NOW, THEREFORE, BE IT RESOLVED, as follows: 1. The recitations above set forth are incorporated in this Resolution as if fully set forth and adopted herein. 2. Pursuant to and in accordance with the provisions of Section 106 of the Town Law, and other applicable provisions of law, the annexed detailed statement of estimated expenditures and revenues is hereby approved and adopted as the Preliminary Budget of the Town of Wappinger for the fiscal year beginning January 1, 2011. 3. The Preliminary Budget adopted herein shall forthwith be filed in the Office of the Town Clerk in the Town of Wappinger where it shall be available for public inspection on weekdays between 8:30 a.m. and 4:00 p.m. 4. The Town Board of the Town of Wappinger shall meet at Town Hall, 20 Middlebush Road, Wappingers Falls, New York on the 4th day of November, 2010 at 6:00 p.m. and then and there shall hold a Public Hearing upon such Preliminary Budget. 5. The Town Clerk of the Town of Wappinger shall give Notice of such Public Hearing in the format attached hereto by publishing Notice thereof in the Southern Dutchess News, the official newspaper of the Town of Wappinger, and also in the Poughkeepsie Journal, at least five (5) days prior to the scheduled Public Hearing and the Town Clerk shall cause a copy of said Notice to be posted on the sign board of the Town no later than five (5) days before the scheduled Public Hearing. 6. This Resolution shall take effect immediately. Supervisor Colsey sets a Special Town Board Meeting Supervisor Colsey set a Special Town Board Meeting for Saturday, October 23rd, 2010, at 5:00 PM, to discuss the Preliminary Budget, accept the Preliminary Budget and set a Public Hearing on the Preliminary Budget. During New Business, an actual motion was made to set the Meeting for 1:00 instead. VII. Resolutions RESOLUTION: 2010-330 Resolution Cancelling Town Board Meeting of October 25, 2010 WHEREAS, the Town of Wappinger Town Board regularly holds its public meetings on the second and fourth Monday of each month as designated at the annual re -organization meeting; and WHEREAS, the Town Board held public meetings on October 4, 12, 18 and 21 to address matters pertaining to the Tentative and Preliminary Budgets; and NOW, THEREFORE, BE IT RESOLVED, that the Town Board hereby cancels the Town of Wappinger Page 3 Printed 10125/2010 Special Meeting Minutes October 21, 2010 meeting scheduled for Monday, October 25, 2010. BE IT FURTHER RESOLVED, that the Town Board directs the Town Board to post and publish the adopted amendment to the Town Board schedule for 2010. RESOLUTION: 2010-331 Resolution Naming a Private Road in the Swenson Subdivision WHEREAS, there is a private road located in the Swenson Subdivision on the north side of New Hackensack Road in the Town of Wappinger without an authorized name; and WHEREAS, it is important to establish a name for these roads in order to ensure an efficient process for emergency response personnel; and WHEREAS, the Applicant has proposed the name of "Fernbrook Lane" for this private road; and WHEREAS, Jim Tompkins, Program Assistant for Dutchess County Emergency Response, has determined that there are no conflicts with the name "Fernbrook Lane", as established through a memo dated October 14, 2010; and WHEREAS, the Town of Wappinger Fire Prevention Bureau has determined that there are no conflicts with the name "Fernbrook Lane," as established through a memo dated October 14, 2010. NOW, THEREFORE, BE IT RESOLVED, the Town Board authorizes formally naming the private road located in the Swenson Subdivision, on the north side of New Hackensack Road in the Town of Wappinger, as "Fernbrook Lane." RESOLUTION: 2010-332 Resolution Approving Statewide Inspection Service as an Approved Electrical Inspector WHEREAS, Chapter 114 of the Town Code of the Town of Wappinger requires all electrical installations to be in conformity with the National Electrical Code and the New York State Uniform Code; and WHEREAS, Section 114-4. permits the Town Board to authorize and approve qualified electrical inspection agencies to make inspections, re -inspections, and to approve or disapprove any electrical installations within the Town of Wappinger to insure compliance with the National Electrical Code and the New York State Uniform Code; and WHEREAS, Statewide Inspection Service, with an address of 8 North Lawn Avenue, Elmsford, NY 10523, has requested to be an approved electrical inspection agency for the Town of Wappinger; and WHEREAS, Sal Morello, Code Enforcement Officer for the Town of Wappinger, has Town of Wappinger Page 4 Printed 10/25/2010 Special Meeting Minutes October 21, 2010 reviewed the qualifications of Statewide Inspection Service to act as an electrical inspector for the Town of Wappinger, and said Sal Morello has determined that the aforesaid organization meets all criteria required by the National Electrical Code to qualify as an electrical inspection agency; and WHEREAS, Sal Morello has recommended that Statewide Inspection Service be approved to provide professional ministerial electrical inspection services for all electrical installations within the Town of Wappinger, to assure compliance with the National Electrical Code and the New York State Uniform Code. NOW, THEREFORE, BE IT RESOLVED, as follows: 1. The recitations above set forth are incorporated in this Resolution as if fully set forth and adopted herein. ,., 2. Statewide Inspection Service, with an address of 8 North Lawn Avenue, Elmsford, NY 10523, is hereby approved as a qualified electrical inspector for the Town of Wappinger and is authorized to provide ministerial electrical inspection services for all electrical installations within the Town of Wappinger, to insure compliance with the National Electrical Code and the New York State Uniform Code. 3. Statewide Inspection Service, with an address of 8 North Lawn Avenue, Elmsford, NY, 10523, is further appointed as an agent of the Town of Wappinger to make electrical inspections and any necessary re -inspections of all electrical installations made in the Town of Wappinger, in accordance with Chapter 114 of the Code of the Town of Wappinger. Vlll. New Business Supervisor Colsey New Business Supervisor Colsey noted that a resident has appealed to the Town Board for credit towards his water bill. The resident would have to pay the bill before the next Town Board Meeting. He is proposing that, since he was under the minimum in the 2nd quarter, he would like to apply a credit towards the 3rd quarter. The Supervisor received a letter from CAMO that notes that the meter was checked and there was no malfunction. Discussion followed. The consensus of the Board was to deny the request. Councilman Beale stated that the Board should determine what they expect to achieve on Saturday so that they can reach consensus. Discussion followed. Councilman Bettina stated that it was 5:00 O'clock, he had been at the Meeting for five hours, he had another appointment to attend and he would see everyone on Saturday. Councilwoman Czarniecki stated that she would like to call for another vote on the Preliminary Budget. She went on to say that, when the Supervisor adds back in to his budget that was distributed, the items that were not discussed at this Meeting, the difference is only a matter of dollars. She stated that the Board spent a lot of time at this Meeting and to not move forward would be a complete waste of her time. She demanded that the Board have another vote. Supervisor Colsey explained that, since she was on the losing side of the first vote, she is not entitled to call for another vote. Councilman Beale asked if was possible to have the Meeting Saturday afternoon. Supervisor Colsey noted that he would not have time to address Councilman Bettina's request to look into a specific item. The Supervisor had asked if Councilman Bettina was willing to make the call to the Office of the State Comptroller. Councilman Bettina was not willing to make the call. Supervisor Colsey clarified that he is not sure of Councilman Bettina's concern and Councilman Bettina is not willing to make the call. Discussion followed. Supervisor Colsey noted that Councilman Bettina has excused himself from the Meeting prior to the Meeting closing. Therefore, the quorum has changed. The motion was seconded by Councilman Paoloni and passed unanimously.
