IN THE MATTER OF THE PROPOSAL TO EXTEND THE
HUGHSONVILLE LIGHTING DISTRICT IN THE TOWN
OF WAPPINGER, DUTCHESS COUNTY, NEW YORK, AND
TO MORE ADEQUATELY DEFINE THE BOUNDARIES IN
THE EXISTING HUGHSONVILLE LIGHTING DISTRICT.

WHEREAS, the Town Board of the Town of Wappinger,
Dutchess County, New York, at a regular meeting held at the Town
Hall in the Village of Wappingers Falls on the 9th day of May,
1963, made an order, pursuant to the provisions of Article 12-A
of the Town Law, to extend, in said Township, the Hughsonvil1e
Lighting District, and to provide improvements and services, and
both, in such district, as extended, wholly at the expense of the
district, which said lighting district, as proposed to be extend-
ed, is bounded and described as follows:
BEGINNING at a point in the center of the Wappin-
ger Creek, said point being in the division line between
the Town of Poughkeepsie and the Town of Wappinger at
the intersection of said division line with the east
shore of the Hudson River; thence running in a north-
easterly direction along said centerline and division
line to a point at its intersection with the corporate
line of the Village of Wappingers Falls; thence along
said corporate line southerly, southeasterly and east-
erly to a point 200 feet easterly of the centerline of
the New York State Highway, Route 9D, thence running in
a southerly direction on a line parallel to and 200
feet distant easterly of the centerline of said highway
1,300 feet more or less to a point in the centerline of
the road known as Midd1ebush Road; thence running' in an

easterly direction along the centerline of said road
1,600 feet more or less to a point, said point being on
the extension of the westerly line of a right of way
leading into Cameli Acres, said westerly line of said
right of way also being the westerly line of the Cameli
Acres Lighting District; thence running along the boun-
dary line of the said Cameli Acres Lighting District
the following courses and distances N 25- 46' W 236.4
feet, N 80- 04' E 223.75 feet, N 5- 23' W 74.35 feet, N
3- 22' E 388.81 feet, N 16- 51' E 277.71 feet, N 16- 03'
w 65.95 feet, N 41- 46' W 75.14 feet, N 19- 46' E 339.75
feet to a point, said point being the southwesterly cor-
ner of the Cameli Acres Lighting District; thence run-
ning in a southerly direction 3,200 feet more or less
crossing the Hughsonville Road to a point, such point
being the southeasterly corner of lands now or formerly
of Noto; thence running in a northerly direction 2,150
feet more or less along the easterly boundary of lands
of the said Noto to the northeasterly corner of said
lands; thence running in a southeasterly direction along
the northerly boundary of lands now or formerly of Noto,
and Bennett 5,000 feet more or less, crossing a road
known as Ketchamtown Road, to a point, in the easterly
line of lands now or formerly of Kligerman; thence run-
ning in a northwesterly direction along the northerly
line of lands of the said Kligerman 650 feet more or
less to the center of Route 9D and continuing along said
line 2,300 feet more or less to the northeasterly corner
of lands of the said Kligerman; thence running in a
southwesterly direction along the northerly line of
lands of the said Kligerman and lands now or formerly of
Crawford 1,400 feet more or less to the northwesterly
corner of lands of the said Crawford; thence running in
a southerly direction along the westerly line of lands
of the said Crawford 800 feet more or less to a point at
the intersection of stone walls; thence running in a
southwesterly direction along a stone wall 1,500 feet
more or less to a point in the centerline of the road
known as Wheeler Hill Road, said point being 1,300 feet
more or less distant northwesterly from the intersection
of said road and the road known as the Reeves By-Pass;
thence running in a northwesterly direction along the
centerline of said road 1,550 feet more or less to an
angle in said road; thence running in a northerly direc-
tion along the centerline of said road 400 feet more or
less to a point, said point being an extension of the
northerly line of lands now or formerly of the Good
Council Novitiate; thence running in a westerly direc-
tion along the northerly line of lands of the said Good
Council Novitiate 800 feet more or less to a point on
the east shore of the Hudson River; thence running in a
northerly direction along the east shore of the Hudson
River to the point or place of beginning.

WHEREAS, it was proposed that lights should be install d,
initially, at the locations shown on a map of said lighting dis-
trict, as extended, and subsequently at other locations to be
determined and designated by the Town Board of said Township, and
within the proposed extension of said lighting district; and
WHEREAS, the maximum amount proposed to be expended fo
the supplying of service in connection with such proposed addi-
tional street lighting, within said lighting district, as extende ,
should not exceed the sum of Two Thousand ($2,000.00) Dollars
annually; and
WHEREAS, the proposed additional street lighting to be
installed in said district, as extended, should consist of the
following, to wit: Marlorville Road - 2500 Lumen, open suburban:
Pole No. 37449, 38417, 40071, 55993, 55992, 55990, 25930 (mast
arm), 25932, 25940 (mast arm), 25942, 41367, 41369; Hamilton Road
- 2500 lumen, open suburban: Pole No. 34174 (intersection Creek
Road), 18172, 18173, 58771, 58769, 25933 (Connor Road), 25935,
25937 (mast arm), 59452 (mast arm); and such additional facilities
as the Town Board may, in the future, determine on Hughsonvil1e
Road, the cost of which should not exceed, however, annually, the
maximum amount to be expended, as hereinbefore set forth, for
supplying of services in connection with such proposed additional
street lighting; and
WHEREAS, a public hearing was held at a meeting of the
Town Board of the Town of Wappinger at the Hughsonvi1le Fire House
in said Township, in accordance with the order made May 9, 1963,

that day to consider said order, and the proposal therein set
forth, and to hear all persons interested in the subject thereof
and concerning the same; and
WHEREAS, the Town Board of the Town of wappinger, at
said meeting, determined that notice of public hearing was pub-
1ished and posted as required by Law, and was otherwise sufficien ,
and that the extension of said district is in the public interest
and that all the property and property owners within the proposed
district, as extended, and the extension thereof, are benefited
thereby, and that all the property and property owners benefited
are included within the limits of the proposed district, as
extended, and the proposed extension; and
WHEREAS, it was resolved and determined by said Town
Board that the notice of public hearing was published and posted
as required by law, was otherwise sufficient; and
WHEREAS, it was resolved and determined by said Town
Board that all of the property and property owners within the
district, as extended, and the extension thereof, were benefited
thereby; and
WHEREAS, it was resolved and determined by said Town
Board that all of the property and property owners benefited were
included within the limits of the district, as extended, and the
extension thereof; and

WHEREAS, it was resolved and determined that the public
interest of the Hughsonvi11e Lighting District in the Town of
Wappinger, Dutchess County, New York, would be promoted and best
served by the extension of the said district, as proposed, and the

extension of the facilities therein, as proposed, subject to the
limitation that the cost of the additional facilities should not
exceed, annually, the maximum amount of $2,000.00 in addition to
the cost presently paid by said district for the supplying of
services in connection therewith; and
WHEREAS, it was resolved and determined by the said
Town Board that said resolutions were adopted subject to a per-
missive referendum as required by law; and
WHEREAS, following the adoption of said resolutions
notice of the same was duly given by posting and publishing as
required by law by the posting and publication of an extract of
the minutes of the meeting of said Town Board on June 3, 1963,
said
proof of which/posting and publication has been filed in the
Office of the Clerk of the Town of Wappinger, which said notice
set forth the date of the adoption of the resolutions, an abstract
of said resolutions concisely stating the purpose and effect there
of, and that such resolutions were adopted subject to a permissive
referendum; and
WHEREAS, the time for filing a petition has expired
and no such petition has been filed with the Town Clerk;
1, HELEN L. TRAVIS, the Town Clerk of the Town of
Wappinger, do hereby certify, as required by law, that the time
for filing a petition requesting the matter be submitted to a per-
missive referendum of the property owners of the proposed extended
district has expired and that no such petition has been filed with
me.
