Dear Mrs. Evertts,
I received a copy of
your letter was slate~o~r 10(10/97,letter on 10/27/97. Coincidentally

own Board meeting of

In your letter you tried to compare some r
to your problem, however the problems ece~t work. done on Dorothy Hgts
case you mentioned the homeowner ha are en~~rely d~fferent. In the
garage under his home. If road wateS ~ neI~t~ve grade driveway with a
driveway it could cause icin durinr ~s a ,owed to shoot down his
water to enter his garage ~o prev~n;hteh~~nterba~d possibly cause the
d ' h' h ". ~s we u~lt a berm past his
r1veway w ~c catche~ roadwater and discharges it t I '
property where it eventually dissipates. 0 a ow area on h~s
In your case yo~r proper~y has a low area which traps water. The only
way to drain th~s water,~s to install a pipe under Dorothy Hgts and drain
the water to the west s~de of the road. Our town attorney has ruled that
to do this we must obtain an easement from all the affected property
owners on the west side of the road which gives the town the right to
discharge the water onto their property. As you recall all the property
owners were not willing to grant this easement which stoped the project.
The water from the road is currently running where it has always run. The
problem is compounded by the negative grade of the surrounding area
contributing runoff to the area during periods of precipation. As you
are well aware the problem has existed since you were a child growing up
in this area. The recent paving of Dorothy Hgts has not changed what has
always existed. I hope this will answer your concerns in this matter.
Sincerely,
cc: Town Board
