The Reorganizational Meeting of the Town Board of the Town of Wappinger
Was held on January 4, 1988, at the Town Hall, 20 Middlebush Road,
Town of Wappinger, Dutchess County, New York.
Supervisor Paino opened the meeting at 7:30 P.M.
Present:
Irene Paino, Supervisor
Vincent Farina, Councilman

Constance Smith, Councilwoman

Dennis Lasowski, Comptroller
The meeting began with the Pledge of Allegiance to the Flag, followed
by a moment of silent prayer for the Town of Wappinger and its residents.
Appointments by Supervisor (Deputy Supervisor, Bookkeeper and
Confidential Secretary).
Mrs. Paino appointed David Reis as Deputy Supervisor, Joyce Benedetto
as Bookkeeper and stated that she would not be appointing a Confidential
Secretary.
Appointments by Town Clerk:
Mrs. Snowden appointed Gladys Ruit and Margaret Roe as Deputy Town
Clerks.
The Highway Superintendent appointed John DeCarlo as Deputy Highway
Superintendent.
On behalf of the Town Board, Councilman Valdati welcomed the newest
member, Constance Smith, Councilwoman of the Fourth Ward, to her first
official meeting.

The following Resolution was offered by COUNCILMAN REIS, who
moved its adoption:
RESOLVED, that the following persons be and they hereby are
appointed to the following offices and positions of employment with
the Town of Wappinger to serve in such capacity at the pleasure of
the Town Board, for the year 1988:

compensation shall be paid to the holder of the office of Deputy
Town Superintendent of Highways, and, the Town Historian is to be
paid on a semi-annual basis, every other Friday throughout the year
1988, with 26 pay periods during such year, with the first payday to
be January 8th, 1988.

The following Resolution was offered by COUNCILMAN REIS who
moved its adoption:
RESOLVED, that Dennis Lasowski be and he hereby is appointed
to the Office of Comptroller in the Town of Wappinger, to serve in
such capacity for a term ending on the 31st day of December 1989, and
BE IT FURTHER RESOLVED, that the Comptroller be paid an annual
salary of $30,000.00 payable every other Friday throughout the year
1988, with 26 pay periods during such year, with the first payday to
be January 8, 1988.

to the Office of Receiver of Taxes and Assessments in the Town of
Wappinger, to serve in such capacity for a term ending on the 31st
day of December, 1989, and

Assessments be paid an annual salary of $21,000.00, payable every
other Friday throughout the year 1988, with 26 pay periods during

BE IT FURTHER RESOLVED, that the Receiver of Taxes and Assessments
be and she hereby is authorized to employ such clerical employees as
may be necessary for the performance of her duties and to compensate

RESOLVED, that Elaine H. Snowden be and she hereby is appointed
to serve as Registrar of Vital Statistics to the Town of Wappinger,
Dutchess County, New York, for a term of four years commencing
January 1st, 1988, and ending December 31st, 1991, pursuant to
Section 4123, Public Health Law, and
BE IT FURTHER RESOLVED, that said Registrar of Vital Statistics
to the Town of Wappinger shall receive no salary or compensation,
however, she shall be entitled to receive for the performance of
the duties of this respective office the fees fixed by applicable
Statute.

Accounts Clerk to the Town Clerk of the Town of Wappinger, be and
the same hereby is fixed and established at the annual rate of
$5,250.00, to be paid every other Friday throughout the year
1988, with 26 pay periods during such year, with the first payday
to be January 8, 1988.

The following Resolution was offered by COUNCILMAN REIS who
moved its adoption:
RESOLVED, that Thomas Classey be and he hereby is appointed
to the Civil Service Position of Building Inspector for the Town
of Wappinger, and
BE IT FURTHER RESOLVED, that the annual salary for this
classified Civil Service position in the Town be and the same
hereby is fixed and established at the following annual rate of
$27,300.00 to be paid every other Friday throughout the year 1988,
with 26 pay periods during such year, with the first payday to be
January 8, 1988.

Mr. Reis noted that Mr. Classey came out No. 1 on the Civil Service
Test for this position and commended him.
MR. REIS moved to waive the probation period for Thomas Classey
in his position of Building Inspector for the Town of Wappinger.
Seconded by Mr. Farina
Motion Unanimously Carried
Mr. Farina also commended Mr. Classey for his rating on the Civil
Service test for Building Inspector.

The following Resolution was offered by SUPERVISOR PAINO who
moved its adoption:
RESOLVED, that Herbert J. Levenson be and he hereby is appointed
to the Civil Service Position of Zoning Administrator for the Town
fkime of Wappinger, and
BE IT FURTHER RESOLVED, that the annual salary for this classified
Civil Service position in the Town be and the same hereby is fixed and
established at the following annual rate of $29,540.00 to be paid
every other Friday throughout the year 1988, commencing on January 8,
1988, with 26 pay periods during such year with the first payday to
be January 8, 1988.

Mrs. Paino commended Mr. Levenson on his rating of No. 1 on the
Civil Service test.
MRS. PAINO moved to waive the probation period for Herbert Levenson

and also waive the residency requirements for this position.

RESOLVED, that the annual salary for Frances Frisina, Secretary
to the Highway Superintendent of the Town of Wappinger, be and the
same hereby is fixed and established at the annual rate of $16,615.00
to be paid every other Friday throughout the year 1988, with 26
pay periods during such year, with the first payday to be January 8,
1988.

FOR PART-TIME CLERICAL
EMPLOYEES ENGAGED TO SERVE
THE TOWN BOARD AND ITS OFFICERS,
OFFICIALS AND AGENCIES
The following Resolution was offered by COUNCILMAN FARINA who
moved its adoption:
RESOLVED, that the pay scale for all presently employed part-
time Clerical employees engaged to perform services for the Town
Board of this Town and/or its Officers, Officials and Agencies, be
and the same hereby is fixed and established at a minimum hourly
rate of $4.00 to a maximum hourly rate of $6.00 per hour, and
BE IT FURTHER RESOLVED, that the part-time hourly rate for
any subsequent part-time Clerical employee engaged by any Official
or Agency Department Head shall be established at the minimum hourly
rate, or, if otherwise fixed and established, shall be subject to
the approval of the Town Board, and
BE IT FURTHER RESOLVED, that all such part-time Clerical
employees engaged on a hourly basis shall be paid every other
Friday throughout the year 1988, with the first payday to be on
Friday, January 8, 1988.

Hydrant Inspector, under the supervision of the Highway Department,
be and the same hereby is fixed and established at $5.25 per hour,
to be paid every other Friday throughout the year 1988, with 26
pay periods during such year, with the first payday to be January 8,
1988.

PATROL PERSONNEL
The following Resolution was offered by SUPERVISOR PAINO, who
moved its adoption:
RESOLVED, that the pay scale for part-time Town of Wappinger
Vandalism Patrol Personnel engaged to perform certain services
for the protection of Town Parks, various other Town properties
and performance of other such duties as may be assigned by the
Town Board of the Town, be and the same hereby is fixed and
established at a maximum hourly rate of $9.00 per hour, and
IT IS FURTHER RESOLVED, that all of such part-time Town of
Wappinger Vandalism Patrol Personnel engaged on an hourly basis
shall be paid every other Friday throughout the year 1988, with
the first payday to be January 8, 1988.

FOR THE TOWN OF WAPPINGER
JUSTICE COURT
The following Resolution was offered by COUNCILMAN VALDATI,
who moved its adoption:
RESOLVED, that all individuals hereinafter designated by the
Town Board as Court Officers as such title is defined by the Uniform
Justice Court Act have all those powers accorded to Court Officers
by Law during such time they are actually serving in such capacity, and
BE IT FURTHER RESOLVED, that the Town Justices of the Town shall
designate and schedule the days and evenings such individuals shall
serve as Court Officers, and
BE IT FURTHER RESOLVED, that one Court Officer be designated
for each session of Court unless the Town Justices determine that
more than one be designated for any one session, and
BE IT FURTHER RESOLVED, that the Court Officers shall be

compensated at the hourly rate of $5.25 for time actually served, and
BE IT FURTHER RESOLVED, that Armed Court Officers shall be
compensated at the hourly rate of $9.00 for time actually served
at sessions of Court where their services are required, and
BE IT FURTHER RESOLVED, that the Town Justices shall submit
to the Town Comptroller on a weekly basis the names and hours served,
and that the Town Comptroller be empowered to issue remuneration
consistant with the foregoing from funds appropriated for Justice
Court, and
BE IT FURTHER RESOLVED, that the following individuals be
designated as Court Officers for the year 1988:

RESOLVED, that the salaries of all persons holding either full
time or part time positions as otherwise fixed for these designated
positions shall be paid to the holders of such offices and positions
payable every other Friday throughout the year 1988, with 26 pay
periods during such year, with the first payday to be on January 8,
1988, and be it further
RESOLVED, that the Comptroller of the Town of Wappinger be
authorized to issue and pay the holders of these designated positions
on such designated paydays of the year 1988.

RESOLVED, that John Vorndran be and he hereby is appointed
to serve as the Maintenance Supervisor for the Recreation Commission
of the Town of Wappinger, Dutchess County, New York, and
BE IT FURTHER RESOLVED, that the salary for the Maintenance
Supervisor for the Recreation Commission be and the same hereby
is fixed and established at an annual rate of $15,900.00, to be
paid every other Friday throughout the year 1988, with 26 pay
periods during such year, with the first payday to be January 8,
1988.

Wappinger against the loss of the type more particularly set forth

entered as second class mail matter, be and the same hereby is
designated as the official paper of this Town, and
BE IT FURTHER RESOLVED, that the Poughkeepsie Journal, the
Evening News and the Hornet, newspapers published in the County of
Dutchess and having general circulation therein, be and they hereby
are designated as additional newspapers for the publication of Town

notices, subject to the limitations of Section 64, Subdivision 11
of the Town Law of the State of New York, and
BE IT FURTHER RESOLVED, that the Town Clerk be and she hereby

RESOLVED, that voucher -order checks of the Town of Wappinger
may be signed with a facsimile signature of the Supervisor of the
Town of Wappinger as reproduced by a mechanical check -signing
device or machine provided that the safeguards specified by the
manufacturer and inherent in the operations of such device are
properly observed, and it is further,
RESOLVED, that a certified copy of this resolution be filed
with all banking institutions which are depositaries of the monies
and funds of the Town of Wappinger, for the purpose of indicating
authority for the use of such facsimile signature, and it is
further
RESOLVED, that the Supervisor of the Town of Wappinger be and
is hereby authorized and empowered to take all steps which may be
necessary and proper to acquire a mechanical checksigning device
for use in conformity with this resolution.

The following Resolution was offered by COUNCILMAN REIS who
moved its adoption:
WHEREAS, It has come to the attention of this Town Board of the
the Town of Wappinger that there are now or may be in the future, funds
and monies, except proceeds of loans and monies the investment of
which is otherwise provided by law, belonging to the Town which are
or which may be in excess of the amount required for immediate
expenditure to pay current expenses and obligations, and
WHEREAS, It is or it may be to the advantage of the Town to
deposit and/or invest all or part of such funds in special time
deposit accounts, or in certificates of deposit issued by, banks
or trust companies located and authorized to do business in this
State, short term obligations of the United States of America
and/or the State of New York, and
WHEREAS, it appears that the Temporary Deposit and/or
investment of such excess and surplus funds may be beneficial and
profitable to the Town of Wappinger,

NOW, THEREFORE, IT IS HEREBY
RESOLVED, that the duly elected, qualified and acting Supervisor
of the Town of Wappinger be and she hereby is authorized, empowered
and directed to deposit and/or invest such surplus and excess funds
of the Town in the aforesaid manner pursuant to Section 11 of the
Federal Municipal Law of the State of New York, and
IT IS FURTHER RESOLVED, that such Temporary Deposits and/or
investments shall be secured, registered or held, as the case may
be in the manner prescribed by Section 11 of the General Municipal
Law of the State of New York, and
IT IS FURTHER RESOLVED, that the aforesaid Supervisor of this
Town be and he hereby is authorized, empowered and directed to take
all steps necessary from time to time to carry out and implement
this resolution.

AUTHORIZING THE SUBMISSION OF
THE SUPERVISOR'S ANNUAL FINANCIAL
REPORT TO THE STATE COMPTROLLER
The following Resolution was offered by COUNCILMAN REIS who
moved its adoption:
WHEREAS, Subdivision 10 of Section 29 of the Town Law required
that the Supervisor of each Town prepare and file with the Town Clerk
within 30 days after the expiration of each fiscal year, an annual
financial report accounting for all monies received and disbursed
by him, together with the certificates or certificate of the bank
or trust company where Town monies are deposited, showing the amount
of such monies on deposit with said bank or trust company and cause
a certified copy of such report to be published in the official
newspaper.
WHEREAS, in lieu of preparing the report required by Subdivision
10 of Section 29 of Town Law, the Town Board may determine, by
resolution, that the Supervisor shall submit to the Town Clerk
within 60 days after the close of the fiscal year, a copy of the
report to the State Comptroller required by Section 30 of the
General Municipal Law and the Town Clerk shall cause a summary
of such report to be published within 10 days after receipt thereof
in a form approved by the State Comptroller in the official newspaper,
NOW, THEREFORE IT IS HEREBY
RESOLVED, that in lieu of preparing the report required by
Subdivision 10 of Section 29 of the Town Law, the Supervisor shall
submit to the Town Clerk within 60 days after the close of the fiscal

MR. REIS moved to appoint George Wells as Dog Control Officer at a
salary of $5.25 per call plus mileage and further moved that Mr. Wells
submit a monthly report of calls and miles traveled to the Town Board
for the purpose of remuneration, etc.

Appointments ---
The term of William Parsons as a member of the Planning Board expires
this day; a recommendation was received from this Board that Mr. Parsons
be reappointed to another term.
The following Resolution was offered by COUNCILMAN REIS who
moved its adoption:
RESOLVED, that William Parsons be and he hereby is reappointed
as a member of the Town of Wappinger Planning Board to fill the vacancy
which has occurred due to the expiration of his term, and
BE IT FURTHER RESOLVED that the said William Parsons is
reappointed as a member of the Town of Wappinger Planning Board
for a term which shall expire January 4, 1995.

At this point, Mr. Valdati wished to discuss the preparation of the
Agenda for future Town Board meetings, since he felt the Board was
reorganizing procedures for the year. He recommended that the Agendas
be prepared and mailed out on the Tuesday prior to the scheduled
meeting in order to give the members ample time to study the material
and contact other sources for information they may need.
Mrs. Paino requested an opinion from the Town Clerk as this task is
performed by her and she concurred with Mr. Valdati and had no problem
with this change.
MR. VALDATI moved that the Town Board Agendas be promulgated the
Tuesday prior to the Town Board Meeting.

The term of George Urciuoli, Member of the Zoning Board of Appeals
will expire on February 1st, 1991 and Mr. Urciuoli has indicated
to the Board that he will no longer be able to continue as a member
of this Board due to the responsibilities and commitments of his own
business.
Mrs. Paino requested the Town Clerk to forward a letter of thanks
to Mr. Urciuoli for his services to the Town as a Member and Chairman
of the Zoning Board of Appeals.

The following Resolution was offered by COUNCILMAN REIS who
moved its adoption:
RESOLVED, that James Tompkins, be and he hereby is appointed
as a member of the Town of Wappinger Zoning Board of Appeals to
fill the vacancy which has occurred due to the resignation of
George Urciuoli, and
BE IT FURTHER RESOLVED, that the said James Tompkins is hereby
appointed to the said Zoning Board of Appeals for a term which shall
expire February 1, 1991.

Mr. Valdati stated prior to the vote on this resolution that he
would like the appointment to be tabled to the next regular meeting
in order to be given the opportunity to be provided with a resume on
Mr. Tompkins and be knowledgable of his background and suitability
for this position. It was his understanding that appointments would
be made only after the members were acquainted with the individual
being considered for a specific position.
Mrs. Paino, on the other hand, felt that the Town Board had ample
time to have this knowledge as they knew previously what appointments
would be made at the Reorganizational Meeting.
Although Mrs. Smith voted for this appointment, she noted that she
did so only because she knew the individual and his qualifications,
however, she did agree with Mr. Valdati's statements.
A vacancy also existed on the Conservation Advisory Council due to
Mr. Semp's resignation.
MR. REIS moved to table action on this appointment.

Correspondence was received from George Urciuoli, former Member and

be appointed Chairman of this Board.

Mr. Valdati stated that he had not received this correspondence.

Board of Appeals for 1988.

appointed to the said Board of Architectural Review for a term which
shall expire January 20, 1993.

Dear Supervisor Irene Paino and Town Board Members:
Now that I am a Councilperson for the Town of Wappinger, I must
resign my position on the Architectural Review Board.
I want to thank the Town Board for the opportunity to serve on
the Board. I found Mr. Richard Cirulli, the Chairperson, very
pleasant to work with.
My appointment was for a four (4) year term. I have served one (1)
year, leaving a three (3) year appointment to be filled.
Mr. Cirulli's appointment was for one (1) year and has expired.
I would like to recommend that he be reappointed to fill the
three (3) year position, and asked to serve as Chairperson
again. He is dedicated, well qualified and has proven his
sincere interest in the Town of Wappinger.

The next matter was to appoint a Board of Ethics and Mrs. Paino
requested the Board Members to offer their appointment to this Board.

County Civil Defense for appointment to the position of Civil
Defense Director for the Town of Wappinger for 1988.

The Supervisor submitted the following appointments of Town Board
Standing Committees for 1988/1989.
All five Town Board Members (Irene Paino, Vincent Farina, David Reis,
Constance Smith and Robert Valdati) belong to each standing committee.
The committees and their respective chairman are listed below. It
is the responsibility of the chairman to make committee reports.

Mrs. Paino explained that Councilwoman Smith was appointed Chairman
to the Committees formerly chaired by the Fourth Ward Councilwoman.
The only problem this presented was that the Town Board Liason
for the Dutchess County Airport Advisory Committee and the Dutchess
County Dial -A -Ride was also chaired by that person, however, in this
case Mrs. Smith works for Dutchess County and Mrs. Paino felt there
might be a conflict of interest. These appointments were tabled
and referred to the Attorneys to the Town and County for their
legal opinion.

The Highway Superintendent had requested to be authorized to advertise
for bids for three sanders, however, due to illness he was not present
and this matter required further discussion with both him and the
Comptroller.
Mrs. Paino congratulated Councilwoman Smith, representing Ward 4
upon the completion of her first meeting and offered her assistance
whenever it was needed.
There was no other business to come before the Board.
MRS. PAINO moved to close the meeting, seconded by Mr. Reis and
unanimously carried.
