The Regular Bimonthly Meeting of the Town Board of the Town of
Wappinger was held on September 3, 1985 at the Town Hall, Mill
Street, Wappingers Falls, New York.
Supervisor Versace opened the Meeting at 8:00 P.M.
Present:

The Meeting started with the Pledge of Allegiance to the Flag.
The Minutes of the Regular Bimonthly Meetings of August 5 and August
19, 1985, having previously been forwarded to all Board Members, were
now placed before them for their consideration.
Mrs. Paino requested that the following addition be made to the August
5th, 1985 Minutes on Page 13 relating to the discussion on the Public
Hearing for the Moratorium: "After comments were received from the
audience, Councilmen McCluskey and Paino requested that the Public
Hearing be rescheduled since the August 29th, 1985 meeting was just
prior to the Labor Day weekend holiday".
MRS. PAINO moved that the Minutes of the August 5, 1985 Meeting,
including the above stated addition and the August 19, 1985 Meeting,
be and they are hereby approved, as submitted by the Town Clerk.

A letter was received from Frank Borquist, Secretary/Treasurer
for the New Hackensack Fire District, advising the Board that

they have appointed Chief Francis Daniels as a member of the Fire
Prevention Bureau. Chief Daniels will replace William Bud Pottenburgh
who is retiring as a member of the Bureau.
MR. MCCLUSKEY moved to confirm the appointment of Chief Francis
Daniels as a member of the Fire Prevention Bureau from the New
Hackensack Fire District.

regarding their intent to renew liquor licenses. These notices
are forwarded to the municipalities so they can express their
opinion either for or against the granting of these licenses.

of Transportation informing us that a 40 MPH speed limit was

Mr. Thomas Brickner of the Chelsea Fire Department wrote to the
Board requesting permission to block off Liberty Street on September
7, 1985 from 12 noon to 7 P.M. for their annual family day at the
Chelsea Firehouse. Mrs. Snowden had previously advised Mr. Brickner
to notify the local law enforcement agencies that this road would be
blocked off for this event.

MR. INCORONATO moved to notify Mr. Brickner that the Town Board has
granted them permission to block off Liberty Street on September 7,
1985 for their family day at the Chelsea Firehouse.

A response was received from Stephen Rabbitt, Supervisor of the
Town of Fishkill regarding our complaint of several fires at the
former Price Brothers Pipe Company which he identified as Brockway
Road. It seems that the site is now used as a dumping ground and
has become an attractive nuisance with fire setting. It is a concern
to our Town as it is serviced by the Chelsea Fire Company who have
responded to several fires in the last few weeks. Mr. Rabbitt
LJ enclosed a copy of a letter forwarded to the owners of this property
notifying them they were in violation of the State Law by operating
a landfill without the proper permit and requested that they take
the necessary measures to correct the problem.
MR. MCCLUSKEY moved to forward copies of these communications to the
Attorney in the event there is future litigation, and place the
letters on file.

Manager, Airports Division, the Flight Standards Division is
investigating the incident of July 20, 1985, and will take
appropriate action.

In reference to radar coverage, we anticipate installing the
latest state-of-the art radar equipment at Stewart Airport to
serve the Mid-Hudson Valley area including the Dutchess County
Airport. This system should be operational early in 1987.

MRS. PAINO moved to direct a letter to Mr. Edmund Spring, Acting
Manager of the Air Traffic Division indicating that his letter did
not address the Town's main conrernrelating to the acceleration of
the time frame on the installation of the radar and the Town Board
again urges the F.A.A. to consider the implementation of the state-
of-the art radar system at Stewart Airport as expeditiously as
possible, and the Board Members have also requested that they be
advised of the outcome of their investigation, when completed.

The Town Board received copy of a communication from Frank Buyakowski,
Satellite Investments, to Ronald Evangelista, regarding completion

of the sewer line extension for the Woodcrest Subdivision and refund
of the bond posted for this purpose.
The Engineer indicated in his letter of September 3, 1985 that the
sewer line extension was in satisfactory condition and recommended
release of the Letter of Credit from the Fishkill National Bank.
MRS. PAINO moved that the Letter of Credit submitted by Mr. Buyakowski
for completion of sewer work on the Woodcrest Subdivision be released,
upon the recommendation of the Engineer and Mr. Buyakowski be notified
of this action.

Committee Reports---
Mrs. Ballard reminded the Board that they would meet at the new
Town Hall on September 6, 1985 at 3:30 P.M. to take a tour of the
building; this date and time was acceptable to the Board Members.
Mrs. Ballard, Recreation--At their meeting last Thursday, the
Recreation Commission discussed the items referred to them at the
Town Board Meeting of September 6, 1985, which included fencing
the Rockingham recreation site and securing the barn on Montfort
Road. It was suggested by some of the Commission Members that
large boulders be placed along the field entering the site to
prevent cars from entering the fieHsand put locking fence midway
down the road to the waterhouse. Mr. Presti will obtain prices
to secure the barn and dispose of the debris that has been cleaned
out of the building.
Mrs. Paino, Water and Sewer, reported on monthly meeting she and
Mrs. Ballard hold with Michael Tremper of Camo Pollution Control.
They have completed the smoke testing of the sewer lines of the Town
which is mandated by the D.E.C. This testing revealed that there is
water in the system which should not be there and this is presently
being corrected. During this testing they also found illegal taps
into the sewer system and the Building Inspector has been directed
to correct these vio~ions.
At the August 5, 1985 meeting, Mrs. Paino had requested the Comptroller
to provide the Town Board with figures on the cost to the residents
for upgrading the Rockingham Mid-Point and Fleetwood Sewer Plants.
Although the Comptroller stated that the Board Members would receive
them during the week of August 12, 1985, they still have not received
them. Mrs. Garrison informed the Board that as soon as the figures
were available she would forward them to all Board Members. Mrs.
Paino felt that the residents have a right to be informed of this
cost and requested the Comptroller to provide the figures as expedi-
tiously as possible.
One final item from Mrs. paino---she requested that a representative
from Morris and Andros be present at the Public Hearing on the
proposed Wappinger Sewer Improvement Area #2, to answer questions
that the residents might have. She also requested that a court
stenographer be available to take the minutes of this Hearing.
Mr. Versace replied that Morris and Andros did the design work on

the Sewer Improvement Area and would be present at the Hearing to
make their presentation to the public and answer their questions.
Mr. Versace reported that he had received inquiries from residents
relating to enforcement of rules and regulations at our recreation
facilities and the water and sewer plants. Although signs have
hours of the recreation parks, they do not stay in place very long

been posted from time to time designating the opening and closing
and for this reason the Vandalism Patrol has a problem enforcing
the laws. He requested the Attorney to prepare a law, for considera-
tion of the Town Board at their September 17th Meeting, which would
allow the Vandalism Patrol to issue tickets to violators of the rules
and regulations outlined in previous laws pertaining to recreation
areas and water and sewer plants.
Mr. Incoronato reported that the dedication ceremony for Kenneth
Browne Playing Field would take place on Saturday, September 28,
1985 at 1 P.M. at the Castle Point Recreation Area. Several months
ago the Town Board approved a resolution naming this playing field
after Kenneth Arthur Browne, who died at the age of nineteen during

the Korean conflict. Thanks to the time and efforts of the Coughlin
Family of Chelsea the dedication of this field was now in place.
The base for the flagpole is in place, the final slate is ordered
and will be superimposed on the concrete base and the bronze plaque
will be mounted on the base. Confirmation has been received from
Congressman Hamilton Fish that he will be present at the ceremony.
He congratulated the Coughlin Family, on behalf of the Town Board,
for making this event possible.
The second item Mr. Incoronato reported on related to the Mosher
property on Ketchamtown Road; the building was destroyed by fire
, over a year ago and has been abandoned. It has become a dumping
site and could be a danger to children entering the remains of the
structure. The question of who owns the property and the Town's

ability to raze the structure should be resolved quickly and he
urged the Attorney to work in conjunction with the Fire Inspector
to locate the owner, or if this is not successful, the necessary
action should be taken for condemnation procedures.
Mr. Incoronato informed the Board that the ninety day appointment

of Eugene Joyce as Zoning Enforcement Officer has expired, as of
last week. The Comptroller has checked with the Dutchess County
Civil Service and learned that this appointment can be renewed for
a two month period thru October 1985. Mr. Incoronato noted that
51 zoning violations have been resolved this month and 45 are
still pending.
In answer to Mr. McCLuskey's question on the status of this position
at the end of the two months, Mr. Incoronato replied that he believed
the Town should appoint a full time Assistant Zoning Administrator
which would be a civil service appointment, and this would have to
be taken into consideration when preparing the 1986 budget. Mr.
McCLuskey was in favor of this position and recommended that they
review the civil service list for an applicant for the position.
MR. INCORONATO moved to reappoint Eugene Joyce as Zoning Enforcement
Officer for a two month period at $7.00 per hour and $.20 mileage,
and approve the transfer of $1,000 from the Contingency Account to
cover the expenses for this position.

Mrs. Paino was in favor of the position but objected to the individual
they were reappointing for these duties. She has reviewed his resume
and checked the municipalities where he was formerly employed and
was unable to obtain their recommendation of him for this position.
As an employer, this individual would not be her choice for this
particular position.
Prompted by Mrs. Ballard's report on the Montfort Road Barn, Mr.
McCluskey expressed his displeasure on the position the Recreation
Commission has taken on this building. A few years ago the Town
Board, Highway Superintendent and Engineer determined that the
building should be demolished and possibly a preconstructed or
metal building put at that location. The Commission wanted to
keep the building and went to bid on refurbishing the barn without
authorization from the Board. The bids were rejected and the matter
is in limbo. As it stands now, it is a potential fire hazard and
presents an insurance problem to the Town. Mrs. Ballard reported
tonight that the Commission is investigating prices to button up
the building; he contended that the building was buttoned at one
time, what happened to unbutton it. His point was that the Commission

has to make a determination on what they are doing and submit a plan
and cost to the Town Board.
MR. MCCLUSKEY moved to direct a letter to the Recreation Commission
requesting that they forward a plan and estimated cost on utilizing
the barn for specific recreation programs to the Town Board, if 'this
is their intent.

Mary Schmaltz, member of the Recreation Commission, was recognized
by the Chair and objected to Mr. McCluskey's statements. Her first
point was that the barn was never comple~ly buttoned up, however,
monies have been set aside to secure it this year. The intent was
to use the building for recreation and storage. Secondly, a complete
package on renovation and use of the barn was submitted to the Town
Board, as requested. There is a report on file from an architect
in Rhinebeck indicating that the building is definitely worth saving.
She contended that the majority of the Recreation Commission is in
favor of preserving the building and felt that monies should be
expended for this purpose. II
Resolutions---
A Public Hearing having been held by the Town Board on August 291
1985 on an Ordinance Introducing a Moratorium on Certain Construction
in the Town of Wappinger, the matter was now placed before the Board
for their consideration.
Mrs. Snowden informed the Board that the recommendation on this
Ordinance has been received from the Dutchess County Department of
Planning.
MR. VERSACE moved to table action on the proposed Moratorium and
schedule an informational meeting for September 18, 1985 at 7:30 P.M.
at the Wappinger Junior High School, to answer questions and receive
comments from the public relating to this subject. II

Mrs. Paino agreed that action on this matter should be tabled in
order to give the residents the opportunity to ask questions on
the proposed moratorium. She requested that, at a future date,
after the informational meeting, the Town Board sit down with the

Zoning Board of Appeals and the Planning Board to discuss the
agenda they plan to follow during the course of the moratorium.
This meeting, she added, should be set prior to the Town Board's
action on the moratorium.
In answer to this request Mr. Versace replied that he has scheduled
a work shop session on September 12, 1985 with the Chairmen of the
Zoning Board of Appeals, the Planning Board and the Conservation
Advisory Council to discuss their participation and the direction
they intend to follow. He has also invited Roger Akeley, Commissioner
of the Dutchess County Department of Planning.
At a previous meeting the firm of Morris and Andros was authorized
to prepare final bid plans and specifications for the Hilltop-Edgehill
Drainage Project. These were now completed and the firm was ready
to go to bid on this project.
MRS. BALLARD moved to authorize Morris and Andros to go to bid on
the Hilltop-Edgehill Drainage Project.

MRS. BALLARD moved to set a Special Meeting for October 3, 1985
at 7:00 P.M. for the purpose of the Town Clerk presenting the
Tentative Budget for 1985 to the Town Board and for them to
consider action on awarding the bid on the Hilltop-EdgehillDrainage
Project.

As requested by the Town Board, Morris and Andros submitted a cost
estimate for the short term recommendations at the Hilltop and
Rockingham Wellfields. Mrs. Ballard explained that this is a
follow up on the Hydrogeologic Evaluation of these Wellfields
prepared by Dunngeoscience earlier this year. Since it is the
intent of the Board to implement these recommendations, which were
outlined in the August 7, 1985 report from Morris and Andros, a
work shop session was held on August 22, 1985 for review and dis-
cussion of the proposal. For the benefit of the residents present,
Mrs. Ballard read the list of tasks associated with the protection
of these wellfields, the category of the personnel performing the
specific task, hours involved and estimated cost for each site.

Task (a) at the Hilltop Site was estimated at $4,052, Task (b) at
$3,370, Task (C) $808, total cost for Hilltop Site $8,230.
Task (a) at the Rockingham Site was estimated at $3,264, Task (b)
at $3,370 and Task (c) at $808, total cost for Rockingham site,
$7,442, total cost of both sites $15,672. The complete breakdown
of tasks involved is included with the report. This is a continua-
tion of the Hydrogeologic Evaluation and monies will be expended

from the Consortium Funds.
MRS. BALLARD moved to authorize Morris and Andros to proceed with
the tasks associated with the short term recommendations for the
protection of the Hilltop and Rockingham Wellfields at a total cost
of $15,672.00 and these monies be expended from the Consortium Funds
available to the Town for this purpose.

Mr. McCluskey mentioned that a letter had been received from Mr.
Evangelista recommending that the Town not accept Daniel Sabia Drive
as a Town road at this time since there were problems that had to be

corrected. He asked the Engineer when the Board could expect a
report on this road and any other one in the Blue Ridge Subdivision.
Mr. Evangelista replied that a report should be ready for the next
meeting on September 17th, 1985.
MR. VERSACE moved to forward a letter to the principals of Pondview
Subdivision requesting an approximate date on when they expect the
roads in this Subdivision to be completed.

Wappinger on September 17, 1985 at the Town Hall, Mill Street,
Wappingers Falls, Dutchess County, New York. on an Ordinance
Amending the Zoning Ordinance (Section 416, Signs).

Mr. Versace noted that the Amendments to this Ordinance have been
drafted by the Citizens Zoning Advisory Council.
The Supervisor asked if there were any comments from those present
either for or against the proposed Amendments.
