The Regular Bimonthly Meeting of the Town Board of the Town of
Wappinger was held on December 17, 1984 at the Town Hall, Mill
Street, Village of Wappingers Falls, Dutchess County, New York.
Supervisor Versace opened the Meeting at 8:04 P.M.
Present:

The Meeting started with the Pledge of Allegiance to the Flag.
The Minutes of the Regular Bimonthly Meeting of December 3, 1984,
having previously been forwarded to all Board Members, were now
placed before them for their consideration.
Mrs. Paino requested that the letter from Hayward and Pakan
regarding a change order for the windows in the new Town Hall
be made part of the December 3, 1984 Minutes. This document,
she felt, would provide a better understanding of the discussion
that took place during that meeting.
MRS. PAINO moved that the Minutes of the December 3, 1984 Meeting
be and they are hereby approved, with the addition of the letter
from Hayward and Pakan dated November 27, 1984, relating to a
change order request for windows for the new Town Hall, as
submitted by the Town Clerk.

Reports were received from the Town Justices, Receiver of Taxes
and the Highway Hydrant Report for the month of November and
from the Building Inspector for October and November.
Mrs. Paino noted that the Hydrant Report from Mr. Croshier
indicated that the following hydrants were full of water in
the casing ---Spook Hill Road and Roberts Road in frontof the
Prassel residence and Myers Corners Road opposite Schnorr
Plumbing. This was brought to the attention of a Camo Pollution
Control representative by Mrs. Paino and she was assured this
would be taken care of.
MRS. PAINO moved to accept the reports received and place them
on file.

An Order was received from the New York State Commission on
Cablevision approving the renewal and amendment of the Town
of Wappinger Cable Franchise with U. S. Cablevision.
The Attorney preferred to further review this document before
discussing it with the Board.
MR. VERSACE moved to table the Order from the New York State
Commission on Cablevision to January 7, 1985 for further review
by the Attorney.

A report was submitted by the Engineer, at the request of
Councilwoman Ballard, on a drainage problem on Briar Lane
(Klein/Alexander Subdivision on All Angels Hill Road).
Mr. Versace noted that correspondence relating to this drainage
problem had been received from Mr. Klein today and in order to
give the Board Members an opportunity to review this communica-
tion he recommended that the matter be tabled.
MR. VERSACE moved to table the Engineer's Report on the Briar
Lane drainage to the meeting of January 7, 1985.

A letter was received from Mr. Maurer, Chairman of the Recreation
Commission recommending that before equipment is installed at
the Fleetwood Playground site, money should be spent to clear,
level and open up the area. Since it is a secluded area, the
Commission feels that the residents may be reluctant to use
the playground.

Mr. Incoronato reported that the residents of Fleetwood are
ready to resurrect their recreation area after many years of
abandonment due to excessive vandalism at that site. Our law
enforcement agencies now seem to have the situation under
control thanks to the persistance of the residents. The Highway
Department has moved the post and chains
to a different location
thereby eliminating the problem of parked cars and Mr. Incoronato
thanked Ken Croshier for his cooperation. He and Mr. Biose, our
Recreation Director, plan to visit the recreation site early next
year to formulate a plan to repair the existing equipment and
improve the site.
MR. VERSACE moved to receive the communication from the Recreation
Commission and place it on file for consideration by the Town Board
pending a recommendation from the Commission on the completed plan.

Committee Reports ----
Mrs. Ballard, Recreation Committee , reported on activities of
the Recreation Commission during 1984. The Wappinger United
Football Club has established a soccer league for the youth
of the Town under the direction of Fran Donofrio and Bill Black.
Both the Recreation Commission and the Town Board have strongly
supported this activity and it has proved to be a tremendous
success; the initial registration in the fall has increased from
120 to the present enrollment of 200 children. The program will
continue through the winter at Myers Corners School and Ron LaSota
of the Castle Racquet and Fitness Club has offered a room to the
league for practice games. In order to help defray expenses for
clinics for the coaches and the rental of the school gym, the
league is planning a candy sale drive.
MRS. BALLARD moved to send a letter to Fran Donofrio, President
of the Wappinger United Football Club, expressing the Town Board's
thanks to the Board of Directors and the coaches for their time
and effort in setting up a soccer league for youth of the Town
of Wappinger.

Other activities accomplished by the Commission included the
upgrading and repairing of some of the Town's recreation
facilities. The upgrading of the Chelsea Boat Ramp was
completed with the cooperation of Mr. Maurer, Mr. Croshier
and Mrs. Paino who was instrumental in the Town receiving a
$1,000 grant for this project. The basketball courts at Martz
Field and the Chelsea School House have been resurfaced; a new
roof on the Martz field house and the addition of a storage
closet at the Chelsea School House for the summer program.
There are plans to install a new gate at the Castle Point
recreation site and a gate for Reese Park to close the area for
the winter months. The recreation site on Spook Hill Road and
Reggie Drive is being developed and will be usable in the spring
of 1985.
Mr. Incoronato suggested that the landfill site at Castle Point
be separated from the recreation area to enable the residents to
make use of the facilities available to them.
Mrs. Ballard, Building Committee, reported that she, Mrs. Crosby
and Mrs. Paino had visited the A T & T telephone setup and viewed
the equipment_ available for the new Town Hall which the Board would
be considering in January of 1985. Mrs. Paino added that they
had also visited Executone and Telecom to see what they had to
offer.
Mrs. Paino,Airport Advisory Committee, reported that a meeting
will be held on Wednesday, December 19, 1984 and items for dis-
cussion include the entrance on Route 376 with a report from Mr.
Spratt, Commissioner of Public Works, also County and FAA capital
programs.
Mrs. Paino, Drainage Committee, requested the Engineer to submit
a list of the drainage problems in the Town that have not been
addressed. She added that on previous occasions she had asked
for this report and would appreciate receiving it during the
month of January.
Mrs. Paino, Building Committee ---Although, at the last meeting
her request for specific information regarding a change order
request from Hayward and Pakan for windows in the new Town Hall,
was rejected by Supervisor Versace, Councilman Incoronato and
Councilwoman Ballard (Councilman McCluskey was absent), Mrs.
Paino chose to pursue the matter and contacted the manufacturers
of these windows; she learned that the cost of the new type of
windows was less than those originally specified due to simplied
hardware and the smaller screen size. In regard to the thermal
breaks in the new windows, both manufacturers indicated that these
are standard features in both windows.
Mr. Versace recommended that Mrs. Paino contact the manufacturers
and request them to submit these facts in writing to the Town
Board.
Mrs. Paino, Building Committee ---reported that she had checked
the contracts for the Town Hall signed by the Supervisor and
found that these documents allow asbestos in the floor tiles
and cement boards that will cover the insulation in the building.
Prior to voting on awarding the bids at the October 15, 1984
meeting, she had stated that she would approve authorizing the
Supervisor to sign contracts provided that no asbestos be used
in the building.
Mr. Versace responded that contracts were reviewed by the Attorney
and the professional people retained by the Town Board to supervise
the construction of the Town Hall. He emphasized the fact that if
he felt the specs included material detrimental to the safety of
employees or residents, he certainly would not have signed these
contracts. These materials are all federally approved and the
professional people would not have approved the documents if
there were harmful materials in the specifications.
Mrs. Paino continued discussion pointing out that the concern was
the inclusion of asbestos in the construction of the building
despite the fact that Hayward and Pakan had been directed to
eliminate this material. At the September Meeting the Board
requested the firm to forward a data sheet of materials to be
used in the Town Hall and whether they were hazardous to employees
or anyone visiting the building, and although she has asked for
this report on numerous occasions since then, it still has not
been submitted.
Mr. McCluskey concurred with the facts brought up by Mrs. Paino
and expressed his dissatisfaction with the firm on the procedures
they were following on the project.
Mrs. Paino mentioned another item included in the conditions of
approving the bids was that any work improperly done must be
corrected by and at the expense of the contractor; this provision
was not stated in the signed contract which could result in extra
expense to the taxpayers if the situation arose that necessitated
removal of the asbestos. Since Hayward and Pakan was remiss
in handling the recent incident in the schools involving the
removal of this material, it was up to the TownBoard to insist
that all directions forwarded to the firm be strictly adhered to.
It was Mr. Versace's opinion that there was no comparison between
the situation that existed in the schools due to materials used
twenty years ago and the present ones which require approval under
the EPA before they are included in specs for public buildings.
He referred the matter to the Attorney for his comments.
Mr. Kessler noted that the long form Environmental Assessment
Statement prepared by Hayward and Pakan, as required by their
contract with the Town, stated that materials in the Town Hall
specs would not cause a risk of any release of hazardous
substances.
The main concern of this discussion, Mr. McCluskey pointed out
was not environmental affects, but the fact that the Town Board
specifically stated to Hayward and Pakan that no asbestos was to
be used in the Town Hall and they have not complied with this
direction.
Mrs. Ballard asked that the following letter be made part of
this meeting:

As Sub -Chairman of the Building and Housing Committee and Town
Board liaison with your firm on our new town hall project, I
am requesting additional information regarding the floor tiles
for the new town hall. The specifications call for "encapsulated
asbestos vinyl tiles". Some Town Board Members are concerned
about the use of this type of tile.
Please prepare a comparison of "encapsulated" asbestos vinyl
tile and plain vinyl tile, regarding safety, durability,
availability, price, types of buildings used in and any other
pertinent features. I would like this information available in
early January for our consideration.
Thank you for your prompt attention to this matter.

Mrs. Ballard recommended that the Town Board review the forth-
coming report from Hayward and Pakan and if they still feel that
the materials in the original specifications are not acceptable,
the firm will be directed to eliminate all asbestos in the Town
Hall building.
There was no further discussion on the matter and the meeting
continued with the remaining Committee Reports.
Mr. Incoronato, Ordinance Committee, reported that the Steering
Committee formed for the purpose of appointing a Zoning Regulations
Advisory Councilumet with the Town Board at their last work shop
session to present their proposals and recommendations for the
organization of this Council, consisting of twenty members. The
first meeting of this organization will meet on January 15, 1985
at 7:30 P.M. at the Town Hall. He requested that the Planning
Board Secretary notify the members of this meeting and include
a copy of the Zoning Ordinance and the new Zoning Map with the
notification.
Michael Hirkala, being recognized by the Chair, recommended that
the Town Board go on record to accept the procedures and recommenda-
tions to avoid any problems that might arise in the future on
actions taken by this Council.
MR. VERSACE moved to accept the procedures of the Steering Committee
relating to the formation of the Zoning Regulations Advisory Council
and their recommendations of appointments to this Council provided
they were residents of the Town of Wappinger.

Mr. McCluskey noted that dumping was still going on in the vicinity
of Jackson Road and New Hackensack Road although numerous complaints
had been forwarded to the Dutchess County Department of Public Works.
He did notice a "no dumping" sign, but that has not helped to halt
private citizens from dumping their garbage and trucks dumping their
excess blacktop, cement and wood chippings.
Mrs. Paino commented that at a previous meeting Mrs. Mills had
suggested that a fence be put up to curtail this activity; she
had discussed this matter with Mr. Whited, Commissioner of
Aviation and was told there was not sufficient money in the 1985
budget for a chain link fence and suggested a snow fence.
Mr. McCluskey felt that railroad ties should be put at that
location which would prevent the vehicles from driving in.
On a related matter, Mr. McCluskey had noticed that inmates
working with Dutchess County Program, have been clearing the
area in the vicinity of Quiet Acres and the end of the airport
runway and this has been going on since last spring. Last week
there were surveyors in the same area and he was curious about
this activijzy.
Mr. McCluskey asked about the time schedule for the construction
of the Town Hall --so far there was clearing and grading and some
preparations for the footings.
Mr. Versace informed him that the contractor indicated that he
intended to clear the area, backfill it, let it settle over the
winter and start the footings in the spring.
Mr. McCluskey's next item related to the submission of a report
from the Recreation Commission on the renovation of the barn on
Montfort Road. The Board has requested the Commission, on
numerous occasions,to inform them of their intentions for either
refurbishing the building or demolishing it and they have not
complied. He asked Mrs. Ballard to discuss this with the Commis-
sion and inform them the Board is waiting for their recommendations.

1984 at 4 P.M. at the Town Hall.

Public Hearings having been held by the Town Board on December 6,
1984 on the following proposed Local Laws, were now placed before
them for their consideration.
MR. MCCLUSKEY moved to adopt the following Local Law #5 of 1984:
LOCAL LAW NO. 5 OF THE YEAR 1984 AMENDING LOCAL LAW
NO. 7 OF 1981 AND LOCAL LAW NO. 8 OF 1980 RELATING
TO THE IMPOSITION AND CHARGE FOR WATER RATES FOR THE
CONSUMPTION AND USE OF WATER FOR FLEETWOOD WATER DISTRICT
BE IT ENACTED, by the Town Board of the Town of Wappinger,
Dutchess County, New York, as follows:
Section 1. Section 2 of Local Law No. 5 of the year 1981
is to be amended as set forth hereinbelow.
Section 2. The owner shall be obligated to pay the minimum
charge of $37.00 each quarter, regardless of the consumption of
water for said quarter, provided said owner is connected to the
system at any time during the quarter, said rate to commence
with the second district fiscal quarter of the year 1985.
Section 3. This local law shall take effect upon adoption
and as provided by the Municipal Home Rule Law.

1981 WITH RESPECT TO MINIMUM CHARGES FOR CONSUMPTION
OF WATER FOR FLEETWOOD SEWER DISTRICT
BE IT ENACTED, by the Town Board of the Town of Wappinger,
Dutchess County, New York, as follows:
Section 1: Effective the second district fiscal quarter
of the year 1985, the following rates shall be charged: the
owner shall be obligated to pay the minimum charge of $47.00
per quarter, regardless of the consumption of water for said
quarter, provided said owner is connected to the system at
any time during the quarter.
Section 2. All other provisions of Local Law No. 1 of
the year 1981 are hereby ratified, with the exception of Section 1
subdivision B which this local law hereby amends and which refers
to the minimum charges for consumption of water.
Section 3. This local law shall take effect upon adoption
and as provided by Municipal Home Rule Law.

per quarter, regardless of the consumption of water for said
quarter, provided said owner is connected to the system at
any time during the quarter.
Section 2. All other provisions of Local Law No. 7 of
the year 1980 are hereby ratified, with the exception of Section 1
subdivision B which this local law hereby amends and which refers
to the minimum charges for consumption of water.
Section 3. This local law shall take effect upon adoption
and as provided by the Municipal Home Rule Law.

LOCAL LAW NO. 8 OF 1984 ESTABLISHING WATER RATES
FOR CENTRAL WAPPINGER WATER IMPROVEMENT AREA
BE IT ENACTED, by the Town Board of the Town of Wappinger,
Dutchess County, New York, as follows:
Section 1. Any and all prior local laws establishing
water rates for the Central Wappinger Water Improvement Area
with respect to residential uses is hereby repealed only with
respect to water rates and the prior laws are otherwise confirmed.
Section 2. The following water rates are hereby established
for the Central Wappinger Water Improvement Area;
A: Residential
(1) Now all metered - $15.00 per quarter for all
users up to and including 2,500 cubic feet of water.
(2) In the event uses exceed 2,500 cubic feet, the
charge shall be .50 per 100 cubic feet.
Section 3. This local law shall take effect upon adoption
and as provided by the Municipal Home Rule Law.

IMPOSITION AND CHARGE FOR WATER RATES FOR THE

WATER DISTRICT
BE IT ENACTED, by the Town Board of the Town of Wappinger,
Dutchess County, New York, as follows:
Section 1. Local Law No. 1 of the year 1982 is amended
by deleting subdivision C and D of Section 1 thereof, and by
deleting Section 2 thereof.
Section 2. Section 1, subdivision C shall now read as
follows: effective the second

BE IT ENACTED, by the Town Board of the Town of Wappinger,
Dutchess County, New York, as follows:
Section 1. Each unit billed within the Ardmore Water
District shall receive for each billing quarter during 1985
a credit of $21.50, such rate being the minimum rate in
effect commencing the second fiscal district quarter for
the year 1985.
Section 2. This local Law shall become effective
immediately upon adoption and as provided by the Municipal
Home Rule Law.

MR. MCCLUSKEY moved to adopt the following Local Law ## 11 of 1984:
_LOCAL LAW NO. 11 OF 1984 AMENDING ALL PRIOR LOCAL
LAWS WITH RESPECT TO THE MINIMUM CHARGES FOR THE
CONSUMPTION OF WATER IN THE ARDMORE WATER DISTRICT
BE: IT ENACTED, by the Town Board of the Town of Wappinger,
Dutchess County, New York, as follows:
Section 1. Effective the second district fiscal quarter
of the year 1985, the owner shall be obligated to pay the
minimum charge of $21.50 each quarter up to and including
2,500 cubic feet of water. In the ev-ent the consumption of
water exceeds 2,500 cubic feet, the charge shall be .50
for each 100 cubic feet of water consumption.
Section 2. Subdivision B of Section 1 concerning the
minimum charges of any prior law is hereby repealed and is to
be in conformity with the aforementioned. All other provisions
of prior laws concerning water charges shall remain in full force
and effect.
Section 3. This local law shall take effect upon adoption
and as provided in the Municipal Home Rule Law.

LOCAL LAW NO. 12 OF 1984 REPEALING ANY AND ALL
LOCAL LAWS RELATING TO THE ALLEGED WATER RATE
CHARGES FOR THE CONSUMPTION OF WATER FOR THE
ROCKINGHAM SEWER DISTRICT, NOW TO BE KNOWN AS
A LOCAL LAW RELATING TO THE CHARGE AND COLLECTION
OF SEWER RATES FOR THE ROCKINGHAM FARMS SEWER
DISTRICT
BE IT ENACTED, by the Town Board of the Town of Wappinger,
Dutchess County, New York, as follows:
Section 1. Any prior local laws relating to the charge
of water rates for the consumption and use of water for the
Rockingham Sewer District is hereby repealed, only with
respect to water rates and the prior laws are otherwise
confirmed.
Section 2. Effective the second district fiscal quarter
of the year 1985, the following rates shall be charged for
sewer service for those connected to the Rockingham Farms
Sewer District:
A. Residential
(1) For each residential unit connected to the system
the sum of $160.00 annually and payable on a quarterly basis.
Section 3. This local law shall take effect upon adoption
and as provided in the Municipal Home Rule Law.

PROVIDE FOR THE ESTABLISHMENT OF SEWER RATES
FOR THE WILDWOOD SEWER DISTRICT
BE IT ENACTED, by the Town Board of the Town of Wappinger,
Dutchess County, New York, as follows:
Section 1. Local Law No. 1 of the year 1983 is hereby
repealed.

BE IT ENACTED, by the Town Board of the Town of Wappinger,

Section 1. Effective the second fiscal district quarter
of the year 1985, the following rates shall be charged for
sewer service to those lines that are connected to the Wappinger
Sewer Improvement #1 facilities:
A: Residential
(1) For each residential unit connected to the system
$76.00 annually payable on a quarterly basis.
B: Commercial, Industrial, Institutional
(1) For each benefit unit assigned to said premises:
$76.00 annually payable on a quarterly basis.

THE MID -POINT PARK SEWER DISTRICT
BE IT ENACTED, by the Town Board of the Town of Wappinger,
Dutchess County, New York, as follows:
Section 1. Effective the second district fiscal quarter
of the year 1985, the fee owner of property connected to the
system shall be obligated to pay the minimum charge of $62.00
each quarter, regardless of the consumption of water during
said period of time, provided the said fee owner is connected
to the system at any time during the said quarter.
Section 2. This local law shall take effect upon adoption
and as provided by Municipal Home Rule Law.

who moved its adoption:
WHEREAS, by Local Law of the Town Board of the Town of
Wappinger, provision is made for the charges for water rates
for consumption and use of mater for the Ardmore Water District;
and
WHEREAS, the charge has been set by such Local Law at the
rate of $21.50 per quarter for the first 2,500 cubic feet of
usage and a charge of $.50 per 100 cubic feet for usage over
2,500 cubic feet of water; and
WHEREAS, the Town Board desires to provide for the operation
and maintenance costs for the said Ardmore Water District and
for the operation and maintenance costs of the Central Wappinger
Water Improvement Area;
NOW, THEREFORE, BE IT RESOLVED as follows:
That out of the collections for the consumption of water
concerning the minimum usage, the sum of $9.00 per quarter shall
be paid to Ardmore Water District for its operation and maintenance,
and
BE IT FURTHER RESOLVED that the sum of $12.50 per quarter
for water plus consumption in excess of 2,500 cubic feet of
water usage be paid over to Central Wappinger Water Improvement

VETERANS EXEMPTION FROM REAL PROPERTY TAXATION
BE IT ENACTED, by the Town Board of the Town of Wappinger,
Dutchess County, New York, as follows:
Section 1: The purpose of this law is to provide that
no exemption from real property taxes shall be granted pursuant
to Section 458-a of the Real Property Tax Law of the State of
New York.
Section 2: Pursuant torthe provisions of subdivision 4
of Section 458-a of the Real Property Tax Law of the State of
New York, no exemption from real property taxes shall be granted
pursuant to Section 458-a of the Real Property Tax Law for purposes
of real property taxes levied for the Town of Wappinger.
Section 3: This local law shall take effect immediately
upon its filing with the Secretary of State.
The following resolution was offered by SUPERVISOR VERSACE
who moved its adoption:
WHEREAS, there has been duly presented and introduced at
a meeting of this Town Board on the 17th day of December, 1984,
a proposed Local Law in Relation to the Alternative Veterans
Exemption from Real Property Taxation and,
WHEREAS, the provisions of the Municipal Home Rule Law
requires that no local law shall be passed by the Legislative
Body of the Town until a Public Hearing thereon has been held
before such body,
NOW, THEREFORE BE IT RESOLVED,
1. That a Public Hearing shall be held on the said proposed
Local Law by the Town Board of the Town of Wappinger on the 10th
day of January, 1985 at 7:30 P.M. on such day at the Town Hall,

Mrs. Paino preferred to delay payment to Hayward and Pakan
until they forwarded a copy of the EPA data sheet to the Board
Members and the Engineer. This request was made by the Town
Board in September and would provide them with information
relating to the materials to be used in the construction of the
Town Hall.
The next resolution placed before the Board related to the
approval of payment to B/D Contracting to cover additional
expenditures on the contract for Robinson Lane Handicap
Facilities.
MR. VERSACE moved to table action on this matter pending further
clarification of the additional expenditures outlined by B/D
Contracting.

Mrs. Paino requested the Engineer to provide the Town Board
with a breakdown on the additional expenditures of $1,140.92.
The following resolution was offered by COUNCILWOMAN BALLARD
who moved its adoption:
RESOLVED, the sum of $400,000.00 be and is hereby appropriated
from Capital Projects, Town Hall Buildings and Land for contracts
and expenditures relating to the construction and furnishings
of the new Town Hall.

Prior to voting, Mrs. Paino noted that the Town Board would
have better control if they approved the expenditures as they
were submitted rather than appropriate the entire sum as indicated
in the resolution.
Mr. Versace responded that these monies would still be earning
interest and by approving this resolution it would eliminate
the necessity of calling meeting for Town Board approval each
time an expenditure was required. Hayward and Pakan would have
the responsibility of approving each invoice submitted before
payment was made by the Town.
After completion of the vote, Mrs. Paino clarified her "Nay"
vote and reiterated the fact that the Town Board would have
better controls over these expenditures if they had the opportunity
to review them before giving their approval for payment.

Contractors Application (#1) for payment for new Town Hall
facilities, certified for payment by the Architect (attached

Mrs. Ballard noted that all Town Board Members would receive
copies of the these applications for payments and would know
exactly what the charges included. If, after reviewing the
contents and they wished to stop payment on any of the items,
the Comptroller would be directed to defer payment. She added
that one of the amounts submitted had been adjusted downward
by the firm and felt they were looking out for the Town.
Mrs. Paino rebutted that the item Mrs. Ballard referred to was
a charge of $25,990.00 which had to be expended by the Town
and she repeated her concern that the Board Members have a
responsibility to the taxpayers of the Town and they would have
better control if they released the funds on an as needed basis.
Under Unfinished Business, a report was received from the Engineer
on the Hamilton Drainage Problem. Mr. Versace noted that further
review of the report was required by the Board and he would set
up a work shop in the near future for discussion of the problem.
MR. VERSACE moved to table the Engineer's report on the Hamilton
Drainage Problem to a later date.

Mrs. Paino requested that a letter be sent to Mrs. Hamilton
indicating that her concern would be addressed at a work shop
in January and suggested that either she or a representative
attend this -meeting. The Supervisor's Office would notify
Mrs. Hamilton of the time and date of the work shop.
At the last Town Board Meeting, a letter from John Railing requesting
confirmation that the Parson Four Lot Subdivision would be
served with Town water facilities from Central Wappinger Water
Improvement Area, was tabled due to Mr. Versace's concern regarding
the easement agreement between Mr. Parsons and the Hilltop Water
Company. A work shop session was held with the applicants for
review of the map and Mr. Versace was satisfied that the agreement
was in order.
MR. VERSACE moved to grant permission for the Parson Subdivision
to tie into the Central Wappinger Water Improvement Area.

MR. VERSACE moved to set the Reorganization Meeting for January
3rd, 1985 at 7:30 P.M. at the Town Hall, Mill Street, Wappingers
Falls, New York.

Mrs. Snowden received a late communication from Dr. Hannigan
3 requesting that the requirement for Kennels and Veterinary
Hospitals in R20 areas be changed from ten acres of land to
seven acres.
This request was referred to the newly formed Zoning Regulations
Advisory Council for review and recommendation.
Mr. Versace announced that no work shop sessions would be held
on December 20th or December 27th, 1984, due to the busy holiday
season.
Mrs. Ballard commented that one application had been received
for the position of Dog Control Office for the Town, and suggested
that she and Mrs. Paino interview the applicant and make a
recommendation to the Town Board.
MR. MCCLUSKEY moved to authorize Mrs. Ballard and Mrs. Paino
to interview the applicant for the position of Dog Control
Officer and forward their recommendation to the Board.

In response to Mr. McCluskey's request on the status of the
aquifer testing for additional sources of water in the Town,
Mrs. Ballard reported that Dunn Geoscience, the firm conducting
this test, had completed their ground work and testing and
plan to submit their report to the Board sometime in January.

for this reduction is due to the fact that there are two
industrial buildings rnow..included.in the operation and
maintenance of the sewer system. When the Board receives the
Engineer's Report sometime in January, they will consider
alternate methods to expand the system which will eventually
be required to service the undeveloped areas.
The Supervisor asked for comments for or against the proposed
Local Law.
There were no comments from the public.

New York on November 19th, 1984, a
proposed Local Law as follows:
LOCAL LAW NO. - OF THE YEAR
1984 AMENDING ALL PRIOR LOCAL
LAWS RELATING TO THE IMPOSITION
CHARGE AND COLLECTION OF
WATER RATES FOR THE CONSUMP-
TION AND USE OF WATER FOR THE
MID -POINT PARK SEWER DISTRICT.
BE IT ENACTED, by the Town Board
of the Town of Wappinger, Dutchess
County, New York, as follows:
Section 1. Effective the second
district flscat quarter of the year 1985,
the fee owner of property connected to
the system shall be obligated to pay the
minimum charge of 882.00 each
quarter, regardless of the consumption
of water during 8810 period of time, pro-
vided the said fee owner Is connected
to the system at any time during the
said quarter.
Section 2. This local law shall take ef-
fect upon adoption end as provided In
Municipal Home Rule Law.
NOTICE IS FURTHER GIVEN that the
Town Board will conduct a Public Hear -
Ing on the aforesaid proposed Local
Law at the Town Hall, Mill Street,
Village of Wappingers Falls, Dutchess
County, New York, on December 17th,
1984 at 7:30 P.M. on such date, at which
time all parties interested will be heard.
NOTICE IS FURTHER GIVEN that

A Public Hearing was held by the Town Board of the Town of
Wappinger on December 17th, 1984 at the Town Hall, Mill Street,
Village of Wappingers Falls, Dutchess County, New York on a
proposed Local Law Amending Local Law No. 5 of the Year 1975
Which Increases Commercial Rates for Central Wappinger Water
Improvement Area.
Supervisor Versace opened the Hearing at 7:45 P.M.
Present:

Joseph Incoronato, Councilman
Gerard McCluskey, Councilman
Irene Paino, Councilwoman
Elaine H. Snowden, Town Clerk
The Town Clerk offered for the record the Affidavits of Posting
and Publication duly signed and notarized. (These Affidavits
are attached hereto and made part thereof of the Minutes of
this Hearing).
Mr. Versace noted that the commercial rates for this Water Area
would be increased from $501.34 per quarter to $600,00 for each
quarter.
He then asked for comments from the public on the proposed rate
change.
There were no comments made for or against the proposed Local Law.
MR. VERSACE moved to close the Public Hearing, seconded by Mr.
Incoronato and unanimously carried.
The Hearing closed at 7:50 P.M.

Section 2. There shall be a minimum
charge, however, of 8600.00 per quarter
for any user falling within the above
mentioned usages.
Section 3. This local law shall take ef-
fect upon adoption and as provided in
the Municipal Home Rule Law.
