1984-12-06 PH Book 2A Public Hearing was held by the Town Board of the Town of
Wappinger on December 6, 1984 at the Town Hall, Mill Street,
Village of Wappingers Falls, Dutchess County, New York, on a
proposed Local Law Amending Local Law No. 7 of 1980 With Respect
to the Imposition and Charge for Water Rates for the Consumption
and Use of Water for the Oakwood Water District.
Supervisor Versace opened the Hearing at 7:30 P.M.

The Town Clerk offered for the record the Affidavits of Posting
and Publication duly signed and notarized. (These Affidavits are
attached hereto and made part thereof of the Minutes of this
Hearing).
Mr. Versace noted that the 1984 rate is $33.00, the proposed rate
for 1985 will be $55.00 minimum charge per quarter which will cover
the operation and maintenance and eliminate the present deficit of
$3,500.00. The New York State Department Of Environmental Conser-
vation has indicated that capital improvements will be required for
this district which will be financed through bonding; public hearings
will be held before any expenditures are approved.
Mr. Versace asked for comments or questions from the public.
No one spoke either for or against the proposed Local Law.
MR. MCCLUSKEY moved to close the public hearing, seconded by
Mrs. Ballard and unanimously carried.

BE IT ENACTED, by the Town Board

County, New York, as follows:
Section 1. Effective the second
district fiscal quarter of the year 1985,
the following rates shall be charged:
the owner shall be obligated to pay the
minimum charge of S55.00 per quarter,
regardless of the consumption of water
for said quarter, provided said owner Is
connected to the system a1 any lime
during the quarter.
Section 2. All other provisions of
Local Law No. 7 of the year 1980 are
hereby ratified, with the exception of
Section 1 subdivision B which this local
law hereby amends and which refers to
the minimum charges for consumption
of water.
Section 3. This local law shall take ef-
fect upon. adoption and as provided by
the Municipal Home Rule Law.
NOTICE IS FURTHER GIVEN that the
Town Board will conduct a Public Hear-
ing on the aforesaid proposed Local
Law at the Town Hall, Mill Street,
Village of Wappingers Falls, Dutchess
County,'New York on December 8, 1984

The Town Clerk offered for the record the Affidavits of Posting
and Publication duly signed and notarized. (These Affidavits
are attached hereto and made part thereof of the Minutes of
this Hearing).
It was noted by Mr. Versace that the present rate for CWWIA
is $12.75 minimum charge per?quatter, the proposed rate is
$15.00 per quarter, an increase of $2.25 per quarter which is
necessary for the operation and maintenance costs. Installation
of the water meters have been completed.
Mr. Versace asked if there were any comments or questions from
the public.
Mrs. Alberta Roe, Regency Drive, suggested that the amount of
cubic feet allowed for the minimum charge be reduced and the
present rate of $12.75 per quarter remain the same. The maximum
amount allowed at that rate is 2,500 cubic feet; for those using
over that amount, the rate is $.50 per 100 cubic feet. At present,
since she is a single occupant in her home, Mrs. Roe uses 600
cubic feet of water each quarter; when there were two in the house,
the usage was under 2,000 cubic feet. She contended that the
larger families who use the extra water or those who waste it
should pay for it, the burden should not fall on single users
or senior citizens.
Mrs. Crosby, Comptroller, pointed out that the proposed rates
were based on the expected expenses of this Improvement Area
and if the present rate remained the same these expenses would
not be met. The present rate for the overage amount, $.50 per
100 cubic feet would have to be raised possibly to $.60 per
100 cubic feet to make up the difference between the $12.75
present rate and the proposed rate of $15.00 per quarter.
Mrs. Roe agreed since that was her point ---let those who use
it pay for it.
Mr. Incoronato asked the Comptroller to recompute the figures,
keeping the minimum rate and allowable amount of water the same,
($ 12.75 per quarter for all users up to and including 2,500
cubic feet) and make up additional revenues by raising the
amount for excess usage; the Board could then review the formula
to determine if it was a workable one and would provide the
revenues required to operate and maintain the system.
Mr. Versace asked if there were any other comments or suggestions
from the public.
There were no other comments made on the proposed Local Law.
MR. VERSACE moved to close the Public Hearing, seconded by Mr.
McCluskey and unanimously carried.

Mr. Versace explained that this credit is due to the healthy
financial status of this district, however, if more than the
allowed amount of 2,500 cubic feet is used, the customer will
be charged $.50 for each 100 cubic feet of water consumption.
The Supervisor asked if there were any comments or questions
on the proposed credit for this district.
There were no comments made either for or against the proposed
Local Law.
MR. VERSACE moved to close the Public Hearing, seconded by
Mrs. Paino and unanimously carried.

Section 1. Each unit billed within the
Ardmore Water District shall receive for
each billing quarter during 1985 a credit
of 521.50, such rate being the minimum
rate in effect commencing the second
fiscal district quarter for the year 1985.
Section 2. This local law shall ,
become effective Immediately upon
adoption and as provided in the
Municipal Home Rule Law.
NOTICE IS FURTHER GIVEN that the
Town Board will conduct a Public Hear-
ing on the aforesaid proposed Local
Law at the Town Hall. Mill Street,
Village of Wappingers Falls, Dutchess

Alberta Roe, Regency Drive asked who there was a deficit of $68,000. when
the year started with an overage.
There were no further comments from the public either for or against this Law.
MR. VERSACE moved to close the Public Hearing seconded by Mr. McCluskey and
unanimously carried.

the Rockingham Farms sewer district:
A: Residential
(1) For each residential unit con-
nected to the system the sum of
5180.00 annually and payable on a
quarterly baste.
Section 3. This local law shall take ef-
fect upon adoption and as provided In
the Municipal Home Rule Law.
