• Public Hearing on the Establishment of the Shamrock Hills Drainage District. The
Town Clerk offered for the record, the Affidavits of Posting, Publication and Mailing,
duly signed and notarized. (These Affidavits are attached hereto and made part
thereof of the Minutes of the Meeting). Supervisor Ruggiero wished to know if there
were any comments or questions on the establishment of the Shamrock Hills
Drainage District. Robert Buyakowski, of 20 Applesauce Lane, one of the owners of
the property said he was in favor of the establishment of the Drainage District.

Sidewalk Maintenance Local Law
Sidewalk Maintenance Local Law - Supervisor Ruggiero explained that there are
plans before the Town on the Old Route 9 corridor between Cablevision and La
Fonda Del Sol Plaza that will be requiring sidewalks. Once that is
constructed, some sort of legislation will be required to create a sidewalk
district in the Town of Wappinger. Al Roberts, Attorney to the Town, said
that Town Law Section 130 specifically authorizes Towns to impose a sidewalk
ordinance which would require the owner of abutting premises to maintain it
during inclement weather. In the absence of the property owner the Town can
go in and do the necessary work and back charge the property owner. Fines
would also be imposed. Discussion followed. Discussion ended at 8:09
Health Care Coverage
Health Care Coverage - Supervisor Ruggiero announced that last month the Town
Board went out to bid for Health Care Coverage and the bid was awarded to
CDPHP as being the most affordable. There were some issues with several
employees regarding prescription drugs and services that MVP provided that
CDPHP does not. It was also brought to Mr. Ruggiero's attention that not all
the employees had MVP. Some of the employees have requested to retain their
previous health care. He checked with several surrounding municipalities
about the cost of premiums that their employees contributed. We pulled the
Town Personnel Policy that was amended the year 2001, and the Health Care
Policy states that "all full time employees will receive 100% health care
depending on which plan is selected by the Town". Supervisor Ruggiero is
requesting the Town Board allow this to continue, but if the other employees
opt to have different health plans, they be allowed and they would pay a
percentage. Discussion followed. Discussion ended at 8:18

day of March, 2006, at 7:30 P.M.

The following Order was introduced by Councilman Paoloni and seconded by
Councilwoman McCarthy.
WHEREAS, the Map, Plan and Report entitled "Map, Plan and Report for the Shamrock
Hills Drainage District", dated September 22, 2005, and relating to the establishment of the
proposed drainage district, was prepared by Paggi, Martin & Del Bene, LLP, duly licensed civil
engineers of the State of New York; and
WHEREAS, the aforementioned Map, Plan and Report, has been duly filed with the
Town Clerk and has been prepared in a manner and in such detail that this Town Board has
determined that said Map, Plan and Report is in accordance with the requirements of Article XII
of the Town Law; and
WHEREAS, the properties to be included within the SHAMROCK HILLS DRAINAGE
DISTRICT consist of those properties described in Exhibit "A" attached hereto and made a part
hereof; and
WHEREAS, the improvements proposed consist of the construction and installation of a
storm water drainage system to serve the properties within said District in accordance with
certain plans incorporated in the Map, Plan and Report, which is hereby approved and adopted
by this Town Board and is now on file in the office of the Town Clerk; and
WHEREAS, the Petitioner, Shamrock of Dutchess, LLC shall construct and install said
drainage system at its own expense and upon completion of same transfer said drainage system
to the Town of Wappinger and/or the SHAMROCK HILLS DRAINAGE DISTRICT, without
any cost to the Town, and all costs and expenses occasioned by the creation of this District shall
be borne by the Petitioner, Shamrock of Dutchess, LLC.; and
WHEREAS, Shamrock of Dutchess, LLC shall install all improvements referenced in
the Map, Plan and Report and dedicate same to the District upon completion thereof; and
WHEREAS, the improvements to be constructed for the SHAMROCK HILLS
DRAINAGE DISTRICT shall consist of, including, but not limited to, ninety-one (9 1) catch
basins, 7,675+/- L.F. of piping, three (3) detention ponds, wetlands, twenty-nine (29) drains with
rip -rap inlet and outlet protection and two (2) swales as set forth in the Map, Plan and Report;
and
WHEREAS, the maintenance of the proposed drainage facilities and improvements and
the expenses in connection therewith is more fully described in the Map, Plan and Report
hereinbefore described; and
WHEREAS, following the aforementioned Petitioner's construction and dedication of
the improvements to the Town, the cost of maintaining the District shall be assessed, levied, and
collected from the several lots and parcels of land within said district in proportion to the benefit
which each lot and parcel of land in said district will derive therefrom as set forth in the Map,
Plan and Report; and
WHEREAS, the Map, Plan and Report, including an estimate of costs has been prepared

in such manner and in such detail as has theretofore been reviewed by the Town Board of the
Town of Wappinger, Dutchess County, New York, relating to the establishment of the proposed
Drainage District of the Town of Wappinger, Dutchess County, New York, to be known as the
SHAMROCK HILLS DRAINAGE DISTRICT; and
WHEREAS, the maximum estimated cost of said improvements to the Town and/or the
District is zero ($0) dollars; and
WHEREAS, there are no hook-up fees proposed to the typical property in the
SHAMROCK HILLS DRAINAGE DISTRICT; and
WHEREAS, the estimated cost to the SHAMROCK HILLS DRAINAGE DISTRICT for
the first year budget will be approximately Twenty Seven Thousand ($27,000.00) Dollars,
which when divided among fifty-three (53) lots results in a cost of Four Hundred and Twenty -
Eight Dollars and Fifty -Seven Cents ($428.57) per lot; and
WHEREAS, a detailed explanation of the manner by which the computations for the
estimated first-year cost to the typical property in the SHAMROCK HILLS DRAINAGE
DISTRICT is contained within the aforesaid Map, Plan and Report which has been filed in the
Office of the Town Clerk where the same is available during regular office hours for
examination by any person interested in the subject matter thereof, and
WHEREAS, the Town Board determines that the creation of this Drainage District is a
Type II Action as defined in 6 NYCRR 617.5 and Chapter 117 of the Code of the Town of
Wappinger and, accordingly, the Town Board hereby expressly determines that this action is not
an action that requires review pursuant to the provisions of the New York State Environmental
Quality Review Act (SEQRA) or pursuant to Chapter 117 of the Code of the Town of Wappinger
or pursuant to 6 NYCRR Part 617; and
WHEREAS, an Order Calling a Public Hearing was duly adopted by this Town Board
on February 27ffi, 2006, reciting the filing of said Map, Plan and Report, the improvements
proposed, the boundaries of the proposed district, the proposed method of financing, the fact that
the Map, Plan and Report describing the same were on file in the Town Clerk's Office for public
inspection, and stating all other matters required by law to be stated, and specifying March 27th,
2006 as the date, at 7:30 in the evening of said day as the time, at the Town of Wappinger Town
Hall, 20 Middlebush Road, Wappingers Falls, New York as the place where this Town Board
would meet and consider said Map, Plan and Report, and to hear all persons interested in the
subject thereof, and to take such action therein as is required or authorized by law; and
WHEREAS, such Order was duly published and posted as required by law and copies of
such Order were duly mailed to Petitioners/homeowners of all properties in the proposed
District, and proof of publication, posting and mailing has been duly presented to the Town
Board; and
WHEREAS, a public hearing on said matter was duly held by said Town Board on
March 27th, 2006 at 7:30 p.m. in the afternoon on said day, in the Town of Wappinger Town
Hall, 20 Middlebush Road, Wappingers Falls, New York, and no person appearing in opposition
thereto, and Shamrock of Dutchess, LLC., the Petitioner, appearing in favor of the Petition; and
WHEREAS, pursuant to said petition, it is the intention of the Petitioner, Shamrock of
Dutchess, LLC., to construct the improvements set forth in the Map, Plan and Report solely at its
own cost and expense.
NOW, AFTER DUE DELIBERATION, IT IS HEREBY ORDERED,

3. The Petitioner as 100% owner of the property was duly mailed a copy of the
Notice of Public Hearing and proof thereof was submitted to the Town Board.
4. The Petition presented to this Board for the establishment of the SHAMROCK
HILLS DRAINAGE DISTRICT was signed and acknowledged as required by law and was
otherwise sufficient.
5. All the property and property owners within the proposed district are benefited
thereby.
6. All the property and property owners benefited thereby are included within the
limits of the proposed district.
7. There will be no hook-up fees for any of the properties within the district.
8. There will be no capital costs assessed to the properties within the district for the
improvements proposed to be constructed.
9. The estimated annual cost of Operation and Maintenance of the proposed
improvements after three years is estimated to be Four Hundred and Twenty -Eight Dollars and
Fifty -Seven Cents ($428.57) per Benefit Unit for a typical property within the district.
10. A detailed explanation of the improvements to be made and the estimate of
Operation and Maintenance charges have been included in the Map, Plan and Report which has
been filed in the Office of the Town Clerk and the same has been made available during regular
office hours for examination by any person interested in the matter thereof.
11. It is in the public interest to establish the SHAMROCK HILLS DRAINAGE
DISTRICT.
BE IT FURTHER RESOLVED, ORDERED AND DETERMINED that the
establishment of the SHAMROCK HILLS DRAINAGE DISTRICT in the Town of Wappinger,
Dutchess County, New York, and the improvements therein, as more fully described above and
in the aforementioned Map, Plan and Report is hereby approved and established and said
drainage district shall be bounded and described as set forth in Exhibit "A" attached to the
Petition; and
BE IT FURTHER RESOLVED, ORDERED AND DETERMINED that the
improvements for the said drainage district as set forth in the Map, Plan and Report are to be
constructed by the Petitioner, Shamrock of Dutchess, LLC, wholly at its own expense, and
Petitioner has agreed to convey such improvements to the Town and/or the SHAMROCK HILLS
DRAINAGE DISTRICT without cost to the Town of Wappinger, free and clear of any liens or
encumbrances; and
BE IT FURTHER RESOLVED, ORDERED AND DETERMINED that once the
drainage improvements as set forth in the Map, Plan and Report have been constructed by the
Petitioner and turned over to the Town, the cost for maintaining the District shall be assessed,
levied and collected from the several lots and parcels of land within the said district in proportion
to the benefit which each lot or parcel of land in said district will derive therefrom as set forth in
the Map, Plan and Report; and
BE IT FURTHER RESOLVED, ORDERED AND DETERMINED that the Town of
Wappinger shall be reimbursed by the Petitioner, Shamrock of Dutchess, LLC, for any fees or

WHEREAS, said Local Law has been on the desks of the Members of the Town Board
of the Town of Wappinger for at least seven days exclusive of Sunday prior to the adoption of
this Resolution.
NOW, THEREFORE, BE IT RESOLVED:

2. The Town Board of the Town of Wappinger hereby adopts Local Law No.4 of the

BE IT ENACTED by the Town Board of the Town of Wappinger as follows:
Section I: Title:
This Local Law shall be known and cited as Town of Wappinger "Local Law No. 4 of
the Year 2006, Rescinding Local Law No. 10 of the Year 2005 and Further Designating a Full Stop
Intersection at the Southeasterly Corner of Northbound Bel -Air as it Approaches Orange Court
which shall amend the present Vehicles and Traffic Code, as set forth below.
Section II: Legislative Intent:
The Highway Superintendent, Graham Foster has requested that the Town of Wappinger
install a stop sign and establish a stop intersection at the northbound intersection of Bel -Air Lane as
it approaches Orange Court and placement of a stop sign at the southeasterly corner thereof. Based
upon the recommendation of the Highway Superintendent, Graham Foster, the Town Board has
determined that it is in the best interest of the citizens of the Town of Wappinger to revise the
Town's Vehicle and Traffic Code §230-43 " Schedule IX: Stop Intersections" to designate the
northbound intersection of Bel -Air Lane and Orange Court as a full stop intersection.
The Local Law also hereby rescinds Local Law No. 10 of the Year 2005 which designated a
stop'intersection at the westbound intersection of Orange Court with Bel -Air Lade as it has been
determined that a prior Local Law designating the same stop intersection was previously adopted.

Section III• Stop Intersection:
The Town of Wappinger Code §230-43 is hereby amended by alphabetically inserting into
Schedule IX the following designated full stop intersection,

Section IV: Stop Sian.
The Town Board hereby directs the Highway Superintendent to place a stop sign
at the southeast corner of the northbound intersection of Bel -Air Lane with Orange Court.

Local Law No. 10 of 2005 is hereby rescinded inasmuch as a previous local law
has established a full stop intersection at the same intersection.
Section VI: Separabilitv.
The provisions of this Local Law are separable and if any provision, clause, sentence,
subsection, word or part thereof is held illegal, invalid or unconstitutional, or inapplicable to any
person or circumstance, such illegality, invalidity, or unconstitutionality, or inapplicability, shall
not affect or impair any of the remaining provisions, clauses, sentences, subsections, words or
parts of this local law or their application to other persons or circumstances. It is hereby declared
to be the legislative intent of the Town Board of the Town of Wappinger that this Local Law
would have been adopted if such illegal, invalid or .unconstitutional provision, clause, sentence,
subsection, word or part had not been included therein, and if such person or circumstance to
which the Local Law or part thereof is held inapplicable had been specifically exempt therefrom.

WHEREAS, the Town Board wishes to establish a healthcare coverage policy for all
employees not represented by a collective bargaining agreement and current retirees of the Town
of Wappinger, and
WHEREAS, the Town of Wappinger has offered healthcare coverage through MVP and
the Empire Plan to all full time employees who are not represented by a collective bargaining
unit, and
WHEREAS, The Town Board has a fiduciary responsibility to seek bids for the most
affordable healthcare coverage for its employees and retirees, and
WHEREAS, the Town Board of the Town of Wappinger has found CDPHP the most
affordable and voted to add CDPHP as a health insurance provider at the February 27, 2006
Town Board meeting, and
WHEREAS, the Town Board of the Town of Wappinger adopted a healthcare coverage
policy as outlined in the Town of Wappinger Personnel Policy Manual on May 29, 2001 as
follows:
1) The Town Board offers a choice of paid health plans for eligible full time
employees. Whichever plan is selected will govern the coverage.
2) All full-time employees and their eligible family members will be
provided health benefits under the available medical plan at no cost to the
employees.
3) Those full-time employees declining medical coverage are eligible to
receive a semi-annual reimbursement from the Town of 50% of the lower
cost applicable plan payable on a pro rated basis for the first year of
employment and yearly thereafter. Payment shall be made in June and
December.
4) Elected Officials who retire from the Town are receiving New York State
Retirement or New York State Retirement Disability benefits, and have
the Town Retirement service credit years with the town, shall have the
option to elect contributory health insurance from the town based on the
following schedule:

WHEREAS, the premium cost of coverage for CDPHP, MVP and Empire varies greatly
resulting in an inequity in funding by the Town per employee, and
WHEREAS, the Town Board wishes to establish parity between employees in regards to
healthcare coverage, and
WHEREAS, the Town Board recognizes that certain employees may want to receive
additional benefits beyond the standard coverage provided by CDPHP
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The recitations above set forth are incorporated in this Resolution as if fully set
forth and adopted herein.
2. All full-time employees not represented by a collective bargaining unit will have
healthcare coverage available through CDPHP at no cost to the employee with the
Town pay 100% of the premiums.
3. All full-time employees electing not to have CDPHP as their healthcare provider
will have the option of selecting either MVP or the Empire Plan, with the
employee contributing 15% and the town paying 85% of the premiums.
4. Any full-time employee electing to participate in MVP or the Empire Plan will be
charged on a weekly basis with funds removed from their paycheck prior to
payroll taxes being withheld.

6. Any employee wishing not to accept health care coverage through the Town of
Wappinger must submit a written declination of healthcare to the Supervisor's
Office.
7. Retired elected officials have the option of retaining their current healthcare
coverage or selecting CDPHP, MVP or Empire Plan through the Town of
Wappinger at a percentage of the premium cost as follows:

8. All non -elected retirees and surviving spouses of Town of Wappinger employees

MVP or Empire, and will continue to contribute payment to the premium as

Resolution Authorizing the Purchase of an Automated External Defibrillator (AED)
for Robinson Lane Park
At a regular meeting of the Town Board of the Town of Wappinger, Dutchess County,
New York, held at Town Hall, 20 Middlebush Road, Wappingers Falls, New York, on the 27`h
day of March, 2006, at 7:30 P.M.
The meeting was called to order by Joseph Ruggiero, Supervisor, and upon roll being
called, the following were present:

The following Order was introduced by Councilwoman McCarthy and seconded by
Councilman Valdati.
WHEREAS, Joseph Kovalsky, Emergency Services Coordinator for the Town of
Wappinger, has recommended in his letter of March 12, 2006, a copy of which is attached
hereto, that the Town of Wappinger purchase a Automated External Defibrillator (AED) for
Robinson Lane Park, and
WHEREAS, Cardiac Science, Incorporated has a Automated External Defibrillator with
a protective case, ready kit, pediatric pads for a child, and extra set of adult pads for the cost of
One Thousand Four Hundred Fifty dollars and 00/100 ($1450.00), and
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The recitations above set forth are incorporated in this Resolution as if fully set forth
and adopted herein.
2. Payment is approved in the amount of One Thousand Four Hundred Fifty dollars and
00/100 ($1450.00) to Cardiac Science, Incorporated 3303 Monte Villa Parkway

New Business/Comments
Councilmember Bettina said he was still waiting for a meeting with the DOT in
regard to traffic concerns on Chelsea Road. Also, he did not see the letter
regarding the Telephone Poles. Supervisor Ruggiero replied the letter was
sent to Mr. John Malone of Verizon and Mr. Malone responded today saying the
poles would be removed within a month.
Supervisor Ruggiero informed the Town Board that he has requested the
Attorney to the Town, Al Roberts, to look into drafting a zoning regulation
regarding double wood throughout the Town. Verizon would have to respond in
so many days or they would be fined.
Councilmember Bettina wants letters sent to DOT regarding the speeding on
Chelsea Road.
Councilwoman McCarthy was curious to know if the Town was prepared to step up
patrolling of the roads as the warm weather approaches. Supervisor Ruggiero
replied, "Yes".
Councilmember Valdati complained that several poles in the town are very
close to the roads and create a safety issue for school buses and cars.
Highway Superintendent announced that at the next meeting the Town Board
should be considering striping of additional roads. Kent Road was done last
year and it was very successful. He thinks the Town should look at some
additional roads to do this season. This will help with traffic calming.
