ADJOURNMENT 1 The Reorganizational Meeting of the Town Board of the Town of Wappinger was held on January 2, 1991, at the Town Hall, Middlebush Road, Town of Wappinger, Dutchess County, New York. Supervisor Smith opened the Meeting at 6:00 P.M. Present: Constance Smith, Supervisor Victor Fanuele, Councilman Joseph Incoronato, Councilman Robert Valdati, Councilman June Visconti, Councilwoman Elaine H. Snowden, Town Clerk The Supervisor started the Meeting with the Pledge of Allegiance to the Flag. Supervisor Smith reaffirmed the appointment of Robert Valdati as Deputy Supervisor and Deborah Hongach, as Confidential Secretary. The Town Clerk reaffirmed the appointment of Gladys Ruit as Deputy Town Clerk and said she would be appointing Jennifer Imm as her Second Deputy Town Clerk. The Highway Superintendent appointed Glenn Thomas Heady as Deputy Highway Superintendent. Prior to beginning the Resolutions for this Meeting, the Supervisor announced that the Town Board had previously established a policy to present plaques to employees who have served the Town for twenty-five years or more and she had expressed the intent to present them at the Reorganizational Meeting. She awarded a plaque to John DeCarlo, a highway employee for thirty- three years of service and commended him for being a dedicated and good employee. Mrs. Smith then awarded a plague to Vincent Francese, former Town Justice for his service of twenty-eight years, as stated by him in his recent campaign. They cannot actually find a record for him stating the number of years. The Supervisor was sorry that he lost the election, but felt he would be back with the Town again. And then the Town Clerk, Elaine Snowden was presented with a plaque for over twenty-five years of service to the Town and as Mrs. Smith mentioned that all of them over these years have depended on her for some type of information and labeled her the encyclopedia of the Town. She was appreciated, the Supervisor said, even though they sometimes give her a lot of "lip". 2. The next order of business was for the Town Board to appoint a County Representative for Legislative District #14 to fill the vacancy created by the resignation of Donald McMillen who was recently elected to the State Assembly. The following Resolution was offered by COUNCILMAN VALDATI who moved its adoption: RESOLVED, that John Beale, be and he hereby is appointed as Dutchess County Legislator for District #14 to fill the vacancy created by the resignation of Donald McMillen. Seconded by: Councilwoman Visconti Roll Call Vote: 4 Ayes 0 Nays Councilman Incoronato --- Abstained The Supervisor congratulated Mr. Beale and requested the Town Clerk to swear him in as County Legislator for District #14. APPOINTING PERSONNEL TO VARIOUS TOWN OFFICES AND POSITIONS OF EMPLOYMENT -------------------------------------- The following Resolution was offered by COUNCILWOMAN VISCONTI who moved its adoption: RESOLVED, that the following persons be and they hereby are appointed to the following offices and positions of employment with the Town of Wappinger to serve in such capacity at the pleasure of the Town Board, for the year 1991: NAME OFFICE Bernard Reimer Recreational Coordinator Brenda Von Berg Town Historian Glenn Thomas Heady Deputy Superintendent Highway Gay Ann Hardisty Secretary to Planning Board Gay Ann Hardisty Secretary to Zoning Board Appeals AND BE IT FURTHER RESOLVED, that the salaries otherwise fixed for the above designated offices and positions shall be paid to the holders of such offices and positions every other Friday throughout the year 1991 with the exception that no compensation shall be paid to the holder of the Deputy Superintendent of Highways, and, the Town Historian is to be paid on a semiannual basis throughout the year 1991. Seconded by: Councilwoman Visconti Roll Call Vote: 5 Ayes 0 Nays ESTABLISHING PAY SCALE FOR PART-TIME CLERICAL, LABORERS & MAINTENANCE MEN OTHER THAN HIGHWAY PERSONNEL The following Resolution was offered by COUNCILWOMAN VISCONTI who moved its adoption: RESOLVED, that the pay scale for all presently employed part- time clerical employees engaged to perform services for the Town Board and/or its Officers, Officials and Agencies, be and the same hereby is fixed and established at a minimum hourly rate of $4.00 to a maximum hourly rate of $7.75 per hour, and BE IT FURTHER RESOLVED, that the part-time hourly rate for any subsequent Part -Time Clerical employee engaged by any official or Agency Department Head shall be established at the minimum hourly rate, or if otherwise fixed and established, shall be subject to the approval of the Twon Board, and BE IT FURTHER RESOLVED, that the pay scale for all presently employed part time Laborers and Maitnenance men, other than Highway Personnel, engaged to perform services for the Town Board of the Town and/or its Officers, Officials and Agencies, be and the same hereby is fixed and established at a minimum hourly rate of $4.00 to a maximum hourly rate of $8.00 per hour, and BE IT FURTHER RESOLVED, that all such extra part-time clerical employees and Laborers and Maintenance Men, other than Highway Personnel, engaged on an hourly basis shall be paid every other Friday throughout the year 1991, with the first payday to be on Friday, January 4, 1991. Contract, and BE IT FURTHER RESOLVED, that all of such Highway Department employees engaged on an hourly basis shall be paid every other Friday throughout the year 1991, with 26 pay periods during such year consistent with the pay schedule in accordance with a signed C.S.E.A. Seconded by: Councilman Valdati Roll Call Vote: 5 Ayes 0 Nays DESIGNATING COURT OFFICERS FOR TOWN OF WAPPINGER JUSTICE COURT The following Resolution was offered by COUNCILMAN FANUELE who moved its adoption: RESOLVED, that all individuals hereinafter designated by the Town Board as Court Officers as such title is defined by the Uniform Justice Court Act have all those powers accorded to Court Officers by Law during such time they are actually serving in such capacity, and BE IT FURTHER RESOLVED, that the Town Justices of the Town shall designate and schedule the days and evenings such individuals shall serve as Court Officers, and BE IT FURTHER RESOLVED, that one Court Officer be designated for each session of Court unless the Town Justices determine that more than one be designated for any one session, and BE IT FURTHER RESOLVED, that the Court Officers shall be compensated at the hourly rate of $7.50 for time actually served, and BE IT FURTHER RESOLVED, that ARmed Court Officers shall be compensated at the hourly rate of $10.00 for time actually served at sessions of Court where their services are required, and BE IT FURTHER RESOLVED, that the Town Justices shall submit to the Town Comptroller on a weekly basis the names and hours served, and that the Town Comptroller be empowered to issue remuneration consistent with the foregoing from funds appropriated for Justice Court, and BE IT FURTHER RESOLVED, that the following individuals be designated as Court Officers for the year 1991: Robert J. Monaco Armed Court Officer Arthur Eichler Unarmed Court Officer Howard Webster Alternate Armed Court Officer Albert Berberich Alternate Unarmed Court Officer Seconded by: Councilwoman Visconti Roll Call Vote: 5 Ayes 0 Nays AUTHORIZING ISSUANCE AND PAYMENT FOR PAYDAYS OF 1991 The following Resolution was offered by COUNCILWOMAN VISCONTI who moved its adoption: RESOLVED, that the salaries of all persons holding either full time or part time positions as otherwise fixed for these designated positions shall be paid to the holders of such offices and positions payable every other Friday throughout the year 1991, with 26 pay periods during such year, with the first payday to be on January 4, 1991, and be it further RESOLVED, that the Comptroller of the Town of Wappinger be authorized to issue and pay the holders of these designated positions on such designated paydays of the year 1991. Roberts be and he hereby is employed and retained for the purpose of furnishing to the Town Board, its officers and agencies, such legal advice and services as may be required and he shall receive compensation therefore in accordance with a proposal to this Board. Seconded by: Supervisor Smith Roll Call Vote: 5 Ayes 0 Nays EMPLOYING ENGINEERING SERVICES FOR THE TOWN OF WAPPINGER The following Resolution was offered by COUNCILWOMAN VISCONTI who moved its adoption: RESOLVED that the Engineering Firm of Paggi & Martin be and they hereby are employed and retained for the purpose of furnishing to the Town Board, its officers and agencies, such engineering advice and services as may be required and they shall receive compensation therefore in accordance with a proposal submitted to this Board. Seconded by: Councilman Incoronato Roll Call Vote: 5 Ayes 0 Nays APPOINTING CERTIFIED PUBLIC ACCOUNTANTS TO AUDIT THE ACCOUNTS OF SUPERVISOR, TOWN CLERK AND TOWN JUSTICES FOR THE YEAR 1990 The following Resolution was offered by COUNCILWOMAN VISCONTI who moved its adoption: RESOLVED, that James Sedore, Jr. and Mark O'Sullivan, Public Accountants, be and they hereby are retained to audit the accounts and reports of the Town Supervisor, the Town Clerk and the Town Justices for the year 1990, and BE IT FURTHER RESOLVED, that the said Accountants are hereby further retained for the purpose of furnishing to the Supervisor, Comptroller and Bookkeeper to the Supervisor, such additional accounting assistance as may be requested from time to time, in accordance with a proposal submitted to this Town Board, and BE IT FURTHER RESOLVED, that the said Accountants receive reasonable compensation for the productive services which they shall render to the Town in this connection. Seconded by: Councilman Incoronato Roll Call Vote: 5 Ayes 0 Nays DESIGNATING INSURANCE AGENT FOR THE TOWN OF WAPPINGER The following Resolution was offered by COUNCILWOMAN VISCONTI who moved its adoption: 11 RESOLVED, that Marshall & Sterling, Inc., a general insurance agent doing business in the Town of Wappinger, Dutchess County, New York, be and it hereby is designated as the insurance agent for this Town. Seconded by: Councilman Fanuele Roll Call Vote: 5 Ayes 0 Nays RELATIVE TO TEMPORARY DEPOSIT AND INVESTMENT OF TOWN FUNDS -------------------------------------- The following Resolution was offered by COUNCILMAN VALDATI who moved its adoption: WHEREAS, It has come to the attention of this Town Board of the Town of Wappinger that there are now or may be in the future funds and monies, except proceeds of loans and monies the investment of which is otherwise provided by law, belonging to the Town which are or which may be in excess of the amount required for immediate expenditure to pay current expenses and obligations, and WHEREAS, It is or it may be to the advantage of the Town to deposit and/or invest all or part of such funds in special time deposit accounts, or in certificates of deposit issued by, banks or trust companies located and authorized to do business in this State, short term obligations of the United States of America 12 and/or the State of New York, and WHEREAS, it appears that the Temporary Deposit and/or investment of such excess and surplus funds may be beneficial and profitable to the Town of Wappinger, NOW, THEREFORE, IT IS HEREBY RESOLVED, that the duly elected, qualified and acting Supervisor of the Town of Wappinger be and she hereby is authorized, empowered and directed to deposit and/or invest such surplus and excess funds of this Town in the aforesaid manner pursuant to Section 11 of the Federal Municipal Law of the STate of New York, and IT IS FURTHER RESOLVED, that such Temporary Deposits and/or investments shall be secured, registered or held, as the case may be in the manner prescribed by Section 11 of the General Municipal Law of the STate of New York, and IT IS FURTHER RESOLVED, that the aforesaid Supervisor of this Town be and she hereby is authorized, empowered and directed to take all steps necessary from time to time to carry out and implement this resolution. Seconded by: Councilwoman Visconti Roll Call Vote: 5 Ayes 0 Nays AUTHORIZING THE SUBMISSION OF SUPERVISOR'S ANNUAL FINANCIAL REPORT TO THE STATE COMPTROLLER The following Resolution was offered by COUNCILWOMAN VISCONTI who moved its adoption: WHEREAS, Subdivision 10 of Section 29 of the Town Law requires that the Supervisor of each Town prepare and file with the Town Clerk within 30 days after the expiration of each fiscal year, an annual financial report accounting for all monies received and disbursed by her, together with the certificates or certificate of the bank or trust company where Town monies are deposited, showing the amount of such monies on deposit with said bank or trust company, and cause a certified copy of such report to be published in the official newspaper. WHEREAS, in lieu of preparing the report required by Subdivision 10 of Section 29 of Town Law, the Town Board may determine, by resolution, that the Supervisor shall submit to the Town Clerk within 60 days after the close of the fiscal year, a copy of the report to the State Comptroller required by Section 30 of the General Municipal Law and the Town Clerk shall cause a summary of such report to be published within 10 days after receipt thereof in a form approved by the State Comptroller in the official newspaper. Seconded by: Councilman Incoronato Roll Call Vote: 5 Ayes 0 Nays 13 DESIGNATING OFFICIAL NEWSPAPER OF THE TOWN OF WAPPINGER The following REsolution was offered by COUNCILMAN VALDATI who moved its adoption: RESOLVED, that the Southern Dutchess News, a newspaper regularly published in the Town of Wappinger, Dutchess County, New York and having a general circulation in the Town, and being a newspaper entered as second class mail matter, be and the same hereby is designated as the official paper of this Town, and BE IT FURTHER RESOLVED, that the Poughkeepsie Journal and the Hudson Valley News, newspapers published in the County of Dutchess and having general circulation therein, be and they hereby are designated as additional newspapers for the publication of Town notices, subject to the limitations of Section 64, Subdivision 11 of the Town Law of the State of New York, and BE IT FURTHER RESOLVED, that the Town Clerk be and she hereby is authorized and directed to give notice of such designation at the publishers of such newspapers. Snowden, be and she hereby is appointed as a Marriage Officer for the Town of Wappinger, pursuant to Article 3, Section llc of the Domestic Relations Law, to serve at the pleasure of t Town Board, and BE IT FURTHER RESOLVED, that Elaine H. Snowden shall not receive a salary for said position, however, she may accept gratuities up to $75.00 per ceremony at which she officiates. Seconded by: Councilman Fanuele Roll Call Vote: 5 Ayes 0 Nays 14 APPOINTING A SENIOR CITIZEN DIRECTOR The following Resolution was offered by COUNCILWOMAN VISCONTI who moved its adoption: RESOLVED, that Kathleen Delisa be and she hereby is appointed to serve as Senior Citizen Director for the Town of Wappinger, Dutchess County, New York, and BE IT FURTHER RESOLVED, that the annual salary for the Senior Citizen Director of the Town of Wappinger be and the same hereby is fixed and established at the annual rate of $11,000. to be paid every other Friday throughout the year 1991, with the first payday to be January 4, 1991. Seconded by: Councilman Incoronato Roll Call Vote: 5 Ayes 0 Nays The Supervisor reported that today was the first Town sponsored meeting for the Senior Citizen Program and about 26 to 28 people showed up and at the time she visited they appeared to be having a great time; some were learning how to make yarn poodles from the new Arts & Craft Director, others playing cards, watching TV. It seems to be going well and she anticipates that this will continue. Appointments --- The term of Christopher Simonetty expires this month as a member of ri the Town Planning Board; a unanimous recommendation for his reappointment was received from that Board. The following Resolution was offered by COUNCILWOMAN VISCONTI who moved its adoption: RESOLVED, that Christopher Simonetty be and he hereby is reappointed as a member of the Town of Wappinger Planning Board to fill the vacancy created by the expiration of his term, AND IT IS FURTHER RESOLVED that the term of Christopher Simonetty to said Planning Board will be for a seven year term which will expire in January of 1998. Seconded by: Councilman Incoronato Roll Call Vote: 5 Ayes 0 Nays There were vacancies on the Conservation Advisory Council and a letter was received from Florence Graff, Chairman of that Council, recommending that the present members be reappointed. Mr. Incoronato asked that Matthew Landi, former Chairman of this Council, be added to the members that are being appointed. He added that Mr. Landi was instrumental, while serving as Chairman, in having the Green Fly Swamp designated as a critical environmental area; he is back in the area and has expressed an interest in being appointed to this Council. Mrs. Smith said she would contact him to confirm this since he had visited her and said maybe he wouldn't be able to be a member, but she had no problem with appointing him. The following Resolution was offered by COUNCILMAN FANUELE who moved its adoption: RESOLVED, that Florence Graff, Roy Andren, Ralph Nenni, Mario Verna, Robert Wallace, Richard Dobbins, be reappointed to the Wappinger Conservation Advisory Council and Matthew Landi be appointed to said Council for a two year term which shall expire in January of 1993. COUNCILWOMAN VISCONTI moved to establish reimbursement for mileage at $.271 per mile for the year 1991 for Town Officials and Employees who perform services to the Town using their own vehicle. Seconded by Mr. Fanuele Motion Unanimously Carried COUNCILWOMAN VISCONTI moved that the Town Board and other authorized personnel be granted permission to attend the Association of Towns Meeting in February. Seconded by Councilman Incoronato Motion Unanimously Carried Mrs. Smith announced that they must hold a Public Hearing on the proposed use of County Consortium Funds prior to January 18th, 1991. MRS. SMITH moved to set a Public Hearing for the use of County Consortium Funds on January 16, 1991 at 6:00 P.M. at the Town Hall for all those interested in commenting on this matter. Seconded by Mrs. Visconti Motion Unanimously Carried 17 This will be discussed by the Town Board at their work shop on January 8, 1991. Unfinished Business --- A Contract with the Sloper-Willen Ambulance Company for service to the Town District --- MRS. VISCONTI moved to authorize the Supervisor to sign a Contract with Sloper-Willen Ambulance Company to provide Ambulance Service to the Town residents in the newly established Wappinger Ambulance District. Seconded by Mr. Incoronato Motion Unanimously Carried Mrs. Smith informed the Board that she had discussed a drainage project on Brothers Road, in the amount of $44,000, with the Highway Superintendent and he said his department can do this work during their slow periods either in the Spring or Fall. Since they will be doing the work, the cost will be less. Mr. Incoronato asked about the installation of a Stop Sign on Cooper Road which was discussed at the last meeting. This was being reviewed and will require a Local Law which, if recommended by the Highway Superintendent and the Engineer, will be on the Agenda of the next meeting. Mr. Valdati recognized our new State Assemblyman, Donald McMillen and invited him to speak to the residents. Since Assemblyman McMillen was just sworn in to this Office yesterday, he had nothing to report, however, he did wish to thank the Board for the use of the Meeting Room for his swearing in ceremony.
