Mr. Swartz explained what had been done and what further repairs would be needed at Carnwath. He also gave a slide presentation showing deterioration that needed to be addressed. Carnwath Farms RFP for Catering Services - Al Roberts • Carnwath Farms RFP for Catering Services—Supervisor Ruggiero announced that he would like to address this item in Executive Session. Lease of EMS Building for TransCare - Manny Saris • Lease of EMS Building for TransCare— Attorney, Manny Saris explained that the Town and TransCare have discussed and entered into an agreement which will be mutually beneficial for TransCare to rent a certain portion of the Emergency Services Building from the Town. It is a completed transaction which will be subject to a Permissive Referendum. Paula Sarvis, Assessor for the Town of Fishkill, has been recommended to fill this position. If no other Assessor is appointed after six months is up, she would automatically, as a matter of law continue as the Acting Assessor and continue until a selection is made. Bulk Pickup - Graham Foster Bulk Pickup—Graham Foster informed the Board due to the popularity of the recycle center he wished to limit the Bulk Pickup Program to "large items only", but realizes that there are many residents who don't have access to a truck or trailer to bring their large items up to the center. Instead, he would like to limit the Bulk Pick-up Program to, "large items only", and instead of sending out a letter to the residents of items we "don't take" only send out letters with a list of items we "do take". The board felt that the letters should be left as they were but remind residents that there is a Bulk Recycle Center available all year round for them to use. Also remind residents that any items that are not taken by the highway at the time of pick-up must be removed or they will be sited. Discussion followed. BE IT ENACTED by the Town Board of the Town of Wappinger as follows: Section I: Title: This Local Law shall be known and cited as Town of Wappinger, "Local Law No. of the Year 2006, Amending Town Code §122-16 Increasing Certain Inspection and Permit Fees and Adding Additional Inspection and Permit Fees", which shall amend the various fees section of the Town Code as set forth in § 122-16 and as set forth below. Section H: Legislative Intent: George Kolb, Jr., the Code Enforcement Officer, has recommended that the Town of Wappinger amend certain portions of the code by increasing various inspection and permit fees and by adding additional inspection fees and permit fees that relate to various provisions of the Building and Zoning Code. Based upon the recommendation of George Kolb, Jr., the Code Enforcement Officer, the Town Board has determined that it is in the best interest of the citizens of the Town of Wappinger to amend the Town's Fees and Permit Section § 122-16 of the Town Code, to increase certain permit fees and inspection fees and to add certain other inspection fees and permit fees. Section V: Separability: The provisions of this Local Law are separable and if any provision, clause, sentence, subsection, word or part thereof is held illegal, invalid or unconstitutional, or inapplicable to any person or circumstance, such illegality, invalidity, or unconstitutionality, or inapplicability, shall not affect or impair any of the remaining provisions, clauses, sentences, subsections, words or parts of this local law or their application to other persons or circumstances. It is hereby declared to be the legislative intent of the Town Board of the Town of Wappinger that this Local Law would have been adopted if such illegal, invalid or unconstitutional provision, clause, sentence, subsection, word or part had not been included therein, and if such person or circumstance to which the Local Law or part thereof is held inapplicable had been specifically exempt therefrom. WHEREAS, the Town of Wappinger previously purchased a 99 acre estate property located on Wheeler Hill Road in the Town of Wappinger, commonly known as the "Greystone Estate", also known as "Carnwath Farms" pursuant to Resolution No. 2003-144 adopted at a Town Board meeting held on May 27, 2003; and WHEREAS, one of the primary structures on the property is the "Carnwath Mansion", a three story mansion constructed in the mid -1800s which is listed on the State and Federal Registrar of Historical Places; and WHEREAS, the Town has planned the long term rehabilitation of the Carnwath Mansion and has applied for grants to fund its restoration; and WHEREAS, recent field inspection has, however, revealed defects in the structural integrity, basement and foundation of the aforementioned premises, and heating and electrical distribution systems therein, creating dangerous and hazardous conditions; and WHEREAS, corrective measures must be immediately undertaken to cure the aforementioned dangerous and hazardous conditions and address the structural integrity of the premises; and WHEREAS, further analysis is required with respect to issues pertaining to asbestos, lead paint and mold, all of which are potentially hazardous; and WHEREAS, the Engineer to the Town and Associated Engineering Consultants, Donald Swartz and Joseph Manfredi have recommended to the Town Supervisor that interim emergency measures be performed; and WHEREAS, it is the intent of the Town to pay for such corrective emergency measures through the creation of a capital account to be funded by a future bond, and WHEREAS, Supervisor Joseph Ruggiero issued Executive Order 2006-1 declaring a State of Emergency at the mansion at Carnwath Farms authorizing emergency repairs to commence immediately to protect life and property. New Business/Comments Councilmember Valdati feels the passing lane on Old Hopewell Road is a dangerous situation and is requesting Graham Foster, Highway Superintendent and Jay Paggi, Engineer to the Town, look into this and make recommendations as to whether or not this presents a safety issue for motorists. Mr. Foster replied that this is a County Road. Supervisor Ruggiero announced that the County is in the process of studying many of the roads in the Town of Wappinger. Councilmember Valdati wished to have the Town memorialize the County as to the danger of having passing lanes on Old Hopewell Road - primarily from Route 9 to 9D.
