1992-09-14 SPMSP91492 A Special Meeting of the Town Board of the Town of Wappinger was held on September 14, 1992, at the Town Hall at the Town Hall, 20 Middlebush Road, Wappingers Falls, Dutchess County, New York. supervisor Smith opened the Meeting at 6:45 P.M. Present: Constance O. Smith, Supervisor James Mills, Councilman Robert Valdati, Councilman June Visconti, Councilwoman Robert Wallace, Councilman Elaine H. Snowden, Town Clerk The Supervisor send notices to the Town Board -and the news media on September 4, 1992, scheduling the meeting for September 14, 1992 at 6:45 P.M. for the purpose of considering Wildwood Drainage, Town Car Bid Authorization, setting a Public Hearing on a Local Law for Sewer Use and any other business that may come before the Board. All joined in the Pledge of Allegiance to the Flag at the commencement of the meeting. The first item was for the Board to consider the Wildwood Drainage Project which had previously been discussed at a work shop. It involved drainage problems in the backyards of several residents in the Wildwood Area and it was Councilman Mills' opinion that if the Town approved the project they would benefit in the long run since it would increase the value of the properties involved thereby increasing the assessed valuation of the Town. The Attorney to the Town rendered his opinion that since the drainage problem was not caused by the Town, it would be illegal for them to use taxpayer's money to alleviate the problem. The Supervisor had stated previously that she would help the residents form a drainage district, however, it would be at their expense. SP91492 Mrs. Mills was recognized by the Chair and stated that, she was not pleased with this decision since she thought., after their previous discussion with the affected residents, that the Board was going to help them. She was also not aware of the figures that the Engineer had submitted relating to surveys and engineering costs, totaling between $13 and $14,000. The Supervisor pointed out that these figures were estimated ones for the purposes of forming a district.. When and if they decided to do this, formal proposals could be submitted. She then asked the Board to put this matter_ to a vote. MR. VALDATI moved that the Town Board authorize the drainage project in the Wil.dwood Area of the Town of Wappinger. Seconded by Mr. Mills Roll Call. Vote: 4 Nays Mr.. Mills ---Aye Motion Defeated Next was the Town Car Bid Authorization -- MRS. VISCONTI moved to table action on this item. Seconded by Mr. Wallace Motion Unanimously Carried A proposed Local Law on Sewer Use was placed before the Board for their consideration. This Local. Law .is attached hereto and made part thereof of the Minutes of this Meeting. The following resolution was offered by SUPERVISOR. SMITH who moved its adoption: WHEREAS, there has been duly presented and introduced at, a. meeting of this Town Board on the 14th day of September, 1992, a proposed Local Law on Sewer Use in the Town of Wappinger, and WHEREAS, the provisions of the Municipal Home Rule Law requires that no local law shall be passed by the Legisl-ative Body of the Town until a, Public Hearing thereon has beenheld before such body, NOW, THEREFORE, BE IT RESOLVED, 1. That a, Public Hearing shall be held on the said proposed ,9yq SP91492 Local Law by the Town Board of the Town of Wappinger on the 28th day of September, 1992, at 6:55 P.M. on such day at the Town Hall, 20 Middlebush Road, Wappingers Falls, Dutchess County, New York. 2. That at least five (5) days notice of such hearing shall be given by the Town Clerk of the Town of Wappinger by the due posting thereof upon the bulletin board maintained by said Town Clerk in the Town Hall and by publishing such notice at least once in the official newspaper of the Town of Wappinger. Seconded by: Councilman Wallace Roll Call Vote: 5 Ayes 0 Nays There was no other business to come before the Board. MRS.
