For approximately the last 30 days my neighbor and I have had a
problem. Water from a drainage ditch which nms along the backs bf
both our properties, on Martin Drive, is now permanently in our yards.
The water has two sources, Top O'Hill Road and the intersection of
H~ View and Valley Roads.
In the nearly ten years that I have lived on Martin Drive there
hasn't been any maintenance work done to the drainage ditch. It is
now filling with leaves and silt in the low area behind my house,
causing water to lay there. This water is now permeating into my yard.
Rt.mning from back to front GOwn my driveway and into the neighbors
driveway (51 Marin Dr.) and out onto Martin Drive. Being February this
is a large sheet of ice, becoming larger each day.
When the homes on Martin Drive were built an easement of 20 feet
was given for the purpose of drainage (see oppies). The problem today is
that the easement was nJt deeded to the town. To correct the problem I
would deed to the town the right to enter my property to maintain
adequate surface water drainage. I purpose the town consider this and
Jther options at its next Board meeting Monday February 24, 1997.
In conclusion, no taxpayer should have to bear financial responsibility
for the correction to a problem the town created. By the town running
drainage water pass personal property, the town should be held accotmtable
to any d3lTIage done by water to personal property.
