VISCONTI moved to accept the correspondence and place it on file. Seconded by Mr.. Valdati Motion Unanimously Carried Mrs. Smith rioted that she put this on the Agenda so it would be recorded in the Minutes for future information. Notice of Public Hearing was received from the Town of �o`7 RM122892 Fishkill on a Local. Law to Amend the Zoning Map, setting a date of January 4, 1.993. MR. VALDATI moved to accept the notification and place it on file. Seconded by Mrs. Visconti Motion Unanimously Carried A Memo was .received from Debbie Brown, Water and Sewer Billing Clerk regarding an illegal water hookup at 33 Gold Road. MRS. VISCONTI moved to accept the correspondence and place it on file. Seconded by Mr. Wallace '_Motion Unanimously Carried Mrs. Smith noted that this was discussed at their work shop and the meter has been installed and the resident is being billed, so everything is in order. A corrected Memo was received from Supervisor Smith on return of escrow to Mid Hudson Chinese Christian Church. There was a discrepancy in the actual amount being returned according to the Comptroller's records, making a difference of $75.00. This was corrected and the amount. to be returned is $3,351.37, instead of $3,126.37. MR. VALDATI moved to approve the corrected amount of $3,351.37, escrow to be returned to Mid Hudson Chinese Church. Seconded by Mrs. Visconti Motion Unanimously Carried A request for return of escrow in the amount of $300.00 was received from James & Edith Rawley , property located at Lot #1, 19 Booth Boulevard. MRS. VISCONTI moved to approve the return of escrow of RM1.22892 $300.00 to James & Edith R.awley, based on the recommenda- tion of the Building Inspector. Seconded by Mr. Valdati Motion Unanimously Carried In regard to setting a date for the Reorganizational Meeting, Mrs. Smith said she Irad originally set it for January 4, 1993, at. 5:00 P.M., however Mr. Valdati informed her he could not make it that early. She would, therefore change it to 7:00 P.M. and if that was convenient. to all, she asked for a motion. MR. VALDATI moved to set. the Reorganizational Meeting for January 4, 1993 at 7:00 P.M. Seconded by Mr. Wallace Motion Unanimously Carried The Engineer required authorization to go to bid for the i sewer pipeline for Tri -Municipal, Phase 1, Contract 1. J, MR. VALDATI moved to authorize the Engineer to the Town to go out to bid for the sewer pipeline for Tri -Municipal, Phase 1, Contract 1. Seconded by Mrs. Visconti 'lotion Unanimouslv Carried A recommendation was received from James Bedore, Project Engineer with Paggi & Martin to pas- Central Hudson charge on Phase II - Contract No. 2, Rockingham Pump Station. He enclosed correspondence from Central Hudson regarding their charge for the inactive heavy duty service required for the pump station. Their position is that there will rrr be no charge for the inactive service, but an approximate charge cost to the Town of $2,600.00 for the relocation of one utility pole, required by this Contract.. This charge will be omitted if the Pump Station is utilized prior to R%l122892 our tentative service date of November 1995. It was the recommendation of that office that the Town pay this charge and not risk the prospect that the Pump Station cost, including labor, will remain at the present level until 1995. The alternative to this, Mr. Paggi explained was to wait to go to bid in January 1995 and then make the Pump Station active again. In that case you would not have the one time charge of $2,600.00 to keep it active, however you would have inflation on the material and labor which they calculated would be approximately- $23,000.00. After examination of these numbers, it appeared obvious to them that it should be activated now and pay that charge now. MRS. VISCONTI moved to authorize the payment, of $2,600.00 to Central Hudson, as recommended by the Engineer. Seconded by Mr. Mills Motion Unanimously Carried COMMITTEE REPORTS --- Mrs. Smith recognized County Legislature John Beale and asked if he had reports for the Town that he wished to give, however, there were no items of interest at County level for him to report at this time. Mr. Mills, Dial -A -Ride, reported that they would have quarterly meetings instead of monthly, due to lack of business. Mrs. Smith, on this subject, had a phone call from them and learned that Central Dutchess Nursing Home gave up their own vehicle acid is now using Dial -A -Ride. This may make an impact on our regular users and she had a problem with that. If this calls for additional service and we have to up our share, Mrs. Smith felt we should talk to the Nursing Home about donating monies toward this. She 90 RM122892 asked Mr. Mills, as the Town .Representative, to keep abreast of this situation. Mr. Valdati, Recycling --the Town is pursuing the idea of stickers for the residents to hopefully minimize the influx of people of other areas using our facilities. He commended the Highway Department, for the great job they did on our icy roads during the past few weeks. Mrs. Visconti had no reports for this Meeting. Mrs. Smith reported on the mats that we keep at the door- ways to catch the dirt from traffic entering the building; This is a service that we have been paying about $1,200 annually which involves a change of mats about every two weeks. She has purchased 15 mats @ $46.00 each for this purpose, total of $690.00, double the thickness of the ones provided with the service, a savings of $4,000 over a two year period. Another item Mrs. Smith reported c,as that the New Hackensack Fire District has waived their fee of $100.00 to the Town to the Town for the use of their facilities as a Polling Place for Election Day. This, she added, was in light of the work done by the Highway Department for the pipeline for the water connection. Mr. Mills asked why we pay the Fire Districts for the use of their facilities as Polling Places since we always loan out the voting machines when they find it necessary to use them. Mrs. Smith agreed and made a note to discuss this at their next cork shop. The Supervisor .gave the following report on Tri -Municipal: $1,493.75 Attorney 1,471.27 Accountant 885.46 Rudikoff 69,543.25 Hayward & Palian, Lapar 715.64 U.S. Hydrogeologic 31t RM122892 This is on a monthly basis and the Tri -Municipal Commission charges this against the $17,000,000.00 bond. BONDS/LETTERS OF CREDIT --- This was a report from the Zoning Administrator on the status of the Bonds and Letters of Credit. There was some confusion on the bond for Wyndham Crossing which expired on December 9, 1992. The Town Clerk noted that the renewal was not received. until last Friday, however the Supervisor had a letter from the Bank on Dec. 17, 1992 but did not send a copy to the Town Clerk who is the keeper of the records. Mr. Levenson added that the Bond was transferred to the Town Clerk today and a copy sent to Attorney Roberts for the usual procedure. Another reason for the delay was that, the Barclay Bank merged with the Bank of New York. MR. VALDATI moved to accept the Report and place it on file. Seconded by Mr. Wallace Motion Unanimously Carried Public Hearings having been held on December 28, 1992 on Local Laws to Amend Sewer and Water Rates on Mid -Point Park Sewer Improvement Area, Wappinger Sewer Improvement Area wl, Wi.ldwood Sewer District, Ardmore Water Lmprovement Area and Wappinger Park Water District, the matter of their adoption was placed before the Board for their consideration. MRS. VISCONTI moved to adopt. Local Lai 12 of 1992, as follows: A LOCAL LAW AMENDING LOCAL LAW '_x0.15 OF 1984 AND NO. 8 OF 1988 WITH RESPECT TO THE ESTABLISHMENT OF SEWER RATES FOR MID -POINT SEWER IMPROVEMENT AREA BE IT ENACTED by the Town Board of the Town of Wappinger RM122892 as follows: SECTION 1. Any and all prior laws establishing sewer rates for the Mid -Point Pari. Sewer Improvement Area with respect to residential uses is hereby repealed, only with respect to sewer rates and the prior laws otherwise confirmed. SECTION 2. The following sewer rates are hereby established for the Mid -Point Park Sewer. Improvement Area. A. Residential 1. Each residential unit connected to the system: $480.00 annually and payable on a quarterly basis. SECTION 3. This Local Law shall take effect upon adoption and as provided by Municipal Home Rule Law. Seconded by: Councilman Valdati. Roll Call Vote: 5 Ayes 0 Nays MRS. VISCONTI moved to adopt Local Law #13 of 1992 as follows: A LOCAL LAW AMENDING LOCAL LAW NO.5 OF 1976 #14 OF 1984, #10 OF 1985, #10 OF 1988, #1 OF 1991 AND #2 OF 1992 ESTABLISHING SEWER RATES IN THE WAPPINGER SEWER IMPROVEMENT AREA #1 BE IT ENACTED by the Town Board of the Town of Wappinger as follows: SECTION 1. Section 2 of Local Law 1#12 of 1992 is hereby amended to read as follows: SECTION 2. The following Sewer Rates are hereby established for the Wappinger Sewer Improvement. Area #1: A. Residential 1. Each residential unit connected to the System: $300.00 annually and payable on a quarterly basis. SECTION 3. This Local Law shall take effect. upon adoption and filing as provided by Municipal Home Rule Law. Seconded by: Mr. Valdati Roll Call Vote: 5 Ayes 0 Nays MRS. VISCONTI moved to adopt Local. Law #11 of 1992 as follows: Wj 1 R -M122892 A LOCAL LAW AMENDING LOCAL LAW 11113 of 1984 AND #7 OF 1988 WITH RESPECT TO SEWER RATES FOR THE WILDWOOD SEWER DISTRICT BE IT ENACTED by the Town Board of the Town of Wappinger as fol_l-oc-.s : SECTION 1. Any and al.l. prior laws establishing sewer rates for the Wildwood Sewer District with respect to residential uses is hereby repealed, only with respect to sewer rates and the prior laws otherwise confirmed. SECTION 2. The following sewer rates are hereby established for the Wildwood Sewer District: A. Residential 1. Each Residential Unit connected to the System: $340.00 Annually* and Payable on a quarterly basis. SECTION 3. This Local. Law shall take effect upon adoption and as provided by Municipal Home Rule Law. Seconded by: Roll Call Vote: Mr. Valdati 5 Ayes 0 Nays MRS. �ISCONTI moved to approve Local Law #15 of 1992 as folloc.S: A LOCAL LAW AMENDING LOCAL LAW NO. 3 OF 1987 AND NO. 7 OF 1985 WITH RESPECT TO THE ESTABLISHMENT OF WATER RATES FOR THE ARDMORE WATER IMPROVEMENT AREA. BE IT ENACTED by the Town Board of the Town of Wappinger as follows: SECTION 1. Any and all prior laws establishing water rates for the Ardmore Water Improvement Area with respect to residential uses is hereby repealed, only with respect to water rates and the prior laws otherwise confirmed. SECTION 2. The following water rates are hereby established for the Ardmore Water Improvement Area. A. Residential Each residential unit connected to the system be obligated to pas- the minimum charge of $24.00 each quarter, regardless of consumption of water for said quarter. In addition to the foregoing, there shall be the following charges: If the residential uses more than 2,500 cubic feet per quarter, the residential unit will be charged at the rate of $.75 per 100 cubic feet. lb''X RM122892 SECTION 3. VISCONTI moved to approve Local Law #16 of 1992 as follows: A LOCAL LAW AMENDING LOCAL LAW NO.l OF 1990,WITH RESPECT TO THE ESTABLISHMENT OF WATER RATES FOR THE WAPPINGER PARK WATER DISTRICT BE IT ENACTED by the Town Board of the Town of Wappinger of the Town of Wappinger as follows: SECTION 1. Any and all prior laws establishing water rates for the Wappinger Park Water District with respect to residential uses is hereby repealed, only with respect to water rates, and the prior laws otherwise confirmed. SECTION 2. The following water rages are hereby established for the Wappinger Park Water District. B. Residential 1. The owner shall be obligated to pay the minimum charge of $85.00 per each quarter, regardless of the consumption of water for said quarter, provided said owner is connected to the system at any time during the quarter. SECTION 3. This Local Law shall take effect upon adoption and as provided by Municipal Home Rule Law. Seconded by: Roll Call Vote: Councilman Valdati 5 Ayes 0 Nays MRS. There may be additional Budget Amendments in order to balance and close out the Revenues and Expenditures for 1992 year end. This was addressed in the motion which authorized a sum not to exceed $500.00 for the additional transfers. Two bids were received for a commercial mower for the Recreation Commission --Westchester Ford Tractor, $12,115.00 and Pine Plain Ford Tractor, $12,081.00. The RM122892 Chairman recommended awarding the bid to Pine Plains Ford Tractor as low bidder and also recommended that they purchase the roll bar at this time since it would result in a savings of $373.00. Mrs. Smith noted that this item was not included in the bid and asked the Attorney's opinion on ordering this. He advised the Board that the Commission either award the bid on the truck alone as advertised in the specs or reject the bids and rebid. Mr. Valdati had made a motion, seconded by Mr. Wallace to award the bid as recommended by the Chairman, however, due to the opinion of the Attorney, the motion was rescinded. MR. VALDATI moved to table action on this bid pending the decision of the Recreation Commission as to whether they wish to rebid on the truck and the roll bar. Seconded by Mr. Wallace Motion Unanimously Carried Three bids were received on the 3/1 ton pickup truck for the Recreation Commission --- Dutchess Dodge, $15,712.30, Pal Chevrolet, $15,245.00 and Orange Motors, $10,999.00. They recommended the bid be awarded to Orange Motors as low bidder. MRS. VISCO:vTI moved to award the bid for the 3/4 ton pickup truck to Orange Motors, in the amount of $10,999.00 as low bidder. Seconded by Mr. Mills Motion Unanimously Carried. Two bids were received for a 1/2 ton 4x1 Pickup Truck for the Highway Department --Pal Chevrolet, $16,215.00 and rrr Orange Motors Co. Inc. $12,999.00. The Superintendent recommended the bid be awarded to Orange Motors as low bidder. Mr. Mills asked if they could get a better price since two 71� RM122892 trucks were being purchased from Orange Motors, however, it was pointed out that this was through state contract and they could not get a lower price. MRS. VISCONTI moved to award the bid for the Highway Pick Up Truck to Orange Motors, in the amount of $12,999.00 as recommended by the Highway Superintendent. Seconded by Mr. Mills Motion Unanimously Carried Three bids were received for the old Vandalism Patrol Car, Barbara Coughlin, $940.00, Daniel Dames, $570.00 and Gary Lindstrom, $388.00. MR. MILLS moved to award the bid for the Vandalism Patrol Car (1988 Chevrolet), 4 door sedan to Barbara Coughlin at $940.00 as high bidder. Seconded by Mrs. Visconti Motion Unanimously Carried The Dial -a -ride Agreement was placed before the Board for their consideration. MR. MILLS moved to authorize the Supervisor to sign the Dial -a -ride contract. Seconded by Mr. Valdatti Motion Unanimously Carried A request was received from the Recreation Commission to transfer monies for the purchase of the truck and mower. Since they were not purchasing the mower at this time, funds were required only for the truck purchase. MRS. VISCONTI moved to approve transfer of $10,999.00 from Parkland Trust to Budget Revenue Account A-2089 and to Budget Expenditure Account A-7110.2 for the purchase of the truck. Seconded by Mr. Valdati Motion Unanimously Carried RM122892 UNFINISHED BUSINESS --- As discussed in work shop, Mrs. Smith reminded the Board Members that they required a company- to prepare specs for the salt bin. MRS. VISCONTI moved to authorize AST to prepare bid documents for the salt bin and further authorize the Supervisor to sign the contract with this company for their service which would include supervision of the work as project managers. Seconded by Mr. Valdati Motion Unanimously Carried The Supervisor noted that they met with the County today regarding their participation in the salt bin and they are very close to finalizing an agreement with them. They are not having the same luck with the Village, but there has been a delay* since the Attorney's partner passed away. Prior to sending outspecs they will have to obtain a commitment from them. NEW BUSINESS --- The following Resolution was moved by COUNCILPER.SON VISCONTI and seconded by Councilperson Wallace. WHEREAS, three (3) separate tax certiorari proceedings for tax years 1981", 1989 and 1990 alleging overassessment of taxes have been commenced by- petitioner, Wappingers Falls Plaza Associates, with respect to real property identified by tax map grid no. 19-6157-02-653974-00, located at the corner of US 9 and Myers Corners Road, Wappingers Falls; and WHEREAS, four (4) separate tax certiorari proceedings for tax years 1987, 1988 and 1990 alleging overassessment of taxes have been commenced by petitioner, Wappingers Falls Owners Corp, with respect to real property identified as Map 6158, Page 19, Parcel 619142, located at 128 East Main Street, Wappingers Falls; and WHEREAS, the Town through its TAx Assessor and Tax Certiorari Counsel have been attempting to amicably resolve and settle the aforementioned claims of overassessment; and WHEREAS, these settlement attempts have postponed the trials, thus requiring the filing of new Notes of Issue by Petitioners' attorney in order to properly 3'�1 RM122892 restore the actions to the Supreme Court's trial calendar; and WHEREAS, it would be imprudent and ineffective for the Town to oppose the filing of the new Notes of Issue on these facts; and WHEREAS, the Town Board has determined that it is in the best interest of the taxpayers of the Town of Wappinger that the various proceedings commenced with respect to each parcel be consolidated into one trial, since such would result in maximum efficiency and avoid duplicative trials and duplicative preparation: of appraisal costs for the taxpayers of the Town; and WHEREAS, Petitioners' attorney has prepared and submitted Stipulations to be signed by the Town's Tax Certiorari Counsel; which Stipulations would permit the filing of new Notes of Issue, place the actions on the trial calendar, and permit one trial for each parcel as set forth above. NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: 1. The Town Board of the Town of Wappinger authorizes Gellert & Cutler, P.C. to execute the Stipulations, copies of which are attached hereto as Exhibits A and B respectively. Roll Call Vote: 5 Ayes 0 Nays Resolution Duly Adopted Mrs. Smith referred to her attempt to have the School District and the County agree to tax installment payments as we do on Town Taxes in an effort to alleviate hardship to some residents when paying the school tax in a lump SUM. The school has been cooperative and they plan to meet after the holidays to discuss various ways that this plan can be activated. After the initial meeting, they plan a public informational meeting to discuss it. Mrs. Smith felt it could and should be done not only to help the seniors but also the young people who are starting out. Mrs. Visconti referred to a presentation by Jim Bedore at their previous work shop and he requested permission to send his report to the State Revolving Fund, Tri -Municipal Commission for an industrial waste survey. The Engineer noted that the Supervisor has the original report. RM122892 MRS. VISCONTI moved to authorize the Supervisor to forward Mr. Bedore's report to the State Revolving Fund. Seconded by Mr. Wallace Motion Unanimously Carried Jerry Cauda was recognized by the Chair and discussed a previous change in calculating the benefit assessment on property and instead of using units it would be ad valorem. Now he finds that it is back to units and this is not beneficial to him. Since his property was affected by the Marcy power lines, it makes a difference in the property value. Mrs. Smith had promised that they would discuss this at a work shop, however, Mrs. Visconti thought he could help the situation if he did some of this research on different categories that might fit into the legislation and change the benefit units based on a uniform criteria. Mrs. Visconti commended Attorney Emanuel Saris on his memorandum on general town board matters, specifically planning boards getting messed up with the fact that they thought low density was the way to go. The Town of Wappinger has made great strides in the cluster development for commercial and residential properties. She thanked Mr. Saris for keeping abreast of these developments. Mr. Foster thoughtthey should have a news release about Christmas trees being accepted on Saturdays at the landfill. There was no other business to come before the Board. MRS.
