The Regular Meeting of the Town Board of the Town of Wappinger was held on November 6, 1989, at the Town Hall, 20 Middlebush Road, Town of Wappinger, Dutchess County, New YOrk. Supervisor Paino opened the Meeting at 7:40 P.M. Present: Irene Paino, Supervisor Vincent Farina, Councilman David Reis, Councilman Constance Smith, Councilwoman Robert Valdati, Councilman Elaine H. Snowden, Town Clerk Those present joined in the Pledge of Allegiance to the Flag followed by a moment of silent prayer for the Town and its residents. The Minutes of the Regular Meeting of October 2, 1989 and the Special Meetings of October 12th, 16th, 23rd and 30th, 1989, having previously been forwarded to the Town Board, were placed before them for their consideration. MRS. SMITH moved that the above stated Minutes be and they are hereby approved as submitted by the Town Clerk. Seconded by Mr. Valdati Motion Unanimously Carried 224 Reports were received from the Town Justices for September and October, Building Inspector for September and October and Receiver of Taxes for August, Hydrant Report for October and Supervisors/Comptroller. MR. VALDATI moved to accept the above stated Reports and place them on file. Seconded by Mrs. Smith Motion Unanimously Carried Mr. Valdati noted that the Dog Control Officer's Report was again not in evidence. Since there were residents still present from Valley Road, Mrs. Paino suggested that the Board act on the Local Law Regulating Traffic on that road so they would not have to sit through the meeting. A Public Hearing having been held on a proposed Local Law Regulating Traffic Within the Town of Wappinger on Valley Road With Its Intersection With Hiview Road, by the Town Board on November 6, 1989, the matter was placed before them for their consideration. The Engineer had recommended that instead of two Stop Signs being 225 placed as requested by the residents, that one Yield Sign and one Stop Sign be installed. At the Public Hearing when this was brought forth, the residents were not pleased and were persistant in their effort to have the Stop Signs placed as they felt it should be. There was also the matter of warnings of the approaching signs and they disagreed with the Engineer on site distance. It was agreed that the Engineer would recheck the site and meet with the residents on this matter. This would not affect the language of the Local Law. Mrs. Smith requested that the Attorney submit a written statement as to liability on the part of the Town. SUPERVISOR PAINO moved to adopt Local Law #9 of 1989, as follows: A LOCAL LAW REGULATING.TRAFFIC, WITHIN THE TOWN OF WAPPINGER VALLEY ROAD WITH ITS INTERSECTION ' WITH HIVIEW ROAD ', Section 1. Legislative Intent In order to protect the health, welfare and safety of the public travelling on the roads in the Town of Wappinger, the Town Board deems it to be in the best interests of all of the residents of the Town of Wappinger that certain traffic control devices be established at the intersection of Valley Road in the Town of Wappinger with its inter- section with Hiview Road. Section 2. Traffic Control All of the vehicles travelling on Valley Road entering in the intersection with Hiview Road shall yield the right-of-way to all oncoming traffic. All vehicles travelling southerly on Hiview Road shall yield to oncoming traffic at its intersection with Valley Road. All traffic travelling on Hiview Road in the northerly direction shall come to a complete and full stop at its intersection with Valley Road. Section 3. Signs The Highway Superintendent of the Town of Wappinger be and hereby is authorized and directed to erect the aforementioned Stop and Yield Signs at the appropriate places and in conformance with all regulations and all governing agencies. Section 4. Penalties for Offenses Any vehicle failing to observe the aforementioned traffic control devices described above, shall be subject to prosecution of a violation of this Local Law and shall be punished by a fine not to exceed $100.00 A violation of this Local Law shall be deemed to be a traffic infraction and shall have all other and additional penalties as prescribed by the Vehicle and Traffic Law of the State of New York. Section 5. Effective This Local Law shall become effective upon the filing with the Secretary of the STate of New York. Seconded by: Councilman Valdati Roll Call Vote: 5 Ayes 0 Nays Petitions & Communications --- 226 A request was received from the Hughsonville Fire District for the use of one of the Town's voting machines for their Annual Election on December 12, 1989 from 6 P.M. to 9 P.M. MR. FARINA moved to allow the Hughsonville Fire District to use one of the Town's voting machines as they have done previously. Seconded by Mr. Valdati Motion Unanimously Carried A resignation was received from Richard Cirulli, Member and Chairman of the Architectural Board of Review due to personal, health and pressing business reasons. MR. FARINA moved to accept Mr. Cirulli's resignation with regret and send him a letter of thanks for his dedication and work for the Town. Seconded by Mr. Valdati Motion Unanimously Carried A resignation was also received from Dennis Lasowski from his position as Comptroller to the Town, effective as of October 27th, 1989. MRS. SMITH moved to accept Mr. Lasowski's resignation. Seconded by Mrs. Paino Motion Unanimously Carried Elizabeth Finger wrote to the Board regarding the placement of a Stop Sign at the westbound intersection of Smithtown Road with Cooper Road. She felt the sign should be on Cooper Road, not Smithtown Road and added that she felt unsafe at the intersection. MRS. PAINO moved to refer this matter to the Engineer and the Highway Superintendent for their review and recommendation. Seconded by Mr. Reis Motion Unanimously Carried Correspondence was received from Peter Marlow, Senior Public Health Engineer of the Dutchess County Department of Health regarding untreated sewage entering the bottom floors of a number of homes located on Patti Place and he has requested a meeting with the Town on this situation. The Engineer plans to meet with Mr. Marlow first to discuss ways to alleviate the problem. Several residents have been affected by this and one has submitted a bill to the Town for expenses incurred for the cleanup. After the Town Board has reviewed the bills, s 227 they will discuss it at a work shop, followed by a Special Meeting to vote on the items to be reimbursed to the resident. Mr. Paggi reviewed the incident as related to him by Mike Tremper of Camo Pollution and they think they have reached a conceptual type solution to the problem. A field meeting will be set up with Pete Marlow and Dave Ruff to discuss it before they prepare a detailed design of a temporary solution of the problem. With the implementation of P,pse I of the Wappinger Sewer Transmission, Mr. Paggi noted that the Board should keep in mind, that the bulk of the flow will be removed and will go straight down Myers Corners Road rather than Robert Lane. At that time the only flow those residents will be getting will be from that development. Correspondence was also received from the Water and Sewer Billing Clerk and Camo Pollution Control relative to this situation. A request was received from Mr. Levenson to attend the Hazardous Material Course #1, State Code Course on November 2, 1989 at New Windsor, New York. MRS. SMITH moved to grant permission to Mr. Levenson to attend the course, as requested and his legitimate expenses will be a Town charge. Seconded by Mr. Valdati Motion Unanimously Carried Notice to Involved Agencies was received from the Tri -Municipal Sewer Commission regarding their designation as lead agency in the Phase I Agreement to treat 1,000,000 GPD of Wastewater from the Town of Wappinger. MR. VALDATI moved that the Town Board consent to the Tri -Municipal Sewer Commission being designated Lead Agency in this action. Seconded by Mrs. Smith Motion Unanimously Carried The Supervisor requested that a letter be forwarded to the Commission indicating that they have the endorsement of the Town Board of the Town of Wappinger in their lead agency status. Several reports were received from the Engineer to the Town, Mr. Paggi; the first referenced the proposed Wappinger Park Water District. He requested a work shop to discuss tying in the well from Hark Plaza No. 3 into the Wappinger Park System. The work shop would be held after the budget work shops were completed. 228 The second one related to a drainage problem on New Hackensack Road in the Cedar Knolls area. One of the residents in that private development had called him and he made a field inspection of the drainage problem existing on this property. It does not involve Town road runoff and he informed the residents that the Town would not authorize expenditures to help solve the problem. It could however, involve liability on the part of the County since the runoff was from New Hackensack Road, a County Road. With this in mind, Mr. Paggi offered to have the Town act as an intermediary between the residents and the County and perhaps they could help the situation and hold meetings together to discuss different avenues they could pursue to correct the problem. Mrs. Paino requested that a letter be forwarded to Joseph Grogan, Dutchess County Department of Public Works, as recommended by Mr. Pagggi, asking that they make a field inspection of this area with the Engineer to the Town, who will then report their findings and recommendations to the Board. The third report referenced the New York State Revolving Loan Fund, Wappinger Sewer Transmission District. Mr. Paggi explained that Mrs. Paino was contacted by the D.E.C. about 2i years ago from what was then the Grants Program which is now the Revolving Loan Fund. At that time Mrs. Paino send in the necessary papers to be eligible to be put on the list for funding. The final list came out last week and Phase I & II of the project was ranked 10 or 11 out of 150 so we are ranked high in the Revolving Loan Fund Program. He and the Attorney to the Town are going through calculations to see if it will be beneficial for the residents of the Town if they participate in this program. Once they have determined this they will complete a draft application and submit it to the Town Board for their review. They should have this application ready within the next ten days. Mr. Paggi reported on a drainage complaint he investigated at the Lutri Residence at 143 All Angels Hill Road. As a result of this inspection he recommended that the owner fill in the low area near the southeasterly corner of the house so as to direct storm drainage away from the house; direct the water from the storm leader away from the house. MRS. PAINO moved to accept the report and place it on file. Seconded by Mrs. Smith Motion Unanimously Carried 229 The last report was a progress report on the Wappinger Sewer Transmission District which Mr. Paggi indicated they had previously been authorized to prepare the necessary plans and specifications for Phase I. They are finalizing these plan for submittal to D.E.C. and the schedule indicates at this time that it will be Friday, November 17,1989. A request was received from the Immanuel Christian Reformed Church that the Town waive the building permit fee for their new sanctuary. MRS. PAINO moved to waive the building permit fee on the Immanuel Christian Reformed Church. Seconded by Mr. Reis Roll Call Vote: 4 Ayes Mr. Farina ---Abstained (Member of Congregation) A letter was received from John & Catherine Gordon regarding assistance with a water problem created by a new dwelling next door to them on Widmer Road. They claim they have received no response or help in solving this problem since they first contacted the Town over four months ago. Mrs. Paino noted that she had received two calls from Mrs. Gordon and immediately contacted Mr. Paggi who checked out the problem. Mr. Paggi spoke to the Highway Superintendent about placing a blacktop burr across the driveway where it intercepts the Town road to stop the flow from the Town road going down into their driveway; he agreed to put it on his list of things to do so it might even be done by now. Mrs. Paino requested the Town Clerk to write to the Gordons' indicating that the work will be done by the Highway Superintendent before the winter season sets in. Another drainage problem was brought to the attention of the Board by George Carlquist at 83 DeGarmo Hills Road. Mrs. Smith commented that she, Jay Paggi and Herb Levenson had gone out there some time ago and she speaks to Mr. Carlquist every singe payday at the County in the room where they get their checks. He was told what to do to alleviate the situation and in his letter it would seem that noone was responding to his dilemma. Mr. Paggi pointed out that if the problem is being caused by runoff from Town Roads, it was the Town's respon- sibility, and it appeared that it was. It was suggested that Mr. Paggi take another look at the situation and perhaps determine what can be done. 230 Committee Reports --- Mr. Valdati spoke of the one-way sign on Old Troy Road which is hidden by shrubbery and asked that the Highway Superintendent place the sign so that it is more obvious and remove some of the foliage; also in the same area, signs indicating the 30 MPH speed limit are not in evidence and he asked that additional signs indicating the speed limit be placed on the road. Mr. Reis had no reports for this meeting. Mr. Farina, Ordinance Committee reported that the Zoning Administrator wishes to remind the residents that the Snow Ordinance is now in effect and vehicles are not to be parked on the roads from November 1st 1989 thru April 1st, 1990. The Town Patrol will be enforcing the Ordinance. Mr. Farina, Cable, reminded residents that effective January 1st, 1990, syndication rules go into effect which will force the company to block out programming which means that if the program appears on two different stations, the station of origination if it is in your zone is the station where it can be seen and the other station will be blacked out. Mrs. Smith had no reports for this meeting. Resolutions --- The consideration of a two year contract for Raymond Arnold, Town Planner was placed before the Board. Mr. Valdati moved to extend Mr. Arnold's contract for two years, however when Mr. Farina voted he felt it should be up to the new Town Board to vote on it when they take office. Mr. Valdati amended his motion to agree. MR. VALDATI moved to defer consideration of a two year contract for the Town Planner to the new Town Board. Seconded by Mrs. Smith Motion Unanimously Carried An application for a Peddler's License was received from Joseph Conrad to sell hot dogs and other foods. There was no action taken by the Town Board on this application. A request was received from Keith Gordon for the return of his Passbook held in escrow for site preparation; a recommendation was received from the Zoning Administrator to return the Passbook as the work was done to his satisfaction. 231 Mr. Levenson wrote to the Board recommending that a fee of $35.00 be returned to Nicholas Benfaremo for a variance. MR. REIS moved to return $35.00 to Mr. Benfaremo for a variance fee, at the recommendation of the Zoning Administrator. Seconded by Mrs. Smith Motion Unanimously Carried Mr. Louis Balducci requested the return of $500 escrow for site work and recommendations to return this money were received from the Building Inspector and Zoning Administrator. MR. VALDATI moved that based on the recommendations of the Building Inspector and Zoning Administrator the sum of $500 escrow be returned to Mr. Balducci. Seconded by Mrs. Smith Motion Unanimously Carried James Klein requested the return of $250 each in escrow deposits for Lot #56 Nicole Drive and Lot #4 Robin Lane. MR. REIS moved to return the escrow deposits of $250 each for the Lots, as requested by Mr. Klein and recommended by the Highway Superintendent. Seconded by Mr. Valdati Motion Unanimously Carried A vacancy existed on the Board of Assessment Review due to the expiration of Raymond Belding's term. It was tabled at the last meeting so the Town Board could contact him to determine if he was interested in being reappointed. Mrs. Smith reported that she had spoken to him and he would like to remain on this Board. The following Resolution was offered by COUNCILWOMAN SMITH who moved its adoption: RESOLVED, that Raymond Belding be reappointed as a member of the Town of Wappinger Board of Assessment Review to fill the vacancy that has been created due to the expiration of his term, and BE IT FURTHER RESOLVED, that the term of said Raymond Belding will be for five years, expiring in September, 1994. Seconded by::: Councilman Farina Roll Call Vote: 5 Ayes 0 Nays 232 The following Resolution was offered by COUNCILMAN VALDATI who moved its adoption: RESOLVED, that all delinquent water and sewer bills in arrears as of November 17th, 1989 in: Oakwood Water District, Central Wappinger Water Improvement Area, Fleetwood Water District, Tall Trees Water Improvement Area, Ardmore Water Improvement Area, Watch Hill Water Improvement Area, Wappinger Park Water, Wappinger Sewer Improvement Area #1, Wildwood Sewer District, Rockingham Farms Sewer District, Fleetwood Sewer District, Mid -Point Sewer District and Watch Hill Sewer District, in the Town of Wappinger, be forwarded to the County of Dutchess to be placed on the Tax Rolls of 1990. A list of all delinquent charges will be forwarded to the County on November 22nd, 1989. Seconded by: Councilman Farina Roll Call Vote: 5 Ayes 0 Nays Although two Public Hearings were held on certain revisions to the Zoning Ordinance and Map, after hearing the comments of the public, the Board further amended the Ordinance and were ready to set a Public Hearing on these Amendments. SUPERVISOR PAINO moved to reintroduce the Amendments to the Zoning Ordinance and Map as follows: (Attached hereto and made part thereof of the Minutes of this Hearing). SUPERVISOR PAINO moved the folloNWing*Resolution: 'WHEREAS, in December of 1988, the Town -Board assumed Lead Agency status with respect to its consideration of proposed amendments to the Zoning Ordinance of the Town of Wappinger, and WHEREAS, on two prior occasions the Town Board has held two Public Hearings at which Public Hearing input was solicited with respect to the proposed revisions to the Zoning Map of the Town of Wappinger, and the Zoning Ordinance of the Town of Wappinger, and WHEREAS, following these two prior Public Hearings, the Town Growth management Committee has considered the comments received and based upon those comments have made further revisions to the proposed Map and Amendments to the Zoning Ordinance as well as prepared additional information with respect to the Environmental Assessment Form prepared and filed pursuant to SEQR for this project, and WHEREAS, the Town Board has once again revised the Zoning Map and the proposed Amendments to the Zoning text, and is now desirous of setting a Public Hearing to consider both the proposed Amendments as well as the Environmental Assessment Form and all the environmental information that has been compiled, NOW THEREFORE, BE IT RESOLVED that the Town Board does hereby introduce the annexed Amendments for consideration with respect to amending the Zoning Ordinance of the Town of Wappinger and the Zoning Map of the Town of Wappinger, and BE IT FURTHER RESOLVED that the Town Board shall conduct a Public Hearing to consider said proposed Amendments on the 14th day of December 1989 at 7:30 P.M. Said Public Hearing to be held at Roy C. Ketcham High School Auditorium, Myers Corners Road, Wappingers Falls, New York, and 233 BE IT FURTHER RESOLVED that the Town Clerk shall publish Notice of said Public Hearing by using the Notice annexed hereto and made a part thereof and BE IT FURTHER RESOLVED that the Town Clerk shall forthwith transmit the entire proposed Map and text amendments to Dutchess County pursuant to the General Municipal Law, and BE IT FURTHER RESOLVED that the Town Clerk shall forward a copy of said Map and Amendments to the Clerks of the adjacent municipalities and BE IT FURTHER RESOLVED that the Town Board shall also accept comments at said Public Hearing from the public with respect to the Environmental Assessment Form and all supplemental memo- randas with respect to SEQR so that the Town Board will then be in a position to make a determination of significance pursuant to the Environmental Conservation Law. Seconded by: Councilman Reis Roll Call Vote: 3 Ayes Mrs. Smith ---Nay Mr. Valdati---Nay Mr. Valdati originally voted in favor of the resolution, however, he later stated that he would rather defer this to the new Board since they will work with it and he changed his vote to a "Nay" one. At the last meeting the Assessor was directed to complete the Benefit Assessment Rolls for the Water and Sewer Districts and Improvement Areas; the next step is for the Town Board to set the dates and times for the Public Hearings. MRS. PAINO moved to set the Public Hearings on the Benefit Assessment Rolls for the following Water and Sewer Districts and Improvement Areas on November 20, 1989 starting at 7:30 P.M. and continuing at two minute intervals until completed: Central Wappinger Water Improvement Area, Oakwood Water District, Fleetwood Water District, Tall Trees Water Improvement Area, Ardmore Water Improvement Area, North Wappinger Water District, Cranberry Water Improvement Area, Myers Corners II Water District, Wappinger Park Water District, Wappinger Sewer Improvement Area #1, Rockingham Farms Sewer District, Fleetwood Sewer District, Wildwood Sewer District and Mid -Point Sewer District. Seconded by Mr. Reis Motion Unanimously Carried Unfinished Business --- At the last meeting the Board received a request from Mr. Holt, Chairman of the Recreation Commission to expend funds from the Schlathaus Fund to redo the well and septic system on that property. It was referred to the Engineer for his review and recommendation. Mr. Paggi had not completed his research on this 234 project and the matter was tabled pending the Engineer's report. At a previous meeting the Town Board granted permission to Wayne Barringer to hook into the Rockingham Farms Sewer District as a tenant, subject to the Dutchess County Department of Health approval. This was allowed due to a breakdown of Mr. Barringer's septic system, causing extreme hardship. Correspondence has since been received from Peter Marlow of the Health Department approving the connection to the Rockingham Farms Sewer District for Mr. Barringer's residence. MRS. PAINO moved to accept the correspondence from the County Health Department and place it on file. Seconded by Mr. Valdati Motion Unanimously Carried A response was received from the D.O.T. regarding a complaint we registered on a drainage problem at the intersection of Route 9 and Old Hopewell Road. The catch basin was cleaned and repaired and the area was paved with asphalt; they felt this should alleviate the ponding water by allowing a more direct flow into the drainage system. In regard to the problem at Old Route 9 and County Road 93 intersection the County anticipates building a new catch basin to take care of that drainage problem although it might not be until next Spring or later. In areas such as these, Mr. Valdati suggested that the Highway Department be extra vigilant and perhaps place warning signs when there are icy conditions. MR. VALDATI moved to accept the correspondence and place it on file. Seconded by Mr. Reis Motion Unanimously Carried Correspondence was received from William Vrooman regarding the drainage problem regarding drainage problems on All Angels Hill Road which also involed the Perkins property. He asked that we forward him a copy of the recommendations made by Mr. Paggi in regard to the pond on Perkins' property so he can check the spillway when he is in that area. Mr. Paggi said he would take care of Mr. Vrooman's request. Mr. and Mrs. Perkins wrote to thank the Town Board for giving Mr. Paggi the okay to check into the problem and his recommendations to solve it. MR. FARINA moved to accept the correspondence and place it on file. Seconded by Mrs. Smith Motion Unanimously Carried 235 During a work shop last week, Mrs. Paino reported that they met with some of the residents on Ketchamtown Road and the Engineer to the Town to discuss the problem with the road during heavy rains. Last weekend the Highway Department had to place heavy barrels on the road to relieve the situation; it is an extremely dangerous condition and the barrels are a temporary relief and even at that do not accomplish too much. Mr. Paggi has recommended to the Board that they do emergency repairs to the road or else they will have no alternative but to close it off. It is his estimation that the maximum amount to be expended will be $19,000.00. SUPERVISOR PAINO moved the following resolution: RESOLVED that $20,000.00 be moved from Highway Contingency 1990.50 to Highway Repairs 5110.40 for emergency repairs to Ketchamtown Road. Seconded by: Councilman Reis Roll Call Vote: 5 Ayes 0 Nays Mr. Paggi asked that a temporary permit to discharge be written by the Town and offered to Jerome Cauda for his signature. MRS. PAINO moved with Mr. Cauda's Seconded by Mrs. to authorize the Attorney to the Town to confer Attorney and prepare the necessary documents. Smith Motion Unanimously Carried A Resolution setting standard workweek hours for all elected & appointed officials and personnel in the Town of Wappinger was again set before the Board since the New York State Retirement System has requested further clarification. Mrs. Smith reported that the Town Justices were not happy with the work hours listed for them and asked to table it until they could have these hours reviewed. In actuality the Justices put in more hours than is reflected in the proposed Resolution and it could make a difference in the retirement amount they are entitled to. Mrs. Smith moved to table the Resolution pending further review of the Town Justices' hours, it was seconded by Mrs. Paino and unanimously carried. The Attorney, however, noted that the Board hours for everyone, excluding the Town Justices since could set the the Retirement System evidently expected fast action on clarification of the one we sent and are anticipating the revised one momentarily. original 236 If the logs of the Town Justices show that they are putting in more hours, they will receive additional credit for them and he will be able to get additional information from the Retirement System pertaining to this credit; with respect to the regular full time people, the System was threatening in their correspondence to suspend crediting any personnel, if the seven hour day and six hour day was not adjusted. Mrs. Smith withdrew her motion to table the Resolution. MRS. SMITH moved to approve the following Resolution, deleting the Town Justices hours with the intent to review them at a future time: WHEREAS, the Town Board did, at their meeting of September 18, 1989, adopt a Resolution setting forth the standard workweek hours for all elected and appointed officials and personnel in the Town of Wappinger, and WHEREAS, the New York State Retirement System has requested further clarification with respect to those hours, and WHEREAS, the Town Board has deemed it necessary to make minor adjustments with respect to the number of hours worked, NOW THEREFORE, BE IT RESOLVED that the following is the standard work week hours for the following elected and appointed officials and personnel of the Town of Wappinger: Highway Superintendent 35 hours Deputy Highway Superintendent 35 hours Supervisor 35 hours Council Members (4) 24 hours (each-) Town Clerk 35 hours Assessor 35 hours Comptroller 35 hours F/T Secretarial 35 hours F/T Clerical 35 hours P/T Secretarial 17ihours P/T Clerical 171hours AND BE IT FURTHER RESOLVED that for all employees who work 35 hours per week, a standard work day is hereby deemed to be a 7 hour day, and BE IT FURTHER RESOLVED that all employees who work less than 35 hours per week, the standard work day shall be a 6 hour day, and BE IT FURTHER RESOLVED that the Town Clerk shall forward a certified copy of this Resolution to the New York State Retirement System in Albany, New York. Seconded by Mrs. Paino Motion Unanimously Carried It was brought to the attention of Mrs. Paino by the Senior Citizen Director, Nancy Donahue that the Wappinger Central School District has 237 a piano they would like to donate to the Town of Wappinger Senior Citizen Center, however in order to do so, the Town must formally request this. MRS. PAINO moved to send a letter to the Wappinger Central School District indicating that the Town Board is aware of the fact that they have a piano to donate and they are formally requesting that this piano be donated to the Town of Wappinger Senior Citizen Center at the Town Hall where it would be put to good use and appreciated. Seconded by Mr. Reis Motion Unanimously Carried Mrs. Paino noted that she had received a letter from the St. Simeon Foundation relating to an application for a HUD grant for additional construction of affordable senior citizen housing units. Last year this Town forwarded a letter of support to the Town of Poughkeepsie for the same project and they were looking again for our support. MRS. PAINO moved to forward a letter to the Town of Poughkeepsie Town Board indicating that the St. Simeon Foundation has the supoort of the Town of Wappinger in their pursuit of additional HUD grants for the purpose of constructing additional affordable housing units. Seconded by Mrs. Smith Motion Unanimously Carried MRS. PAINO moved to set a Special Meeting on December 14, 1989 at 8 P.M. at the Roy C. Ketcham High School Auditorium for the purpose of consideration of the adoption of the Zoning Ordinance Amendments. Seconded by Mr. Farina Roll Call Vote: 3 Ayes Mrs. Smith ---Nay Mr. Farina ---Nay Motion Carried Mrs. Smith brought up a previous complaint on a drainage problem at the property of Fred Zaith, 14 Partners Road. Mr. Paggi had evidently inspected the site back in June but nothing has been done and he has since sent another letter asking for assistance with the problem. Mr. Wood said he had been in touch with one of the men in Mr. Paggi's office who was working on acquiring easements necessary to do this work. Once that is accomplished, the Highway Department can do this work. Mr. Levenson, Zoning Administrator asked the Board to authorize him to set up Drug Free Zones in the schools in the Town of Wappinger. 238 MR. VALDATI moved to authorize the Zoning Administrator to set up Drug Free Zones in the Schools located in the Town of Wappinger, in conjunction with the Attorney to the Town. Snowden Town Clerk A A Public Hearing was held by the Town Board of the Town of Wappinger on November 6th, 1989 at the Town Hall, 20 Middlebush Road, Town of Wappinger, Dutchess County, New York, on a proposed Local Law Regulating Traffic Within the Town of Wappinger on Valley Road With its Inter- section with Hiview Road. Supervisor Paino opened the Hearing at 7:17 P.M. Present: Irene Paino, Supervisor Vincent Farina, Councilman David Reis, Councilman Constance Smith, Councilwoman Robert Valdati, Councilman Elaine H. Snowden, Town Clerk Others Present: Thomas Wood, Attorney Joseph E. Paggi, Jr., Engineer Herbert Levenson, Zoning Administrator The Town Clerk offered for the record the Affidavits of Posting and Publication, duly signed and notarized. (These Affidavits are attached hereto and made part thereof of the Minutes of this Hearing). Mrs. Paino explained that consideration of this Law was prompted by a request from the residents of that area with suggestions mapped out on locations for Stop Signs. The Engineer inspected the site and reported his recommendations to the Town Board. Mr. Paggi was present and explained the location of the Yield Signs and the Stop Signs and his reason for this particular setup. There were questions from the residents as to why a Stop Sign in one direction but not the opposite direction; he explained that there was not enough site distance. The resident disagreed with this and used the Stop Sign located on Kent Road and Lake Oniad Drive as an example, noting that there was not enough site distance at that point but they had installed a Stop Sign. This discussion continued along the same vein but the Engineer could not convince this resident (name not given) that the provisions for the signs in this Local Law were the proper ones. It appeared that the concern was that the triangle was the location for the school bus stop and it needed a Stop Sign, rather than a Yield Sign; the residents also asked about a lower speed limit, perhaps 20 MPH, however they were told that the County and State set this and it is never lower than 30 MPH no matter how many petitions they have. Other residents, also unnamed, uttered identical concerns that they wanted a Stop Sign rather than a Yield Sign. The Engineer voiced his concern, however since these residents were not happy with the regulations in the Law, maybe there was another alternative, perhaps the school transportation would recommend a solution. Mrs. Paino announced that consideration of this proposed Local Law was on the Agenda of the meeting following this hearing and they could discuss it at that time. MR.
