A Special Meeting of the Town Board of the Town of
Wappinger was held on February 10, 1992, at the Town Hall,
20 Middlebush Road, Wappingers Falls, New York.
Supervisor Smith opened the Meeting at 7:05 P.M.

The Meeting commenced with all joining in the Pledge of
Allegiance to the Flag.
Public Hearings were field on February 10, 1992.on five
proposed Local Laws regarding operation and maintenance
charges on various Water and Sewer Improvement Areas and
Districts, namely, North Wappinger Water District, Wappinger
Sewer Improvement Area #1 Oakwood Water District, Tall Trees
Water Improvement Area and Fleetwood Sewer District.
COUNCILWOMAN VISCONTI moved to adopt to Local Law #1 of 1992
as follows:
BE IT ENACTED by the Town Board of the Town of Wappinger
as follows: North Wappinger Water District
SECTION 1: Section 1 of Local Law #10 of 1991 is hereby
amended to read as follows:
The following water rates for the Consumption/Usage
of Water provided by the North Wappinger Water District
are hereby established as follows:
A. Residential: Each residential dwelling unit
connected to the water system, excluding such units
and users otherwise expressly provided for herein, shall
pay the minimum charge of $15.00 (Fifteen Dollars) per
quarter, for the first fifteen thousand (15,000) gallons

of water consumed/used, and $1.00 for each one thousand
(1,000) gallons consumed and used thereafter. Each unit
of a multiple dwelling shall be individually and separately
charged in accordance with this schedule.
C. Greentree Apartments: The Greentree Apartments
shall be billed $15.00 (Fifteen Dollars) per quarter for
each unit, or an aggregate minimum of $270.00 (Two Hundred
Seventy Dollars) per quarter, whichever is greater. In the
event that the aggregate water consumption/usage of
Greentree Apartments exceeds two hundred seventy thousand
(270,000) gallons, such excess will be billed at a. rate of
$1.00 for each one thousand (1,000) gallons per quarter.
SECTION 2: This Local Law shall take effect. upon adoption
and filing as provided by Municipal Home Rule L•a.w.

BE IT ENACTED by the Town Board of the Tor -.n of Wappinger

SECTION 1: Section 2 of Local Law #1 is hereby amended
to read as follows:
The following Sewer Rates are hereby established for
the Wappinger Sewer Improvement, Area 41:
A. Residential
1. Each residential unit connected to the system:
$280.00 annually and payable on a quarterly-
basis.

SECTION 1: Section 2, Subdivision B of Local Law #4 of 1988 is
hereby amended to read as follows:
The owner shall be obligated to pay the minimum charge of
$85.00 per quarter, regardless of the consumption of water for
said quarter, provided said owner is connected to the system
at any time during the quarter.
SECTION 2: This Local Law shall take effect upon adoption and
as provided by the Municipal Home Rule Law.

which amended applicatioi was received on December 19, 1991,
and
WHEREAS, the Town Bord, in the exercise of its legislative
discretion, has elected �ot to entertain said application.
NOW, THEREFORE, BE I' RESOLVED;
1. The Town Board, in the exercise of its legislative
discretion, hereby elects not to entertain the application
for a change of zone of Contrail Associates of Wappinger and
Pastor Ken Stevenson of the Everlasting Covenant Christian
Ecclesia submitted under cover of letter dated December 16,
1991, rejects same, and irects no action shall be taken
thereon.

Stevenson was recognized by the Chair and stated that they were
disappointed in the outcome of the vote but were committed to
i
moving into the building. They will pursue every avenue to do
this because they believe they can make a positive impact on
the community.
Mr. Valdati addressed Mr. Melvin stating that they were
concerned about the property being removed from the school tax
roll as that would make a big difference in the community. They
would make good neighbors but these are hard times and this
would cause a burden on our people. They should address this
with the School Board and see if they can come to an agreement.
Mr. Melvin responded that they had intentions to build a school
for their own and Town children which would lessen the burden
on the residents, however, Mr. Valdati did not think this would
make a dent in the taxes now being paid in school taxes by our
residents; if they can come up with some agreementwith the
school district so our residents are not burdened because of
their project, then he would look at it again.
Gerard Hankin, Attorney for the Church, spoke to the Board
stating that they tried to address all the issues. The impact
of each child that would attend their school would far out-
weigh the taxes that are currently being paid. If the Church
found another building with the proper zoning, it would be the
same situation, they would lose the taxes for the district.
An unnamed person offered his comments that they should try
to work this out.
Mrs. Smith explained that any further discussion would have
to be on the advice of the Attorney to the Town and then
closed the discussion.
The next item was an Amendment to the Bidding Policy; the
Attorney forwarded a letter indicating that the amount in
the second paragraph should be $8,099.00 instead of $8,000.00

Pursuant to subdivision I of Section 103 of the General
Municipal Law, as separately amended by Chapters 453 and 454
of the laws of 1982, wherein it was amended by adding Section
104-B, said section increasing the bid limits for commodities
from $5,000.00 to $10,.000.00, and Public Works projects from
from $7,000.00 to $20,00 .00, and which requires that procedures
be established for purchasing goods or services that fall below
the new monetary bid limits and said procedures be approved by
the governing board, the following is submitted:

following circumstances:
1. Acquisition of professional services, including but
not limited to the following professions: architects,
attorneys, accountant/auditors, engineers, surveyors, planning
consultants, financial advisors, emergency medical/ambulance
operators or labor negotiators;
2. Emergencies;
3. Sole source situations;
4. Goods purchased from agencies for the blind or
severely handicapped;
5. Goods purchased from correctional facilities;
6. Goods purchased from another governmental agency;
7. Goods purchased at auction.

This policy shall be reviewed annually by the Town Board at
its Organizational Meeting or as soon thereafter as is
reasonably practicable.

The next item was to authorize a feasibility report for a
proposed Emergency Services Building which was being pursued
by the Supervisor.
MRS. VISCONTI moved to authorize Paggi and Martin and Donald
Schwartz of Archetypes to prepare a feasibility report for
the Emergency Serices Building.

It was required that the Town Board determine whether they
preferred to join the County Consortium for Worker's
Compensation or stay with the current company. Mrs. Smith
noted that the Comptroller was present if anyone had questions
on this matter.

on the rate increase for North Wappinger Water District.

A Public Hearing was held by the Town Board of the Town of Wappinger

Falls, New York, on a proposed Local Law Amending previous Local Laws
Establishing Sewer Rates in the Wappinger Sewer Improvement Area #1.
The Supervisor opened the Hearing at 6:47 P.M.

hereto and made part thereof of the Minutes of this Hearing).
The rates for Improvement Area #1 will increase $10.00 per quarter
due to state aid being reduced in the previous two years.
Rosemary Del,,'Pes6hiq,Rosewood Court asked what the operation and
maintenance covers toward the expense of running the district. Mrs.
Smith said she had sent a letter to her explaining this, however the
resident wished a fuller explanation.
The Engineer, Mr. Paggi, was asked to give a more detailed presentation
to the residents on what they were paying for if they belonged to this
Improvement Area. The 0&M charges include the collection lines and
pipes in front of the houses, approximately five pump stations in the
streets that have to pump up sewerage from low areas to high areas;
the bulk of the money goes to the Oakwood Sewer Plant where the sewerage
is treated and discharged into Hunters Creek. Manpower costs, electric
costs, pumps, motors, compressors that are needed to lift, chemicals
that are needed to run the plant, chlorine, etc.
Why put money into the Oakwood plant, the resident wanted to know if
it's going to eventually be demolished? Mr. Paggi explained that
the Tri -Municipal plant will take over in December of 1995 but until
then they still have to treat the sewer from the homes and the plant
has to be kept running. He then explained the process of the cost of
the operation which is divided by the number of users to determine the
cost for each resident. Mrs. Del Peschio then questioned if they will
still be paying the operator's cost when Tri -Municipal takes over; Mr.
Paggi said there would be a charge to run the Tri -Municipal plant,
a charge to run a portion of the line that we are renting from them
and a cost to run our lines and pump stations that are currently
operating and they are already being charged to run the treatment plant.
In answer to her next question Mr. Paggi said the current operator is
engaged to run the sanitary sewer and water lines, not the storm sewers.
Dick Bickerton, Primrose Court, felt this was a considerable increase,
why? The reason, Mrs. Smith said, was that the fund balance was
depleted by the previous administration, state aid reduced in 1990 and
1991, interest rates dropped, benefit units reduced for commercial user
therefore revenue had to be increased per user. No building in that
district since 1989, under state order we cannot issue them. Mr.
Bickerton hoped that the Town Board was sensitive to these increases;
the response from the Supervisor was that they were very sensitive to
this fact and are trying very hard to keep the expenses as low as
possible and save the taxpayers' money.
There were no other comments made.
MR. WALLACE moved to close the Public Hearing, seconded by Mrs.

A Public Hearing was held by the Town Board of the Town of Wappinger
on February 10, 1992, at the Town Hall, 20 Middlebush Road, Wappingers
Falls, New York, on a proposed Local Law Amending Local Law #1 of 1980,
#1 of 1982, #1 of 1985 and #3 of 1988, Establishing Water Rates for the
Tall Trees Water Improvement Area.
Supervisor Smith opened the Hearing at 7:05 P.M.

The Town Clerk offered for the record the Affidavit of Posting and
Publication duly signed and notarized. (These Affidavits are attached
hereto and made part thereof of the Minutes of this Hearing).
This Improvement Area will increase from $45 per quarter to $85 per
quarter due to fund balance being depleted, interest rates dropped.
There are 82 customers.
The Supervisor asked for comments from the public. No one spoke for
or against the increased water rates in the Tall Trees Water Improvement
Area.
MRS. VISCONTI moved to close the Public Hearing, seconded by Mr. Valdati
and unanimously carried.
The Hearing closed at 7:06 P.M.
