The Regular Bimonthly Meeting of the Town Board of the Town of
Wappinger was held on NOvember 3, 1986 at the Town Hall, Middlebush
Road, Town of Wappinger, Dutchess County, New York.
Supervisor Paino opened the Meeting at 7:30 P.M.
Present:

The Meeting started with the Pledge of Allegiance to the Flag.
Reports were received from the Building Inspector for the months of
June thru September.
MR. REIS moved to accept the reports from the Building Inspector
and place them on file.
Seconded by Mr. Farina
Motion Unanimously Carried
The Minutes of the Regular Bimonthly Meeting of October 20, 1986,
having previously been forwarded to all Board Members, were now
placed before them for their consideration.
MR. FARINA moved that the Minutes of the October 20, 1986 Regular
Bimonthly Meeting be and they are hereby approved, as submitted by
the Town Clerk.

Petitions and Communications ---
A communication was received from the State of New York Equalization
and Assessment relating to a new law effective January 1, 1987,
which will allow the elderly and the disabled to designate a third
party to receive duplicate copies of their tax bills and notices
of unpaid taxes. Eligible taxpayers must file their applications
by a designated date which the Town Board is required to set. The
Director of Dutchess County Real Property Tax Office recommended
that November 15, 1986 be adopted as the deadline date for filing
this application with the tax collecting officer.
MR. REIS moved to set November 15, 1986 as the deadline date for

the eligible taxpayers to file their applications designating the
third party to receive their tax bills.

MRS. PAINO moved to forward a letter to the State Division of
Equalization Assessment indicating that the Town Board objects to
the burden placed upon the municipalities relating to the cost of
the involved paper work required for Third Party Notification.

A communication in the form of a Resolution was received from the
Planning Board resolving that they have been designated the lead
agency in the application by Jeanette Yanitelli, CLy Realty Corp.,
for subdivision approval of 18 lots on Smithtown Road.
MR. REIS moved to accept the communication and place it on file.

A copy of a letter to John DeCarlo, Deputy Highway Superintendent
from the Engineer to the Town, Joseph Paggi, was forwarded to the
Town Board and related to work remaining to be done on three roads
in the Town---Sabia Drive, Schuele Drive and Peel Lane, before they
can be dedicated to the Town.
MRS. PAINO moved to accept the correspondence and place it on file.

The following letter was received from the Dutchess County Commissioner
of Public Works, James Spratt, in response to our letter regarding
the placement of County Road Name Signs:

RE: Road Name Signs, County Road Intersections
Dear Elaine:
This is to acknowledge receipt of your letter dated September
16, 1986 wherein you have passed on to me complaints from residents
regarding the lack of road names at road intersections.

Please be advised that when the County entered into the road
identification program, which includes the numbering of all County
roads and the placement of signs on the roads to indicate those
numbers, the question of road names did come up. At that time a
decision was made that the County would not be responsible for
road names on any of the intersections along County highways.
This is primarily attributed to the fact that the towns have
total control for the naming of roads; as an example, our County
Road #21, I believe, has four names as it changes communities
progressively from west to east across the midsection of the
County. With the town having that control we have never taken
on the responsibility to place road names on intersections along
the County highway system. We have always felt that this is a
local concern and has local controls; therefore, we should not be
a part of that decision making nor part of that decision and
operation.
This policy has been established now for a great many years
and I cannot see that in the near future we would ever get into
the situation of placing road names at our intersections. We
have invested considerably into the route numbering system and
it meets all of the criteria required of us in the Manual for
Uniform Traffic Control Devices which governs the signing of
our roads.

MRS. PAINO moved to direct a letter to Commissioner Spratt
indicating that the Town Board takes exception with his comment;
the County has never taken. the responsibility to place road
names on intersections along the County highway system, and
the Town would appreciate the return of the County Road Name
Signs that were removed and the Town Highway Superintendent will
place these signs on the existing poles if the County has no
objection.

Mrs. Paino also requested that if the County has a problem with
returning these signs, that they please set them aside so the
Town can pick them up. The signs that were placed several years
ago included All Angels Hill Road, New Hackensack Road, Old Hopewell
Road and Meyers Corners Road.
Bernice Mills was recognized by the Chair and commended the Board
for taking this action. She felt the numbers were confusing and
it is our Town, We should know the names of the roads.

Resolutions ---
A Public Hearing having been held by the Town Board on a proposed
Local Law Increasing Tax Exemptions on Real Property owned by
Senior Citizens, the matter was now placed before them for their
consideration.
MR. FARINA moved to adopt Local Law #4 of 1986 as follows:
This Local Law amends the provisions of the following local
laws providing for partial tax exemptions of real property owned
by certain persons with limited income who are 65 years of age or
older by implementing the provisions of Chapter 991 of the Laws
of 1983 and Chapter 756 of the Laws of 1986.
A Local Law amending Local Law No. 1 of 1967, Local Law No. 5
of 1977, Local Law No. 2 of 1980, Local Law No. 6 of 1980, Local Law
No. 7 of 1982 and Local Law No. 8 of 1983.
BE IT ENACTED by the Town Board of the Town of Wappinger,
Dutchess County, New York as follows:
SECTION I: Section 2(b) of Local Law No. 1 of 1967,
Section 2 of Local Law No. 5 of 1977, Local Law No. 2 of 1980,
Local Law No. 6 of 1980 and Local Law No. 7 of 1982 and Local Law
No. 8 of 1983 are hereby amended to read as follows:
Section 2(b): The income of the owner or the combined income
of the owners of the property shall not and may not exceed the sum
of Twelve Thousand and Twenty -Five ($12,025.00) Dollars for the
income tax year immediately preceding the date of making the
application for exemption. The income tax year shall mean the
twelve month period for which the owner or owners filed a federal
personal income tax return, or if no such return is filed, the
preceding calendar year. Where title is vested in either the
husband or the wife, their combined income may not exceed such
income. Such income shall include social security and retirement
benefits, interest, dividends, net rental income, salary or earnings,
and net income from self-employment, but shall not include a return
of capital gifts or inheritances. Rental income and self-employment
shall not be reduced by an allowance for depreciation.
SECTION II: Section 2(c) of Local Law No. 8 of 1983 is
hereby amended to read as follows:
Section 2(c): If the income of an eligible property owner or
the combined income of the owners of the property exceeds the sum
of $12,025.00 for the income tax year immediately preceding the
date of making the application for tax exemption and is not greater
than $15,025.00, said owner shall be entitled to a partial exemption
as follows:

In administration of the foregoing, the provisions of Section
2(b) shall be applicable other than the provisions limiting income

SECTION III: This Local Law shall take effect immediately
upon adoption and filing.

Town Board, on the Benefit Assessment Rolls for the Central
Wappinger Water Improvement Area, Oakwood Water District, Fleetwood
• Water District, Tall Trees Water Improvement Area, Ardmore Water
Improvement Area, Wappinger Sewer Improvement Area, Wildwood Sewer
District, Fleetwood Sewer District, Mid -Point Sewer District and
Watch Hill Sewer District, the matter was now placed before them

for their consideration.
The following Resolution was offered by COUNCILMAN FARINA who moved
its adoption:
WHEREAS, the Town Assessor did prepare at the direction of the
Town Board, the Assessment Roll for the Central Wappinger Water
Improvement Area, for the assessment to be levied in 1987, and
WHEREAS, said Assessment Roll was filed with the Town Clerk
of the Town of Wappinger, and
WHEREAS, she thereafter gave notice by posting upon the
bulletin board of the Town and in the newspaper published within
the Town of the time and place when the Town Board would conduct
a hearing and hear objections upon or to said roll, and
WHEREAS, the Town Board of the Town of Wappinger did meet on
the 3rd day of November, 1986, to consider and hear objections of
said roll,
NOW, THEREFORE, BE IT RESOLVED, that the Assessment Roll of
1986, for the Central Wappinger Water Improvement Area for taxes
to be collected in 1987, be approved, ratified and confirmed and

The following Resolution was offered by COUNCILMAN FARINA who moved
its adoption:
WHEREAS, the Town Assessor did prepare at the direction of the
Town Board, the Assessment Rolls for the Watch Hill Sewer District,
for the assessment to be levied in 1987, and
WHEREAS, said Assessment Roll was filed with the Town Clerk
of the Town ofWappinger, and
WHEREAS, she thereafter gave notice by posting upon the
bulletin board of t1e Town and in the newspaper published within
the Town of the time and place when the Town Board would conduct
a hearing and hear objections upon or to said roll, and
WHEREAS, the Town Board of the Town of Wappinger did meet
on the 3rd day of November, 1986, to consider and hear objections
of said roll,
NOW, THEREFORE, BE IT RESOLVED, that the Assessment Roll
of 1986, for the Watch Hill Sewer District for taxes to be
collected in 1987, be approved, ratified and confirmed and
adopted, and the Supervisor and Town Clerk are hereby authorized
and directed to execute the warrant for collection of said taxes.

Since the Assessment Rolls for the Rockingham Farms Sewer District
were not completed for the scheduled Public Hearing, it was required
that the Town Board set another date and time for this District.
Mrs. Paino set the Public Hearing for the Benefit Assessment Rolls
for the Rockingham Farms Sewer District on November 17th, 1986 at
7:28 P.M.
A Public Hearing having been held by the Town Board on September
25th, 1986 in the matter of the increase and improvement of the
facilities of the Rockingham, Wildwood, Midpoint and Fleetwood
Sewer Districts, the matter was placed before them for their
consideration:
The following Resolution was offered by COUNCILMAN REIS who moved
its adoption:
A RESOLUTION AUTHORIZING THE ISSUANCE OF $299,000
SERIAL BONDS OF THE TOWN OF WAPPINGER, DUTCHESS
COUNTY, NEW YORK, TO PAY THE COST OF THE INCREASE
AND IMPROVEMENT OF THE FACILITIES OF THE ROCKINGHAM,
WILDWOOD, MIDPOINT AND FLEETWOOD SEWER DISTRICTS.
WHEREAS, pursuant to proceedings heretofore had and taken in
accordance with the provisions of Section 202-b of the Town Law, and
more particularly an order dated September 2nd, 1986, the Town Board
of the Town of Wappinger, Dutchess County, New York, has determined
it to be in the public interest to increase and improve the
facilities of the Rockingham, Wildwood, Midpoint and Fleetwood
Sewer Districts in said Town; and
WHEREAS, such increase and improvement consists of the purchase
and installation of sand filters and the detection and location
of inflow and infiltration throughout the sewer systems of the
Rockingham, Wildwood, Midpoint and Fleetwood Sewer Districts; and
WHEREAS, the maximum amount proposed to be expended for said
overall improvement is $299,000, of which amount $181,000 shall be
allocated as the Rockingham Sewer District's share of the cost of
such increase and improvement of facilities, of which amount
$26,0000 shall be allocated to the Wildwood Sewer District, of
which amount $71,000 shall be allocated to the Midpoint Sewer
District and of which amount $21,000 shall be allocated to the
Fleetwood Sewer District; and
WHEREAS, It is now desired to provide for the financing thereof;
NOW, THEREFORE, BE IT
RESOLVED, by the Town Board of the Town of Wappinger, Dutchess
County, New York, as follows:
Section 1. For the specific object or purpose of paying
the cost of the increase and improvement of the facilities of the
Rockingham, Wildwood, Midpoint and Fleetwood Sewer Districts of
the Town of Wappinger, Dutchess County, New York, in the manner
prescribed in the preambles hereof, there are hereby authorized
to be issued $299,000 serial bonds of the Town of Wappinger,
Dutchess County, New York serial bonds of the Town of Wappinger,
Dutchess County, New York pursuant to the provisions of the Local
Finance Law.
Section 2. It is hereby determined that the maximum
estimated cost of the increase and improvement of the facilities
of the Rockingham, Wildwood, Midpoint and Fleetwood Sewer Districts
is $299,000 and that the plan for the financing thereof shall
consist of the issuance of the serial bonds of said Town Authorized
to be issued pursuant to this bond resolution. Further details
pertaining to said bonds will be prescribed in a further resolution
or resolutions of this Town Board.
Section 3. It is hereby determined that the period of
probable usefulness of the aforesaid specific object or purpose is
forty years, pursuant to subdivisions 1, of paragraph 2 of Section
11.00 of the Local Finance Law. It is hereby further determined
that the maximum maturity of the serial bonds herein authorized
will exceed five years.
Section 4. Subject to the provisions of the Local Finance
Law, the power to authorize the issuance of and to sell bond
anticipation notes in anticipation of the issuance and sale of
the serial bonds herein authorized, including renewals of such
notes, is hereby delegated to the Supervisor, the chief fiscal
officer. Such notes shall be of such terms, form and contents,
and shall be sold in such manner, as may be prescribed by said
Supervisor, consistent with the provisions of the Local Finance
Law.
Section 5. The faith and credit of said Town of Wappinger,
Dutchess County, New York, are hereby irrevocably pledged to the
payment of the principal of and interest on such obligations as the
same respectively become due and payable. An annual appropriation
shall be made in each year sufficient to pay the principal of and
interest on such obligations becoming due and payable in such year.
Section 6. the validity of such bonds and bond anticipation
notes may be contested only if:
(1) Such obligations are authorized for an object or purpose
for which said Town is not authorized to expend money, or
(2) The provisions of law which should be complied with at the

IN THE MATTER OF THE INCREASE AND IMPROVEMENT
OF THE FACILITIES OF THE ROCKINGHAM, WILDWOOD,
MIDPOINT AND FLEETWOOD SEWER DISTRICTS IN
THE TOWN OF WAPPINGER, DUTCHESS COUNTY,
YORK.
WHEREAS, the Town Board of the Town of Wappinger, Dutchess
County, New York, has duly caused to be prepared a plan and
estimate of cost, pursuant to Section 202-b of the Town Law,
relating to the increase and improvement of the facilities of
the Rockingham, Wildwood, Midpoint and Fleetwood Sewer District;
and
WHEREAS, at a meeting of said Town Board duly called and
held on September 2, 1986, an order was duly adopted by it and
entered in the minutes reciting the filing of such plan and
estimate of cost, the improvement proposed and the maximum
aggregate amount proposed to be expended for the improvement,
to -wit: the sum of two hundred and ninety nine thousand dollars
($299,000) and specifying that the said Board would meet to
consider the plan and estimate of cost and the increase and
improvement of the facilities of the Rockingham, Wildwood,
Midpoint and Fleetwood Sewer Districts and to hear all persons
interested in the subject thereof concerning the same at 20
Middlebush Road, in Wappinger, New YOrk, in said Town, on the
25nd day of September, 1986, at 7:15 o'clock P.M., Prevailing
Time; and
WHEREAS, the said order duly certified by the Town Clerk was
duly published and posted as required by law, to -wit: a duly
certified copy thereof was published in the W. & S. D. News, the
official newspaper of this Town, on September 10, 1986, and a
copy of such order was posted on September 10,1986 on the
signboard maintained by the Town Clerk of the Town of Wappinger,
pursuant to Section 30, subdivision 6 of the Town Law; and
WHEREAS, a public hearing was duly held at the time and
place set forth in said notice, at which all persons desiring to
be heard were duly heard; NOW, THEREFORE, BE IT
ORDERED, by the Town Board of the Town of Wappinger, Dutchess
County, New York, as follows:
Section 1. Upon the evidence given at the aforesaid public
hearing, it is hereby found and determined that it is in the public
interest to make the improvement, in the manner described in the
preambles thereof, at a maximum aggregate estimated cost of
$299,000, of which amount $181,000 shall be made on behalf of
the Rockingham Sewer District, of which amount $26,000 shall be
made on behalf of the Wildwood Sewer District, of which amount
$71,000 shall be made on behalf of the Midpoint Sewer District
and of which amount $21,000 shall be made on behalf of the
Fleetwood Sewer District.
Section 2. This order shall take effect immediately.

One bid on Phase VI, Stream Cleaning and Storm Drainage Improvement
Program (Edgehill Area) was received and opened on October 31, 1986.
The results were as follows: Sun -Up Enterprises, $64,227.00 - Section A.
The following is an excerpt of a report received from the Engineer:
"This was the only bid submitted and was for Section A only.
There were no bids submitted for Section B. For your information,
Section A was the pipe replacement work and Section B was the
stream cleaning.
The price submitted was over the estimated cost and should be
rebid. This could be due to=the _amount of__construction_work
available in the area at this time or the inherent nature of
the job.
As you know, this is the third time Section B has been bid
without submittals. I suggest that the Attorney be contacted
to determine another avenue of executing this project.
If there are any questions, please contact this office".
Mrs. Paino questioned the Engineer on how much this bid was over the
estimated cost. Mr. Paggi replied that it was 50% of their estimation
of the cost of the project.
MRS. PAINO moved to reject the bid from Sun -Up Enterprises in the
amount of $64,227.00 for the Stream Cleaning Project.

Unfinished Business ---
Mr. Farina referred to correspondence received from Mr. Erichsen of
U. S. Cablevision in response to our request for Channel 62 reception
for Town residents at no additional cost. Due to information received
in recent surveys the Company conducted, they have informed the New
York State Cable Commission and copied the Town Board, that beginning
January 1, 1987, they will provide WTZA-TV62 and two other channels
(Discovery and the Cable Value Network) to our residents.
On a related subject, Alberta Roe was recognized by the Chair and
complained about the cable trucks snapping off branches of trees
in their area; she asked if the Town could do anything about this
matter which could be dangerous as well as destructive.
Mr. Farina requested that a letter be forwarded to Mr. Erichsen
informing him that the cable trucks are being operated in an unsafe
manner and creating a public hazard.

Mrs. Paino referred to correspondence received from the Highway
Department requesting permission to go to bid on highway equipment
MRS. PAINO moved to authorize the Highway Department to go to bid
on the following equipment: Two (2) Model 2554 Diesel Dump Trucks
with plows, one (1) Model 1954 Diesel Dump Truck with plow, one (1)
Lee Boy Paver, one (1) Chevrolet Diesel Dump, two yards and one (1)
Diesel Pickup.
Seconded by Mr. Bracone
Motion Unanimously Carried
Mrs. Paino requested that the Highway Department be informed to
delete "Chevrolet" when preparing the specs for the equipment.
Correspondence was received from Dutchess County regarding the
C.D. Program (Consortium Funds), indicating that the Town of
Wappinger will be receiving an additional $7,000 in C.D. Funds.
Mrs. Paino proposed that these funds be used to supplement the
Hilltop Aquifer Protection Project which has been in existence
since 1984.
Mrs. Paino requested the Town Clerk to place an advertisement in
the official newspaper of the Town indicating that this matter will
be on the Town Board Agenda of November 17, 1986 for the consideration
of the Town Board and all interested persons are invited to attend
and offer their comments.
In response to the Town Clerk's question on the necessity of a public
hearing on the use of these funds, Mrs. Paino replied that she had
spoken to the pertinent agency in the County and was informed that
since it is an amendment to an approved project, it was not required
to hold a public hearing. It was sufficient to address it at a Town
Board Meeting and include the use of the funds in the Minutes; also
place an ad in the paper.
There was no other business to come before the Board.
MR. FARINA moved to adjourn the meeting, seconded by Mr. Bracone and
unanimously carried.

(D.W.S.) also objected to the Benefit Assessment Roll, inadvertently,
since this was not the pertinent Hearing for grievances from this
Company. He, too, was informed to present this objection at the
proper Public Hearing.

Dear Town Board Members:
It is respectfully requested that you consider the following
matters relative to our client, Pizzagalli Development Company.
In regard to operation and maintenance (0 & M) charges in the
Sewer Improvement Area, Pizzagalli is paying a disproportionate
amount. Pizzagalli's buildings on Meyers Corners Road (IBM Buildings
920, 921 and 922) contribute approximately 19.5% of the total flow.
However, Pizzagalli is paying approximately 69.4% of the total
charges. This is based on payments of $70,194.56 as compared to
total billings of $101,238.97 in 1985-1986.
A further comparison of the benefit units assessed against
Pizzagalli for retirement of capital costs shows that it was
assessed 37.68% of the capital budget in 1985-86. This assessment
is disproportionately high since the formula used is to divide
the average residential assessment into the assessment on commercial
property to determine the units assigned to the commercial property.
Many of the lots in the Sewer Improvement Area are unimproved (e.g.
Cranberry Hill Subdivision has 440 units, each with a low assessment),
resulting in an average residential assessment valuation that is too
low. It is our position that improved residential lots should be
compared to improved commercial property. This is graphically
illustrated by the fact that the average residential assessment in
the Central Water Improvement Area is $7,900.00 per unit, but is
only $5,400.00 per unit in the Central Sewer Improvement Area.
This results in a debt payment by Pizzagalli of almost one and
one-half (i) times as much toward the sewer capital costs. We
submit that an equitable use of the formula would result in an
average residential assessment closer to $7,900.00 for assessing
capital costs charged to Pizzagalli.
The disproportionate sewage operation and maintenance costs
are summarized on the attached exhibit. This shows that although
Pizzagalli only contributes 19.5% of the flow, and is assessed
37.68% of the capital budget, it is paying almost 70% of the
operation and maintenance budget.
In our opinion, these allocation formulas are unreasonable
and unfair.

Mr. Herbert Wallace, Attorney for Cranberry Hills Development (D.W.S.)
objected to their inclusion in the district for the number of units
which are included and formerly adopted as a form of vacant land and
also has a formula for lands that cannot be served in the judgment
of the Assessor, shall be assessed at one-third of the full benefit
units which would normally be assigned if the property could be
served. Mr. Wallace continued his presentation and referred to a
letter his client received from Dr. John R. Scott, Dutchess County
Commissioner of Health, dated June 24, 1986 where he stated on that
date "the Oakwood Knolls facility exceeds full capacity which precludes
any additional hookups. You may advise the court that Cranberry Hills
proposed development will be unable to obtain approval for any
connections in the Oakwood Knolls facility". Since they have contested
this roll for years before, they have received final approval and
"I respectfully submit, since we cannot have any hookups, we should
be assessed as vacant residential land which provides for .8 benefit
units for less than 2 acres and in excess of 2 acres, .8 benefit units
for the first 2 acres, .2 benefit unit for each acre in excess
of 2 acres". He also pointed out, relating to the formula that previous
Town Boards' have adopted and he assumed this Board would adopt for
the assessment that the resolution states that "lands which cannot
be served in the judgment of the Assessor shall be assessed at one-
third of full benefit units which would normally be assigned if the
property could be served". On that basis he objected, on behalf of
his client, to the assessment as it relates to Cranberry Hills.
Mrs. Paino asked if there were any further comments from the audience
either for or against this Roll.
There were no other comments made by the audience either for or against
the Wappinger Sewer Improvement Area #1 Benefit Assessment Roll.
As a matter of information and public record, Mrs. Paino stated that
the Town of Wappinger is preceding to build a new plant to service
the entire WSIA#l, and secondly, although the Health Department may
have sent the letter to Mr. Wallace, it was her understanding and
concern that if they were interested in building in that area of the
Town, more than likely they would be unable to because they are not
currently able to be served by water.
MR. BRACONE moved to close the Public Hearing, seconded by Mr. Reis
and unanimously carried.

Mrs. Paino asked for comments from the audience either for or against
the Benefit Assessment Roll for the Wildwood Sewer District.
Bernice Mills, a resident of the District asked how many users there
are in the District; the response was 338.77 benefit units which is
the figure used to determine the rate. Mrs. Mills asked where the
money was being spent, was it for the X -Ray machine for the plant.
Mrs. Paino added that Wildwood has a capital indebtedness for 1987
of $27,168.00, in addition, $7,800 will be assessed to that District
for the leak detection study. Mrs. Mills did not think it added up --
the increase to the amount of users. It was explained that the figure
of $7,800 represented the principal and interest for the first year
for the B.A.N needed for the improvements to that plant; the rate
was being set for just one year; the second year the principal of the
bond will be reduced and the third year it will be further reduced;
they will be decreased every year. It was further explained that the
work that is being done on the plant has been mandated by the D.E.C.
Another question posed by Mrs. Mills ---if they find something else
wrong does that mean additional money will be assessed to the users.
The portion assessed to Wildwood for the improvement to the sewer
plants will be $26,000. The Engineer gave a breakdown of the monies
assessed to Wildwood for the bond. Mrs. Mills asked if any was coming
out of the operation and maintenance fund and was told this is over and

tal income and self-employment shall not
be reduced by an allowance for
depreciation.
SECTION II: Section 2(c) of Local Law
No. 8 of 1983 is hereby amended to read ,
as follows:
Section 2(c): If the income of an eligible
property owner or the combined Income of
the owners of the property exceeds the sum
of $12,025.00 for the Income tax year im-
mediately preceding the date of making the
application for fax exemption and Is not
greater than $15,025.00. said owner shall_
be entitled to a partial exemption as follows:

$13025.00 40%
$13,525.00 35%
$14,025.00 • • 30%
$14,525.00 25% '1
$15,025.00 20%
In administration of the foregoing, the
provisions of Section 2(b) shall be ap-
plicable other than the provisions limiting
Income to $12,025.00.
SECTION III: This local law shall take ef-
fect immediately upon adoption and filing.
NOTICE IS FURTHER GIVEN that the
Town Board will conduct a Public Hearing
on the aforesaid proposed Local Law at the
