Gentlemen: This proposal resarding street lighting in the Rughsonville Lighting District is submitted to the Town ot Wapp1Deer (hereinafter called the Town) by CentrallIudson Gas " Electric Corporation (here1naf'ter called the COJD.pany'). A. Services Supplied and Bates The CClIIlpSZI1' will furnish the services and equipaent described in this section at the rates stated herein. 1. Electric Energy. The C~ shall supply all electric enerQ used tor street lightins tor (i) An enerQ charge ot $.0125 per Kilowatt hour, and (ii) A ruel adJustaent ot $.0001 per Kilowatt hour tor each :run $.25 increase in tb.e price per net ton (2000 pound) ot bi tum1nous coal, f. o. b. Poughkeepsie, J'. Y., above $5.15 per net ton at the beginning ot the month tor which the bill is rendered. The quantity ot energr used shall be ccaputed by mul- tiplyins the manufacturer's average or normal wattage rat1J18 ot 1am.ps installed (includ1ng the wattage ot mercury lemp ballasts) and the number ot hours they are operated which shall be considered as 4000 hours per year for all-night operation. Monthl7 usage shall be considered equivalent to one-tweltth ot the annual usage. 2. Transtormers. The Caar,pany shall turnish the transtomers used to provide current ot the character required tor operation ot the street lamps tor a charge ot $.009 per year per watt ot the aggregate average wattage rat ins ot the incandescent leaps installed and ot the aggregate normal wattage ra tiDS ot the mercury lamps installed plus the adcl1tional transf01'ller capacity required tor their operation, as specitied by the manufacturers. r- Town of WapP1neer - - 2 - - August 1, 1947 3. Circuits. !he COIIlp8.lq shall furnish the circuits required for operation of the lamps to be installed in accordance with this agre.ent includ1ne wires, in- aulators, cables, and support1ne poles. Add! tional overhead cireui ts required for operation of additional lamps shall be installed by the C~ on COJIlp&IJy-owned poles at the Town's request wherever such poles are likewise used, or may reasonably be expected to be subsequently used, for supportin8 the COIII.pany's distribution system. If the poles required to support add1 tional overhead circuits will not be used for support1ne the Company's distribution system, the Com;pe.ny will only install such circui ta where the Town provide,s and. maintains the supporting poles. , tJnclersround circuits for operation of 1am;ps My likewise be installed by the Cc:apany at the Town's request, but the Caar;pany shall not be o'blisated to provide such circuits without its consent. !he charges tor circuits provided by the Ccapany shall be the sum ot: (i) $338.64 per ;year for the circuits now used in lighting the streets listed in Schedule IT and indicated on the map designa tea. Fixtures. a. Compe,ny-owned fixtures !he COJIl.P&XlY shall furnish the fixtures, including standards, brackets, mast arms, span wires, and. other supports, and lighting units for the lamps to be installed in COIIlpaIly-owned tixtures as specified in Schedule I at the locations shown in Schedule III; shall repair them and replace th_ when necessary with similar fixtures (unless the Town elects to install a Town-owned fixture) j and shall provide add1 tional tixtures of standard design approved by the Cc::apa.ny tor new street lamps, at the Town's request wherever the poles supportine such new lamps are used, or may reascmably be expected to be subsequently used, tor supporting The Com;pe.ny's distribution system. Beplao_ent of Lamps and Glassware. When replaced by the CoapI!I.1l1, laaps installed shall be replaced at regular intervals not in excess of the rated normal operating life of the lamps used. The Town shall use appropriate measures at all times to a1n11111 ze malicious breakage of the lamps and glassware which are replaced by the Caape,ny. B. Street Lighting Installation and Billing. The number of lemps operated and the monthly charges for this installa- tion are stated in Schedule I attached to this agre_ent. The particular streets lighted are shown in Schedule n also attached to this agre_ent. The location of the laps and lighted streets are indicated on the map designated as Schedule In, likewise attached. The size, num.ber and location of lamps may be changed at the direction of the Town at any t11lle during the term of this agre_ent. The circuits and fixtures to be provided by the CC1IIIp8.l'J1' and the extent of the services to be performed by the COIIlpI.D1 in replacing lamps and glassware may also be changed during the term of this agreeent at the direction of the Town as provided in Sections A-3, A-4 and A-' above. The wattage rating of lamps and tranafo1'ller capaci ty on which the ener@1 and transforation charges are now based will also be changed at the beginning of each calendar year if any change in the anufac- turerls rating has occurred during the previous year. The fuel adjustment will likewise be cbanged during the term of this agreement whenever changes in the price of coal occur which vary- the amount of the adjustment determined in accorc1ance with Section A-l(11) above. Street Lighting Installation and Billine (Continued) Each monthly bill shall include the charges specified under A for an entire month based on the l.am,ps in operation at the bes1Im1ng of the month for which the bill is rendered, prortded that no adjustunt shall be _de in the JDOnthly circuit charge because of reduction in the length of street then lighted result1ng f'ro.m. seasonal or teaporary suspension of operation of any lamp. The Ccapany shall bancUe the electrici't7 supplied when in or upon the cables, lightine fixtures and other tacili ties owned by the C~; care tor and _intain all tacili ties owned. by the COJIlp&ny and used tor supplying the service herein contracted tor; and replace lamps and glassware periodically or during regularly scheduled workins hours as prortded in Section A-5.
