Smith and the Wappinger Town Board Date: January 20, 1995 Subject: Comprehensive Zoning Law Revisions: Addendum to Submittals #2 and #3 As requested at the Board's January 9, 1995 workshop meeting, we have prepared the attached addendum to Submittals #2 and #3 of the comprehensive zoning revisions. The addendum addresses the concerns expressed by the Board (Items #1 and #2 below). The following is a summary of the obj ecti ves of this addendum followed by descriptions of the respective changes made herein: 1. Reservation of special permit approval of all recreational uses in residential districts to the Town Board. This is accomplished by amending the Schedule of Use Regulations -- Residential Districts to add the wording "subject to Town Board approval" after each recreational use. (See Uses 21, 22 and 23 in the attached excerpt from the Schedule of Use Regulations -- Residential Districts). 2. Provision of a procedure, similar to that in the rezoning process, whereby applications for special permit approval of recreational uses in residential zoning districts are referred by the Town Board to the Planning Board for its review and recommendation. This is accomplished by adding a new paragraph b. to Section 434.2, Referrals, of the Zoning Law. This new section provides for a referral by the Town Board to the Planning Board for review and recommendation prior to the Town Board's public hearing on the application. (See addendum for changes to Amendment 1). The amendments contained in the attached addendum should be considered replacements for the comparable sections in Submittals #2 and #3.
