1989-08-17 SPMA Special Meeting of the Town Board of the Town of Wappinger was
held on August 17, 1989, at the Town Hall, Middlebush Road, Town
of Wappinger, Dutchess County, New York.
Supervisor Paino opened the Meeting at 7:20 P.M.

Notices of the meeting was sent to all Board Members on August 11,
1989, calling the meeting for August 17, 1989 at 7:15 P.M.; notices
were sent to the news media and posted on the Town Clerk's Bulletin
Clerk on the same day. The purpose of the meeting was to consider
setting a Public Hearing on the proposed purchase of the Atlas Water
Company and a Special Meeting following to consider approving same;
setting a Public Hearing on the proposed Wappinger Sewer Transmission
District; consider a proposed Agreement with Sedore, O'Sullivan and
Letterio; and a request from Mr. Levenson to attend a required course.
The following resolution was offered by SUPERVISOR PAINO who moved
its adoption:
WHEREAS, the Town Board has previously authorized the Town
Engineer to study and prepare a Map, Plan and Report with respect
to the Atlas Water System and the acquisiion by the Town of said
Water System, its well fields and distributions facilities, and
WHEREAS, following a prior Public Hearing an amended proposal
for the establishment of this District has been prepared and filed
with the Town Clerk, and
WHEREAS, the Town Board has now received the amended Engineer's
Report entitled, "Proposed North Wappinger Water District", and
WHEREAS, the Engineer to the Town has filed with the Town Clerk,
his Map showing the boundaries of the proposed District, and a
general Plan for the District, and a Report of the proposed method
of operation and financing, and that said Plan also shows the source
of the water supply, described the land to be acquired, etc.,
WHEREAS, the Engineer to the Town has filed these plans with
the Town Clerk of the Town of Wappinger, and
WHEREAS, annexed hereto and made a part hereof, is a Schedule
describing the metes and bounds of the proposed District, and

WHEREAS, the maximum amount proposed to be expended on the
part of the new North Wappinger Water District shall not exceed
$50,000.00 and that said funds will be raised through the issuance
of a Municipal Bond, and
WHEREAS, the Map, Plan and Report are on file in the Town
Clerk's Office and available for public inspection, and
WHEREAS, the charges against the property owners located within
said District will be made on.a benefit assessment basis, and
WHEREAS, the Town Board is the only agency involved with
improving this project, and for the purposes of SEQRA will thus
be the Lead Agency, and
WHEREAS, an Environmental Assessment Form has*been prepared
and is part of the Engineer's Report, and is available for public
inspection,
NOW THEREFORE, BE IT RESOLVED, that the Town Board will hold
a Public Hearing in this matter on the 7th day of September, 1989
at 7:30 P.M. at the Town Hall, Middlebush Road, Wappingers Falls,
New York, and
BE IT FURTHER RESOLVED, that the Map, Plan and Report shall be
available for public inspection in the Office of the Town Clerk
during business days between 8:30 a.m. and 4:00 p.m., and
BE IT FURTHER RESOLVED that a copy of this Order and complete
itemization of the metes and bounds description of said District
shall be published at least once in the official newspaper of the
Town not less than ten (10), no more than twenty (20) days before
the date set herein for the Public Hearing, and
BE IT FURTHER RESOLVED, that the Town Clerk shall post said
Resolution and Notice of Public Hearing on the official Posting
Board of the Town of Wappinger, and
BE IT FURTHER RESOLVED that all parties interested in being
heard on both the Environmental Assessment Form and the proposed
District Establishment, should be present at the aforementioned
date and time to be heard, and
BE IT FURTHER RESOLVED that the Town Board does hereby declare
itself to be the Lead Agency with respect to this matter pursuant
to 6 NYCRR Part 617.6.

MRS. PAINO moved to set a Special Meeting on September 7, 1989 at
7:45 P.M., or immediately following the Public Hearing, to consider
approving the purchase of the Atlas Water System by the Town.

The following resolution was offered by SUPERVISOR PAINO who moved

Clerk, his Map showing the boundaries of the proposed District,
and a general Plan for the District, and a Report of the proposed
method of operation and financing, and, describes the Easements
to be acquired, etc., and
WHEREAS, the Engineer to the Town has filed these plans with
the Town Clerk of the Town of Wappinger, and
WHEREAS, annexed hereto and made a part hereof, is a Schedule
describing the metes and bounds of the proposed District, and

WHEREAS, the maximum amount proposed to be expended on the part
of the new Wappinger Sewer Transmission District shall not exceed
$6,058,002.00, and that said -funds will be raised through the
issuance of a Municipal Bond, and
WHEREAS, the Map, Plan and Report are on file in the Town
Clerk's Office and available for public inspection, and
WHEREAS, the charges against the property owners located within
said District will be made on an ad valorum basis, and
WHEREAS, the Town Board has circulated its notice of its
intention to assume the posiion of the Lead Agency, and
NOW, THEREFORE, BE IT RESOLVED, that the Town Board shall conduct
a Public Hearing with respect to the proposed establishment of the
Wappinger Sewer Transmission District and said Public Hearing will
be held on the 14th day of September, 1989 at 7:30 P.M. at the Town
Hall, 20 Middlebush Road, Wappingers Falls, New York, and
BE IT FURTHER RESOLVED, that the Map, Plan and Report filed herein
shall be available for public inspection in the Office of the Town
Clerk during business days between 8:30 a.m. and 4:00 p.m., and
BE IT FURTHER RESOLVED, that a copy of this Order and complete
itemization of the metes and bounds description of said District
shall be published at least once in the official newspaper of the
Town not less than ten (10), no more than twenty (20) days before
the date set herein for the Public Hearing, and
BE IT FURTHER RESOLVED, that the Town Clerk shall post said
Resolution and Notice of Public Hearing on the official Posting
Board of the Town of Wappinger, and
BE IT FURTHER RESOLVED that the Town Board does hereby declare
itself to be the Lead Agency with respect to this matter pursuant
to 6 NYCRR Part 617.6.

The next item to consider was the Agreement with Sedore & O'Sullivan
regarding assistance with compiling information for the Budget
preparation for 1990, such as balances for all the accounts, etc.
It was Mrs. Smith's understanding that the Comptroller would be
preparing the budget and Mrs. Paino commented that he will be working
with the Accountants.
MRS. SMITH moved to approve the Agreement with Sedore, O'Sullivan &
Letterio and authorize the Supervisor to sign said Agreement.

Mr. Levenson, Zoning Administrator, requested permission to attend
a final course required for his certification on August 29 through
September 1, 1989.
MRS. SMITH moved to allow Mr. Levenson to attend the course requested
and all legitimate expenses will be a Town charge.

Mr. Farina asked to bring up another item which would occur prior
to the next Town Board meeting. On August 23, 1989 U. S. Cablevision
will be presenting a special live video conference and training course
direct from the Federal Emergency Management Agency. The program will
be entitled Community Flood Plain Management which will be shown on
Channel 6, starting at 11 A.M. and concluding at 3:30 P.M.
MRS. PAINO moved to close the Special Town Board Meeting, seconded
by Mr. Reis and unanimously carried.
