He thanked the Highway Department for doing a beautiful job cleaning out the easement behind his home. The next resident to speak was Christopher Smart. He asked for the status of a zoning change request that he and his wife had made last year. Councilman Beale informed the resident that this issue was not on the Agenda, but he would be allowed to speak briefly about it. He has met with the Planning Board in October. They unanimously agreed to support the request for zoning change, pending the correction of certain issues. The resident resolved those issues over the winter. They are now waiting for a letter from the Town indicating that the issues were fully resolved. Discussion about this issue followed. Councilman Beale recommended that the resident contact Councilman Bettina. Councilman Bettina recommended that the resident contact the Planning Board Chairman. Councilman Bettina then stated that he will reach out to the Planning Board Chairman. The next resident to speak was Donald Meade. Discussions A. Carnwath Park Assessment - Town Board Councilman Beale opened the discussion at 7:10 PM. Councilman Bettina had asked for a report from the Town's risk management officer, Jack Peluse, from Marshall & Sterling. Councilman Beale asked Mr. Peluse to give his presentation. Mr. Peluse visited and walked about 90% of the property. The purpose of the visit was to determine if the public should be allowed to access the park. The Board has received Mr. Peluse's report. Mr. Peluse summarized his recommendations. The main safety concern is hanging branches. They would need to be removed. The fields, which were mowed at one time, are now hay. This is a fire hazard. He recommends that they be cut with a brush hog to a point where the grass is green. Mr. Peluse then stated that the administration building needs to be cordoned off. He went on to list the many safety hazards at the administration building. He recommends that a fence be put up with a "No Trespassing" sign. The final issue has to do with the lack of power and water. Since there is no power or water, the public should not be allowed access. Councilman Bettina added that the ROTC from Fordham want to use the property. In order for them to use the property, the field will have to be hayed. He then asked, since the buildings have no power and water, if Mr. Peluse is recommending that those buildings should be fenced off or that the property shouldn't be used at all. Mr. Peluse replied that he isn't suggesting that the Town not use the property at all. If the public is allowed access to the property for hiking, they have to understand that there is no access to those buildings. Councilman Beale asked Steve Frazier, the Buildings and Grounds Supervisor, to comments on the work that his staff has been doing at Carnwath. Mr. Frazier stated the response to Carnwath has been limited. The other Town parks were also damaged by the storm. His focus was to get those other parks back into safe condition for the residents to use and to be able to have the summer camps. As manpower became available, workers have been sent down to Carnwath to do occasional mowing and to clear some brush. He has been contact with a local tree contractor for an estimate to take the hanging branches down to ground level. Mr. Frazier also noted that the brush hog that they have is broken and they are having trouble locating a part for it. He also considered the possibility of having a farmer come in to hay the fields. Councilman Beale asked that the high grass adjacent to the mansion and g other buildings be mowed. Discussion followed. Councilman Beale closed the discussion at 7:22 PM. B. Highway Capital Plan - Foster Councilman Beale opened the discussion at 7:22 PM. He mentioned that Graham Foster, Highway Superintendent, submitted a memo to the Board for various capital needs. He asked Mr. Foster to summarize the memo. Mr. Foster noted that there are about 100 miles of road. They should try to pave at least 5 miles of road per year. He estimates the cost, per mile of road, to be $150,000. When Mr. Foster took his position in 1990, funding for paving was done in the budget. At that time, they had enough money to pave 7 miles of road. Mr. Foster has submitted his recommendation for 5.33 miles of road to be done at a cost of $769,000. As long as the Town doesn't have to take any of its CHIPS money for the emergency generator project, there would be $150,000 available for paving. There would then be a remainder of $619,000 to be bonded. Mr. Foster then discussed drainage issues that he mentioned in his memo. The drainage system at Granger Place will fail. The price to repair was estimated at $800,000. If that project is going to be done, the Engineer to the Town, Bob Gray, will need to make a new estimate. Mr. Foster then listed the Highway vehicles and equipment that need to be replaced. Mr. Foster then discussed the repairs that are currently being made at the Highway facility. He recommends that the Board have Mr. Gray suggest what needs to be done for Phase Il. Mr. Foster then suggested that the Board discuss, at the 2011 budget cycle discussions, the Highway employees that were laid off. Overall, the Town is looking at the potential for $2.5MM of bonding. He would like the Board to authorize him to go to bond counsel to get a potential bond drawn up and to see how much this would cost the Town. He would like this to be ready by the next Board Meeting. Councilman Beale stated that, before moving forward, he would like the Engineer to the Town to expand on the drainage discussion. Mr. Gray discussed the Granger Place drainage issue. Councilman Beale then asked Mr. Gray to discuss Phase II of the Highway facilities repairs. Mr. Gray explained what was done during Phase I and what was to be done in Phase II. Councilman Beale asked if there were any other comments or questions from the Board. There were none. Councilman Beale closed the discussion at 7:32 PM. C. White Corners Road Status - Bettina Councilman Beale opened the discussion at 7:32 PM. Councilman Bettina noted that he has been out to the Whites Corners area and sees that work has been done. He asked the Engineer to the Town, Bob Gray, to meet with the contractor to determine the timeline to Town of Wappinger Page 3 Printed 7/22/2010 Town Board Meeting Minutes July 12, 2010 lX. complete the work. Mr. Gray provided the Board with a memo. Councilman Beale asked Mr. Gray to discuss the memo. Mr. Gray summarized his memo. In a week from today, the contractor will be in a position to bring a paver in. At the request of Councilman Beale, Mr. Gray explained the work that has been completed so far. Mr. Gray went on to discuss other issues that need to be addressed. Councilman Bettina asked for clarification on one of the issues that Mr. Gray mentioned. There are trees that were planted by the owner of lot 9. The trees were actually planted on lot 8. The Town will have to deal with two property owners to get the trees relocated. There is also a driveway in the easement on lot 9. Mr. Gray noted that this will be completed within the 60 day limit set by the Board. Councilman Beale wants this road to be dedicated before the start of the school year. Councilman Beale opened the floor to the public. Don Meade was first to speak. He did not see any grading done. Mr. Gray explained what grading had been done. Discussion followed. Mr. Meade asked where the water goes after it is collected in the retention pond. Graham Foster, Highway Superintendent, explained where the water flowed on its route to Sprout Creek. Mr. Meade asked if this water would make its way near or to any wells or drinking water systems. He noted that bad fill was used in the construction of his lot and he is concerned that it could pollute the water table. Councilman Paoloni thanked the resident for raising the concern and recommended that the issue be looked into. Councilman Bettina understood that the bad fill had been removed. Mr. Meade stated that it was not. He described a large piece of asphalt that he pulled out of his yard. Mr. Foster and the Town Attorney, Al Roberts, stated that asphalt was not in the bad fill that came from the Rail Trail. Councilman Beale asked Mr. Gray to look into the issue. Mr. Meade then asked a question, on behalf of his neighbor, about the neighbor's easement and the trees that are in it. Discussion followed. Next to speak was Sal Contes. He asked how the residents will be notified that they shouldn't be driving on the road after it is paved. Councilman Bettina answered that they will be notified by the contractor. Councilman Beale closed the discussion at 7:52 PM. D. Barry Subdivision Sewer Hook -Up - Colsey Councilman Beale opened the discussion at 7:52 PM. Al Roberts, Town Attorney, explained that, as part of the improvements for Phase 3A, the Town constructed a sewer line extension down South Avenue. The Barry Subdivision is a parcel immediately adjacent to Phase 3A, but was not included as part of 3A. When the parcel was subdivided, their engineer assumed that they needed approval to connect from Tri -Muni only. They did not realize that they needed approval to connect from the Town as well. This was discovered as part of the Town's sewer consolidation mapping. The Resolution that is now before the Board authorizes the property owner to connect to the line. They would have to pay the capital buy -in. Councilman Beale closed the discussion at 7:53 PM. Resolutions RESOLUTION: 2010-235 Resolution Introducing Local Law No. _ of the Year 2010, Amending Section 122-16 of the Town of Wappinger Code WHEREAS, the Town Board has determined that it is necessary to increase the fees charged by the Town in order to maintain revenues consistent with the expenses incurred to operate the services; and WHEREAS, on January 4, 2010, and January 25, 2010, the Town Board, by Resolutions 2010- 56 and 2010-61, approved and adopted a new fee schedule for various fees charged by the Town of Wappinger, and the proposed Local Law is intended to codify those increases; and WHEREAS, this is a Type II action pursuant to 6 NYCRR § 617.5 (c) (20) and is otherwise exempt from environmental review pursuant to the New York State Environmental Quality Review Act ("SEQRA"). NOW, THEREFORE, BE IT RESOLVED: 1. The recitations above set forth are incorporated in this Resolution as if fully set forth and adopted herein. 2. The Town Board hereby introduces for adoption Local Law No. of the Year 2010 in the form annexed hereto. 3. Town of Wappinger Page 5 t'nntea iittitw v Town Board Meeting Minutes July 12, 2010 RESOLUTION: 2010-237 Resolution Authorizing the Use of Robinson Lane Park for the Annual Dutchess County Classic (Mid -Hudson Road Runners Club) WHEREAS, the Mid -Hudson Road Runners Club, will be sponsoring the Annual Dutchess County Road Runners Race to be held on Saturday, September 18 and Sunday, September 19, 2010; and WHEREAS, The Mid -Hudson Road Runners must provide proof of General Liability Insurance in the amount of One Millions Dollars ($1,000,000.00) in advance of the event(s); and WHEREAS, The Mid -Hudson Road Runners Club requests that Robinson Lane be closed for the safety of the runners during the time of the road races. RESOLUTION: 2010-238 Resolution Authorizing Lots in Barry Subdivision to Connect to Route 9D Sewer Main WHEREAS, the Town of Wappinger Planning Board granted Final Subdivision Plat Approval and Lot Realignment Approval pursuant to the application of Stephen and Kim A. Barry for premises located on Route 9D in the Town of Wappinger; and WHEREAS, in accordance with said Resolution of Final Approval, the map entitled "Subdivision Map of the Lands of Stephen & Kim A. Lots 1, 2 and 3 contained in the "Subdivision Map of the Lands of Stephen & Kim A. Barry" filed in the Dutchess County Clerk's Office on June 9, 2010, as filed map number 9419A, are hereby authorized to connect to the Town of Wappinger owned sewer main located on Route 9D (South Avenue). 3. The aforementioned three lots shall be assessed benefit units for both the WST/TIA pipe area, as well as WST/TIA Phase 3A, as determined by the Town of Wappinger Assessor. 4. Pursuant to Chapter 236, Article 2 of the Town Code of the Town of Wappinger, each lot shall be assessed a capital buy -in to connect to the sewer main by the addition of a 30% surcharge on Operation and Maintenance (O&M) charges for a period of five (5) years from the date of the adoption of this Resolution. 5. The capital buy -in assessment will be in addition to the capital charges assessed against each lot. 6. The individual lots above mentioned shall also pay O&M charges to the Village of Wappingers Falls in accordance with a separate agreement between the lot owners and the Village of Wappingers Falls. 7. X. Items for Special Consideration Councilman Beale Discussion about Carnwath Meeting Councilman Beale attended a meeting with the ROTC at Carnwath in place of Supervisor Colsey. The purpose of the meeting was to explain what they would want to use Carnwath for. Councilman Beale explained that they would like to train at the park on four different occasions: Aug 23-25, Sept 9, Sept 23 and Oct 28. They would do leadership training, checkpoint training and other tactical training. The ROTC would also help maintain the trails and buildings. They would not need electricity or running water. They would need a porto-potty. They also have insurance in place. A "hold harmless" agreement would be put in place. Councilman Beale asked for a motion to allow the ROTC to use Carnwath Farms, pending the "hold harmless" agreement and any necessary liability paperwork that would be required to be on file with the Town. The picnics are being published in the newspapers. The senior citizen centers are also passing the word. He does not believe that postcards were sent. Councilman Beale asked that the Poughkeepsie Journal representative in the audience do what he can to get the senior picnic notice in the paper. Victor Fanuele Comments on Resolution 2010-226 Victor Fanuele, Planning Board Chairman, asked if he could address the Board. Councilman Bettina added that they need consistency. Councilman Beale stated that he will have a decision in two weeks. Councilman Paoloni asked if the applicants are residents or if they are builders and contractors. He asked if the fees that these builders pay would cover the cost of the Planning Board and ZBA secretary.
