1
The Reorganizational Meeting of the Town Board of the Town of
Wappinger was held on January 2, 1990 at the Town Hall, 20 Middlebush
Road, Town of Wappinger, Dutchess County, New York.
Supervisor Smith opened the Meeting at 7:35 P.M.
The Meeting commenced with the Pledge of Allegiance to the Flag.

Elaine H. Snowden, Town Clerk
The Supervisor appointed Robert Valdati as Deputy Supervisor;
Joyce Benedetto as Bookkeeper and Deborah Hongach as Confidential
Secretary.
The Town Clerk reaffirmed her two Deputies, Gladys Ruit and Margaret Roe.
The Highway Superintendent requested that John DeCarlo be the Deputy
Highway Superintendent.
Resolutions ---
RESOLUTION APPOINTING PERSONNEL
TO VARIOUS TOWN OFFICES AND
POSITIONS OF EMPLOYMENT.
The following Resolution was offered by COUNCILWOMAN VISCONTI who
moved its adoption:
RESOLVED, that the following persons be and they hereby are
appointed to the following offices and positions of employment with
the Town of Wappinger to serve in such capacity at the pleasure of
the Town Board, for the year 1990:

1990 with the exception that no compensation shall be paid to the
holder of the office of Clerk to the Planning and Zoning Boards, and
the Town Historian is to be paid on a semi-annual basis throughout
the year 1990.

FOR TOWN OF WAPPINGER
The following Resolution was offered by COUNCILWOMAN VISCONY who
moved its adoption:
RESOLVED, that Ann Buckley be and she hereby is appointed
to the Office of Comptroller in the Town of Wappinger, to serve in
such capacity for a term ending on the 31st day of December, 1991.
and
BE IT FURTHER RESOLVED, that the Comptroller be paid an annual
salary of $30,000.00 payable every other Friday throughout the year
1990, with 26 pay periods during such year, with the first payday to
be January 5, 1990.

OF TAXES AND ASSESSMENT IN THE
TOWN OF WAPPINGER
The following Resolution was offered by SUPERVISOR SMITH who moved
its adoption:
RESOLVED, that Patricia Maupin be and she hereby is appointed
to the Office of Receiver of Taxes and Assessments in the Town of
Wappinger, to serve in such capacity for a term ending on the
31st day of December, 1991, and
BE IT FURTHER RESOLVED, that the Receiver of Taxes and Assessment
be paid an annual salary of $21,000.00 payable every other Friday
throughout the year 1990, with 26 pay periods during such year,
with the first payday to be January 5, 1990, and
BE IT FURTHER RESOLVED, that the Receiver of Taxes and Assessments
be and she hereby is authorized to employ such clerical employees as
may be necessary for the performance of her duties and to compensate
such clerical employees up to the prevailing maximum hourly rate.

and the same are hereby fixed and established at the following annual

OF MARRIAGE OFFICER FOR TOWN OF WAPPINGER
The following Resolution was offered by COUNCILMAN INCORONATO who
moved its adoption:
RESOLVED, that Gloria Morse be and she hereby is appointed
as a Marriage Officer for the Town of Wappinger, pursuant to
Article 3 Section llc of the Domestic Relations Law, to serve at
the pleasure of the Town Board, and
BE IT FURTHER RESOLVED, that Gloria Morse shall not receive
a salary for said position, however, she may accept gratuities up
to $75.00 per ceremony at which she officiates.

to serve as Secretary to the Superintendent of Highways of the Town
of Wappinger, Dutchess County, New York, and
BE IT FURTHER RESOLVED, that the annual salary for the Secretary
to the Superintendent of Highways of the Town of Wappinger be and the
same hereby is fixed and established at the annual rate of $12,000,
to be paid every other Friday throughout the year 1990, with the

RESOLUTION ESTABLISHING PAY SCALE
FOR PART-TIME CLERICAL EMPLOYEES
ENGAGED TO SERVE TOWN BOARD, ITS
OFFICERS, OFFICIALS AND AGENCIES
The following Resolution was offered by COUNCILMAN FANUELE who moved
its adoption:
RESOLVED, that the pay scale for all presently employed part-
time clerical employees engaged to perform services for the Town
Board of the Town and/or its Officers, Officials and Agencies, be
and the same hereby is fixed and established at a minimum hourly
rate of $4.00 to a maximum hourly rate of $7.50 per hour, and
BE IT FURTHER RESOLVED, that the part-time hourly rate for any
subsequent part-time clerical employee engaged by any Official or
Agency Department Head shall be established at the minimum hourly
rate, or, if otherwise fixed and established, shall be subject to
the approval of the Town Board, and
BE IT FURTHER RESOLVED, that all such extra part-time clerical
employees engaged on an hourly basis shall be paid every other
Friday throughout the year 1990, with the first payday to be on
Friday, January 5, 1990.

RESOLUTION ESTABLISHING PAY SCALE
FOR CERTAIN EMPLOYEES OF THE TOWN OF
WAPPINGER HIGHWAY DEPARTMENT
The following Resolution was offered by COUNCILWOMAN VISCONTI who
moved its adoption:
RESOLVED, that the pay scale for the employees hired by the
Town of Wappinger Highway Department will be in accordance with
the C.S.E.A. Contract, and
BE IT FURTHER RESOLVED, that all of such Highway Department
employees engaged on an hourly basis shall be paid every other Friday
throughout the year 1990, with 26 pay periods during such year
consistent with the pay schedule in accordance with a signed C.S.E.A.
Contract, retroactive to January 1, 1990.

31 RESOLUTION SETTING THE SALARY
FOR THE PART TIME HYDRANT INSPECTOR
The following Resolution was offered by COUNCILMAN VALDATI who moved
its adoption:
RESOLVED, that the hourly rate for Robert Cacio, Part time
Hydrant Inspector, under the supervision of the Highway Department,
be and the same hereby is fixed and established at $5.75 per hour,
to be paid every other Friday throughout the year 1990, with 26
pay periods during such year, with the first payday to be January
5th, 1990.

There was some discussion among the Town Board Members on the next
Resolution which was relative to the pay scale for part time Vandalism
Patrol personnel and it was agreed to table this item.
SUPERVISOR SMITH moved to table the Resolution on the Pay Scale for
the Vandalism Patrol and refer it to the next work shop meeting for
discussion with the involved personnel.

The Supervisor scheduled this matter for the work shop on January
8th, 1990.
RESOLUTION DESIGNATING COURT OFFICERS
FOR TOWN OF WAPPINGER JUSTICE COURT
The following Resolution was offered by SUPERVISOR SMITH who moved
its adoption:
RESOLVED, that all individuals hereinafter designated by the
Town Board as Court Officers as such title is defined by the Uniform
Justice Court Act have all those powers accorded to Court Officers
by Law during such time they are actually serving in such capacity,
and
BE IT FURTHER RESOLVED, that the Town Justices of the Town shall
designate and schedule the days and evenings such individuals shall
serve as Court Officers, and
BE IT FURTHER RESOLVED, that one Court Officer be designated
for each session of Court unless the Town Justices determine that
more than one be designated for any one session, and
BE IT FURTHER RESOLVED, that the Court Officers shall be
compensated at the hourly rate of $7.00 for time actually served, and
BE IT FURTHER RESOLVED, that Armed Court Officers shall be
compensated at the hourly rate of $10.00 for time actually served
at sessions of Court where their services are required, and
BE IT FURTHER RESOLVED, that the Town Justices shall submit
to the Town Comptroller on a weekly basis the names and hours served,
and that the Town Comptroller be empowered to issue remuneration
consistent with the foregoing from funds appropriated for Justice
Court, and

The following Resolution was offered by COUNCILMAN VALDATI who moved
its adoption:
RESOLVED, that the salaries of all persons holding either
full time or part time positions as otherwise fixed for these
designated positions shall be paid to the holders of such offices
and positions payable every other Friday throughout the year 1990,
with 26 pay periods during such year, with the first payday to be
on January 5, 1990, and
BE IT FURTHER RESOLVED, that the Comptroller of the Town of

Mr. Fanuele clarified his Nay vote stating that there could be a
conflict with this appointment since the appointee is a partner of
one of our Town Justices and this has not been cleared up to his
satisfaction. Mr. Incoronato voted Nay for the same reason noting
that it could delay in court cases if it was determined that there
was a conflict. He further noted that Mr. Roberts is the Attorney
for Mr. Lapar who is the the Engineer to the Tri -Municipal Commission.
Mrs. Visconti mentioned that none of the Attorneys to the Town have
practiced in front of the Town Court within the last two years.
Mr. Valdati added that it was pointed out to any applicants for the
Attorney's position that they would have to cease representing clients
within the Town of Wappinger since, if appointed, they would be represent-
ing the Town's interest and this action would avoid any conflict.
Mr. Incoronato asked if they would have this assurance from Mr. Roberts
and was told by the Supervisor that this would be forthcoming in writing
at her request.
The next Resolution related to the appointment of Engineering Services
for the Town.

WHEREAS, it is or it may be to the advantage of the Town to
deposit and/or invest all or part of such funds in special time

or trust companies located and authorized to do business in this

and/or the State of New York, and
WHEREAS, it appears that the Temporary Deposit and /or
investment of such excess and surplus funds may be beneficial and

and acting Supervisor of the Town of Wappinger be and she hereby is
authorized, empowered and directed to deposit and/or invest such

WHEREAS, Subdivision 10 of Section 29 of the Town Law requires
that the Supervisor of each Town prepare and file with the Town Clerk
within 30 days after the expiration of each fiscal year, an annual
financial report accounting for all monies received and disbursed
by her, together with the certificates or certificate of the bank
or trust company where Town monies are deposited, showing the amount
of such monies on deposit with said bank or trust company, and cause
a certified copy of such report to be published in the official
newspaper, and
WHEREAS, in lieu of preparing the report required by Subdivision
10 of Section 29 of Town Law, the Town Board may determine, by
resolution, that the Supervisor shall submit to the Town Clerk within
60 days after the close of the fiscal year, a copy of the report to
the State Comptroller required by Section 30 of the General Municipal
Law and the Town Clerk shall cause a summary of such report to be
published within 10 days after receipt thereof in a form approved by
the State Comptroller in the official newspaper.
NOW, THEREFORE, BE IT RESOLVED, that in lieu of preparing the
report required by Subdivision 10 of Section 29 of the Town Law, the
Supervisor shall submit to the Town Clerk within 60 days after the close

Mrs. Smith noted that the reason she designated the Town Clerk was
that anyone wishing to use the rooms in the Town Hall for meetings,
etc., will be required to make these arrangements with Mrs. Snowden

The next item for the Board to consider was a Resolution to exercise
the Town's right to receive direct payments regarding the County
distribution of a portion of the Sales Tax Revenues.
The following Resolution was offered by COUNCILMAN VALDATI'who moved
its adoption:
WHEREAS, the County of Dutchess increased the County Sales Tax
from 1% to 3%, by resolution adopted by its Legislature on December
11, 1989, and
WHEREAS, the County has agreed to allocate a portion of its
Sales Tax Revenues to the Towns in the County of Dutchess, and
WHEREAS, the County Executive has notified all Town Supervisors
of the Town's right, pursuant to Section 1262 of the Tax Law, to
receive its share of the revenues by direct payment rather than to
have it allocated in reduction of County and Town taxes starting
in 1991, and

WHEREAS, a copy of the resolution of the Town Board exercising
its right of election must be sent to the County Commissioner of
Finance, registered or certified mail, within thirty days of the
enactment of the resolution of the Dutchess County Legislature,
NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the
Town of Wappinger, pursuant to Section 1262(c) of the Tax Law,
hereby elects to receive its share of County Sales Tax Revenues by
direct payment, and
BE IT FURTHER RESOLVED, that the Town Clerk is hereby authorized,
directed and empowered to send a certified copy of this resolution,
registered or certified mail, to M. Philip Amodeo, Dutchess County
Commmissioner of Finance, 22 Market Street, Poughkeepsie, New York,

In regard to the Resolution adopted by the Town Board on November 6th,
1989, on standard workweek hours for all elected and appointed officials
and personnel for the Town, the hours for the Town Justices were
deleted with the intent of reviewing them at a future time. Judge
Francese has communicated with the Town Board indicating that the
Town Justices have logged their -time and have averaged 30 hours per
week for Judge Wolfson and 40 hours for Judge Franchese, based on 51
weeks per year.

WHEREAS, the Town Board had previously established standard
workweek hours for elected and appointed officials and personnel
which excluded the two Town Justices, and
WHEREAS, a review by the Town Justices was requested to
ascertain their average workweek hours for purposes of clarification
for the New York State Retirement System,

it is hereby established that the standard workweek hours for the

Mr. Fanuele brought one more item to the attention of the Board
and suggested, since there are various opinions on which Zoning
Ordinance is in effect, that the Town comply with the Ordinance they
have been using prior to the Public Hearing on the Amendments to the
Zoning Ordinance. Mrs. Smith agreed noting that the ramifications
of these varied opinions has caused much confusion in the Building
as
and Zoning Departments and with our residents.
MR. FANUELE moved that the Town operate under the old Zoning Ordinance
until legality is determined on approval or disapproval of the
Amendments to the Zoning Ordinance.

In voting Aye, Mr. Incoronato stated that although he had gone on
record as supporting the zoning changes, he also recognized that
there are legal liabilities in perhaps misrepresenting the status of
the old Ordinance until a further legal ruling on the validity of the
Zoning Ordinance revisions is submitted and accepted by this Board.
Mr. Valdati asked the Town Clerk if she knew who initiated the
publication of the purportedly adopted Zoning Ordinance Amendments.
Mrs. Snowden had no idea who had submitted it and authorized its
publication, but noted that under normal circumstances when Ordinances
are adopted, the Town Clerk puts in the publication with her certiifca-
tion that the Board has adopted it. She further stated that she did
not submit this to the Southern Dutchess News for publication.
Mr. Valdati asked the media to make note of this discussion and
print it clearly so the residents and all concerned are aware of it
and a state of turmoil will be avoided.
Mrs. Smith recognized Sandra Goldberg, Wappinger County Legislature,
who wished the new Town Board the best of luck in their service to
the Town. She mentioned that the previous Board had received a
Draft E.I.S. regarding obstruction removal at the Airport. Since
this involves cooperation from the Town on zoning regulations, she
made note of the fact that the County will be acting on this in a
few months; there will be a public informational meeting for Town
of Wappinger residents and those in LaGrange and Poughkeepsie who
are affected by this, in order to present the environmental study
to them so they are aware of its contents ahead of time and can
comment or ask questions at the Public Hearing. The purpose is to
find permanent solutions to obstruction removal without permanent
easements and the E.I.S. does do that. The Town has been asked to
respond to the County by early February on any comments they may
want to make at this stage. The Town Clerk advised Mrs. Goldberg
that the Town had not, at this point, received a copy of the E.I.S.
and was told to call the Clerk to the County Legislature who would
supply us with the document. Mrs. Goldberg mentioned the date of
January 30, 1990 for this meeting, however, no location has been
designated as yet.
Don McMillen, Wappinger County Legislature welcomed the new Board,
stating that he looked forward to working with them. They would all
work with the Board and invited them to bring any Town problems to
the Wappinger representatives on the Legislature.
Bernice Mills was recognized by the Chair and noted that it was her
understanding that Mr. Incoronato was the Town Liason to the Dutchess
County Airport and, if this was so, she objected, since he did not
live near the Airport and could not know the problems. Mrs. Smith
explained that the Board Members are all on jobs during the day, but
Mr. Incoronato said he could attend day time meetings which is when
they are set. When it was learned that there are only four meetings
each year, Mr. Fanuele, who lives in close proximity to the Airport,
said he would share this responsibility with Mr. Incoronato. As a
result, Mrs. Smith appointed both Mr. Incoronato and Mr. Fanuele as
Liasons to the Airport,
The Supervisor thanked all for coming to the meeting, announced that
there would be a work shop on January 8th and the Regular Monthly
Meeting on January 22nd, and invited them to attend.
MR. INCORONATO moved to close the Reorganizational Meeting, seconded
by Mrs. Visconti and unanimously carried.
