Emergency Repairs to Carnwath - Don Swartz & Jay Paggi
• Emergency Repairs—Don Swartz announced the he and Jay Paggi were sent to
Carnwath several weeks ago to determine the extent of the problem due to the
basement ceiling shifting and falling on the electrical distribution system. Mr. Swartz
explained what had been done and what further repairs would be needed at
Carnwath. He also gave a slide presentation showing deterioration that needed to
be addressed.
Carnwath Farms RFP for Catering Services - Al Roberts
• Carnwath Farms RFP for Catering Services—Supervisor Ruggiero announced that he
would like to address this item in Executive Session.
Lease of EMS Building for TransCare - Manny Saris
• Lease of EMS Building for TransCare— Attorney, Manny Saris explained that the
Town and TransCare have discussed and entered into an agreement which will be
mutually beneficial for TransCare to rent a certain portion of the Emergency Services
Building from the Town. It is a completed transaction which will be subject to a
Permissive Referendum. The only open item would be the length of the term of the
lease.

Acting Assessor - Manny Saris
Board Meeting of March 13, 2006
Acting Assessor—Attorney, Manny Saris explained that pursuant to Real Property Tax
Law, the Town Board is authorized to appoint another Acting Assessor to fill this
position. Paula Sarvis, Assessor for the Town of Fishkill, has been recommended to
fill this position. If no other Assessor is appointed after six months is up, she would
automatically, as a matter of law continue as the Acting Assessor and continue until
a selection is made.
Bulk Pickup - Graham Foster
Bulk Pickup—Graham Foster informed the Board due to the popularity of the recycle
center he wished to limit the Bulk Pickup Program to "large items only", but realizes
that there are many residents who don't have access to a truck or trailer to bring
their large items up to the center. Instead, he would like to limit the Bulk Pick-up
Program to, "large items only", and instead of sending out a letter to the residents of
items we "don't take" only send out letters with a list of items we "do take". The
board felt that the letters should be left as they were but remind residents that there
is a Bulk Recycle Center available all year round for them to use. Also remind
residents that any items that are not taken by the highway at the time of pick-up
must be removed or they will be sited. Discussion followed.

WHEREAS, the written Petition of Creekview Holdings, Ltd., dated February 6, 2006,
executed by David W. Stenger, as President and owner of 100% of the Tuscany Subdivision
("Subdivision"), has been presented to and filed with the Town Board of the Town of
Wappinger, New York requesting the approval of a drainage district to be known as the
"TUSCANY SUBDIVISION DRAINAGE DISTRICT", which is more particularly described in
the Map, Plan and Report for the Tuscany Subdivision dated October 12, 2005, prepared by
Paggi, Martin & Del Bene, LLP,,and filed in the office of the Town Clerk; and
WHEREAS, the Map, Plan and Report entitled "Map, Plan and Report for the Tuscany
Drainage District", dated October 12, 2005, and relating to the establishment of the proposed
drainage district, was prepared by Paggi, Martin & Del Bene, LLP, duly licensed civil engineers
of the State of New York; and
WHEREAS, the aforementioned Map, Plan and Report, has been duly filed with the
Town Clerk and has been prepared in a manner and in such detail that this Town Board has
determined that said Map, Plan and Report is in accordance with the requirements of Article XII
of the Town Law; and
WHEREAS, an Order Calling a Public Hearing was duly adopted by this Town Board
on February 13, 2006, reciting the filing of said Map, Plan and Report, the improvements
proposed, the boundaries of the proposed district, the proposed method of financing, the fact that
the Map, Plan and Report describing the same were on file in the Town Clerk's Office for public

WHEREAS, pursuant to said petition, it is the intention of the Petitioner, Creekview

own cost and expense.
NOW, AFTER DUE DELIBERATION, IT IS HEREBY ORDERED,
DETERMINED AND RESOLVED AS FOLLOWS:

9. The estimated annual cost of Operation and Maintenance of the proposed
improvements after three years is estimated to be $800.00 per Benefit Unit for a typical property
within the district.
10. A detailed explanation of the improvements to be made and the estimate of
Operation and Maintenance charges have been included in the Map, Plan and Report which has
been filed in the Office of the Town Clerk and the same has been made available during regular
office hours for examination by any person interested in the matter thereof.
11. It is in the public interest to establish the TUSCANY SUBDIVISION
DRAINAGE DISTRICT.
BE IT FURTHER RESOLVED, ORDERED AND DETERMINED that the
establishment of the TUSCANY SUBDIVISION DRAINAGE DISTRICT in the Town of
Wappinger, Dutchess County, New York, and the improvements therein, as more fully described
above and in the aforementioned Map, Plan and Report is hereby approved and established and
said drainage district shall be bounded and described as set forth in Exhibit "A" attached to the

constructed by the Petitioner, Creekview Holdings, Ltd., wholly at its own expense, and

SUBDIVISION DRAINAGE DISTRICT without cost to the Town of Wappinger, free and clear
of any liens or encumbrances; and

Petitioner and turned over to the Town, the cost for maintaining the District shall be assessed,

WHEREAS, said Local Law has been on the desks of the members of the Town Board

LOCAL LAW NO. #3 OF THE YEAR 2006
A Local Law entitled "Local Law No. #3 of the Year 2006, Amending Town Code § 122-
16 Increasing Certain Inspection and Permit Fees and Adding Additional Inspection and Permit
Fees."
BE IT ENACTED by the Town Board of the Town of Wappinger as follows:
Section I: Title:
This Local Law shall be known and cited as Town of Wappinger, "Local Law No.
of the Year 2006, Amending Town Code §122-16 Increasing Certain Inspection and Permit Fees
and Adding Additional Inspection and Permit Fees", which shall amend the various fees section of
the Town Code as set forth in § 122-16 and as set forth below.
Section H: Legislative Intent:
George Kolb, Jr., the Code Enforcement Officer, has recommended that the Town of
Wappinger amend certain portions of the code by increasing various inspection and permit
fees and by adding additional inspection fees and permit fees that relate to various
provisions of the Building and Zoning Code. Based upon the recommendation of George
Kolb, Jr., the Code Enforcement Officer, the Town Board has determined that it is in the
best interest of the citizens of the Town of Wappinger to amend the Town's Fees and Permit
Section § 122-16 of the Town Code, to increase certain permit fees and inspection fees and
to add certain other inspection fees and permit fees.

Section III: Amendments:
The following sub -sections of § 122-16 are amended to read as follows:
§122-161.1(1) — "§192-2A, permit for installing lateral water lines: $100.00;"
§ 122-16I.1 (2) — "§ 192-2A, permit for installing lateral sewer lines:
$100.00;"
§ 122-16N(1)(a) — "Special permit (accessory apartment): $500.00 per
application;"
§122-16N(1)(b) —"Special permit: $500.00 per application;"
§ 122-16N(5)(a) — "(Resident) Area/Use variance fee: $175.00 per
application;"
§ 122-16N(5)(b) — "(Commercial) Area/Use variance fee: $375.00 per
application;"
§ 122-16N(5)(c) — "Interpretation fee: $150.00 per application;"
§ 122-16N(6)(a)[ 1 ] [a] [i] — "One and Two Family Homes and Modular
Dwellings: $.55 per sq. ft. of living space;"

§ 122-16N(6)(b) — "Demolition: $100.00 minimum fee up to 2,000 sq. ft.

§ 122-16N(6)(e)[2] — "Replacement of Furnace/Boiler

Section IV: New Fees:
The following new fees are hereby established by the creation of the following new
sub -sections to Town Code §122-16:
"§122-16P — Fire Prevention Bureau Fees:
§ 122-16P(1) — Agricultural Burning Permits: $150.00;
§ 122-16P (2) — Commercial Roof Truss Assembly Inspection pursuant to
Title 19 of the Uniform Code Part 1264: $50.00."
"§122-16Q — Fire Prevention Permits pursuant to Title 19 of the Uniform Code:
§ 122-16Q(1) — Areas of Public Assembly: $150.00 per year;
§ 122-16Q(2) — Non-residential uses and occupancies including, but not
limited to, hazardous materials, combustible liquids, and
gases, compressed gases, cryogens, junkyards, lumberyards,
commercial/industrial ovens and cooking equipment, service
stations and repair garages, welding and cutting, fire
protection equipment: $150.00 per year;
§122-16Q(3)(a) — Multiple Dwellings (3 —10 units): $150.00 per year;
§ 122-16Q(3)(b) — Multiple Dwellings (11— 50 units): $225.00 per year;
§ 122-16Q(3)(c) — Multiple Dwellings (over 50 units): $300.00 per year;
§ 122-16Q(4) — Alarm for Non-residential Occupancies: $150.00 per year;
§ 122-16Q(5) — Hospitals, Nursing Homes, Healthcare Facilities: $150.00 per
year; .
§ 122-16Q(6) — Special Events (per occurrence), Outdoor Assemblies,
Outdoor Sales, Commercial Tents and Membrane Structures,
Carnivals and Fairs, Concerts, Fireworks, etc.: $150.00 each;
§ 122-16Q(7) — Fire Protection Equipment — Sprinklers and Fire Suppression
Systems: $200.00 each for New Installations (building permit
required) or $100.00 each for Renovations or Modifications
to Existing Systems (building permit required)."

"122-16R — Explosives and Combustibles:
§ 122-16R(1) — Minor Blasting for Earthmoving/Demolition (up to 5 blasts
or 5 days, whichever occurs first): $150.00;
§ 122-16R(2) — Minor Blasting for Earthmoving/Demolition (over 5 blasts or
5 days and no greater than 6 months): $500.00;
§122-16R(3) — Blasting Permits for Quarry Operations: $1,000.00/year."
Section V: Separability:
The provisions of this Local Law are separable and if any provision, clause, sentence,
subsection, word or part thereof is held illegal, invalid or unconstitutional, or inapplicable to any
person or circumstance, such illegality, invalidity, or unconstitutionality, or inapplicability, shall
not affect or impair any of the remaining provisions, clauses, sentences, subsections, words or
parts of this local law or their application to other persons or circumstances. It is hereby declared
to be the legislative intent of the Town Board of the Town of Wappinger that this Local Law
would have been adopted if such illegal, invalid or unconstitutional provision, clause, sentence,
subsection, word or part had not been included therein, and if such person or circumstance to
which the Local Law or part thereof is held inapplicable had been specifically exempt therefrom.
Section VI: Effective Date:
This Local Law shall become effective immediately upon filing with the Secretary of
State as provided by law Municipal Home Rule Law.

Resolution Authorizing the Town Board to Issue and Approve the Warrant to Pay
the Audited Claims Presented to the Town for 2005
At the regular meeting of the Town Board of the Town of Wappinger, Dutchess County,
New York, held at Town Hall, 20 Middlebush Road, Wappingers Falls, New York, on the 13th

The following Resolution was introduced by Councilman Paoloni and seconded by

WHEREAS, pursuant to Town Law 119, which sets forth the procedure for the auditing
of claims and issuance of warrants where there is no Town Comptroller, the Town Board must
audit the claims and issue the warrants for the payment of said claims; and
WHEREAS, since the office of the Town Comptroller is currently vacant and the duties
of auditing claims presented to the Town and the issuing of warrants authorizing the payment of
said claims and bills must be approved by the Town Board.
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The recitations above set forth are incorporated in this Resolution as if fully set forth and
adopted herein.
2. The Town Board hereby confirms that it has audited all the claims on the vouchers
enumerated in the attached warrant: Abstract 20869 with total of Two Thousand, Six Hundred
ninety and 20/100 ($2,690.20). The Town Board has found that all the claims are just and
accurate, directs to the Town Clerk to prepare an abstract of the audited claims, specifying the
number of the claim, the name of the claimant, the amount allowed and the fund and
appropriation account chargeable therewith, and then shall direct same to the Supervisor Joseph
Ruggiero and authorize and direct him to pay the claimant the amount allowed upon his claim.
3 The Town Board hereby authorizes the Supervisor and Bookkeeper to transfer the
following funds into the General Disbursement Fund (GDF) to pay all claims as outlined in
Abstract 20869:

audit the claims and issue the warrants for the payment of said claims; and
WHEREAS, since the office of the Town Comptroller is currently vacant and the duties
of auditing claims presented to the Town and the issuing of warrants authorizing the payment of
said claims and bills must be approved by the Town Board.
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The recitations above set forth are incorporated in this Resolution as if fully set forth and
adopted herein.
2. The Town Board hereby confirms that it has audited all the claims on the vouchers
enumerated in the attached warrant: Abstract 20871 with total of One Million, Three Hundred,
Sixty-nine Thousand, Five Hundred six and 90/100 ($1,369,506.90). The Town Board has found
that all the claims are just and accurate, directs to the Town Clerk to prepare an abstract of the
audited claims, specifying the number of the claim, the name of the claimant, the amount
allowed and the fund and appropriation account chargeable therewith, and then shall direct same
to the Supervisor Joseph Ruggiero and authorize and direct him to pay the claimant the amount
allowed upon his claim.

WHEREAS, the duration of the lease and option periods are subject to incremental
increases in the monthly rent fee.
NOW, THEREFORE, BE IT RESOLVED, as follows:

2. The Town Board hereby agrees to execute and enter into a written Lease Agreement with
TransCare Corp. with the terms aforesaid of $2,000.00 per month rental fee for designated bays

Resolution Authorizing Allocation of Funds for
Emergency Repairs to Carnwath Farms

WHEREAS, the Town of Wappinger previously purchased a 99 acre estate property located on
Wheeler Hill Road in the Town of Wappinger, commonly known as the "Greystone Estate", also
known as "Carnwath Farms" pursuant to Resolution No. 2003-144 adopted at a Town Board
meeting held on May 27, 2003; and
WHEREAS, one of the primary structures on the property is the "Carnwath Mansion", a three
story mansion constructed in the mid -1800s which is listed on the State and Federal Registrar of
Historical Places; and
WHEREAS, the Town has planned the long term rehabilitation of the Carnwath Mansion and
has applied for grants to fund its restoration; and
WHEREAS, recent field inspection has, however, revealed defects in the structural integrity,
basement and foundation of the aforementioned premises, and heating and electrical distribution
systems therein, creating dangerous and hazardous conditions; and
WHEREAS, corrective measures must be immediately undertaken to cure the aforementioned
dangerous and hazardous conditions and address the structural integrity of the premises; and
WHEREAS, further analysis is required with respect to issues pertaining to asbestos, lead paint
and mold, all of which are potentially hazardous; and
WHEREAS, the Engineer to the Town and Associated Engineering Consultants, Donald Swartz
and Joseph Manfredi have recommended to the Town Supervisor that interim emergency
measures be performed; and
WHEREAS, it is the intent of the Town to pay for such corrective emergency measures through
the creation of a capital account to be funded by a future bond, and
WHEREAS, Supervisor Joseph Ruggiero issued Executive Order 2006-1 declaring a State of
Emergency at the mansion at Carnwath Farms authorizing emergency repairs to commence
immediately to protect life and property.
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The recitations above set forth are incorporated in this Resolution as if fully set forth and
adopted herein.
2. The Town Board of the Town of Wappinger hereby affirms Executive Order 2006-1
issued by Supervisor Joseph Ruggiero and deems the actions taken as necessary to promote the
safety of the residents of the Town of Wappinger.

RESOLUTION: 2006-98
Resolution Authorizing the Town Board to Issue and Approve the Warrant to Pay
the Audited Claims Presented to the Town for 2005
At the regular meeting of the Town Board of the Town of Wappinger, Dutchess
County, New York, held at Town Hall, 20 Middlebush Road, Wappingers Falls, New York, on
the 13th day of March, 2006, at 7:30 P.M.
The meeting was called to order by Joseph Ruggiero, Supervisor, and upon roll being
called, the following were present:

The following Resolution was introduced by Councilwoman McCarthy and seconded
by Councilman Paoloni.
WHEREAS, pursuant to Town Law 119, which sets forth the procedure for the auditing of
claims and Issuance of warrants where there Is no Town Comptroller, the Town Board must
audit the claims and issue the warrants for the payment of said claims; and
WHEREAS, since the office of the Town Comptroller is currently vacant and the duties of
auditing claims presented to the Town and the issuing of warrants authorizing the payment
of said claims and bills must be approved by the Town Board.
NOW, THEREFORE, BE IT RESOLVED, as follows:

1. The recitations above set forth are incorporated in this Resolution as if fully set forth
and adopted herein.
2. The Town Board hereby confirms that it has audited all the claims on the vouchers
enumerated in the attached warrant: Abstract 20876 with total of One Hundred and 00/100
($100.00). The Town Board has found that all the claims are just and accurate, directs to
the Town Clerk to prepare an abstract of the audited claims, specifying the number of the
claim, the name of the claimant, the amount allowed and the fund and appropriation
account chargeable therewith, and then shall direct same to the Supervisor Joseph Ruggiero
and authorize and direct him to pay the claimant the amount allowed upon his claim.
3 The Town Board hereby authorizes the Supervisor and Bookkeeper to transfer the
following funds into the General Disbursement Fund (GDF) to pay all claims as outlined in
Abstract 20876:

New Business/Comments
Councilmember Valdati feels the passing lane on Old Hopewell Road is a dangerous situation
and is requesting Graham Foster, Highway Superintendent and Jay Paggi, Engineer to the
Town, look into this and make recommendations as to whether or not this presents a safety
issue for motorists. Mr. Foster replied that this is a County Road. Supervisor Ruggiero
announced that the County is in the process of studying many of the roads in the Town of
Wappinger. Councilmember Valdati wished to have the Town memorialize the County as to
the danger of having passing lanes on Old Hopewell Road - primarily from Route 9 to 9D.
Councilmember Paoloni wished to thank whoever was responsible for the removal of the old
telephone poles on Myers Corners north of All Angels Hill Road.
