The Regular Meeting of the Town Board of the Town of Wappinger
was held on March 25, 1991, at the Town Hall, 20 Middlebush Road,
Town of Wappinger, Dutchess County, New York.
Supervisor Smith opened the Meeting at 7:40 P.M.
Present:

All joined in the Pledge of Allegiance to the Flag at the commencement
of the meeting.
The Minutes of the Regular Meetings of January 28th, February 25th,
1991, Special Meetings of February 27th and March 11th, 1991,
having previously been forwarded to the Board, were placed before
them for their consideration.
Mrs. Visconti noted that on Page 63 of the February 25, 1991 Minutes,
it states that the Wappinger United Soccer Club has a membership of
150, but it should read 750.
MRS. VISCONTI moved that the above stated Minutes be and they are
hereby approved, as corrected, as submitted by the Town Clerk.

Receiver of Taxes, Town Justices for the month of February and the
Annual Report from the Zoning Administrator.

The Board of Elections notified us that they had appointed the
Election Machine Custodians, as recommended, namely -----
2 Republicans, Nicholas Johnson and James Mills, Jr., and
2 Democrats, Joseph DeAngelo, Sr. and Joseph DeAngelo, Jr. They
also informed us of a one day School for these Custodians at the
Board of Elections Office on Cannon Street in Poughkeepsie, on
April 20, 1991, 9A.M. to 4P.M. at a cost of $80.00 each. In the
past the Board has authorized all four of them to attend, but usually
one Republican and one Democrat goes.
MR. FANUELE moved to authorize the four Election Machine Custodians
to attend this School and the fee will be a Town charge.

A Memo was received from Herbert Levenson, Clerk to the Planning
Board notifying the Town Board that they recommended reduction of
a Road Bond submitted by Satellite Investments from $931,622.00 to
$340,349.00. The Engineer submitted his report on this stating that
he had reviewed the improvements made by the developer with the
Highway Superintendent and set the reduction amount.
MRS. VISCONTI moved to reduce the Satellite Investment Road Bond
from $931,622.00 to $340,349.00, at the recommendation of the
Planning Board and the Engineer to the Town.

It was now required that the Town Board notify the Planning Board of
their approval of the reduction in order for that Board to hold a
Public Hearing on the reduction.
A request was received from the Zoning Administrator to attend a
Codes School on May 29th and 30th, or June 5th and 6th, 1991 at
the Dutchess County Fire Control in Poughkeepsie. There is no fee
for attendance. _
The Supervisor noted that he had already attended one conference
this year, which is the Town Policy, and Mr. Levenson was told that
he could take his own personal time if he wished to attend this but
he did not opt to do this; Mrs. Smith had checked to see if it was
mandated for him and learned that it was for the Fire Enforcement
Officials, not the Zoning Administrator.

to attend the Codes School.

�^ Requests for return of funds held in Escrow were received from
Wilro Construction, Pondview Lot #25 and #26, $3,000 each, Jean
Cappelletti, Rt. 376 and Maloney Road, (balance due after withdrawal
of application to the Zoning Board). All required documents were
received and recommendations from the pertinent department heads.
MRS. VISCONTI moved to release the Escrow Funds, as requested, at
the recommendation of the department heads.

Lynne Sheppard, River Road North, wrote to the Board requesting that
they consider placing a Stop Sign at the intersection of Skytop Drive
and River Road North in place of the existing Yield Sign. It seems
that on several occasions cars have come directly out of Skytop -Drive
into her yard and barely missing her house. The Deputy Highway
Superintendent agreed that it was a dangerous intersection and added
that he recommended a sign be placed before the intersection alerting
motorists of the oncoming Stop Sign.
MR. VALDATI moved to authorize the Attorney to the Town to prepare
a Local Law Amending the current Law allowing a Yield Sign, and
replace this with a Stop Sign.

The Engineer submitted reports including three letters on the Hark
Plaza Well in the Wappinger Park Water District regarding corres-
pondence from the NYSDEC notifying us that if either Well#3 or either
of the other two wells in that District become contaminated they will
not put filters on the wells free of charge. It will become our
responsibility if we continue to use them but there is no other choice,
we have to use them. When they did the test for the chloroform level
at Well #3 it was considerably lower than the contamination level set
forth by the EPA. The remaining correspondence on this subject matter
is for the Board's information. Regarding the easement from Mrs.
Sofair, the Attorney informed the Board that he had prepared an

agreement for her to sign which is in the hands of her Attorney.
He hopes to hear from the Attorney by tomorrow and they plan a
meeting with Mr. Klein on Wednesday to discuss the arrangements in
detail.
The other report was on the Castle Point Landfill on the proposed
subsurface investigation. There are now additional costs to the
original fee that Camo Pollution Control quoted for the work they
would perform and the Supervisor set April 8, 1991 for a work shop
discussion on same. It was brought up that the hydrogeological study
added a considerable amount to the original cost and Mr. Incoronato
recommended that they discuss seeking bids for this project.
The Hayden, Pine Ridge Drainage was a project outlined by the
Engineer in 1989 and his report indicated that a paved swale would
be constructed from the intersection of Pine Ridge Drive and Dorothy
Land to the proposed catch basin at McCullough Terrace to direct the
road runoff into the proposed dMinage system. Mr. Paggi emphasized
that the Haydens' would be responsible for any grading and/or other
work required to transport the flood water from private property to
the inlet pipe in the Town's right-of-way. It was his recommendation
that a formal letter be sent to the Haydens' from the Supervisor
stating their responsibility in this project.
Another report referenced Wappinger Sewer Improvement Area #3,
flow data on infiltration/inflow; further discussion will be included
in the April 8, 1991 work shop.
The final report was the Wappinger Creek Tributary, Rt. 376 --
during drainage investigations for the Russell Road drainage he
noticed that the water level of the stream was higher than usual
and upon checking this found that a property owner on Rt. 376 across
from the New Hackensack Reformed Church had recently raised the level
of the pond on his property. It is very possible that there is no
violation involved, however, it did affect the upstream properties.
He recommended that the increase in the dam height be investigated
further to determine if increased flooding will develop which will
cause further drainage problems. The Supervisor requested that the
Attorney and Engineer research the matter and bring their report to
the work shop on.April 8, 1991.
A communication was received from the New York State Office of
Mental Retardation and Developmental Disabilities, Wassaic, N.Y.

They explained that they were working to establish community homes
for people with developmental disabilities throughout this State
in order to accommodate those currentlyliving in large institutions
and allow others who currently reside in communities to remain in
this environment. They asked for the cooperation of the community
leaders to help in this cause and provide assistance for them to
review proposed sites in the Town for community residential programs.
Mrs. Visconti asked for a master list of all such residences in the
Town of Wappinger, including the sponsoring agencies. It appeared
to her from the language of the letter that this organization was
looking for additional community homes in the Town of Wappinger.
Committee Reports ---
Mr. Fanuele, Recycling, reported that he was at the site on Saturday
when a dump truck arrived to deposit newspaper. He turned him away
and asked the other Board Members if he was right in doing so. They
all agreed that the program was for private residences only, not
commercial.
Mr. Valdati had no reports for this meeting.
Mr. Incoronato, refuse, just received his bill for disposal and
found out he's spending $440 each year to get rid of one can of
garbage once a week excluding tires, metal, construction etc.
He complained to his carter who cried the blues about his fees
going up and tipping fees he had to pay, however, since the actual
garbage has decreased due to recycling, the tipping fees should also
decrease. The increase has amounted to 50% over two years which he
felt was steep and the excuse is the recycling expenses which doesn't
make sense since they have had a substantial reduction in tipping fees.
He further noted that when the County entered the recycling program
this year, they did not put any controls in place to scrutinize rate
increases by the carters, there's virtually no competition in the
business and the consumer has no way of knowing if this is a reasonable
rate or a ripoff, so for these reasons, he proposed that the Town
seriously consider licensing the carters and one of the requirements
to obtain such license should be the submission of a financial statement
so we can try to determine if the rate increase is fair and reasonable
and not consumer gouging. He asked that the Board Members address this
at an upcoming work shop session. The Supervisor agreed to schedule

this matter since she too concurred with him on the rate increase
by the carters after she checked her previous bills with the current
one. If they cannot control the rates of the carters, Mr. Incoronato
felt they might have to look into municipal sanitation so the consumers
are treated fairly in this respect. They agreed that Scott Daniels
of Dutchess County Solid Waste should be invited to this work shop
and it should be in April, space permitting on the Agenda, or if not,
then in May.
Mrs. Visconti had no reports for this meeting.
Mrs. Smith informed the Board and the public that the State Auditors
are in the Town Hall starting the audit of the Town Departments.and
her Office and the Comptroller's Office have dazzled them with their
cooperation which they are evidently not used to.
Since April is Recycling Awareness Month and the Supervisor issued
the following Proclamation:
THE TOWN OF WAPPINGER HAS PROMOTED THE BENEFITS AND THEREFORE
PROCLAIMS APRIL AS RECYCLING AWARENESS MONTH IN WAPPINGER.
This, she added, was a request from the Recycling Resource Recovery.
In response to Mr. Fanuele's question on what we were doing about it,
Mrs. Smith had plans to hold open house at our Recycling Center which
was suggested by the agency, also do recycling, which we already do,
so there wasn't anything left to do. There will also be an open house
at the Resource Recovery sometime in April, date not available now.
A request was received from the Justice Court for the Supervisor to
place an ad in the paper for the position of Deputy Court Clerk.
MRS. VISCONTI moved to authorize the Supervisor to place a newspaper
ad for the position of Deputy Court Clerk in the Town Justice Court.

The Village of Wappingers Falls Trustees invited the Town Board to
their Annual Picnic In The Park on July 7, 1991, although Mrs. Smith
said that date would probably change since the County was planning a
big celebration to welcome home the troops on July 6th, rain date
July 7th ---parade, unifaith council, fireworks, etc. etc. etc.
Our Recycling Cleanup will start April lst,1991, west of Route 9
and continue every two weeks in another area, as done previously.
Resolutions ---
Public Hearings having been held by the Town Board on March 25th,
1991 on Amendments to various Local Laws which would increase fines
for violations of the laws, they were placed before the Board for
their consideration.
Since the language of five of the Local Laws was not acceptable, the
Members wished to review them further.
MR. INCORONATO moved to table proposed Local Laws Amending Local
Law #2 of 1978, #3 Of 1978, #2 of 1979, #8 of 1979 and #15 of 1987
for further review by the Attorney and the Town Board.

MR. INCORONATO moved to approve Local Law #4 of 1991 as follows:
BE IT ENACTED by the Town Board of the Town of Wappinger,
Dutchess County, New York, as follows:
SECTION 1
Local Law #3 of 1981, "A Local Law Adopted Pursuant to Vehicle and
Traffic Law Section 1660-A" is hereby amended to read as follows:
Section 1. There shall be no parking or standing by any
motor vehicles in lanes marked Fire Lanes within those parking areas
and driveways maintained by Wappinger Plaza, its successors and
assigns.
Section 2. It shall be the responsibility of the owner of
Wappinger Plaza, its successors or assigns to construct and maintain
signs and other markings appropriate to identify fire lanes and to
provide notice of tow -away restrictions and fines. Said signs shall
conform to the uniform standards prescribed by the New York State
Department of Transportation to the extent provision is made for
such signs. Fire lanes shall be located in those areas designated
by the Fire Chief in whose jurisdiction such lanes lie.
Section 3. Any motor vehicle found standing or parked
within an area designated as a Fire Lane may be removed or towed
away and any owner or operator of such motor vehicle shall be
subject to payment of reasonable fees for such removal and storage.
Section 4. A person operating any motor vehicle in violation
of the Local Law herein described shall be subject to punishment by
a fine of not more than One Hundred ($100.00) Dollars or by
imprisonment for not more than fifteen (15) days or by both such
fine and imprisonment; for a conviction of a second violation,
both which were committed within a period of eighteen (18) months,
such person shall be punished by a fine of not more than Two
Hundred ($200.00) Dollars or by imprisonment for not more than
forty-five (45) days or by both such fine and imprisonment; upon
a conviction of a third or subsequent violation, all of which
were committed within a period of eighteen (18) months, such person
shall be punished by a fine of not more than Three Hundred($300.00)
Dollars or by imprisonment for not more than ninety (90) days or by
both such fine and imprisonment. A violation of this Local Law
shall constitute a traffic infraction as defined in the New York
Vehicle and Traffic Law.

Section 5. In the event any portion of this law is declared
to be unenforceable by a court of competent jurisdiction, all of the
remainder shall continue in full force and effect.
Section 6. This Local Law shall take effect immediately
upon adoption and filing as provided by the Municipal Home Rule
Law.
SECTION 2
Except as specifically modified and amended by the adoption of
the additions, revisions, modifications and amendments above set
forth, Local Law #3 of 1981, "A Local Law Adopted Pursuant to
Vehicle and Traffic Law Section 1660-A" is hereby modified,
confirmed and re -adopted.
SECTION 3
This Local Law shall take effect immediately upon adoption and
filing as provided by the Municipal Home Rule Law.

A Public Hearing having been held on a proposed Local Law Amending
the Zoning Ordinance by deleting Section 428, "Architectural and
Historic District Advisory Board", by the Town Board on March 11,
1991, the matter was placed before them for their consideration.
The wording of this law provided for the deletion of the whole
section rather than the Board's intent to delete just the
Architectural Board and for this reason they wished to redo the
amendment.
MR. INCORONATO Moved to table action on the proposed Local Law.

The Attorney was authorized to prepare another Local Law Amending
Section 428 of the Zoning Ordinance and refer it to the Planning
Board for their review and recommendation prior to presenting it
to the Town Board.
A request was received from Ralph Holt, Chairman of the Recreation
Commission for two transfers for their accounts:
$700.00 From B7310.4 To B7310.1
This was for the increase in salary for the Director authorized at
the February 25, 1991 Town Board meeting.
$3,500.00 From A1410.1 To A7020.1
This was to adjust the salary of the Secretary of the Recreation
Commission appointed at the Reorganizational Meeting of Jan. 2, 1991
when she transferred from her position as Deputy Town Clerk.
In his second Memo, Mr. Holt explained that when the 1991 Budget
was adopted, the money for the Senior Citizen Account 7620 was
put in .4 account and he requested that $20,410.00 be transferred
to the .1 Payroll Account to cover their payroll for 1991.
MRS. VISCONTI moved to approve the transfers as requested by the
Recreation Commission Chairman.

Next on the Agenda for the Town Board to consider was awarding the
bids for the Highway Materials, road aggregates, gas, fuel oil,
dumpsters for the clean-up and back hoe.
Mrs. Smith introduced Tom Heady, Deputy Highway Superintendent and
Dot Schwartz, Secretary to the Highway Superintendent who were
present for the awarding of bids since our Highway Superintendent,
Graham Foster was in Florida due to his father passing away.
The Town Clerk read the Bid Report submitted by the Highway
Superintendent and the recommendations for the various items he
put out to bid.
MRS. VISCONTI moved to award the bids for the road aggregates,
gas and fuel oil, as recommended by the Highway Superintendent.

One bid was received for a dumpster for the Town Cleanup from
M&G Sanitation, Inc. although the bid specs were sent to all local
carters. The cost per ton for metal was $25.00 and for combustibles,
$105 per ton, $60. per trip. The Secretary to the Highway Superin-
tendent noted that the bid prices were lower this year than the
previous year.
MRS. VISCONTI moved to award the bid for the dumpsters to M & G
Sanitation, Inc. at the prices quoted, as recommended by the Highway
Superintendent.

Three bids were received for the backhoe for the HIghway Department:
Ralph Hermann ---$54,756, less $7,000 trade in, total $47,756
Pine Bush ------ 58,641, less $5,000 trade in, total $53,641
Case Power------ 49,950, includes trade in, total $49,950
The Highway Superintendent recommended the bid be awarded to Case
Power and Equipment and noted that even though this was not the lowest

bid he carefully screened all the bids to be sure the machine met
with the specifications and determined that this is the machine
that will do the jobs required by the Highway Department. The
Attorney to the Town advised the Board that the decision of the Board
should be based on not only the lowest bid, but the lowest responsible
bid --- responsible meaning that the Highway Superintendent feels
the company can produce the product that he requires to do the job.
The Board has the right to reject the bids and rebid if they so desire.
The Deputy Highway Superintendent interjected the fact that the low
bidder did not meet all the specifications required and the Attorney
then stated, in this case, it would not be considered the low bidder.
Mr. Heady elaborated noting that they were under the minimum specifi-
cations for the hydraulic power, they came in 1908 lbs. less, the
specs were for 11,500 lbs.
MRS. VISCONTI moved to award the bid for the backhoe to Case Power
and Equipment at a total amount of $49,950.00, at the recommendation
of the Highway Superintendent.

The Recreation Commission received one bid for a tractor/mower from
Jonmar Associates, Inc. which included a hydraulic angle broom and
various optional equipment. They chose not to go for the optionals
and decided that the cost of the broom was excessive and probably a
duplication of equipment since the Highway Department has one. The
Chairman recommended that they purchase the tractor with mower deck
at a total cost of $12,400.00 to be expended from the Parkland Trust
Fund, which was previously approved.
MRS. VISCONTI moved to award the bid for one (1) New John Deere
Model F935 Tractor with 76" mower deck at a total cost of $12,400.00,
to be appropriated from Parkland Trust Fund.

A request was received from the Comptroller to appropriate surplus
fund balance and budget amendment and explained that if actual cash
exceeds the 1991 budgeted estimated revenues and appropriated fund
balance, in Highway Fund, the excess can be appropriated for lawful
use by the Supervisor and Town Board according to Town Law #112,

A second request was received from the Comptroller for transfers
within the Vandalism Patrol Account and the Recycling Account was
received by the Board Members at the meeting which afforded them no
time to review them.
MRS. SMITH moved to table this request to the next meeting for
further review by the Board Members.

There was another item under "Resolutions" brought up by the
Supervisor regarding authorization for the Attorney and the Supervisor
to sign the Consent Order from D.E.C. regarding the Oakwood Sewer
Plant which has been of prime concern to this Board since they took
office. The Supervisor announced that she had received notice this
day that the Consent Order was acceptable to Commissioner Jorling
and was elated that he had signed it. She thanked the Attorney and
the Engineer for their patience and efforts in helping the Town Board
to have the Order accepted; it took a lot of time for them and the
entire Board to achieve this and they should be very proud of this
accomplishment. She felt that in their year and one half in office
they have come closer to finalizing the sewer problem and the legal
problems involved than previous administrations had done in twenty
years.
MRS. VISCONTI moved to authorize the Attorney to the Town and the
Supervisor to sign the Consent Order.

In the matter of the Mosquito Control Program, The Supervisor
said she had done a lot of research on this and first she preferred
adulticiding spraying, then changed to larvaciding; she has talked
to many people, checked the phone calls she received last year which
resulted in 50% for one or the other. She asked the Board Members
to consider action on their preference.
Mrs. Visconti preferred the larvacide since it was her understanding
that if they did this properly and in a timely fashion they would be
able to make a significant dent in the mosquito population. She also
recommended that when this is announced to the residents they be
requested to advise the Supervisor's Office of any bodies of water
on their property so that they can be mapped; there are many of them
that we have no knowledge of and this would help identify them. By
doing the mapping they can give the information to Dutchess County so
they know these areas and they can effectively remove the mosquito
problem. Mrs. Supervisor asked the media to bring this to the
attention of the residents so they will comply with the request to
alert her Office of the location of the ponds, etc.
Mr. Incoronato referred to the Mosquito Control Report from Dutchess
County, Pg. 44, where it tells you how they determine where to spray
and this is based on a study made in 1967 and the maps are updated
annually by the Office of Mosquito Control.
Mr. Fanuele added his comments that he reviewed the report that Mr.
Incoronato referred to and it seemed to him that they have their act
under control by using spray approved by the D.E.C. and they look at
the areas before they either larvacide or adulticide before they spray,
and if the population is not large, they do not spray. The larvacide,
he said is for the ponds, which is fine where Mrs. Visconti lives, but
he has no ponds in his area and he felt the adulticide would be more
effective. There should be no thought of cutting this funding off
because maybe the demand is'nt present now but comes the warmer
weather we'll be getting the calls and will have to take action.
Mr. Incoronato went back to Pg. 24 of his report which stated that
you should avoid inhalation of spray mist ---how can you do this when
it's all over the lawn; this product is toxic to fish ---when you spary
it on the ground how do you keep it from getting into the water table
and into streams; do not apply in weather conditions with drifting
winds ---the wind is always drifting, etc.

Application of this product into water is prohibited ---that's what
we're doing. Repeat applications are needed to obtain the desired
reduction in adult mosquito populations, so it's not a one shot deal,
it's constantly poisoning the atmosphere.
Although Mr. Fanuele persisted in his opinion that they go for the
two options the other Board Members felt that the one product was
more disastrous to the environment than the other. Further discussion
ensued pro and con and the Supervisor reminded the Board that a
decision must be made since it was previously tabled and we must
notify the County.
MRS. VISCONTI moved to notify Dutchess County that we wish to
participate in the Mosquito Control Spring/Summer Larvaciding
Spraying, and authorize the Supervisor to sign the contract.

A report was received from the Attorney on the Sofair Easement for
the Wappinger Park Water District regarding a communication from
Mrs. Sofair's Attorney in which he asked the Town to consider amending
the boundaries of the District to include his client's property. It
seems that since this communication, they have had discussion and
the Attorney has prepared an Agreement which he feels will be
acceptable. Mr. Roberts recommended that the Board give the Supervisor
authorization to sign the proposed Agreement when and if it becomes
acceptable to both parties.
MRS. VISCONTI moved to authorize the Supervisor to sign the Agreement
with Mrs. Sofair in the event the proposal is accepted by her.

The next item was in regard to a contract with the Town and Village
of Fishkill which would allow the use of the Sarah Taylor Park in
the Village of Fishkill for soccer fields. The Attorney requires
authorization to contact the Fishkill Attorney to formulate a
contract for the three municipalities which would provide the use
of the Park for the Soccer League.
MR. VALDATI moved to authorize the Attorney to the Town to contact
the Fishkill Town Attorney and coordinate their efforts to prepare
a contract for the use of the Sarah Taylor Park by the United Soccer
League.

Mrs. Visconti explained, at the Attorney's request that the contents
of Councilwoman Joan Pagones's letter, Town of Fishkill, were
accurate in stating that the proposal was that the Town of Fishkill
would maintain and landscape the fields, the Village would allow the
use of the fields and the Town of Wappinger would continue to fund
the League, and they wanted a one year contract which they hoped
would alleviate a specific problem at the Rockingham fields; if it
proves to be successful, they will then consider another contract.
A communication was received from the Attorney regarding the
acquisition of a portion of Market Street in the Chelsea area by
the Town, now presently owned by the County. This came about when
the Highway Superintendent recommended placement of additional stop
signs in that area and discovered that we could not since it was
partially a County Road. He recommended that County Legislator
John Beale introduce the appropriate resolution through the Legislature
to obtain the acquisition. Mr. Roberts briefly explained the situation
that does exist and Mr. Beale agreed to take action to expedite the
matter.
The Supervisor introduced County Legislator John Beale who complimented
the Town Board on the great job they were doing which he based on the
size of the audience (very small). As Chairman of the Transportation
Committee, he reported that they will be meeting during the week to
focus on the opportunities for the County at Stewart Airport. His
concern was the growth of residential homes, referred to as a bedroom
community in Dutchess County, which they consider a negative impact
taxwise. The Committee's intent is to bring business into the County
now that we have a major airport in close proximity to our area.
Mrs. Smith had another item to bring before the Board which required
action, either one way or another, as soon as possible. The Little
League Association contacted our Recreation Commission regarding
their sponsorship of a one week training camp at the Robinson Lane
Recreation Area.

The Association would receive $500.00 and George Foster, a Major League
baseball player would be affiliated with the program and also receive
a good portion of the fee being charged those who choose to participate.
The Attorney was previously notified of this and his opinion was that
the Little League could not legally use the Town owned fields for
commercial enterprises unless, one, they authorize the Little League
to use the fields, and two, if there is a policy, they would have to
suspend such policy and issue a license for the use of the Town
property. It was agreed that they would discuss this further at a
work shop.
Going back to the communication from the Attorney regarding the
Market Street acquisition, he had suggested that the Town Board
request the Dutchess County Legislature to approve a stop sign at
Market Street at its intersection with Bank and Front Street for
safety reasons. He would like to have this discussion at the same
work shop as that of the other Local Laws they wanted to review.
The Village Officials will be sworn in on April 1, 1991 and the
Supervisor felt it would be a nice gesture for the Town Board to be
present and introduce themselves to the new Board of Trustees.
On April 2, 1991, 1:30 P.M., the Supervisor announced they would
have the raising of the new MIA flag at the Town Hall and all are
invited to attend the ceremony.
A work shop was set for reviewing rezoning requests for April 29,
1991 at 7:00 P.M.
The Town Clerk had contacted Mr. Bristol's office at Central Hudson
in regard to our request for street lights at Kendell Road and was
waiting for a return call as to the status of this request.
In regard to the Town Compost, Mrs. Smith reported that she had met
with the County Attorney, Beatrice Malgeri today and was told the
contract would be ready by the end of the week and said it wasn't
priority and she lots of work to do; she also informed Mrs. Smith
that it would have to go before the County Legislature to get their
approval and then they will have to hold a public hearing. The Town
started negotiations with the County over four months ago and now
they find out they still have to hold a hearing on this; since the
Highway Department has to do work on the area before it is ready for
the Town residents to use, the opening will be delayed beyond the

intended April/May date. Mr. Beale promised he would pursue this
and hopefully there'll be no further delays.
Mr. Fanuele asked about deduction of Social Security payment for the
senior citizens who work part time for the Town. If this can be done
with the Town system, we could save money for the Town as well as for
the employees. Mrs. Smith said she would look into it.
Mr. Valdati asked the status of the census; it was protested once,
now the Dutchess County Planning has joined us and we protested again
but won't know anything until July. Mr. Fanuele thought that the
number reported would be in our favor as far as affordable housing is
concerned; the number of people per household has dropped considerably,
he did not think we had anything to protest.
Mrs. Visconti commended the Zoning Administrator for the summary of
the escrow monies she had requested previously, it was very helpful.
Mrs. Visconti referred to court monitor reports received by the Board
and recommendations, some of which couldn't be done, others that
could be done by the Wappinger courts. She asked if they had heard
from the two Town Justices on when they would act on the recommendations.}
Mrs. Visconti reviewed some of the items and requested that they get
a status report on the recommendations submitted by the State.
New Business ---
Mr. Fanuele, re Central Hudson pipe line that runs through Town
property, thought perhaps the Town Board should write a letter,
however Mrs. Smith said she wrote a letter, as did the Engineer and
Camo Pollution Control, His next question was if this is a shoot off
from the Iroquois line why shouldn't we get some land preservation and
enhancement money. Mrs. Smith explained that this started two years
ago when she was a Councilwoman and both she and County Legislator
Sandy Goldberg got involved and tried to oppose Central Hudson,
however they are using their own easement and it turned out that the
residents in the Rockingham area were putting their swimming pools
and putting sheds on the easement so actually, they were encroaching
on the easement and they agreed to leave the situation alone as long
as we did likewise.

Mr. Fanuele had a story about a tree in Alabama that became a
tourist attraction when someone took a chain saw and cut around the
bottom of the tree to kiil it; the community built a small house
around it so they could save this attraction. This made him think
about what the Town of Wappinger has to offer as a tourist attraction
and the more he thought about it he came up with a suggestion that
the Town Board take pictures in their Ward of areas that are beneficial
to the Town and since "Connie" did such a good job on the pictures of
the Councilpeople she could take the good ones and hang them in the
hallway. It was a suggestion and he felt it would add to the history
of the Town.
There was no other business to come before the Bord.
MR. INCORONATO moved to adjourn the Meeting, seconded by Mrs.
Valdati and unanimously carried.

A Public Hearing was held by the Town Board of the Town of Wappinger
on March 25, 1991 at the Town Hall, 20 Middlebush Road, Town of
Wappinger, Dutchess County, New York, on a proposed Local Law
Amending Local Law #2 of 1978 Prohibiting Parking or Standing by
Motor Vehicles in Fire Lanes Maintained by the Village Crest
apartments.
Supervisor Smith opened the Hearing at 7:15 P.M.

The Town Clerk offered for the record the Affidavits of Posting and
Publication duly signed and notarized. (These Affidavits are attached
hereto and made part thereof of the Minutes of this Hearing).
It was the intent of the Board to increase the violation fines on
all local laws for parking or standing in fire lanes in apartment
complexes and/or condos, but for now they were only addressing some
of them that already had a law on the records. The complexes that
have not requested these restrictions previously will have to do so
if they want them and at that time, the new fees will be incorporated
into the proposed local law.
Mr. Fanuele took issue with the words "Parking or Standing" and did
not think this was realistic if a person was letting someone out.of
his car which was standing, he could receive a citation.
The Attorney explained that they were amending a previous law and the
State does not recommend that you change any of the text other than
what you are amending. Mr. Fanuele still felt it would be a stiff
fine ($100.00) for just standing there, it would be different if he
was leaving it there.
Mrs. Smith explained that she discussed these amendments with both
Judge Francese and Judge Francese and they recommended the $100.00
fine, however, the way she understands it is that they can fine this
amount if they feel the situation calls for this, but they are not
obliged to.
Mr. Fanuele argued that the proposed Law read that the fine for a
first violation of this Law is increased from $25.00 to $100.00, it
does not read that the amount is the maximum; the Attorney noted that
this is at the discretion of the presiding judge.
Mrs. Smith asked if there were any other comments or questions on the
proposed Local Law ---there were none.
MR. INCORONATO moved to close the Public Hearing, seconded by
Mrs. Visconti and unanimously carried.

The Town Clerk offered for the record the Affidavits of Posting and
Publication duly signed and notarized. (These Affidavits are attached
hereto and made part thereof of the Minutes of this Hearing).
Mr. Fanuele also objected to the wording in this previous Law which
they were amending and, in this case, he felt it should prohibit
"parking or standing" since it applied to designated areas for
handicapped drivers and he wouldn't want anyone to be parking or
standing in these areas in the event a handicapped driver did need
the space.
The Attorney explained that a change in the wording would necessitate
another Public Hearing. Mrs. Visconti asked, how many cases are we
talking about since the law was enacted in 1978, but Mr. Fanuele felt
a violator shouldn't be given an "out" if he was cited for a violation,
he could say he wasn't parked. Mr. Incoronato interjected that it was
not imperative that it be enacted tonight and Mr. Fanuele's point was
well taken, however, Mrs. Visconti had no problem with the language.
Mrs. Smith asked if there were any comments or questions from the
public, however, no one had any statements to make.
MRS. VISCONTI moved to close the Public Hearing, seconded by Mr.
Incoronato and unanimounsly carried.

Mr. Fanuele noted that the Law allowed for Stop Signs at five
interesections--- what about all the other Stop Signs in the Town.
The Attorney replied that they were included in other Local Laws,
however they were not being amended at this time. Mr. Fanuele had
a problem with this since the fines were being increased and if there
were violators on other laws with lower fines it didn't seem appropriate
to be charging different fines for the same violation. Why not have
it uniform and address all the Stop Signs in one Local Law and the
Attorney replied that he would have to nullify each and every law on
this subject matter and redo them.
There were no other comments or questions on this proposed Local Law.
MRS. VISCONTI moved to close the Public Hearing, seconded by Mr..
Incoronato and unanimously carried.
