III. Resolutions
RESOLUTION: 2006-125
Resolution Allowing Towns to Set Their Own Speed Limits
WHEREAS, Assembly Bill A.02822 and Senate Bill S.723, concurrent resolutions of
the New York State Assembly and Senate, proposing amendments to Section 1662-a, Vehicle
and Traffic Law of the State of New York, in relation to certain municipalities establishing speed
limits on local roads within their jurisdiction and introduced in both houses of the New York
State Legislature, and
WHEREAS, current provisions of the Vehicle and Traffic Law Section 1662-a
authorize only certain towns (i.e., suburban towns and those with over 50,000 in population -
approximately 8.6 percent of towns) to set speed limits on all highways within a town other than
State highways maintained by the State, while all cities and villages regardless of classifications
of population set their own limits, and
WHEREAS, there are 852 towns in New York State that are prohibited from addressing
speed limit issues in their jurisdiction without petitioning New York State Department of
Transportation, and
WHEREAS, the New York State Department of Transportation can take as much as two
years to process requests for speed limit reductions and has, in most instances, declined to reduce
speed limits on town highways when requested to do so by local officials, and
WHEREAS, the need to address road safety issues through speed limits in a timely
fashion should not be limited and the current law presents an inequality among municipalities,
and

WHEREAS, town officials are legally required to set speed limits based upon the same
engineering standards and traffic investigation techniques as the State Department of
Transportation, cities, and villages are required to employ, and
WHEREAS, A.02822/S.723 would amend the Vehicle and Traffic Law in relation to
establishing speed limits on town highways which have been classified by the Department of
Transportation as local roads, and
NOW, THEREFORE, BE IT RESOLVED, that the Town of Wappinger Town Board
hereby urges the New York State Assembly to Approve Assembly Bill A.02822 and Senate Bili
5.723 , and
BE IT FURTHER RESOLVED, that the Town of Wappinger Town Board urges the
State Legislature and Governor to extend to .all towns an options -through adoption of a local law -
to assume responsibility and authority to set speed limits on town roads within their respective
jurisdictions, within the limits as defined in Section 1662-a of the Vehicle and Traffic Law, and
so long as those roads have been functionally classified by the Department of Transportation as
local roads, and
BE IT FURTHER RESOLVED, that a copy of this resolution be forwarded to
Governor George E. Pataki, Senators Stephen M. Saland and Vincent Leibell, Assemblymen
Thomas Kirwan, Joel Miller, Patrick Manning, Willis H. Stephens Jr., and Kevin Cahill.

RESOLUTION: 2006-126
Order Calling Public Hearing for Wappinger Sewer Improvement 5
WHEREAS, a map, report and plan, including an estimate of cost, have been duly prepared
in such manner and in such detail as has heretofore been determined by the Town Board of the
Town of Wappinger, Dutchess County, New York, relating to sewer improvements, to serve a
benefited area in said Town to be known as Wappinger Sewer Improvement Area #5 (the "Area"),
whose boundaries shall consist of the area specified in Appendix A as attached hereto and hereby
made a part hereof (and which is contiguous with present Wappinger Sewer Improvement Area #1),
as more fully shown upon a map on file in the office of the Town Clerk, which map is available for
inspection by any person or person interested in same during regular office hours at said office; and
WHEREAS, said map, plan and report, including estimate of cost, were prepared by a
competent engineer, duly licensed by the State of New York and have been filed in the office of the
Town Clerk of said Town, where the same are available during regular office hours for examination
by any person or persons interested in the subject matter thereof; and
WHEREAS, the capital improvements proposed in connection with the establishment of
Wappinger Sewer Improvement Area #5 of the Town of Wappinger consist of the construction of a
wet well mounted pump station, with related generator set and gravity main, as well as other
original equipment, machinery, apparatus, appurtenances, and incidental improvements and
expenses in connection therewith, to be installed near the existing air ejector station on Cedar Hill
Road in said Area, at a maximum estimated cost of $250,000; and
WHEREAS, said maximum estimated cost shall be authorized to be financed by the
issuance by the Town of Wappinger of its serial bonds with a maximum maturity not in excess of
the forty year period prescribed by the Local Finance Law; and
WHEREAS, said maximum estimated cost is not greater than one-tenth of one per centum
of the full valuation of taxable real property in the area of the Town of Wappinger outside of any
villages; and
WHEREAS, it is proposed that the cost of the aforesaid improvements shall be borne by the
real property in said Wappinger Sewer Improvement Area #5 by assessing, levying upon and
collecting from the several lots and parcels of land within such Wappinger Sewer Improvement
Area #5, outside of any village, which the Town Board shall determine and specify to be especially

benefited by the improvements, an amount sufficient to pay the principal and interest on serial
bonds and bond anticipation notes issued in anticipation of the issuance of serial bonds, as the same
become due and payable; and
WHEREAS, the aforesaid improvements have been determined to be an Unlisted Action
pursuant to the regulations of the New York State Department of Environmental Conservation
promulgated pursuant to the State Environmental Quality Review Act, the implementation of which
as proposed, the Town Board has determined will not result in any significant environmental
effects; and
WHEREAS, it is now desired to call a public hearing for the purpose of considering said
map, plan and report, including estimate of cost, and to hear all persons interested in the subject
thereof concerning the same, all in accordance with the provisions of Section 209-q of the Town
Law;
NOW, THEREFORE, BE IT ORDERED, by the Town Board of the Town of
Wappinger, Dutchess County, New York, as follows:
Section 1. A public meeting of the Town Board of the Town of Wappinger, Dutchess
County, New York, shall be held at the Town Hall, in Wappingers Falls, New York, in said Town,
on the 12`h day of June, 2006, at 7:30 P.M., Prevailing Time, to consider the aforesaid map, plan and
report, including estimate of cost, and to hear all persons interested in the subject thereof concerning
the same and to take such action thereon as is required by law.
Section 2. The Town Clerk is hereby authorized and directed to cause a copy of this
Order to be published once in the official newspaper, and also to post a copy thereof on the town
signboard maintained by the Town Clerk, not less than ten (10) nor more than twenty (20) days
before the day designated for the hearing as aforesaid, all in accordance with the provisions of
Section 209-q of the Town Law.
Section 3. This Order shall take effect immediately.

Resolution Appointing Town Comptroller
WHEREAS, the position of Town Comptroller became vacant effective January 1, 2006,
and
WHEREAS, Jean Gallucci has been interviewed. by the members of the Town Board
and has been found capable of performing the functions of Town Comptroller for the Town of
Wappinger, and
NOW, THEREFORE, BE IT RESOLVED, that Jean Gallucci is hereby appointed
Town of Wappinger Comptroller, and
BE IT FURTHER RESOLVED, that Jean Gallucci shall receive a salary established at
$65,000 per year.

RESOLUTION: 2006-129
Resolution Approving Warrant for 2006
WHEREAS, pursuant to Town Law 119, which sets forth the procedure for the auditing
of claims and issuance of warrants where there is no Town Comptroller, the Town Board must
audit the claims and issue the warrants for the payment of said claims; and
WHEREAS, since the office of the Town Comptroller is currently vacant and the duties
of auditing claims presented to the Town and the issuing of warrants authorizing the payment of
said claims and bills must be approved by the Town Board.
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The recitations above set forth are incorporated in this Resolution as if fully set forth and
adopted herein.
2. The Town Board hereby confirms that it has audited all the claims on the vouchers
enumerated in the attached warrant: Abstract 20898 with total of Two Hundred Forty
One Thousand Eight Hundred Forty Two and 01/100 ($241,842.01). The Town Board
has found that all the claims are just and accurate, directs to the Town Clerk to prepare an
abstract of the audited claims, specifying the number of the claim, the name of the
claimant, the amount allowed and the fund and appropriation account chargeable
therewith, and then shall direct same to the Supervisor Joseph Ruggiero and authorize
and direct him to pay the claimant the amount allowed upon his claim.

Resolution Authorizing Refund of U:iused Escrow Fands for Evergreen Estates, Lot No. 7
WHEREAS, Andlyn Associates has previously posted Six Thousand Dollars ($6,000.00) in
connection with the planting of trees on Let No. 7 in Evergreen Estates; and
WHEREAS, the Six Thousand Dollar ($6,000.00) escrow was a result of an agreement reached
with the New York State Department of Environmental Conservation to plant trees into the Wetlands
Buffer in the fall of 1999; and
WHEREAS, Andlyn Associates has stated that the New York State Department of
Environmental Conservation is not taking any action with regards to the planting of these trees; and
WHEREAS, Joseph E. Paggi, Jr., P.E., Engineer to the Town, by letter dated March 23, 2006,
has stated that the builder has requested the return of the Six Thousand Dollars ($6,000.00) escrow and
has agreed that the escrow monies should be returned to the builder. (A copy of the letter is annexed
hereto as Exhibit "A".)
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The recitations above set forth are incorporated in this Resolution as if fully set forth and
adopted herein.
2. That payment is approved in the amount of Six Thousand Dollars ($6,000.00) made
payable to Andlyn Associates in connection with the return of escrowed monies for Lot
No. 7, Evergreen Estates.

Resolution Authorizing Supervisor to Sign Separation Agreement and General Release for
Mr. Robert Cornell
WHEREAS, Mr. Robert Cornell was employed as a Laborer with the Town of
Wappinger Highway Department; and
NOW, THEREFORE, BE IT RESOLVED, as follows: the Town Board of the Town
of Wappinger authorizes the Town Supervisor to enter into a Separation Agreement and General
Release providing for Mr. Cornell's resignation from the Town of Wappinger, Highway
Department effective December 30, 2005, in accordance with the material terms and conditions
of the Agreement and Release on file in the Town Clerk's office.

1. Councilman Bettina New Business
1) Councilman Bettina would like to thank Jay Paggi and Graham Foster for looking into
the problem concerning Mrs. Garrett on Market Street in Chelsea.
2) The supervisor and Councilman Bettina have been dealing with Robert Balkind, the
Assistant Director of Engineering at the Dutchess County Department of Public Works.
Mr. Balkind came out and walked the Chelsea Road area to put the residents fears at rest.
Mr. Bettina also mentioned Michael Conners, an Engineering Technician/Inspector with
The Chazen Companies. He sent out a letter to the residents of that area to let them know
that it's going to take time but the area will be cleaned up and their concerns will be taken
care of.
3) Councilman Bettina stated that he had been talking to the Chelsea Fire Department about
an issue concerning the fire hydrants in the area. Supervisor Ruggiero and Jay Paggi
pointed out that the fire hydrants should have color coded disks and Councilman Bettina
requested that that recommendation be included in the minutes of the meeting.
4) Councilman Bettina would like to thank Vincent Fabiano for the letter that was sent out
to the residents on Osborne Hill Road.
5) Councilman Bettina stated that he had received complaints from residents about
construction activity and noise on early Sunday mornings. He then asked the Code

Enforcement Officer and Town Attorney if there were laws pertaining to this. Discussion
followed.
6) Councilman Bettina requested an update on the situation with Dr. Vilardi from the Code
Enforcement Officer. Mr. Kolb informed Councilman Bettina that there currently was a
Stop Work Order. Discussion followed.
2. Councilwoman McCarthy New Business
1) Councilwoman McCarthy would like a letter sent to the residents in the Spook Hill Road
area concerning the adoption of Resolution 2006-125; the resolution allowing Towns to
set their own speed limit.
3. Councilman Paoloni New Business
1) Councilman Paoloni had questions regarding the information that was delivered to him
pertaining to 217-12 (H) of the Town Code and, specifically, about dissolvable lot lines.
Discussion followed.
4. Councilman Valdati New Business
1) Councilman Valdati asked about an operation on Oid Hopewell Road that, as he pointed
out, should not be allowed - truck and heavy equipment being operated in a residential
area. He requested an update on the situation. Supervisor Ruggiero and George Kolb
gave a combined brief overview. Councilman Valdati requested that a letter be sent out
from his desk to the residents of Old Hopewell Road notifying them that the situation is
currently being addressed by the courts.
V. Discussions
A. State Agriculture and Markets Law Discussion - David Stolman
David Stolman of Frederick P. Clark notified the Board of the changes made since the
discussion two weeks earlier.
Mr. Stolman stated that at the Town Board meeting two weeks prior, there was discussion on
what needed to be changed - proposed amendments - to the Town Code to be compatible with
the Department of Agriculture & Markets Law. The last discussion ended with confusion
pertaining to the difference between timber processing and timber harvesting. To clarify the
code, Clark added a definition of Timber Processing. That was the only change made in the two
weeks. The proposed changes will address Agriculture Districts, activities protected in those
Districts, and the differences between Agriculture Districts and Non -Agriculture Districts.
Regulation of activities in Non -Agriculture Districts will be enforced the same way as has
always been.
Clark put together a package containing an introductory local law, public hearing notice, etc.
The duration of the discussion was the fielding of follow-up questions from the Town Board.
B. Master Plan Land Use Chapter Discussion - David Stolman
1. The discussion will be rescheduled.
