ADJOURNHENT 3:2.fJ' The Regular Bimonthly Meeting of the Town Board of the Town of Wappinger was held on November 4, 1985 at the Town Hall, Mill Street, Wappingers Falls, Dutchess County, New York. Supervisor Versace opened the meeting at 8:15 P.M. L Present: ,~" Frank Versace, Supervisor Renata Ballard, Councilwoman Joseph Incoronato, Councilman Gerard McCluskey, Councilman Irene Paino, Councilwoman Elaine H. Snowden, Town Clerk Others Present: Bernard Kessler, Attorney Ronald Evangelista, Engineer Kenneth Croshier, Highway Superintendent The Supervisor invited all to join in the Pledge of Allegiance to the Flag. The Minutes of the Regular Bimonthly Meetings of October 7th and October 21st, 1985, having previously been forwarded to l all Board Members, were now placed before them for their consideration. MRS. PAINO moved that the Minutes of October 7th and October 21st, 1985, be and they are hereby approved, as submitted by the Town Clerk. Seconded by Mrs. Ballard Motion Unanimously Carried Reports were received from the Town Justices for October, the Receiver of Taxes, Zoning Administrator, Zoning Enforcement Officer and Comptroller/Supervisor report thru September. MRS. PAINO moved to accept the above reports and place them on .---" file. L Seconded by Mr. Incoronato Motion Unanimously Carried A letter was received from Mr. and Mrs. Tanueer Hussain regarding a sewer pump station in front of the home at 18 Bell Air Lane. It appears that the former owner of the home informed him that the pump station would be removed when the development was completed. Jeff Hunt, one of the principals of the development informed him that this was not true. Mr. . 3:A" Hussian indicated several reasons why this pump station was an annoyance to him, among them, it was a hazard to his children, the noise wakes them up at night and when in operation causes a vibration in the frame of the building which results in another annoying noise. MR. MCCLUSKEY moved to notify Mr. Hussian that although the Town Board sympathizes with him, they are not considering It II moving the pump station now or in the future. /----...., Seconded Mrs. Ballard Motion Unanimously Carried An application was received from Robin Hall, Route 9D, for a Peddler's License to sell furniture with a motor vehicle traveling through the Town roads. Mr. Versace referred the matter to the Attorney for his opinion who required time to review this situation before rendering a decision. Mrs. Robin Hall, wife of the applicant was present along with Linda Hall who owned the property and admitted, when asked by Mr. McCluskey, that she was selling furniture on the property located on Route 9D; she indicated that she would continue -~ II this operation when she receives a permit from the Zoning Administrator. Mr. McCluskey pointed out that the license, if approved, would allow the applicant to travel on Town roads to sell the furniture, but it does not give him permission to sell merchandise on private property, as they have been doing illegally. Linda Hall noted that the applicant would move his vehicle every half hour (a provision in the Peddler's Ordinance). Mr. Kessler agreed, after reviewing the application that Mr. McCluskey had a good point and noted that this situation was similar to a matter he had handled in another municipality, ~ which involved many problems. Seconded by Mr. Incoronato Motion Unanimously Carried &1 Committee Reports--- Mrs. Ballard, Town Hall, moving dates are November 21st and 22nd; notice was sent out by Mrs. Garrison on October 30th, regarding the moving dates and the housekeeping chores that all departments will be required to do for this move. The l dedication ceremonies are scheduled for Sunday, December 1, at 2 P.M.; invitations have been sent to all Officials and ~ ~ employees and others associated with the Town. Recreation---reported that someone driving a stolen vehicle rammed into the newly installed fence gate at the Rockingham Farms Recreation Area which was placed to prevent drivers from driving on that field. This happened in the early hours of Monday morning, the State Troopers arranged to have the car towed away and returned to its legal owner. The question now remains, who is responsible for the damage to the gate. It would appear that the cost should be borne by the suspect driving the car and it is possible that the owner's insurance will cover the cost of replacing the gate and would be reimbursed l if the suspect is apprehended. This incident has proven that the gate has been effective is keeping the cars off the fields and Mrs. Ballard felt that they were on the right track and the gate should be immediately replaced. MRS. BALLARD moved to replace the gate at the Rockingham Recreation Area from the Parkland Trust Account and reimburse this account when the matter is resolved. Seconded by Mr. McCluskey Motion Unanimously Carried Mr. Versace recommended that Mrs. Ballard forward all pertinent ~ information on this incident to the Attorney and to the Comptroller who, in turn, should forward it to our insurance [ agent. Mrs. Ballard re Election Day, reported that all Polling Places and Election Inspectors are in place and the ramp at the Chelsea School House has been installed. Mrs. Paino thanked Mr. Evangelista for submitting a report on the cost estimate for the Robert Lane Sewer Main Replacement; this information was requested after the public hearing and public informational meeting on either replacing the Oakwood ~ ~e Knolls Sewer Treatment Plant or tying into the Tri-Municipal Project. Both reports referred to replacing the sewer main on Robert Lane, but neither included the cost. According to Mr. Evangelista, the estimated construction cost will be $241,885. Mr. Incoronato had no reports for this meeting, however he wanted to express his thanks to Tim Classey, our Fire Inspector for tracking down the heir to the Mosher property on Ketchamtown Road that burned down almost a year ago. The site is unsafe and presents a hazard to any children who might be attracted to wander through the ruins. It has become an attractive nuisance and an eye sore to the community; now action can be taken to clear the property. Mr. McCluskey referred to the Schlathaus property owned by the Town and rented to a private party. This property on All Angels Hill Road was deeded to the Town when the owner } George Schlathaus) passed away. The Town has leased it out since 1979 and as far as he knows has never been inspected by Town Officials since then to determine if it is still being occupied by a single family. Last Saturday morning, he counted two used vehicles with "For Sale" signs on them and in addition there were seven licensed vehicles in the driveway; he noted that this was about 10 A.M. He reviewed the lease and learned that the rent was increased in May of 1982 from $200.00 to $350.00---this was three and one half years ago and he felt it was time for the Town to review the use of the property and decide whether they wanted to use it for their own use or continue the lease. Mr. McCluskey made a motion to inform the tenants that the Town is considering terminating the lease and would like to make arrangements to inspect the house; the motion was seconded by Mr. Incoronato. Prior to the vote on the motion Mr. Kessler suggested that the Town should notify them in proper legal form that they are terminating the lease within the ninety day period as provided in the lease. This will provide better bargaining powers for the Town if the tenants choose not to comply ~..,... 11III ~ ~ c I ~ 3:l? with certain conditions the Town may want to impose for the continuation of the lease. Mr. Kessler added that he would execute this termination in proper form effective ninety days from date of December 1, 1985. The tenant can be informed that the Town is willing to consider renegotiating L this lease and the termination notice is not necessarily final. Mr. McCLuskey agreed to amend the motion to reflect the Attorney's recommendation. '-' MR. MCCLUSKEY moved to authorize the Attorney to notify the tenants of Schlathaus property that the lease will terminate ninety days from December 1, 1985 and indicate that if the tenants choose to discuss reinstatement of the lease, they should contact the Town. Seconded by Mr. Incoronato Motion Unanimously Carried Mr. McCluskey, Town Hall, did not think there was sufficient parking space to accommodate guests for the dedication ceremony ~ and suggested that the Town ask the Wappinger Central School District for permission to park on their property. Mr. Versace asked the Town Clerk to contact Connie Smith and ask her to take care of this matter. A Public Hearing having been held on November 4, 1985 on a proposed Local Law Amending Local Law #3 of 1983 Which Provides for the Administration and Enforcement of the New York Fire Prevention Code, the matter was now placed before the Board for their consideration. MR. INCORONATO moved to adopt Local Law #5 of 1985 as follows: BE IT ENACTED by the Town Board of the Town of Wappinger as follows: ..., That Article 8 be amended by adding thereto paragraph "c" to read as follows: l C. The Building Inspector and the Fire Inspector shall have the authority to issue an appearance ticket pursuant to Criminal Procedure Law Section 150.20 in the enforcement of Local Law #3 of the year 1983. INCORONATO moved to adopt the following Ordinance: BE IT RESOLVED AND ORDAINED by the Town Board of the Town of Wappinger as follows: That Section 5 with respect to the duties and powers of the Chief Building Inspector be amended by adding thereto an additional paragraph (e) to read as follows: - (e) The Chief Building Inspector and duly appointed deputy inspector shall have the authority to issue an appearancec,ticket pursuant to Criminal Procedure Law Section 150.20 for the enforcement of this ordinance. \rJ This Ordinance shall take effect upon adoption, posting and publication, as prescribed by Town Law. Seconded by: Councilwoman Paino Roll Call Vote: 5 Ayes 0 Nays 33.s- At the last meeting the acceptance of Field Stone Farms Road was tabled to the November 4th meeting due to some items not completed by the developer per the Engineer's report. Mr. Evangelista reported that he and the Highway Superintendent visited the site on October 30th and the items still remain '-' incomplete; he recommended that the Board table it again. They are having trouble hiring the proper personnel to do these jobs and discussion with Mr. Klein revealed that he hoped to have it ready by November 18th. L Mr. Versace requested the Engineer to notify Mr. Klein to do everything possible to move the work schedule up on the work so the Town could accept the road before the winter season begins; he was also concerned with bus transportation for the children so they would not have to walk down the hill. MR. VERSACE moved to table this matter to the November 18th, 1985 meeting for further review and recommendation from the Engineer and Highway Superintendent. Seconded by Mr. McCluskey ~ Motion Unanimously Carried The following resolution was offered by COUNCILWOMAN PAINO who moved its adoption: A RESOLUTION PROVIDING FOR THE CONSOLIDATION, DETAILS AND SALE OF $1,348,641 PUBLIC IMPROVEMENT (SERIAL) BONDS, 1985, OF THE TOWN OF WAPPINGER, DUTCHESS COUNTY, NEW YORK, FOR VARIOUS PURPOSES IN AND FOR SAID TOWN. BE IT RESOLVED, by the Town Board of the Town of Wappinger, Dutchess County, New York, as follows: '-' Section 1. Of the $185,000 serial bonds authorized by bond resolution dated June 13, 1983, for the purchase of international dump trucks with plows, wings and sanders for use by the Town Highway Department of the Town of Wappinger, Dutchess County, New York, there shall be issued and sold $138,571 serial bonds which shall mature $23,571 in the year 1986, $25,000 in the year 1987, and $30,000 in each of the years 1988 to 1990, both inclusive, and shall be consolidated with other issues of bonds of said Town as hereinafter authorized. It is hereby determined that the period of probable usefulness of the aforesaid class of objects or purposes is fifteen years pursuant to subdivision 28 of paragraph a of Section 11.00 of the Local Finance Law, it being hereby further determined that the maximum maturity of the serial bonds will not exceed seven and one-half years, computed from August 22, 1983, the date of the first bond anticipation note issued therefor. It is hereby further determined that the sums of $26,429 and $20,000, from a source other than the proceeds of bonds or bond anticipation notes, were used on August 22, 1984 and August 22, 1985 respectively, to partially reduce outstanding bond anticipation notes of said Town for such purpose, such amounts constituting the first two installments of the principal amount of such indebtedness. L 330 Section 2. The $700,000 serial bonds authorized by bond resolution dated August 20, 1984, for the construction of a new Town Hall in and for the Town of Wappinger, Dutchess County, New York, shall mature $28,950 in each of the years 1985 to 1996, both inclusive, $34,150 in the year 1997, and $43,425 in each of the years 1998 to 2005, both inclusive, and shall be consolidated with other issues of bonds of said Town as hereinafter authorized. It is hereby determined that the period of probable usefulness of the aforesaid specific object or purpose is thirty years pursuant to subdivision ll(a) (1) of paragraph a of Section 11.00 of the Local Finance Law, computed from January 18, 1985, the date of the first bond anticipation note issued therefor. Section 3. Of the $202,000 serial bonds authorized by bond resolution dated August 6, 1984, for paying additional costs of the construction of a water system to serve the Central Wappinger Water Improvement Area in the Town of wappinger, Dutchess County, New York, there shall be issued and sold $148,070 serial bonds which shall mature $6,170 in the year 1986, $6,100 in each of the years 1987 to 1996, both inclusive, $7,700 in the year 1997, and $9,150 in each of the years 1998 to 2005, both inclusive, and shall be consolidated with other issues of bonds of said Town as hereinafter authorized. It is hereby determined that the period of probably usefulness of the aforesaid specific object or purpose i~ forty years pursuant to subdivision 1 of paragraph a of Section 11.00 of the Local Finance Law, computed from July 5, 1973, the date of the first bond anticipation note issued pursuant to a bond resolution dated October 10, 1972. It is hereby further determined that the sum of $53,930, from a source other than the proceeds of bonds or bond anticipation notes, was used on August 13, 1985, to partially reduce outstanding bond anticipa- tion notes of said Town for such purpose, such amount constitut- ing the first installment of the principal amount of such indebtedness. Section 4. Of the $440,000 serial bonds authorized by bond resolution dated August 25, 1983, for paying part of the cost of improvements in and for Wappinger Sewer District No. 1 in the Town of Wappinger, Dutchess County, New York, there shall be issued and sold $362,000 serial bonds which shall mature $14,950 in each of the years 1986 to 1996, both inclu- sive $18,150 in the year 1997, and $22,425 in each of the years 1998 to 2005, both inclusive, and shall be consolidated with other issues of bonds of said Town as hereinafter authorized. It is hereby determined that the period of probable usefulness of the aforesaid specific object or purpose is forty years pursuant to subdivision 4 of paragraph a of Section 11.00 of the Local Finance Law, computed from December 27, 1972, the date of the first bond anticipation note issued therefor pursuant to a bond resolution dated August 14, 1972. It is hereby further determined that the sums of $62,858 and $15,142, from a source other than the proceeds of bonds or bond anticipa- tion notes, were used on October 18, 1984 and October 18, 1985, respectively, to partially reduce outstanding bond anticipation notes of said Town for such purpose, such amounts constituting the first two installments of the principal amount of such indebtedness. Section 5. The serial bonds described in the preceding sections hereof are hereby authorized to be consolidated for purposes of sale into one bond issue aggregating $1,348,641. Such bonds shall each be designated substantially PUBLIC IMPROVEMENT (SERIAL) BOND, 1985, shall be dated December 1, 1985, shall be of the denomination of $5,000 each or any integral multiple thereof not exceeding the principal amount of each respective maturity, except for one bond of the denomination of $3,641. Bonds may be transferred or exchanged at any time prior to maturity at the Municipal Paying Agency Department of Citibank, N.A., in New York, New York, (the "Fiscal Agent"), or any successor Fiscal Agent, for bonds of the same maturity of any authorized denomination or denomina- tions in the same aggregate principal amount. The bonds shall mature in the amount of $73,641 on June 1, 1986, $75,000 on June 1, 1987, $80,000 on June 1 in each of the years 1988 to ~....: l1li ~ ~ ~ ~.~.... l1li ~7' l to 2005, both inclusive, and shall bear interest payable on June 1, 1986 and semi-annually thereafter on December 1 and June 1. Such bonds shall bear interest at such rate as may be necessary to sell the same, which rate shall be determined in the manner provided in Section 59.00 of the Local Finance Law. Such bonds shall be in registered form and shall not be regisbrable to bearer or convertible into bearer coupon form. Principal of the bonds will be payable to the registered owners upon surrender of the bonds at the Municipal Paying Agency Department of the Fiscal Agent for the bonds. Interest on the bonds will be payable by check or draft mailed by the Fiscal Agent to the registered owners of the bonds, as shown on the registration books of the Town maintained by the Fiscal Agent, as of the close of business on the fifteenth day of the calendar month preceeding the date of the interest payment. Principal of and interest on the bonds will be payable in lawful money of the United States of America. The aforesaid maturities constitute the aggregate of the individual maturities of each separate issue, which individual maturities are prescribed in the preceeding sections hereof. Such bonds shall be executed in the name of said Town by the manual or facsimile signature of the Supervisor, and a facsimile of its corporate seal shall be imprinted thereon and attested by the manual or facsimile signature of its Town Clerk. The bonds shall be authenticated by the manual countersignature of an authorized officer or employee of the Fiscal Agent. It is hereby determined that it is to the financial advantage of the Town not to impose and collect from registered owners any charges for mailing, shipping and insuring bonds transferred or exchanged by the Fiscal Agent, and accordingly, pursuant to paragraph c of Section 70.00 of the Local Finance Law, no such charges shall be so collected by the Fiscal Agent. ~ l Section 6. The Supervisor, as chief fiscal officer of the Town, is hereby authorized and directed to enter into an agreement with a bank or trust company located or authorized to do business in the State of New York for the purpose of having such bank or trust company act, in connection with the obligations herein described, as the Fiscal Agent for said Town to perform the services described in Section 70.00 of the Local Finance Law, and to execute such agreement on behalf of the Town Board of said Town. Section 7. All other matters, except as provided herein relating to such bonds shall be determined by the Supervisor. Such bonds shall contain substantially the recital of validity clause provided for in Section 52.00 of the Local Finance Law and shall otherwise be in such form and contain such recitals, in addition to those required by Section 51.00 of the Local Finance Law, as the Supervisor shall determine. ~ Section 8. The faith and credit of said Town of Wappinger, Dutchess County, New York, are hereby irrevocably pledged for the payment of the principal of and interest on such bonds as the same respectively become due and payable. An annual appropriation shall be made in each year sufficient to pay the principal of and interest on such bonds becoming due and payable in such year. L Section 9. The powers and duties of advertising such bonds for sale, conducting the sale and awarding the bonds, are hereby delegated to the Supervisor, who shall advertise such bonds for sale, conduct the sale and award the bonds in such manner as he shall deem best for the interests of said Town, provided, however, that in the exercise of these delegated powers, he shall comply fully with the provisions of the Local Finance Law and any order or rule of the State Comptroller applicable to the sale of municipal bonds. The receipt of the Supervisor shall be a full acquittance to the purchaser of such bonds, who shall not be obliged to see to the application of the purchase money. Section 10. This resolution shall. take effect immediately. 33& Seconded by: Councilman Incoronato Roll Call Vote: 5 Ayes 0 Nays During the discussion that ensued prior to the adoption of the resolution, Mrs. Garrison explained that the purpose of the resolution was to combine certain outstanding Bond Antici- pation Notes and the bond for the new Town Hall; all have previously been approved but at this time the Town Board is required to approve the consolidation for serial bonds which will enable the Town to secure a lower interest rate. The outstanding BAN'S were for Wappinger Sewer Improvement Area #1, Central Wappinger Water Improvement Area and Highway Dump Trucks. A motion was made by Mr. Incoronato and seconded by Mrs. Ballard to adopt the resolution. Mrs. Paino asked for further clarifi- cation of the work covered by these bonds in WSI#l and CWWIA; Mrs. Garrison explainffithe bond on CWWIA was originally $202,000, the outstanding indebtedness has been reduced to $184,070, the original amount of the WSI#l bond was $440,000; both projects were for the extension of lines to service residents in the Improvement Areas who were previously unserviced. Mr. Versace recommended that the matter be tabled for further review by the Board Members since they had just received the resolution at the meeting, however, Mrs. Garrison advised the Board to approve the resolution as the date of sale on the serial bonds is November 26th 1985 and the bonding company required that the information be available to them as soon as possible. She further explained that the Town now has a sufficient amount of money in bonding to consolidate for serial bonds (they cannot go to long term bonding with small amounts). The total amount is $1,348,641, which includes $700,000 for the new Town Hall. It cannot wait until the November 18th meeting because of the bonding market; the bonding company has advised her that in order for the Town to benefit by lower interest rates, the serial bonds should be sold as soon as possible. The end of December will bring a change in rates and the interest payments may start in January when the Town is short on funds. If action is tabled to the 18th of November, Mrs. Garrison added that she will not be able to do the required paper work and forward them to the bonding company - ~ - ~ ~ 33; L ~ in time for them to process the bonds for the November 26th sale. Mr. Versace interjected his comments that in order to get the best interest rate on the bonding market, it's best to consolidate to serial bonds; one bond, as pointed out by Mrs. Garrison is for the new Town Hall, the BAN'S were taken out in 1983, one for CWWIA, one for WSI#l, for extension of the lines to provide service to residents in the Cedar Hill Area; the projects started in 1983 and were completed early in 1984. At this time the market is better than it has previously been and this is the reason the resolution has been placed before the Board tonight. The vote was then taken---Mrs. Ballard and Mr. Incoronato voted in favor of the resolution while Mr. McCluskey and Mrs. Paino abstained so they could have the opportunity to review the document before voting either way. It was now up to Mr. Versace to vote, however he requested Mr. Incoronato to withdraw his motion and Mrs. Ballard to withdraw her second so the two members of the Board could review the resolution as they requested. Mr. Incoronato rescinded his motion and Mrs. Ballard rescinded her second to the motion. At this point Mr. Kessler added his comments for the record--- the Town is involved in BAN's and are obligated to pay them; they have never sold serial bonds before, this application is proposed by Munistat Services Inc. for the finance advisory service that the Town has utilized. The Bonding Counsel, Willkie, Farr and Gallagher, has been notified to prepare the resolution; the serial bonds are merely to cover the BAN'S that have already been issued and are still in effect; we are consolidating the bonds for lower interest rate. Munistat has recommended to bonding counsel that the date of sale should take place on NOvember 26, 1985 at 11:30 A.M., the fiscal agent will be Citibank in New York City which will be the municipal paying agent; they have been assured that the bonding interest rate at that particular time will probably be lower than they anticipate at a later time. He urged the Board to act on the resolution. Mrs. Paino suggested that the Board caucus for five or ten minutes with the Attorney and the Comptroller. Mr. Versace recommended that an open recess be held as there is no litigation involved. u ~ l "'" i\ ' ..3 'It> Mr. Versace called for a five minute recess at 8:55 P.M. The meeting was called back to order at 8:59 P.M. and all Board Members were present. Mrs. Paino stated that now she understood the resolution and made the motion to approve it. MRS. BALLARD moved to authorize the Supervisor to sign the necessary documents so bonding counsel can proceed with the I sale of the serial bonds. .." Seconded by Mrs. Paino Motion Unanimously Carried Three transfer resolutions were presented to the Town Board for their consideration. As they were presented, Mrs. Garrison explained the reason for the transfer. The first one related to insufficient funds in the budget for the leasing of the Animal Hospital. It appeared to Mrs. Garrison that there were not enough funds coming in to the Town on dog violations due to the lack of able and efficient Dog Control Officers; also there was an increase in stray dogs being brought to the shelter. The following resolution was offered by COUNCILWOMAN PAINO - who moved its adoption: WHEREAS, there are insufficient funds in the budget for the leasing of the Animal Hospital and related expenses, BE IT RESOLVED, that the sum of $2,100~00 be and hereby is transfered from DC 3510.1 to DC 3510.4. Seconded by: Councilwoman Ballard Roll Call Vote: 5 Ayes 0 Nays The second transfer was for line item, Refuse and Garbage--- at present there are $6,900 outstanding bills. We are still conducting the Fall Clean-up and monies will be required to tJ excavate and cover the materials at the landfill site. Some of Garage for the Saturday Morning Garbage Program. - the monies will be recouped from revenues received at the Highway The following resolution was offered by COUNCILWOMAN PAINO who moved its adoption: WHEREAS, there are insufficient funds in the budget under FRS 8160.4, for garbage collection, and WHEREAS, this line item is considered a town outside village charge, BE IT RESOLVED, that the sum of $8,000.00 be and is 3W hereby transferred from Contingency B1990.4 to Refuse and Garbage CF8l60.4. Seconded by: Councilwoman Ballard Roll Call Vote: 5 Ayes 0 Nays A transfer was required for chemical purchases in CWWIA; for some reason more chemicals were required than anticipated. l The following resolution was offered by COUNCILMAN MCCLUSKEY who moved its adoption: ~ WHEREAS, the charges for the year to date for chemicals in CWWIA have been more than was anticipated in the budget, and WHEREAS, there is an unexpended balance in the equipment line item in CWWIA, BE IT RESOLVED, that the sum of $400.00 be and hereby is transferred from Equipment SW 8340.2 to Purification SE 8330.4. Seconded by: Councilwoman Ballard Roll Call Vote: 5 Ayes 0 Nays Unfinished Business--- At the October 21st, 1985 meeting, Ronald Walden requested to hook up his home at Lot #7 Peel Lane, to the Rockingham l Farms Sewer District as a tenant. The Board referred the request to the Dutchess County Department of Health for their approval and Mr. Walden was informed that before the Town would consider this request he would have to obtain approval from the Health Department. A letter from James Napoli, Supervising Public Health Engineer with the Dutchess County Health Department to Mr. Walden and copied to the Town Clerk, indicated that they had no objection to connecting the residence to the existing sanitary sewer main which serves Section lA of the Edgehill Manor Development. MR. VERSACE moved to notify Mr. Walden that the Town has ~ received notification of Dutchess County Health Department L approval for this hook up and request that he contact the Town Clerk's office for procedure he must follow to become a tenant to the Rockingham Farms Sewer District. Seconded by: Mrs. Ballard Motion Unanimously Carried On October 7th, 1985 the Planning Board forwarded copies of the Draft Environmental Impact Statement on the Wedgewood Heights Subdivision to all involved agencies requesting that .. .' ~1).. any comments the particular agency wished to make should be forwarded to the Planning Board within thirty days. Mrs. Snowden received the DEIS and asked the Board if they had any comments. MR. MCCLUSKEY moved to inform the Planning Board that the Town Board has no comments to make on the Draft Environmental Impact Statement on the Wedgewood Heights Subdivision. Seconded by Mrs. Ballard Motion Unanimously Carried A request was received from Mr. & Mrs. Lustgarten for a reimbursement of $35.00 for replacement of their water meter; this matter was supposed to have been remedied last year but apparently it was not. MRS. PAINO moved to authorize the Comptroller to reimburse $35.00 to Mr. & Mrs. Lustgarten for the replacement of their water meter. Seconded by Mr. McCluskey Motion Unanimously Carried At the last meeting, Mr. Incoronato referred a matter relating to consideration of free sewer hookup to Fleetwood Sewer District for Eugene Broadie at 2 Fleetwood Drive, to the Attorney for a legal opinion. In light of the fact that Mr. Broadie and the former owner of that residence had paid benefit assessments and operation and maintenance charges for the past fifteen years and were not connected to the system, Mr. Broadie requested the Town to consider this "trade off". He was reimbursed $47.00 for the current billing, however the Town could not refund for the previous fees. PRESENT: Frank Versace, Supervisor Renata Ballard, Councilwoman Joseph Incoronato, Councilman Gerard McCluskey, Councilman Irene Paino, Councilwoman Elaine H. Snowden, Town Clerk The Town Clerk offered for the record the Affidavits of Posting and Publication duly signed and notarized. (These Affidavits are attached hereto and made part thereof of the Minutes of this Hearing.) It was noted that the rate per unit for this Roll was $115.93 in 1985 and $91.57 in 1986, a reduction of $24.36. Herb M. Wallace, Attorney spoke on behalf of his clients Cranberry Hills _ D. W. S. and W. V. C. to protest the Benefit Assessments on this Subdivision. He stated that it was his understanding that the assessment unit formula is the same one used since 1975 and that his clients will be assessed .8 units for each residential unit that has subdivision approval. He protested the formula in that the property given subdivision approval was vacant land and cannot be used. Mr. Wallace mentioned that he had attended a recent meeting where the Engineer to the Town reported that the plant servicing this property does not have the capacity to accept the subject property and that they are being assessed in excess of the benefits. He quoted from the formula which was adopted in 1975 and carried forward which states "lands which cannot be served in the judgement of the Assessor shall be assessed at 1/3 of the full benefit units which would normally be assigned if the property could be serviced." They protested the assessment stating it was their contention that they should be assessed as vacant land and should be at 1/3 of full assessment as opposed to the benefit assessment on approved subdivision lots. There were no further crnnments from those present either for or against the Assessment Roll and no written grievances had been received or filed. Mr. Kessler noted that this amendment was proposed by various municipal agencies of the Town; the Criminal Procedure Law provides that in order for the Inspectors to issue a notice of appearance summons, the Town Board, if it is their intent, must amend the present law. Vincent Francese, Town Justice asked if the Town Board was considering sending these officials to school to learn the procedure. An appearance ticket alone is not sufficient for the court to hold a person, it would have to be accompanied by an informational instrument. He has found in the past that part time police agencies have had difficulty with following proper procedures and filing the required paper work even after many hours of training. Mr. Kessler agreed with Mr. Francese and he had discussed this with the various municipal agents involved and they recognize that the proper in~ruments must be placed before the court. They have found in previous incidents that the issuance of an appearance ticket does the trick without any further court decisions. Tim Classey, Fire Inspector, noted that he was allowed to issue these tickets when he worked in Yonkers, so he had some knowledge of the proper procedures. It was their intent to meet with the Town Justices to discuss this prior to the adoption of the law. Mr. Versace added that these laws were recommended by the Fire Inspector, the Building Inspector and the Zoning Administrator .... and they worked with the Attorney to draw up this law. If school- ing is necessary, the Town Board will allow them to attend a school. There were no other comments made either for or against this amendment to the Building Code. MR. Mr. Kessler explained that this was the same situation as the previous public hearing on an amendment to the Building Code and allows for the Zoning Inspector and any deputy inspectors appointed by the Town Board to issue an appearance ticket pursuant to Section 150.20 of the Criminal Procedure Law. This allowance may result in disposing of simple minor infractions before they go to court. Vincent Francese, Town Justice, asked if they have devised a form of the appearance ticket. Mr. Kessler replied that it will be in conformity with the Criminal Procedure Law and noted that the officials involved planned to meet wi th the TownJustices so they know when to make them returnable and how the Judges prefer to handle this procedure. Mr. Francese had a question---normally when an appearance ticket is issued, a carbon copy if forwarded to the court with an appearance date when the defendant must appear in court. Mr. Classey's previous statement on these procedures does not coincide with the normal procedure on appearance tickets--perhaps he could clarify the question he has. When the appearance ticket is forwarded to the court the Town Justice expects the defendant to appear---how will it work now if they expect to settle the violation out of court. Mr. Versace reiterated Mr. Kessler's statement that the officials will meet with the Town Justices for correct procedure to follow. It isa new law and has to be worked on. Mr. Classey felt there were misunderstandings and clarified that there will be a court appearance and then the disposition will be decided. There were other procedures that must be followed, but it was agreed that they would discuss this at a future meeting. Linda Hall asked if this procedure was used in other town, or just Wappinger; Mr. Classes replied there are many towns allowing proper officials to issue appearance tickets. Supervisor Versace opened the Hearing at 8:07 P.M. Snowden , Town Clerk The Town Clerk offered for the record the Affidavits of Posting and Publication duly signed and notarized. (These Affidavits are attached hereto and made part thereof of the Minutes of this Hearing) . The Attorney stated that the comments made at the previous two public hearings on the subject of authorizing the Building Inspector, Fire Inspector and Zoning Administrator to issue appearance tickets, are still applicable to this Local Law; the other laws amended for this purpose are the Ordinance for Administering and Enforcing the New York State Building Code and the addition of Section 505 to the Zoning Ordinance. Tim Classey, Fire Inspector for the Town of Wappinger for the last year and one half noted that these laws are necessary and although during this time, the situation has not arisen whereby it was necessary for these officials to issue an appearance ticket, in the event it is needed, the law must be there to back them up. Mr. Incoronato added that the notion of these appearance tickets was presented at a state wide conference of building and zoning departments held about six or seven weeks ago and it was recom- mended by the professional people that the local municipalities adopt the laws giving the officials the authorization to issue the appearance tickets.
