ADJOURNMENT 199 The Regular Meeting of the Town Board of the Town of Wappinger was held on October 2, 1989, at the Town Hall, 20 Middlebush Road, Town of Wappinger, Dutchess County, New York. Supervisor Paino opened the Meeting at 7:35 P.M. Present: Irene Paino, Supervisor Constance Smith, Councilwoman Robert Valdati, Councilman Elaine H. Snowden, Town Clerk Absent: Vincent Farina, Councilman David Reis, Councilman Others Present: Thomas Wood, Attorney Joseph E. Paggi, Jr., Engineer All joined in the Pledge of Allegiance to the Flag followed by a moment of silent prayer for the Town and its residents. Mrs. Paino welcomed students from Roy C. Ketcham High School who were attending the meeting to learn the procedure of Town business. She offered her assistance to them after the meeting if they had any questions. The Minutes of the Special Meeting of September 7, 1989 and the Regular Meeting of September 18, 1989, having previously been forwarded to the Board Members, were now placed before them for their consideration. MR. VALDATI moved that the above stated Minutes be and they are hereby approved, as submitted by the Town Clerk. Seconded by Mrs. Smith Motion Unanimously Carried The Town Clerk informed the Board that she had received the Tentative Budget of 1990 this day and was now presenting it to the Town Board from the Budget Officer. Mrs. Paino informed those present that the Tentative Budget reflects a decrease in taxes for residents outside of the Village of Wappingers Falls of 9%, and for those residents within the Village the decrease at this point will be 10%. These are figures submitted by the Town Assessor, Mr. Logan and it is hoped that there will be further deductions. The Hydrant Report was received for the month of September. MRS. SMITH moved to accept this report and place it on file. Seconded by Mr. Valdati Motion Unanimously Carried 200 Mr. Valdati asked about a schedule for a work shop discussion on the matter of the Dog Control Officer's Reports and Mrs. Paino replied that she planned to do this during the budget work shops. Petitions & Communications --- A Notice of Intent to renew a liquor license was received from Jerome Gold, Attorney for La Fonda Del Sol Restaurant, located on Old Route 9 and Old Hopewell Road. MR. VALDATI moved to accept the Notice and place it on file with no comments. Seconded by Mrs. Smith Motion Unanimously Carried The Town of Poughkeepsie forwarded Notice of Public Hearing on an Amendment to the Zoning Ordinance on October 18,1989. MR. VALDATI moved to accept the Notice of Public Hearing and place it on file. Seconded by Mrs. Smith Motion Unanimously Carried An application for a Peddler's License was received from Laura Goldstein for the purpose of selling food. MRS. SMITH moved to approve the application and grant the license. Seconded by Mr. Valdati Motion Unanimously Carried A request was received from Mr. Classey, Building Inspector, to attend a six hour Seminar which will be credited towards the mandatory 24 hours in service required by the State. He also informed the Board that there was no cost involved. MRS. SMITH moved to grant permission to Mr. Classey to attend the six hour Seminar on November 28, 1989 at the New Windsor Fire Department. Seconded by Mr. Valdati Motion Unanimously Carried Mr. Croshier wrote to the Board requesting clarification and direction regarding Local Law #3 of 1989 which prohibits parking along the most southerly, easterly and northerly outer perimeter of Regency Drive. He was under the impression that this directive pertained to Saturday only between 9 A.M. and 4 P.M. during the summer months. The Engineer had previously discussed this with the Highway Superintendent and it was his understanding that there was a period of the year and a period 201 of the day involved in the No Parking restriction and obviously it was not included in this law. MRS. PAINO moved to direct the Attorney to amend the Local Law to reflect the correct language, as indicated by the Engineer and forward to Town Board and Highway Superintendent for consideration. Seconded by Mr. Valdati Motion Unanimously Carried If the amended Local Law was agreeable to the Highway Superintendent, the Town Board would introduce it at the next meeting and set a Public Hearing. Correspondence was received from Ralph Holt, Chairman of the Recreation Commission requesting funds from the Schlathaus Fund to redo the well septic system on the Schlathaus property; he indicated that they had received two estimates, $6,000 for the well and $3,000 to $3,5000 to do the septic. It was his intent to do the septic work this year, subject to Town Board approval. MRS. PAINO moved to refer this matter to the Engineer for his review and recommendation to the Town Board at the November 6, 1989 meeting. Seconded by Mr. Valdati Motion Unanimously Carried Mr. Logan wrote to the Board requesting permission to attend the New York State Assessor's Conference from October 10th to 13th, 1989 for continuing Education and Recertification. MRS. SMITH moved to grant permission to Mr. Logan to attend the Conference, as requested, and all legitimate expenses would be a Town charge. Seconded by Mr. Valdati Motion Unanimously Carried Committee Reports --- Mr. Valdati, reported on another bad road condition on the southeast corner of Route 9 and Old Hopewell Road due to poor runoff during heavy rains which creates a hazardous situation. The Engineer noted that there was a drain in that area and possibly it was clogged; he recommended that they notify the State Department of Transportation. Mr. Valdati referred to another bad road condition at Old Route 9 and Middlebush Road which has previously been reported to the Dutchess County Department of Public Works; they responded and did some work at 4 202 that location, however, he felt it needs further attention to eliminate the existing hazard. MR. VALDATI moved to refer the two unsafe road conditions to the proper agencies for their attention and correction of same. Seconded by Mrs. Smith Motion Unanimously Carried Mrs. Smith, Personnel, reported that it had been brought to her attention that one of the part time employees has been given a raise of 50 an hour as of May. The Supervisor said this would be discussed at work shop. Gordon Hirt, Wappinger County Legislator, reported that this Wednesday and Thursday, starting at 3:00 P.M., the Legislature will be holding committee meetings on various issues including recycling. The session for voting on these issues will be the following Monday starting at 4:00 P.M. Resolutions --- A request was received from Jerome Ivy for the return of his driveway escrow in the amount of $250.00. The required correspondence was received and the Building Inspector recommended release of the escrow as the required improvement were satisfactorily completed. MRS. SMITH moved to release the driveway escrow deposit in the amount of $250.00 to Mr. Ivy, as recommended by the Building Inspector. Seconded by Mr. Valdati Motion Unanimously Carried Notice was received from the New Hackensack Fire District of the appointment of George Budd as a member of the Town Fire Prevention Bureau. MRS. SMITH moved to confirm the appointment of George Budd as a member of the Town of Wappinger Fire Prevention Bureau from the New Hackensack Fire District. Seconded by Mr. Valdati Motion Unanimously Carried 203 RESOLUTION DIRECTING ASSESSOR TO COMPLETE ASSESSMENT ROLL FOR CENTRAL WAPPINGER WATER IMPROVEMENT AREA The following resolution was offered by SUPERVISOR PAINO who moved its adoption: The Town Assessor is hereby authorized and directed to prepare an Assessment Roll for the Central Wappinger Water Improvement Area in accordance with the following standards: 1. All property within the benefit area shall be assessed. 2. The formula for such assessment shall be as follows: a. A single family house on a lot of less than two acres - one benefit unit. Where acreage over two acres - .2 benefit unit for each acre or part thereof over two acres. b. Vacant residential land less than two acres - .8 benefit unit. c. Residential acreage in excess of two acres - .8 benefit unit for the first two acres, .2 benefit unit for each acre in excess of two acres. d. Multi -family residential units - .75 benefit units per residential dwelling unit. e. Individual, commercial institutional and exempt properties shall be assessed by a computation whereby the assessed valuation shall be computed in relation to the assessed valuation of all property within the benefited area, and a benefit unit assigned in accordance with the ratio which the subject property bears to the total assessed valuation within the benefited area. f. All those subdivisions that have received preliminary approval prior to the date of this resolution. g. The lands which can not be served in the judgment of the Assessor shall be assessed at one-third of the full benefit units, which would normally be assigned if the property could be served. All property within the benefit area shall be assessed. 2. The formula for such assessment shall be as follows: a. A single family house on a lot of less than two acres - one benefit unit. Where acreage over two acres - .2 benefit unit for each acre or part thereof over two acres. b. Vacant residential land less than two acres - .8 benefit unit. c. PAINO moved to authorize the Attorney to prepare Local Laws setting the operation and maintenance rates for Wappinger Park Water District and North Wappinger Water District and.Myets_II. WateicD±str.ict (formerly served by Atlas Water Company). 21 2 Correspondence was received from Mr. Paggi, including a voucher for G & M Construction, contractors for the Bojman Drainage project on Valley Road. Mr. Paggi explained that there was an overrun on the bid price due to additional stone used to bring the swale to grade instead of using fill material. The price was increased from $7,650.00 to $8,337.50, ($687.50). Mr. Paggi indicated that he had reviewed the quantities of material needed for the job and the final price and found them to be in order. MRS. SMITH moved to authorize the overrun of $687.50 on the Bojman Drainage Project and approve the voucher submitted by G & M Construction. Seconded by Mr. Valdati Motion Unanimously Carried A vacancy existed on the Board of Assessment Review due to the expiration of Raymond Belding's term. The Councilpeople had not been able to reach Mr. Belding to determine if he was interested in being reappointed, and they agreed to table action. MRS. SMITH moved to table action on this appointment pending discussion with the present member of the Board of Assessment Review to determine his interest in a reappointment. Seconded by Mrs. Paino Motion Unanimously Carried The contract with Shaker, Travis & Quinn, Inc., was tabled at the last meeting for further discussion at a work shop. At this time Mrs. Paino recommended that it be tabled again since the work shop had not been scheduled, however, Mrs. Smith noted that they had held one work shop on this already and she was ready to act on it. Mr. Valdati agreed since without a contract the Town would be subject to an hourly rate for work needed at this time for the heating system. MRS. SMITH moved to approve the contract with Shaker, Travis & Quinn, Inc. for HV/AC service at the Town Hall, as presented, and authorize the Supervisor to sign said contract. Seconded by Mr. Valdati Motion Unanimously Carried A transfer request from the Comptroller for payment of school taxes on two parcels of land recently deeded to the Town was referred to the Attorney at the last meeting for his review and recommendation. 213 Both the Attorney and the Assessor researched this matter and concurred that since the property was deeded over to the Town, payment of the school taxes is not required. There were certain documents that had to be signed by the Supervisor exempting the Town from this tax payment. MRS. SMITH moved to authorize the Supervisor to sign the necessary documents. Seconded by Mr. Valdati Motion Unanimously Carried COUNCILWOMAN SMITH introduced the following proposed Local Law: A LOCAL LAW REGULATING TRAFFIC WITHIN THE TOWN OF WAPPINGER ON VALLEY ROAD WITH ITS INTERSECTION WITH HIVIEW ROAD Section 1. Legislatie Intent In order to protest the health, welfare and safety of the public traveling on the roads in the Town of Wappinger, the Town Board deems it to be in the best interests of all of the residents of the Town of Wappinger that certain traffic control devices be established at the intersection of Valley Road in the Town of Wappinger with its intersection with Hiview Road. Section 2. Traffic Control All of the vehicles travelling on Valley Road entering in the intersection with Hiview Road shall yield the right-of-way to all oncoming traffic. All vehicles travelling southerly on Hiview Road shall yield to oncoming traffic at its intersection with Valley Road. All traffic travelling on Hiview Road in the northerly direction shall come to a complete and full stop at its intersection with Valley Road. Section 3. Signs The Highway Superintendent of the Town of Wappinger be and hereby is authorized and directed to erect the aforementioned Stop and Yield Signs at the appropriate places and in conformance with all regulations and all governing agencies. Section 4. Penalties for Offenses Any vehicle failing to observe the aforementioned traffic control devices described above shall be subject to prosecution of a violation of this Local Law and shall be punished by a fine not to exceed $100.00. A violation of this Local Law shall be deemed to be a traffic infraction and shall have all other and additional penalties as prescribed by the Vehicle and Traffic Law of the State of New York. Section 5. Effective Date This Local Law shall become effective upon the filing with the Secretary of State of the State of New York. 214 The following resolution was offered by COUNCILWOMAN SMITH who moved its adoption: WHEREAS, there has been duly presented and introduced at a meeting of this Town Board on the 2nd day of October, 1989, a proposed Local Law Regulating Traffic Within the Town of Wappinger on Valley Road With Its Intersection with Hiview Road, and WHEREAS, the provisions of the Municipal Home Rule Law required that no local law shall be passed by the Legislative Body of the Town until a Public Hearing thereon has been held before such body, NOW, THEREFORE, BE IT RESOLVED, 1. That a Public Hearing shall be held on the said proposed Local Law by the Town Board of the Town of Wappinger on the 6th day of November, 1989 at 7:15 P.M., on such day at the Town Hall, 20 Middlebush Road, Town of Wappinger, Dutchess County, New York. 2. That at least five (5) days notice of such hearing shall be given by the Town Clerk of the Town of Wappinger by the due posting thereof upon the bulletin board maintained by said Town Clerk in the Town Hall and by publishing such notice at least once in the official newspaper of the Town of Wappinger. Seconded by: Councilman Valdati Roll Call Vote: 3 Ayes 0 Nays Mr. Farina, Mr. Reis ---Absent Unfinished Business --- At the last meeting a request from Mr. DeTullio to hook up to the Town water and/or sewer facilities was referred to the Engineer for his review and recommendation. Mr. Paggi reported that the parcel on All Angels Hill Road is not in the Rockingham Farms Sewer District but is within the boundaries of the Central Wappinger Water Improvement Area. He further explained that if the parcel was hooked up to sewer they would have to be a tenant to that district and in order to reach the nearest sewer main it would require an easement through private properties which might be difficult to obtain. The water main is located at the intersection of All Angels Hill Road and Hilltop Drive and to hook up to that a service connection would have to run down All Angels Hill Road to the property. They are entitled to go on the system and if they intend to do so, the Town will have to run a service line from Hilltop Road down All Angels Hill Road to their house. MRS. SMITH moved to table action on this matter and refer it to a future work shop for discussion. Seconded by Mrs. Paino Motion Unanimously Carried Mr. Paggi reported on a situation brought up at the previous meeting by Don Stenabaugh who was requesting to become a tenant to Central Wappinger Water Improvement Area because of contamination of his well 215 which evidently was caused by soapy water from the Hertz Car Wash next door. This was referred to the New York State Department of Environmental Conservation and the Dutchess County Department of Health for investigation. A report was received from the Health Department which Mr. Paggi reviewed and noted that they agreed with Mr. Stenabaugh regarding the contaminated water and said he should not drink it. The property is not within the district so all expenses to run the line to hook into the system will have to be borne by the applicant. The Attorney informed the Board that the Zoning Administrator was aware of the situation and was following through, also the D.E.C. scheduled a hearing this week on the situation and Mr. Levenson planned to attend, so further information would be forthcoming. MRS. PAINO moved to allow Mr. Stenabaugh to hook into the Central Wappinger Water Improvement Area, under the conditions of the Tenant Policy, and the expense of the connection will be borne by him. Seconded by Mrs. Smith Motion Unanimously Carried A request from Patricia Gardner for reimbursement from the Town regarding repair done on her water service was referred to the Engineer for review. This was done in view of the fact that the company that did the work was owned by Mr. & Mrs. Gardner and the Board felt that the amounts charged should be checked. Mr. Paggi did review the billing and found the amount of hours spent and the rates charged to be consistent for a repair of this type; he recommended that the request for reimbursement be honored. MR. VALDATI moved that Mrs. Gardner be reimbursed the amount of $429.46 for expenses incurred for the repair of water service, at the recommendation of the Engineer and Camo Pollution Control. Seconded by Mrs. Smith Motion Unanimously Carried Mr. Valdati referred to a request from the Justice Court at the last meeting for the Chief Court Clerk and the Assistant Court Clerk to attend a conference. The Board approved attendance for the Chief Court Clerk but not the Assistant Court Clerk. In a discussion with the Town Justices, they indicated to Mr. Valdati that this conference would be beneficial to the personnel and at this time he wished to amend the previous motion and allow Cheryl Hait, the Assistant Court Clerk to attend the conference. 216 MR. VALDATI moved to allow the Assistant Court Clerk to attend the Conference for Court Clerks, as requested by the Town Justices. Seconded by Mrs. Smith Roll Call Vote: 2 Ayes Mrs. Paino---Nay Motion Defeated Mrs. Paino objected to this for the reason that it would set a precedent for the other deputies in the Town to be allowed to attend the Association of Towns Meeting and various other ones pertinent to their respective positions. Mr. Valdati persisted in his efforts to have this motion approved and made note of the fact that when he was discussing this with Judge Francese, he offered to forego remuneration for himself for the expenses of going to the Conference and allow these monies to pay the expenses of the Assistant Court Clerk. The Judge, he said felt very strongly that this Clerk should attend the conference. Mrs. Paino noted that this would not change her vote, she felt it would set a precedent for others in that category to be allowed to attend these conferences. New Business --- A letter was received from Dennis Truett, 23 Alpert Drive regarding a previous letter he had written informing the Board that his basement had been flooded in June of 1989 and since this problem had a long time history, he requested to discuss this at the next Town Board meeting. Mrs. Paino said she planned to schedule a work shop meeting on this matter and would inform Mr. Truett. Mr. Valdati asked the Supervisor to consider a work shop to discuss the funds already expended in the clean-up and the total projection. It appears that the condos in the Town have not been included in this program and if there are funds available it would seem reasonable to have dumpster in place for them to dispose of their bulk items. Mrs. Paino informed him that they will discuss it after the bills come in and they determine if there are funds available for this service. 217 Wayne Barringer, a resident at 5 Edgehill Drive, requested to speak to the Board on hooking up to the Rockingham Sewer District. His septic system has failed and he was in an emergency situation; he was aware that he was not within this district and would have to receive this service as a tenant. Mr. Paggi was aware of this situation, having discussed it with Mr. Barringer earlier this day. He recommended that the Town seek approval from the Dutchess County Department of Health in writing since they are not allowing new hookups to the sewer system, however, since this is an emergency he does not foresee a problem with obtaining their approval. MRS. PAINO Moved to forward a letter to the Dutchess County Department of Health, enclosing copy of Mr. Barringer's letter, requesting their approval of a hookup to the Rockingham Farms Sewer District . Seconded by Mrs. Smith Motion Unanimously Carried MRS. PAINO moved to allow Mr. Barringer at 5 Edgehill Drive, to hook into the Rockingham Farms Sewer District, as a tenant to the District, subject to the approval of the Dutchess County Health Department. Seconded by Mrs. Smith Motion Unanimously Carried There was no other business to come before the Board. MR. VALDATI moved to adjourn the meeting, seconded by Mrs. Smith and unanimously carried.
