1986-04-02 SPMWAIVER OF NOTICE OF SPECIAL MEETING OF THE TOWN BOARD OF THE TOWN OF WAPPINGER DUTCHESS COUNTY, NEW YORK The undersigned, being all of the members of the Town Board of the Town of Wappinger, Dutchess County, New York, do hereby waive notice of the time and place of the holding of a Special Meeting of said Town Board, and do hereby agree and consent that the same be held on the 2nd day of April, 1986, at 6:00 o'clock in the afternoon of that day at the Town Hall of the Town of Wappinger, Mill Street, in the Village of ' Wappingers Falls, Town of Wappinger, Dutchess County, New York, for the sole purpose of placing Councilman Gerard McCluskey's resignation on file and appointing another person to fill this vacancy on the Town Board. Town .ZIA.411Ar Clerk Town of Wappinger A Special Meeting of the Town Board of the Town of Wappinger was held on April 2, 1986, at the Town Hall, Mill Street, Wappingers Falls, Dutchess County, New York. Supervisor Paino opened the Meeting at 6:00 P.M. Present: Irene Paino, Supervisor Vincent Farina, Councilman David Reis, Councilman June Visconti, Councilwoman Elaine H. Snowden, Town Clerk All present joined in the Pledge of Allegiance to the Flag. 98 The Town Clerk noted that the news media had been notified of the meeting and its purpose, also a notice was posted on the bulletin board maintained by the Town Clerk. The Board Members have signed a Waiver of Notice of the Special Meeting called for 6:00 P.M. this day. Mrs. Snowden further noted that she has received a resignation from Gerard McCluskey, Councilman for Ward I in the Town of Wappinger., dated April 1st, 1986 and effective immediately. MR. REIS moved to accept Mr. McCluskey's resignation and place it on file. Seconded by Mr. Farina Motion Unanimously Carried MRS. PAINO moved to send a letter to Mr. McCluskey thanking him for his years of service to the Town and to the residents whom he represented. Seconded by Mrs. Visconti Motion Unanimously Carried Mrs. Paino added that Mr. McCLuskey had put a great deal of time and effort into this position and had served the residents well. She then asked the Town Board to forward nominations for the position of Councilman for Ward I in the Town of Wappinger. MR. REIS moved to nominate Joseph Bracone for position of Councilman representing the Village of Wappingers Falls, in the Town of Wappinger. Seconded by Mrs. Visconti Motion Unanimously Carried Prior to the vote Mr. Reis gave a brief resume on Mr. Bracone-- he residesat Walnut Drive in the Village of Wappingers Falls, was a member of the Zoning Board of Appeals from 1977 thru 1980; served on the Board of Assessment Review from 1982 thru 1984 and is an active member of the Town Republican Committee. William Egan, resident of the Town and County Chairman of the Democratic Party, was recognized by the Chair, and protested that the Town Board was rushing this appointment. It was evident that they would not put Mr. McCluskey's appointment to the County Legislature in jeopardy if they did not act on this matter tonight, so why not check with their constituents in Ward I for suggestions on other nominations for the position. Mrs. Paino replied that this was certainly no surprise, the new media has publicized the vacancy on the County Legislature and Mr. McCluskey indicated some time ago that he was interested in this position. Mr. Bracone was the only person to step forward and announce his interest on serving as Councilman for Ward I -- he is a life time resident in the Village of Wappingers Falls. The Supervisor then called for the vote on the motion to appoint Mr. Bracone. After Mr. McCLuskey's resignation was accepted and placed on file, he made his farewell to the Town Board, stated that he enjoyed working with the Board and hoped to be present at some future Town Board meetings as a County Legislator; he added that he hoped it would be at the new Town Hall. There was no further business to come before the Town Board. MR. FARINA moved to close the Special Meeting, seconded by Mr. Reis and unanimously carried. Mtg. 4/2/86 i A Special Meeting of the Town Boards of the Town of Poughkeepsie and the Town of Wappinger was held on April 2, 1986, at the Town Hall of the Town of Poughkeepsie, Route 44, Dutchess Turnpike, Town of Poughkeepsie, Dutchess County, New York. The meeting was called to order at 7:06 P.M. by Supervisor Anna Buchholz. Present: Absent: Supervisor Buchholz Councilman Pyrek Councilman Bodo Councilman Del Santo Councilman Tedone Councilman Pinckney Town Clerk Karn Councilman Darrow Supervisor Councilman Councilman Councilman Councilman Town Clerk Paino Bracone Farina Reis Visconti Snowden Mrs. Buchholz opened the meeting with the Pledge of Allegiance to the Flag. Mrs. Buchholz stated the purpose of this joint meeting of the Towns of Poughkeepsie and Wappinger was selecting a person to fill a vacancy Legislature, left by the resignation on for tihe purpose of the Dutchess County of Joseph V. Poillucci, who had represented County Legislative District #7. Mrs. Buchholz first announced there would be a Special (Poughkeepsie) Town Special Meeting. She stated she wished to Board meeting at the conclusion of this then acknowledged Supervisor Paino, and turn the gavel over to the Supervisor of the Town of Wappinger, so that she may Chair this Special Meeting. Upon taking the Chair, Mrs. Paino stated that she received notice the week of March 17, 1986, from the Clerk to the Dutchess County Legislature, advising of the vacancy in County District #7. Shortly thereafter, upon Mrs. Buchholz's return from vacation, Mrs. Paino contacted her and indicated to her that she would like to have a Joint Meeting with both Boards because, according to the Dutchess County Charter, that would be the method of appointing an individual to serve the unexpired term, until the coming Election (November 1986), that was vacated by Joseph Poillucci. We both, in turn, discussed this with our Boards and the meeting was set for tonight. Continuing, Mrs. Paino stated that, after reaching an agreement on a date for a Special Meeting, Notice of a Special Meeting was mailed to the Wappinger Town Board Members, the News Media (including four Radio Stations and three Newspapers) and the Town Clerk posted a Notice of Special Meeting on the Bulletin Board in the Wappinger Town Hall Bulletin Board maintained by her. All Notices were dated and mailed March 26, 1986. Mrs. Buchholz stated the method of notification of this Special Meeting to the Town of Poughkeepsie Board was in person, on March 26, 1986, at a Committee of the Whole Meeting. Notices of the meeting were handed out at that meeting, and Mr. Pyrek's was received by him the following day. Mrs. Karn stated that the media was also notified and that the Notice of this Special Meeting was posted on the Town Clerk's Bulletin Board in the Poughkeepsie Town Hall. The next item presented to the Boards was to accept the population figures, as certified by the Dutchess County Department of Planning, in a letter dated March 26, 1986, and to allocate weighted voting, based on those figures, as follows: In County District #7, the total vote is 6,790. A majority would be 3,396. Each Wappinger Councilman gets 729 votes, Each Poughkeepsie Councilman gets 449.2857. Councilman Tedone moved the following resolution: Resolved, that we accept the population figures and allocation of weighted votes, as certified by the Dutchess County Department of Planning. Seconded by: Councilman Pinckney Motion Carried Mrs. Paino reiterated the purpose of the meeting, to fill a vacancy under Section 2.13 of the County Charter, and entertained a motion to accept the procedure as outlined. %03 Councilman Reis moved the following resolution as follows: RESOLVED, that we accept the procedure as outlined in Section 2.13 of the Dutchess County Charter dictating the procedure for the selection of interim successor for the purpose of filling a membership vacancy. Seconded by: Councilman Tedone Motion Carried The following resolution was offered by Supervisor Buchholz, who moved its adoption: RESOLVED, that we place in nomination the name of Roger Higgins, and that he be appointed to the vacancy. Poillucci, and BE IT FURTHER RESOLVED, that the said Gerard J. McCluskey be and he hereby is appointed to fill such vacancy for the remainder of the year 1986.
