Subject: Comprehensive Zoning Law Revisions: Submittal #2 -
Schedules of Use Reaulations. Etc.
As requested, we are in the process of preparing recommended
revisions and other amendments as part of a comprehensive update of
the Town's Zoning Law. Attached is the second set of such proposed
amendments.
The primary purpose of the comprehensive zoning revisions is to
update and modernize the entire Zoning Law in accordance with
currently accepted planning standards and procedures, recent
enabling legislation, and new case law. The revisions will also
correct the many inconsistencies and internal conflicts which have
developed over the years as a result of many independent and
uncoordinated zoning amendments.
As previously mentioned, due to the number and extent of necessary
revisions, we recommend reviewing the proposed amendments in
relatively self-contained units such as those attached hereto. The
proposed revisions contained in this second submittal represent
only'a portion of the additional work we have performed on the
comprehensive zoning revisions subsequent to the first submittal.
This submittal has been prepared in consideration of and in the
context of many additional revisions which will be the subject of
future submittals.
In this set of revisions, we have focused on the 17 lists of
permitted uses pertaining to the respective zoning districts and
their conversion into two comprehensive schedules of use
regulations (one for the residential districts and another for the
non-residential districts). It has been our experience that these
types of schedules simplify the administration and use of the
Zoning Law. The schedules also make the comparison of permitted
uses within each zoning district and between different zoning
districts particularly easy. The schedules are equally useful in
developing an understanding of the similarities and differences

between the Town's nine residential and 13 non-residential zoning
districts. Such an understanding is essential when considering
amendments to the Zoning Law and Zoning Map. Further, the
schedules will be very useful to developers and business people who
are trying to determine in which zoning districts a particular use
is permitted or may be appropriate.
The process of converting the existing I ists of permitted uses into
the attached schedules has been very useful in identifying many
existing inconsistencies, errors and redundant uses. The need for
additional corrections and modifications to other sections of the
Zoning Law has also become evident.
While the proposed revisions address the majority of the issues
related to permi tted uses, there are a number of addi tional
concerns which require the input of the Town Board, the Planning
Board and other Town staff prior to our preparation of specific
amendments. We expect that, through the process of our
presentations and discussions of the proposed revisions with the
boards and Town staff, the remaining issues will be clarified.
We anticipate that the next (third) set of proposed amendments to
the Zoning Law will include revised Schedules of Dimensional
Regulations and modifications to the site plan and special permit
standards and procedures.

PROPOSED AMENDMENTS
TO THE TOWN OF WAPPINGER ZONING LAW (Submittal #2)
As presented below, HWiJ$l:illlil indicates wording to be added;

and as specified in Section 200 of the Zoning Law, words in
"quotation marks" below are terms which are defined in Section 202
of the Zoning Law.
1. ARTICLE II, Defini tions, would be amended to add the
followinq new definitions:
Bed and Breakfast Establishment: A "dwelling" containing more
than two (2) but less than six (6) rooms without individual
kitchen facilities, which are provided or offered for
occupation by transient guests for sleeping purposes for
compensation.
The term "bed and breakfast establishment"
shall not include "motels", "hotels", "multi-family dwellings"
or "boarding houses".
Commercial Recreation Facilities:
Facilities designed and
used for active and passive participatory athletic and general
recreation activities, such as gymnasia, dance halls, skating
rinks, swimming pools, tennis courts, ball fields, bowling
alleys and billiard rooms including the incidental retail sale
of sundries, snacks and refreshments; excluded are facilities
intended for spectator activities, such as stadia and arenas.
Health, Exercise and Fitness Club:
Membership facil i ties
designed and used for body conditioning and rehabilitation,
including activities such as aerobic and related class

exercises. "Health, exercise and fitness clubs" may contain
equipment such as whirlpools, saunas, steam rooms, showers,
locker facilities and the incidental retail sale of related
sundries, snacks and refreshments.
Private, community or Fraternal Recreation Club: A not-for-
profit corporation organized to cater exclusively to its
members and their guests, including land, "buildings", and
facilities for recreational, athletic, social, professional
and cultural purposes. The members of the organization shall
have a financial interest in, and method of control of, the
assets and management of the "private, community or fraternal
recreation club".

ARTICLE II, Definitions, would be amended to modify the
