ADJOURNMENT /fa The Regular Meeting of the Town Board was held on September 2nd, 1986 at the Town Hall, 20 Middlebush Road, Town of Wappinger, Dutchess County, New York. Supervisor Paino opened the Meeting at 7:42 P.M. Present: Irene Paino, Supervisor Vincent Farina, Councilman David Reis, Councilman June Visconti, Councilwoman Absent: Joseph Bracone, Councilman (on vacation) Others Present: Joseph E. Paggi, Jr., Engineer Kenneth Croshier, Highway Superintendent The Meeting started with the Pledge of Allegiance to the Flag. The Minutes of the Regular Meeting of August 4th, 1986, having previously been forwarded to all Board Members, were now placed before them for their consideration. MR. FARINA moved that the Minutes of August 4th, 1986 be and they are hereby approved, as submitted by the Town Clerk. Seconded by Mrs. Visconti Motion Unanimously Carried Reports were received from the Town Justices for August, Receiver of Taxes and Hydrant Report for July. Mr. Farina commented per the footnote on the Hydrant Report indicating that the hydrants at Kent Road and Pippin Lane and Spook Hill Road at Hopewell Road were not replaced; Pippin Lane has not been replaced; hydrant replaced at Spook Hill Road 8/22/86. MR. FARINA moved to direct a letter to Camo Pollution Control requesting that the hydrant be replaced at Pippin Lane and Kent Road. Seconded by Mr. Reis Motion Unanimously Carried MRS. PAINO moved to accept the above stated reports and place them on file. Seconded by Mr. Reis Motion Unanimously Carried Petitions & Communications --- Mrs. Paino wished to deviate from the order of the Agenda and lel entertain Item 5o ---Ronald Andriello requests discussion on School Busses Mina Drive in situation for not coming in to NancyAleen Drive and parts of the Pondview Subdivision. In order to clarify the the residents present, the following resolutions were read into the Minutes. In the Matter of the Laying Out of Certain Town Roads known as "David Loop", "Mina Drive", "Bell Air Lane", "Grace Court", "Stanley Lane", "Nancyaleen Drive", and "Scotse Road" within the Pond View Subdivision in the Town of Wappinger, County of Dutchess and State of New York, as set forth in Filed Map No. 4700. HIGHWAY SUPERINTENDENT RECOMMENDATION I, KENNETH CROSHIER, Town Highway SUperintendent of the Town of Wappinger, have inspected the above named roads and do hereby recommend to the Town Board that the offer of dedication thereof as Town Roads be accepted by the Town Board. Seconded by Mr. Farina Motion Unanimously Carried In the Matter of the Laying Out of Certain Town Roads known as "David Loc", "Mina Drive", "Bell Air Lane","Grace Court", "Stanley Lane", "Nancyaleen Drive", and "Scotse Road" within the Pond View Subdivision in the Town of Wappinger, County of Dutchess and State of New YOrk, as set forth in Filed Map No. 4700 Resolution offered by SUPERVISOR PAINO RESOLUTION ACCEPTING DEDICATION OF TOWN HIGHWAYS AND AUTHORIZING LAYING OUT OF TOWN ROADS WHEREAS, the roads in this subdivision having been previously offered for dedication under Town Law Section 278 by virtue of the filing of said plat, and WHEREAS, the owner has now delivered a deed dedicating and releasing the above named roads to the Town of Wappinger as public highways, and WHEREAS, the Town Highway Superintendent and Town Engineer's Office have inspected the premises and recommended acceptance of these roads as Town Highways; NOW, THEREFORE, BE IT RESOLVED, that the Town of Wappinger hereby accepts the offer of dedication of said "David Loop", "Mina Drive", "Bell Air Lane", "Grace Court", "Stanley Lane","Nancyaleen Drive", and "Scotse Road" within the Pond View Subdivision (Filed Map No. 4700)) as public highways for all purposes, and the Town Attorney is hereby directed to cause the deed thereto to be duly recorded in the Dutchess County Clerk's Office, and it is further 19A RESOLVED, that the developer post a maintenance bond in the sum of $100,800.00 in a form approved by the Attorney to the Town, and be it further RESOLVED, that, in accordance with the provisions of Section 171 of the Highway Law of the State of New York, consent is hereby given that the Town Superintendent of Highways of the Town of Wappinger order the laying out of the aforesaid Town Roads as delineated in Schedule "A" annexed hereto, and be it further RESOLVED, that the Town Superintendent of Highways record said Order in his office and in the office of the Clerk of the Town of Wappinger, Seconded by: Councilman Farina Roll Call Vote: 4 Ayes 0 Nays (Mr. Bracone---Absent) Whereupon, the resolution was declared adopted by the Town Board of the Town of Wappinger. *Schedule "A" is attached hereto and made part of the Minutes of this Meeting. Mrs. Paino noted that she was aware there was concern on the part of the residents on whether the school busses would be coming into Nancyaleen and Mina Drives and surrounding roads; another concern was that the school had set up a bus stop on the corner of Spook Hill Road and Nancyaleen Drive. In order to put these concerns to rest, Mrs. Paino had contacted the Superintendent of Schools, Larry Gilmour who assured her that starting tomorrow morning (first day of school) and for the remainder of this week, there will be a school bus stop on the corner of Nancyaleen and Mina Drive. The School Department of Transportation will designate bus stops in the area of the roads accepted by the Town in the previous Resolution. Mr. Gilmour indicated that starting Monday morning, the busses will transport the children from the various stops within the area of the above mentioned roads, now accepted by the Town. This will be determined by Friday and parents will be notified of the designated bus stops. In the Matter of the Laying Out of Certain Town Roads known as "David Loop", "Mina Drive", "Bell Air Lane", "Grace Court", "Stanley Lane", "Nancyaleen Drive", and "Scotse Road" within the Pond"View Subdivision in the Town of Wappinger, County of Dutchess and State of New York, as set forth in Filed Map No.4700. ORDER The roads in this subdivision having been previously offered for dedication under Town Law Section 278 by virtue of the filing of said plat, and the owners thereof having now offered a proposed conveyance dedicating and releasing the above named roads to the Town of Wappinger as public highways, and the Town Board on September 2, 1986 having accepted the dedication of these roads as public highways, and consenting to the opening thereof, 113 NOW, THEREFORE, I, the Town Superintendent of Highways of the Town of Wappinger, County of Dutchess, State of New York do hereby determine and order that the roads hereinabove named and further described on Schedule "A" annexed hereto (pages 1-9) are hereby laid out at Town Highways. Dated: September 2, 1986 s/ Kenneth Croshier Town Superintendent of Highways Jeff Cooper was recognized by the Chair and asked when they could expect to have Stop Signs placed on the roads,also speed limit signs. Mr. Croshier replied that the speed limit is set by the State and he will check in the records to determine if a speed limit has been previously set for that area. For Stop Signs, the residents must request these in writing designating the intersections where they wish them to be placed and a law will have to be filed with the State once the Town approves the request. Mrs. Paino asked that they have their letter regarding the Stop Signs sent to the Town next week and it will be on the September 15th, 1986 meeting. Mr. Cooper then asked whose responsibility it would be if a child was hit on these roads and there are no Stop Signs installed. Now that the Town has taken over these roads, would it be their respon- sibility. As would be the case on all roads, whether Town owned or private, the driver would be responsible Mr. Cooper was told. Ronald Andriello was recognized by the Chair and strongly voiced his opinion that the Town accepted these roads tonight out of a clear blue sky after he and his wife went through a lot of aggravation in jumping on the backs of the Town Officials to resolve the issue. In the last few days they were told that the Town could do nothing, it was the developer's fault, he was told. Everything was blamed on the developer, Jeff Hunt. For two years he has been after the Town to accept these roads, now it is suddenly resolved. He was disgusted with the fact that if he and his wife had not pushed the Town, nothing would have been done. All of a sudden all of the problems that existed in that subdivision have been resolved. Mrs. Paino responded she was sorry for their aggravation, they should not have had to go through that, but she, the Highway Superintendent and the Engineer to the Town also went thru a lot of aggravation. Over a year ago, the Town signed an agreement with Jeff Hunt and representatives of Highland Glen Development which stated in part, "that the party of the second part (Jeff Hunt) will use its best efforts to complete the roadway system in Sections 2 & 3 (the back part of Pondview) of said Pondview Subdivision on or before September 1, 1985 to the satisfaction of the party of the first part (the Town)". This Agreement was so loosely worded, as to be ambiguous as as the Town having any muscle to make it binding. The clause"using their best efforts" means nothing and would never stand up in court if it came to that. Referring to the problems, Mrs. Paino continued, when she came into office in January of 1986, one of the first meetings she had was with the Highway Superintendent, the Engineer to the Town, Jeff Hunt, Keith Gordon and their Engineer, Jack Railing regarding the Pondview roads. This was one of the many that followed and Mrs. Paino relayed the history of these meetings, the developer's promises and their excuses for failing to fulfill these promises. All the corres- pondence that transpired between the Town and the developer were available to those interested. The developers were told during these various meetings that they would not be given approval for any future projects until they cleaned up their act in Pondview. At this point there are still some incomplete items and an agreement has been signed by the principals of Pondview setting forth a thirty day limit to complete the unfinished items. If they fail to perform during that time, the check in Mrs. Paino's possession in the amount of $100,800.00 will be expended by the Town to have the work completed. In addition there is a maintenance bond posted in that amount for the roads. The residents have obtained what they are concerned about, but it has not been a last minute arrangement as Mr. Andriello said, ---their children willnow have busses available to them in their own area. The Town has to keep plugging for the completion of the items and they do not appreciate the lack of action by Highland Glen Development nor from Barger, Gray, Campbell and Railing the engineering firm for the developer. In response to a question from Mr. Andriello on what they could do to prevent these problems from reoccurring, Mrs. Paino replied that she had been discussing this with the Engineer and the Attorney to the Town on what they could do to prevent a repeat performance short of banning them from building in the Town of Wappinger. The Engineer is putting together guidelines and descriptions as to what constitute3"as builts" which has not been wholly completed by Pondview. They have attempted to schedule the procedure of putting the back roads in and then move forward to the front portion; in this instance the front roads have been put in first and heavy vehicles are apt to ruin new driveways when travelingwith the materials to the back portion. Frank Versace was recognized by the Chair and for clarification purposes regarding Mrs. Paino's statement regarding the Agreement between Jeff Hunt and the Town of Wappinger being loosely worded he reminded Mrs. Paino that she was also a member of the Town Board that signed the Agreement. She had earlier indicated to the residents that the wording of the Agreement was the reason they couldn't make it stick. He further stated that the reason for the Agreement was basically that past Town Policy was never to assume responsibility of roads when there is undeveloped land within that specific area that's been approved by the Planning Board and they work them last, but because the developer had indicated he would not develop those lots in the very near future the Town Board deviated from normal procedure and entered into an Agreement of retention of $100,000.00 which the developer would forfeit if he developed the 10 acres of land because of drainage problems. Because the Town could not enter private roads to provide service to the taxpayers they entered into the aforementioned Agreement. He resented the description of a "loose Agreement". Although Mr. Versace thought the roads were plowed this past winter by the Highway Department, Mr. Croshier informed him he was wrong, they plowed only the two roads already dedicated to the Town; the other roads were served by a private contractor. Mr. Versace apologized for his statement. He continued his presentation stating that the developer has had enough time since their meetings in January and continued ones, to perform the work required---now they'll come up with the same excuses. He reiterated his opening statement that whatever items were wrong in 1985 pointed out by Mrs. Paino, were also her doing since she participated as a member of the same Town Board and agreed to the wording in the Agreement in order to help the residents. Mrs. Paino interrupted at this point since she felt he was repeating his statements. She rebutted that she also resented the "loosely worded" contract, but at that time the Town had another Attorney who put the wording together. The present Attorney, Jennifer VanTuyl has stated that if the Town thought of going to court on this Agreement, they wouldn't stand a chance due to the wording. The same problems )9e that existed last September continued thru the winter, but their excuses were well taken ---road materials could not be poured in below freezing weather. Compare the incompleted items in January with the work now remaining to be completed. Since she has handled the matter there is a small portion left to be done and it is mostly paperwork. The point now is the roads are accepted and the children of the area will have the facility of the school bus pickup near their homes, plus the other services they pay for. Mrs. Paino %If thanked the residents for their patience, and resumed the order of the Agenda. A notice was received from the Town Planning Board regarding Type I Action relating to the Pizzagalli application and included the Environmental Assessment Form submitted by them. The lead agency for this project must be designated within thirty days and comments were requested from involved agencies. MRS. PAINO moved to accept the correspondence from the Planning Board and place it on file. Seconded by Mr. Farina Motion Unanimously Carried MRS. PAINO moved to direct a letter to the Planning Board indicating that the Town Board agrees with designation of the Planning Board as lead agency. Seconded by Mr. Farina Motion Unanimously Carried A request was received from Achiel Vandewinckel for Town approval on water and sewer connection for his second parcel on Lake Oniad Drive; the first parcel has water and sewer facilities. Mr. Farina, Chairman of the Water and Sewer Committee reported that based on the information received from the Dutchess County Department of Health, a new lot can be served with water but not with sewer hookup unless it is an emergency. MR. FARINA moved to direct a letter to Mr. Vandewinckel informing him that the Town has approved a hookup to the water system, but according to present regulations, he cannot hook up to the sewer system. Seconded by Mr. Reis Motion Unanimously Carried 197 Mr. Tanveer Hussain wrote to the Town Board regarding the annoyance of having a sewer pump located in front of his home at 18 Bell Air Lane; on the same matter a report was received from our Engineer, Joseph Paggi, Jr. and correspondence from Keith Gordon of Highland Geln Devlopment Corp, developer of the Pond 'view Subdivision. Mr. Farina reported that there are problems with this pump station which he learned through speaking to the residents and Camo Pollution Control. Camo has responded to the alarm malfunction which occurs whenever it rains and has passed to cost to Highland Glen Development Corp. MR. FARINA moved to send a letter to Camo Pollution Control requesting that they investigate the problems and report their findings to the Town Board, also determine what financial responsibility Highland Glen Development Corp. has to the Town, and notify Mr. Hussian that Camo is investigating. Seconded by Mr. Reis Motion Unanimously Carried In compliance with a previous request from the Town Board, Mr. Victor Vivalda, 20 Shale Drive submitted a sketch of a proposed curtain drain installlation on his property to help eliminate a drainage problem. The Engineer to the Town and the Highway Superintendent had no objection to the curtain drain. MRS. PAINO moved to send a letter to Mr. Vivalda indicating that the Town has no objection to the construction of a curtain drain, however, he must be informed that there is no guarantee on the part of the Town that this installation will eliminate his problem. Seconded by Mrs. Visconti Motion Unanimously Carried Mrs. Dolores Gill wrote to the Board with regard to a water problem on her property at 45 Hilltop Drive where a 30 ft. right-of-way exists with a stream running through it. She had previously contacted Mrs. Ballard (former Councilwoman in her Ward) and the project went to bid twice with no success. It went out to bid again in 1986 and again with no success. It was her opinion that the Town realizes its responsibility and she urged them to at least consider her property if they cannot proceed with the entire project. Mrs. Paino concurred with these facts ---the Town has gone out to bid several times and received no bids on the entire project, however L as suggested by Mrs. Gill, she again concurred that the back section could be addressed. MRS. PAINO moved to authorize the Engineer to go to bid on the Edgehill/Hilltop Drainage Project, however, this time incorporate the lower section of that area, about 500 ft in from Pye Lane which will address Mrs. Gill's property and notify Mrs. Gill of this action. Seconded by Mr. Farina Motion Unanimously Carried Antonino Licari, of Nin -Lee Restaurant Corporation D/B/A Da Nino Restaurant notified the Town that he was submitting an application for renewal of his liquor license. MR. FARINA moved to receive this correspondence with no comments and place it on file. Seconded by Mrs. Visconti Motion Unanimously Carried Arthur Waddle, Secretary/Treasurer of the Hughsonville Fire District wrote to the Board requesting the use of one of the Town's Voting Machines for their Annual Election on December 9, 1986 from 7 P.M. to 10 P.M. MR. REIS moved to grant permission to the Hughsonville Fire District to use one of the Town's Voting Machines for their Annual Election on December 9, 1986, under the supervision of one of the Town's Voting Custodians.. Seconded by Mr. Farina Motion Unanimously Carried Notices of Public Hearings were received from the Town of Lloyd relating to a Local Law Declaring Moratorium on Application for Residential Developments and Subdivision Exceeding Two Lots, and from East Fishkill regarding a Local Law Creating a Conservation Residential Development Zone to Replace the Existing.Planned Residential Zone. MR. FARINA moved to receive these Notices of Public Hearings and placethem on file. Seconded by Mrs. Visconti Motion Unanimously Carried Mr. Barry Kaufman, a meter reader for the Town, wrote to Debbie Brown, the Town Water and Sewer Billing Clerk, regarding a problem he is having getting access to a water meter on property at 50 Tor Rd, /98 IT? due to dog problems. MRS. PAINO moved to direct a letter to the owner of the property requesting that they keep their dog under control so the meter reader has access to read the water meter, carbon copy Mr. Kaufman and request him not to cut across the lawn at said property. Seconded by Mr. Reis Motion Unanimously Carried A Memo was received from Hans Gunderud, Zoning Administrator re storage of abandoned cars which he takes possession of and holds pending notice to owners. The time involved is sometimes in excess of a month before the Town can legally auction off the vehicle and storage charges could exceed the value of the car itself. He requested that the Board designate an area on Town property (Highway Dept., recreation site, or Town Hall) as a holding area for such vehicles. Mr. Croshier informed the Board there was no room to store these cars at the Highway Garage. Mrs. Paino will contact Mr. Gunderud and ask for another recommendation. A request was received from Central Installation Co. for release of their retainage fee posted for their contract with the Town on installing water meters. According to this communication the amount of the retainage fee is $7,333.70. Mrs. Paino checked with the Assistant to the Comptroller who determined that the correct amount to be returned is $7,123.38. MR. FARINA authorized the Comptroller to return the retainage fee amount of $7,123.38, which represents the final amount due to Central Installation Co. on their contract with the Town to install water meters in Central Wappinger Water Improvement Area. Seconded by Mrs. Visconti Motion Unanimously Carried A request was received from Terri Crane for a refund of $35.00 paid for a variance fee in error. Mr. Farina reported on a letter received from the Zoning Administrator re this matter and he concurred with Mrs. Crane that the variance was issued in error since her particular application did not require a variance, per the Attorney's advise. MR. FARINA moved to return the sum of $35.00 for variance fee issued in error.to Mrs. Crane. Seconded by Mrs. Visconti Motion Unanimously Carried A Memo was directed to the Town Board from Debbie Brown, Water and Sewer Billing Clerk seeking their direction on billing water and sewer for condominiums; the second item related to billing Contrail Associates for service to their office building located on All Angels Hill Road which they are leasing from I.B.M. She questioned whether they should be billed as commercial with commercial rates, or the same as individual homeowners in the Central Wappingers Water District. Mrs. Paino referred to the first item on billing condominiums which is a legal question to assure that the Town can collect on the delinquent bills and the Attorney to the Town is researching the New York State Condominium Act and will contact Mrs. Brown with recommendations on how to handle this category. MRS. PAINO moved to send a letter to Contrail Associates informing them that they are considered commercial property and as such, must be charged commercial rates for the water service. Seconded by Mr. Farina Motion Unanimously Carried A request was received from our two Town Justices, Vincent Francese and Carl Wolfson to allow their Court Clerks, Gloria Morse and Frances Patterson to attend the 7th Annual Conference of the New York State Association of Magistrates Court Clerks at the Fallsview Resort and Country Club from October 9th through October 22nd, 1986. Mr. Farina had researched the cost of this conference and learned it would cost a total of $429.00 for lodging and meals plus 22 a mile for traveling costs. MR. FARINA moved to grant permission for the Court Clerks to attend this Conference and the sum of $429.00 for both Clerks plus 22c a mile will be a Town Charge. Seconded by Mr. Reis Motion Unanimously Carried The next item to be addressed was a letter from Kevin Lehman at 2 Beatty Road regarding a problem with a storm drain across his back yard which would interfere with his plan for an inground pool in that area of the yard. He indicated that a Town easement already exists on his property line, however, the storm drain is outside the easement. Since he was planning to install the pool this season, he was anxious for the Town to rectify the situation. MRS. PAINO moved to authorize the Engineer to prepare the necessary plans and specifications for the bidding process to place the storm drain in the Town easement. Seconded by Mr. Reis Motion Unanimously Carried A report from the Engineer was submitted regarding the Hydrogeologic proposal from Hydro -Group for Phase I at Briar Lane. At the last meeting Mrs. Paino reported that a pond existed at Briar Lane and it was their hope that it could be an additional water source for the Town and/or a recreational facility. After meeting with Hydro - Group, Mrs. Paino, Mr. Reis and our Engineer, Mr. Paggi felt they should follow the recommendations of this Group and requested that they submit their proposal for Phase I. It was reviewed by the Engineer who recommended that the Town retain this firm to perform the work for Phase I. After review of Phase I upon its completion, he will make further recommendations regarding Phase II. The budget estimate for Phase I amounted to $5,560.00. This Phase will include data review to gain an understanding of the surroundings of the Briar Creek area, well logs, published and unpublished geologic information. Mrs. Paino reviewed the remaining items which would be included in Phase I. MRS. PAINO moved to authorize Hydro -Group to complete Phase I project for the amount of $5,560.00 and requested the Engineer to the Town to notify the firm of this action. Seconded by Mr. Reis Motion Unanimously Carried Mr. Glorioso was recognized by the Chair and asked why they were jumping into another project when they didn't even finish the recreation area by his home at Nancyaleen Drive. Mrs. Paino explained that this project had to do with our water supply of a quality we can drink, otherwise it might be of use for a swimming facility. The main concern is to find additional sources of water which is urgently needed. Mr. Glorioso had complaints on the new recreation area and Mrs. Paino said it would be discussed with the Recreation Commission. Mr. Thomas Wilkinson, President of the Wappingers District Pop Warner Football League wrote to the Board requesting ambulance coverage for their 1986 games. He supplied dates and times of the games which L would be on September 7th, 1986 and each week thereafter up to and including October 26, 1986. Mrs. Paino noted that under the terms of the 1985 contract between the Town of Wappinger and Sloper Willen Ambulance Company, standby service will be provided for the opening day of Pop Warner Football Games but they will not cover future games; this was discussed with Dr. Schwerman, co-signer of the Agreement on behalf of the Ambulance Company. ihw MRS. PAINO moved to send a letter informing Mr. Wilkinson that the terms of the contract with Sloper Willen Ambulance Company and the Town will allow standby coverage on Pop Warner's opening day, September 7th, 1986, but will be unable to supply this standby service after that date, per the Agreement. Seconded by Mr. Farina Motion Unanimously Carried Mrs. Paino requested that a copy of Mr. Wilkinson's letter be forwarded with the covering letter for informational purposes. Mr. Ralph Holt, Chairman of the Recreation Commission wrote a letter of thanks to our Highway Superintendent, Mr. Croshier, for the help given by the Highway Personnel during the past few months in regard to the bandstand at Schlathaus by transporting the material to the Park from BOCES, helping to construct the roof and carting truck loads of debris from Chelsea Boat Ramp. MR. REIS moved to accept the letter, place it on file, and thanked Mr. Croshier for the time and effort expended by his department, on behalf of the Town Board. Mr. Farina reported that the Castle Point Landfill will be open this Saturday, September 6th. Mrs. Visconti reported that there was no meeting of the Airport Advisory Committee during the month of August. The Dial -a -Ride Program had no meeting in July, reported by Mrs. Visconti. a63 Resolutions --- The term of the members of the Conservation Advisory Council expired in July and the Town Clerk asked the Board if they wished to consider making new appointments. MRS. PAINO moved to table these appointments to the next meeting of September 15, 1986. Seconded by Mr. Reis Motion Unanimously Carried The term of Stella Dhlosh, member of the Board of Assessment Review will expire September 30th, 1986 and this matter was placed before the Board for their consideration. Seconded by Mr. Reis Motion Unanimously Carried There were several bids due in August, the first one was the Edgehill/Hilltop Drainage Project. There were no bids received, and this was addressed under Item 5e relating to Mrs. Gill's complaint. One bid was received for Hilltop and Rockingham Water Storage Tank Contractfrom Broome Industrial Construction, Inc. in the following amounts: Hilltop ---$17,000.00, Rockingham ---$23,333.00. It was the recommendation of the Engineer that the Town accept this bid; the documents and bid bond were found to be in order and the bid price was within the estimated project cost. MR. FARINA moved to award the bid for Hilltop/Rockingham Water Storage Tank to Broome Industrial Construction, Inc. in the amounts presented and authorize the Supervisor to sign the contract with this company. Seconded by Mr. Reis Motion Unanimously Carried The Engineer was requested to notify the firm of this action and make the necessary arrangements with them. Bids were received for Sludge Removal and Chemical Purchases; the recommendation from the Engineer was to award the bid to M & 0 Sanitation, bid price of $130.00 per 1,000 gallons of sludge; Jones Chemical Co. for sodium hypochlorite, muriatic acid and 50% hydrogen peroxide; Duso Chemical Co. for hydrated lime; Axton - Cross Co. for 35% hydrogen peroxide. The breakdown of the costs and the bidders were reported by the Engineer; contract documents were examined by their office and found to be in order. MRS. PAINO moved to award the bids, as recommended by the Engineer, to M & 0 Sanitation for Sludge Removal; to Jones Chemical Co. for sodium hypochlorite, muriatic acid and 50% hydrogen peroxide; to Duso Chemical Co for hydrated lime; to Axton -Cross Co. for 35% hydrogen peroxide. PAINO moved to forward letters to each of the firnsthat submitted the Certificates of Substantial Completion indicating that any work not completed by August 29th, 1986, will be completed by another contractor hired by the Town and the cost will be deducted from their final payment. Seconded by Mr. Reis Motion Unanimously Carried At the last meeting a request was received from Eugene Ossie, Inc. 11110 for payment of $42,930.00 which would have left for the Town a retainage of $10,000.00. Payment in the amount of $10,095.00 was approved due to the fact that the Contract required submission a copy of Certification of Substantial Completion along with the date of completion of items on punch list ---neither were received. They have since been received and the original payment requested can now be authorized for payment. MRS. PAINO moved to authorize payment of $32,395.00 to the General Contractor, Eugene Ossie, Inc. PAINO moved.. that a letter be directed to Eugene Ossie, Inc. indicating that work -not completed by the 29th of August, 1986 will be completed by a contractor hired by the Town and a fair amount for that work will be deducted from final payment to the General Contractor. Seconded by Mr. Reis Motion Unanimously Carried Another communication was received from Hayward and Pakan Associates indicating that the Dutchess County Health Department requires that a water meter and sampling valve be installed on the Town Hall water supply system; the cost quote from A. C. SMith is $495.00. Direction was requested on whether the Town would like to proceed with a Change Order to A. C. Smith or solicit bids from other plumbing contractors.. MRS. PAINO moved to forward a letter to Camo Pollution Control with copy of Hayward and Pakan's letter and request that they bid on the water meter and sampling valve installation; also send a letter to Hayward and Pakan advising them that the Town will seek other bids. Seconded by Mr. Reis Motion Unanimously Carried Another communication was received from William Molloy, President of Granite Homes Inc. requesting release of bonds posted for Lot # 8, Stoneykill Road. In his previous correspondence to the Board he sought release of bonds for the Shelburne Hills, by mistake, and actually meant to write on the Stoneykill Road bonds. After several communications to the Highway Superintendent and the Engineer to the Town, it was finally conveyed that Mr. Molloy meant the bonds for Stoneykill Road and both officials indicated there was no problem with this subdivision. MRS. PAINO moved to inform Mr. Molloy that the bonds would be released for Stoneykill Roads, however no bonds will be release for the Shelburne Hills subdivision until all work has been completed. Seconded by Mr. Farina Motion Unanimously Carried Unfinished Business --- Mrs. Paino had a few items under this category, the first relating to a bid awarded at the last meeting on new sand filters at Mid -Point 2 Gln Park and Rockingham; the Board also authorized inflow and infiltra- tion studies at all sewer systems in the Town. Bonding resolutions were received from our bonding counsel and were placed before the Town Board for their consideration. The following Resolution was offered by SUPERVISOR PAINO who moved its adoption: In the Matter of the Proposed Sewer Improvement in the Town of Wappinger, Dutchess County, New York, Pursuant to the Provisions of Article 12-c of the Town Law. WHEREAS, a plan and report have been duly prepared in such manner and in such detail as has heretofore been determined by the Town Board of the Town of Wappinger, Dutchess County, New York, relating to the detection and location of inflow and infiltration mains and lines of the Wappinger Sewer Improvement Area No. 1 and the establishment of a proposed Sewer Improvement Area therefor; and WHEREAS,said plan and report have been filed in the office of the Town Clerk where they are available for public inspection; and WHEREAS, the proposed area determined to be benefited by said Sewer Improvement Area shall be coterminous with the boundaries of the existing Wappinger Sewer Improvement Area No. 1. WHEREAS, the maximum amount proposed to be expended for such improvement is $65,500, and the proposed method of financing to be employed consists of the issuance of serial bonds of said Town of Wappinger to mature in annual installments over a period not to exceed forty years, such bonds to be payable from assessments upon and collected from the several lots and parcels of land deemed benefitted from said improvement and located in the aforesaid benefitted area, so much upon and from each as shall be in just proportion to the amount of the benefit which the improvement shall confer upon the same. WHEREAS, It is now desired to call a public hearing for the purpose of considering said plan and report and the question of creating said new Wappinger Sewer Improvement Area and providing said improvementandto hear all persons interested in the subject thereof and concerning the same, all in accordance with the provisions of Section 209-q of the Town Law; NOW THEREFORE, IT IS HEREBY ORDERED, by the Town Board of the Town of Wappinger, Dutchess County, New. Mr. Incoronato was recognized by the Chair and asked about the three districts being included in the bond; he questioned the legality ---how do they apportion the cost to each district with different. rates. Mrs. Paino responded that the Attorney has approved this method and so has Audit and Control. Each district will be charged their share of the bond. The actual amount expended will be deducted from the budget, according to Mr. Paggi. He did not have the figures available but for Fleetwood it was in the area of $10,000, substantially less than the other two districts. Actually the inflow and infiltration studies are being done at the direction of the Department of Environmental Conservation. New Business --- Mrs. Jean Pitchford, Winfield Terrace, was recognized by the Chair and stated concerns about a building lot at the corner of her road and Pine Ridge Drive. The lot was less than the required size for that area which is one acre zoning (R-40); the lot in question was she thought, 180 x 190. Mrs. Pitchford also asked if a building permit was required and if so were they supposed to be posted on the premises. The building is already constructed and there was no permit posted. Mrs. Paino noted that she had notes on this particular site and they did have a building permit and it should have been displayed. Mrs. Paino informed the resident that she would check again with the Building Inspector and get back to Mrs. Pitchford at the end of the week. There were other concerns about setbacks and the fact that as soon as the foundation was in the building was put up --- shouldn't there be a time period for the foundation to set before building on it. She was assured this would all be checked out and the information would be forthcoming. Mr. Incoronato was recognized by the Chair and asked what the Board was doing about the sulphur in the Fleetwood Water. Mrs. Paino replied there would be a work shop on Oakwood Water on September 18th at 7:30 P.M. and on Fleetwood Water on September 25th at 7:30 P.M. Mr. Farina referred to the 7-11 Store on Old Hopewell Road and Route 9 and noted that the residents are concerned about the curb cut on Old Hopewell Road. There were also concerns from the Zoning Board of Appeals and the Planning Board on this curb cut when they reviewed the County's recommendation on this matter. One of the recommendations was for a sign to be placed indicating Aq no left turn on Old Hopewell Road from the Store going up that road in an easterly direction, however this sign is constantly ignored. It is particularly dangerous during the rush hour when vehicles come off of Route 9 and attempt to make a left turn into the 7-11. He noted that the Zoning Administrator has also received numerous complaints on this situation. MR. FARINA moved that the Town Board would like to go on record as identifying this as a potentially hazardous situation and request the"Dutchess County Planning Department to revisit the site and consider the recommendation of the Town of Wappinger to close the curb cut from the 7-11 Store on to Old Hopewell Road. Seconded by Mrs. Paino Motion Unanimously Carried Another item brought up by Mr. Farina related to U. S. Cablevision. A new Channel 62 has been on the air approximately one year ago and the Town of Wappinger residents have not been provided with this local station. MR. FARINA moved to formally requests Mr. Erichson of U. S. Cablevision to provide Channel 62 to the Town residents at no additional cost and at no loss of their present service. Seconded by Mrs. Paino Motion Unanimously Carried The last part of the motion was included at the request of Mrs. Mills who was recognized by the Chair and referred to the fact that the Cablevision Company may well take a channel off if they put #62 on.
