Card, Assistant Director State Assessment Services SUBJECT: 1996 Tentative Special Franchise Assessments For the past five years, eight major Electric and Gas Companies have filed complaints and have brought proceedings against special franchise assessments provided by the Office of Real Property Services (ORPS). The eight companies involved in this litigation are: 1. Central Hudson Gas & Electric Corp. 2. Long Island Lighting Co. 3. National Fuel Gas Distribution Corp. 4. New York State Electric & Gas Corp. 5. Niagara Mohawk Power Corp. 6. Orange & Rockland utilities, Inc. 7. Rochester Gas & Electric Corp. 8. st. Lawrence Gas Company ORPS and the eight companies have held negotiation!=- and have reached a settlement agreement of the litigation. This settlement will be implemented for the companies mentioned above except for st. Lawrence Gas beginning with the 1996 special franchise assessments. Changes for st. Lawrence Gas will begin with the 1998 assessment roll. The enclosed assessments reflect the~ reductions. ~ ft +Je't ~tz~v - The 1996 tentative special franchise assessments attached have been computed in accordance with our Rules and Regulations (Section 197), the settlement mentioned above and the settlement agreement with New York Telephone Company. If you have any questions, direct them in writing to me or call me at (518) 474-1071. The tentative special franchise assessments transmitted herewith were calculated with the latest State equalization rate that was made from the 1995 assessment roll of your municipality. If the final state equalization rate or a different equalization rate differs from the rate used in determining the tentative special franchise assessments, the change will be automatically reflected in the final special franchise assessments. The amounts of the special franchise assessments set forth in this notice are "tentativeU and must not be entered on the assessment roll.
