ADJOURNMENT 1 The Reorganization Meeting of the Town of Wappinger for 1989 was held on January 2, 1989, at the Town Hall, 20 Middlebush Road, Town of Wappinger, Dutchess County, New York. Supervisor Paino opened the meeting at 7:35 P.M. Present: Irene Paino, Supervisor Vincent Farina, Councilman David Reis, Councilman Constance Smith, Councilwoman Robert Valdati, Councilman Elaine H. Snowden, Town Clerk Others Present: Joseph E. Paggi, Jr., Engineer The audience joined the Town Board in the Pledge of Allegiance to the Flag, followed by a moment of silent prayer for the Town of Wappinger and its residents. Supervisor Paino reaffirmed the appointment of David Reis as Deputy Supervisor and Joyce Benedetto as Bookkeeper. Mrs. Snowden reaffirmed the apointments of Gladys Ruit and Margaret Roe as Deputy Town Clerks. The Highway Superintendent had previously requested Mrs. Snowden to reaffirm his appointment of John DeCarlo as Deputy Highway Superintendent. Resolutions --- TOWN BOARD, TOWN OF WAPPINGER DUTCHESS COUNTY, NEW YORK AUTHORIZING ISSUANCE AND PAYMENT FOR PAYDAYS OF 1989 The following resolution was offered by SUPERVISOR PAINO who moved its adoption: RESOLVED, that the salaries of all persons holding either full time or part time positions as otherwise fixed for these designated positions shall be paid to the holders of such offices and positions payable every other Friday throughout the year 1989, with 26 pay periods during such year with the first payday to be January 6, 1989, and be it further RESOLVED, that the Comptroller of the Town of Wappinger be authorized to issue and pay the holders of these designated positions on such designated paydays of the year 1989. Seconded by: Councilman Reis Roll Call Vote: 5 Ayes 0 Nays TOWN BOARD, TOWN OF WAPPINGER DUTCHESS COUNTY, NEW YORK APPOINTING PERSONNEL TO VARIOUS TOWN OFFICES AND POSITIONS OF EMPLOYMENT 2 The following resolution was offered by COUNCILWOMAN SMITH who moved its adoption: RESOLVED, that the following persons be and they hereby are appointed to the following offices and positions of employment with the Town of Wappinger to serve in such capacity at the pleasure of the appointing officers: NAME John DeCarlo Brenda Von Berg Bernard Reimer OFFICE Deputy Superintendent Highways Town Historian Recreational Coordinator AND BE IT FURTHER RESOLVED, that the salaries otherwise fixed for the above designated offices and positions shall be paid to the holders of such offices and positions, with the exception that no compensation shall be paid to the holder of the office of Deputy Town Superintendent of Highways, and the Town Historian is to be paid on a semi-annual basis, payable every other Friday throughout the year 1989, with 26 pay periods during such year consistent with the pay schedule adopted for the year 1989. Seconded by: Councilman Reis Roll Call Vote: 3 Ayes Mrs. Smith ---Nay, Mr. Valdati---Nay 3 TOWN BOARD, TOWN OF WAPPINGER DUTCHESS COUNTY, NEW YORK ESTABLISHING THE SALARIES OF CERTAIN CLASSIFIED CIVIL SERVICE POSITIONS IN THE TOWN The following resolution was offered by SUPERVISOR PAINO who moved its adoption: RESOLVED, that the annual salaries for Town Officers and Employees be and the same established at the following rates: Deputy Town Clerk Deputy Town Clerk Assessor Secretary to Planning Board Secretary to Zoning Board Receiver of Taxes and be it further the following named are hereby fixed and $ 19,400.00 13,800.00 36,000.00 6,200.00 6,200.00 24,500.00 RESOLVED, that the salaries of persons holding the aforesaid positions shall be paid with 26 pay periods throughout the year 1989, consistent with the pay schedule adopted for the year 1989. Seconded by: Councilman Reis Roll Call Vote: 5 Ayes 0 Nays The previous two resolutions were originally combined, however, Councilwoman Smith requested that they separate the elected officers from the employees since she did not feel that they should receive raises on an off year. It was her opinion that they should serve the taxpayers at the same salary received when elected. Mr. Valdati objected to the increase in the Supervisor's salary which represented a 63% increase included in an 18% increase in Town taxes and it should not take place this year, perhaps at election time. TOWN BOARD, TOWN OF WAPPINGER DUTCHESS COUNTY, NEW YORK SETTING SALARY FOR COMPTROLLER FOR THE TOWN OF WAPPINGER The following resolution was offered by SUPERVISOR PAINO who moved its adoption: RESOLVED, that the annual salary for Dennis Lasowski, Comptroller to the Town of Wappinger be and the same hereby is fixed and established at the annual rate of $31,000.00 to be paid every other Friday throughout the year 1989, with 26 pay periods during such year consistent with the pay schedule adopted for the year 1989. Seconded by: Councilman Reis Roll Call Vote: 3 Ayes Mrs. Smith ---Nay, Mr. Valdati---Nay Councilwoman Smith brought up the fact that in 1987 at a work shop, it was agreed that the Comptroller would receive $28,675.00 for the following year, however, Mrs. Paino had the figure changed to $30,000.00 4 without the Board's knowledge. She did vote on this amount and did not fully realize the change that had occurred. In light of the Town's recent financial situation, such as illegal payments without transfers, an overpayment to Saratoga Associates, above and beyond the cap that the Board put on the amount to be paid for their services, and the fact that the Town has been paying for a full time Comptroller who is working part time basis, this is her reason for voting against the resolution. She also called for Mr. Lasowski's resignation at this time. Mr. Farina was annoyed because he said he had been given wrong information by the two Councilpeople on the end, and although he voted for this resolution, he really was not in favor of giving the Comptroller any raise due to the information Mrs. Smith provided him with on last year's salary. He, Mrs. Smith and Mr. Valdati then briefly discussed this matter and then went on to the amount of the Supervisor's salary and how the final figure was arrived at. TOWN BOARD, TOWN OF WAPPINGER DUTCHESS COUNTY, NEW YORK ESTABLISHING THE SALARY OF CERTAIN CLASSIFIED CIVIL SERVICE POSITIONS IN THE TOWN OF WAPPINGER The following resolution was offered by SUPERVISOR PAINO who moved its adoption: RESOLVED, that the annual salary for the following classified civil service positions in the office of the Comptroller in the Town of Wappinger be and the same hereby is fixed and established at the following annual rates: Melva Laffin Debra Brown Clerk to the Comptroller $19,400.00 Water & Sewer Billing Clerk 16,500.00 AND IT IS FURTHER RESOLVED, that the salaries fixed for the above designated offices and positions shall be paid to the holders of such offices and positions, payable every other Friday throughout the year 1989, with 26 pay periods during such year consistent with the pay schedule adopted for the year 1989 with the first payday to be January 6, 1989. Seconded by: Councilman Valdati Roll Call Vote: 5 Ayes 0 Nays TOWN BOARD, TOWN OF WAPPINGER ESTABLISHING THE PAY SCALE FOR PART TIME CLERICAL EMPLOYEES ENGAGED TO SERVE TOWN BOARD, ITS OFFICERS, OFFICIALS AND AGENCIES The following resolution was offered by COUNCILMAN VALDATI who moved its adoption: RESOLVED, that the pay scale for all presently employed part- time clerical employees engaged to perform services for the Town Board of this Town and/or its Officers, Officials and Agencies, be and the same hereby is fixed and established at a minimum hourly rate of $4.00 to a maximum hourly rate of $7.00 per hour, and BE IT FURTHER RESOLVED, that the part-time hourly rate for any subsequent Part -Time Clerical employee engaged by any Official or Agency Department Head shall be established at the minimum hourly rate, or if otherwise fixed and established, shall be subject to the approval of the Town Board, and BE IT FURTHER RESOLVED, that all such extra part-time Clerical employees engaged on an hourly basis shall be paid every other Friday throughout the year 1989, with the first payday to be on Friday, January 6, 1989. Seconded by: Councilwoman Smith Roll Call Vote: 5 Ayes 0 Nays TOWN BOARD, TOWN OF WAPPINGER EMPLOYING LEGAL SERVICES FOR THE TOWN OF WAPPINGER The following resolution was offered by SUPERVISOR PAINO who moved its adoption: 9 RESOLVED, that Thomas Wood be and he hereby is employed and retained for the purpose of furnishing to the Town Board, its Officers and Agencies, such legal advice and services as may be required and he shall receive compensation at a rate not to exceed $55.00 per hour, which shall be set forth in a proposal to be submitted to this Town Board. Seconded by: Councilman Reis Roll Call Vote: 4 Ayes Mr. Valdati---Nay TOWN BOARD, TOWN OF WAPPINGER EMPLOYING ENGINEERING SERVICES FOR THE TOWN OF WAPPINGER The following resolution was offered by SUPERVISOR PAINO who moved its adoption: RESOLVED, that Paggi & Martin be and they hereby are employed and retained for the purpose of furnishing to the Town Board, its Officers and Agencies, such engineering advice and services as may be required and they shall receive compensation therefor in accordance with a proposal submitted to this Town Board. TOWN BOARD, TOWN OF WAPPINGER APPOINTING CERTIFIED PUBLIC ACCOUNTANT TO AUDIT THE ACCOUNTS AND REPORTS OF THE SUPERVISOR, TOWN CLERK AND TOWN JUSTICES FOR THE YEAR 1988 The following resolution was offered by COUNCILWOMAN SMITH who moved its adoption: RESOLVED, that Sedore and O'Sullivan, Certified Public Accountants, be and they hereby are retained to audit the accounts and reports of the Town Supervisor, Town Clerk and Town Justices for the year 1988, and it is further RESOLVED, that the said Accountants receive reasonable compensation for the productive services which they shall render to the Town in this connection, based on the Letter of Engagement and the time frame they have agreed to. Seconded by: Councilman Valdati Roll Call Vote: 3 Ayes Councilman Reis ---Nay, Supervisor Paino---Nay TOWN BOARD, TOWN OF WAPPINGER DESIGNATING COURT OFFICERS FOR TOWN OF WAPPINGER JUSTICE COURT The following resolution was offered by COUNCILMAN VALDATI who moved its adoption: 10 RESOLVED, that all individuals hereinafter designated by the Town Board as Court Officers as such title is defined by the Uniform Justice Court Act have all those powers accorded to Court Officers by Law during such time they are actually serving in such capacity, and BE IT FURTHER RESOLVED, that the Town Justices of the Town shall serve as Court Officers, and BE IT FURTHER RESOLVED, that one court officer be designated for each session of Court unless the Town Justices determine that more than one be designated for any one session, and BE IT FURTHER RESOLVED, that the Court Officers shall be compensated at the hourly rate of $6.50 for the time actually served, and BE IT FURTHER RESOLVED, that Armed Court Officers shall be compensated at the hourly rate of $9.50 for time actually served at sessions of Court where their services are required, and BE IT FURTHER RESOLVED, that the Town Justices shall submit to the Town Comptroller on a weekly basis the names and hours served, and that the Town Comptroller be empowered to issue remuneration consistent with the foregoing from funds appropriated for Justice Court, and BE IT FURTHER RESOLVED, that the following individuals be designated as Court Officers for the year 1989: Howard Webster Arthur Eichler Seconded by: Councilman Reis Roll Call Vote: 5 Ayes 0 Nays TOWN BOARD, TOWN OF WAPPINGER ESTABLISHING THE PAY SCALE FOR PART TIME VANDALISM PATROL PERSONNEL The following resolution was offered by SUPERVISOR PAINO who moved its adoption: RESOLVED, that the pay scale for part-time Town of Wappinger Vandalism Patrol Personnel engaged to perform certain services for the protection of Town Parks, various other Town properties and performance of other such duties as may be assigned by the Town Board of this Town be and the same hereby is fixed and established at a maximum hourly rate of $15.00 per hour, and it is further RESOLVED, that all of such part-time Town of Wappinger Vandalism Patrol Personnel engaged on an hourly basis shall be paid every other Friday throughout the year 1989, with 26 pay periods during such year consistent with the pay schedule adopted for the year 1989 with the first payday to be January 6, 1989. Seconded by: Councilman Farina Roll Call Vote: 5 Ayes 0 Nays L L 11 TOWN BOARD, TOWN OF WAPPINGER DESIGNATING TIME AND PLACE FOR THE HOLDINGS OF TOWN BOARD MEETINGS The following resolution was offered by SUPERVISOR PAINO who moved its adoption: RESOLVED, that the first monthly meeting of the Town Board of the Town of Wappinger for the year 1989, shall be held on January 16th 1989 at 7:30 P.M., at the Town Hall, 20 Middlebush Road, Town of Wappinger, New York, and BE IT FURTHER RESOLVED, that commencing with the first Monday in February, 1989, that the regular monthly meeting of the Town Board of the Town of Wappinger, shall be held at 7:30 P.M. at the Town Hall, 20 Middlebush Road, Town of Wappinger, Dutchess County, New York, in the evening of the 1st Monday of each month, or at such other place or places within the Town of Wappinger as the Town Board shall from time to time designate. TOWN BOARD, TOWN OF WAPPINGER ESTABLISHING PETTY CASH FUND FOR THE RECEIVER OF TAXES The following resolution was offered by SUPERVISOR PAINO who moved its adoption: RESOLVED, that a petty cash account not to exceed the sum of $200.00 and the same hereby is established for the Receiver of Taxes, and it is further RESOLVED, that payments from said petty cash account be made and the Supervisor of this Town be reimbursed for advances made to such account in accordance with the provision of Section 64, Subdivision la of the Town Law of the State of New York. Seconded by Mr. Valdati Motion Unanimously Carried TOWN BOARD, TOWN OF WAPPINGER AUTHORIZING USE OF A MECHANICAL CHECK -SIGNING DEVICE FOR SIGNING CHECKS WITH A FACSIMILE SIGNATURE OF THE SUPERVISOR The following resolution was offered by COUNCILMAN REIS who moved its adoption: 12 RESOLVED, that voucher -order checks of the Town of Wappinger may be signed with a facsimile signature of the Supervisor of the Town of Wappinger as reproduced by a mechanical check -signing device or machine provided that the safeguards specified by the manufacturer and inherent in the operations of such device are properly observed, and it is further RESOLVED, that a certified copy of this resolution be filed with all banking institutions which are depositories of the monies and funds of the Town of Wappinger, for the purpose of indicating authority for the use of such facsimile signature, and it is further RESOLVED, that the Supervisor of the Town of Wappinger be and is hereby authorized and empowered to take all steps which may be necessary and proper to acquire a mechanical check signing device for use in conformity with this resolution. Seconded by: Councilman Valdati Roll Call Vote: 5 Ayes 0 Nays TOWN BOARD, TOWN OF WAPPINGER DESIGNATING OFFICIAL NEWSPAPER OF THE TOWN OF WAPPINGER The following resolution was offered by COUNCILMAN VALDATI who moved its adoption: RESOLVED, that the Southern Dutchess News, a newspaper regularly published in the Town of Wappinger, Dutchess County, New York, and having a general circulation in this Town, and being a newspaper entered as second class mail matter, be and the same hereby is designated as the official paper of this Town, and BE IT FURTHER RESOLVED, that the Poughkeepsie Journal and the Evening News and the Hornet, newspapers published in the County of Dutchess and having general circulation therein be and they hereby are designated as additional newspapers for the publication of Town notices, subject to the limitations of Section 64, Subdivision 11 of the Town Law of the State of New York, and BE IT FURTHER RESOLVED, that the Town CLerk be and she hereby is authorized and directed to give notice of such designation to the publishers of such newspapers. Seconded by: Supervisor Paino Roll Call Vote: 5 Ayes 0 Nays TOWN BOARD, TOWN OF WAPPINGER RELATIVE TO THE TEMPORARY DEPOSIT AND INVESTMENT OF TOWN FUNDS The following resolution was offered by COUNCILMAN REIS who moved its adoption: WHEREAS, It has come to the attention of the Town Board of the Town of Wappinger that there are now or may be in the future, funds and monies, except proceeds of loans and monies, the investments of which is otherwise provided by law, belonging to the Town which are or which may be in excess of the amount required for immediate expenditure to pay current expenses and obligations, and 13 WHEREAS, it is or it may be to the advantage of the Town to deposit and/or invest all or part of such funds in special time deposit accounts, or in certificates of deposit issued by, banks or trust companies located and authorized to do business in this State, short term obligations of the United States of American and/or the State of New York, and WHEREAS, It appears that the Temporary Deposit and/or investment of such excess and surplus funds may be beneficial and profitable to the Town of Wappinger, NOW, THEREFORE, BE IT RESOLVED, that the duly elected qualified and acting Supervisor of the Town of Wappinger be and she is authorized, empowered and directed to deposit and/or invest such surplus and excess funds of this Town in the aforesaid manner pursuant to Section 11 of the General Municipal Law of the State of New York, and BE IT FURTHER RESOLVED, that such Temporary Deposits and/or investments shall be secured, registered or held, as the case may be in the manner prescribed by Section 11 of the General Municipal Law of the State of New York, and BE IT FURTHER RESOLVED, that the aforesaid Supervisor of this Town be and she hereby is authorized and directed to take all steps necessary from time to time to carry out and implement this resolution. Seconded by: Councilman Reis Roll Call Vote: 5 Ayes 0 Nays TOWN BOARD, TOWN OF WAPPINGER DESIGNATING DEPOSITORIES FOR THE TOWN OF WAPPINGER MONIES The following resolution was offered by COUNCILMAN VALDATI who moved its adoption: RESOLVED, that the Marine Midland National Bank of Southeastern New York, the Dutchess Bank and Trust Company, Bank of New York, the Chase Manhattan Bank, the Norstar Bank, and the Fishkill National Bank, each being a banking institution maintaining banking rooms and offices in Dutchess County, New York, be and they each hereby are severally designated as depositories of the monies of this Town, and BE IT FURTHER RESOLVED, that the Town Clerk be and she hereby is directed to give notice of such designation to each of said banking institutions. Seconded by: Councilman Valdati Roll Call Vote: 5 Ayes 0 Nays TOWN BOARD, TOWN OF WAPPINGER AUTHORIZING THE SUBMISSION OF THE SUPERVISOR'S ANNUAL FINANCIAL REPORT TO THE STATE COMPTROLLER The following resolution was offered by COUNCILMAN REIS who moved its adoption: WHEREAS, subdivision 10 of Section 29 of the Town Law required that the Supervisor of each Town prepare and file with the Town CLerk within 30 days after the expiration of each fiscal year, an annual financial report accounting for all monies received and disbursed by her, together with the certificates or certificate of the bank or trust company where Town monies are deposited, showing the amount of such monies on deposit with said bank or trust company, and cause a certified copy of such report to be published in the official newspaper, and 14 WHEREAS, in lieu of preparing the report required by Subdivision 10 of Section 29 of Town Law, the Town Board may determine, by resolution, that the Supervisor shall submit to the Town Clerk within 60 days after the close of the fiscal year, a copy of the report to the State Comptroller required by Section 30 of the General Municipal Law and the Town CLerk shall cause a summary of such report to be published within 10 days after receipt thereof in a form approved by the State Comptroller in the official newspaper, NOW, THEREFORE IT IS RESOLVED, that in lieu of preparing the report required by Subdivision 10 of Section 29 of the Town Law, the Supervisor shall submit to the Town CLErk within 60 days after the close of the fiscal year, a copy of the report to the State Comptroller required by Section 30 of the General Municipal law and that the Town Clerk shall cause a summary of such report to be published within 10 days after receipt thereof in a form approved by the State Comptroller in the official newspaper. Seconded by: Mr. Reis Roll Call Vote: 2 Ayes, Mr. Farina, Mrs. Smith, Mr. Valdati---Nay Motion Defeated Mrs. Smith objected to voting for all three Chairman in one motion and pointed out that it was her understanding that the Zoning Board Members were not receptive to appointing Mr. Brooker as their Chairman. Mr. Valdati added that Mr. Brooker was a member of this Board for only six months before he was appointed Chairman and he felt there were members on that Board who had served longer and were more qualified for that position. Mr. Farina commented that if there was concern on the ZBA regarding this matter he would like the opportunity of talking to the members for their input before he votes. It does not mean he's not in favor of Mr. Brooker, he just wants the information. 15 It was agreed that the appointments would be considered separately for the three Agencies. Mrs. Smith asked that the appointment of the Chairman of the Zoning Board of Appeals be tabled pending further discussion with the members of that Board. im MRS. MR. FARINA moved to establish reimbursement for occasional mileage for Town business at $.24 per mile for 1989. Seconded by Mrs. Paino Motion Unanimously Carried MRS. SMITH moved to establish the fee for the Dog Control Officer at $5.25 per call. Seconded by Mrs. Paino Motion Unanimously Carried It was agreed that health insurance benefits for the Dog Officer will be discussed at a future work shop.
