LIEBERMANN Fire Inspector Office: 914-297-1373 . \:.1 MEMO RAN DUM .~ '-'...- ::.4 ' DATE: TO: FROM: RE: APRIL 18, 1990 TOWN BOARD MARK LIEBERMANN, FIRE INSPECTOR CODE ENFORCEMENT PROCEDURES IN In March of this year the Fire Prevention Bureau drafted a letter to Governor Cuomo, urging a change in legislation to allow the local Code Enforcement Officials to review plans and enforce and administer the Uniform Code (9NYCRR) in all public school buildings. Title 19 New York Codes, Rules & Regulations, (19NYCRR) Part 411.2E, provides that all buildings owned and occupied by school districts and BOCES shall fail under the jurisdiction of the State Education Department with regards to enforcement of the Uniform Code. Since the Coldenham disaster, there have been many articles relating to the State Education Department not having the time or manpower to review plans for new buildings, nor do they make any on site inspections during the construction process. In addition, a school district designated Health and Safety Officer is responsible for enforcement and overseeing the application of provisions of the Uniform Code is in the school districts. <"1 This procedure does not guarentee that violations will be corrected. The only possible way to guarentee that our schools will be properly inspected and that existing violations will be properly corrected, is to return <the enforcement and administration of the Uniform Code in public school buildings back to the local authority having jurisdiction and the local Code Enforcement Officials. In the April 14, 1990 edition of the Times Herald Record of Middletown, New York, Assemblyman Bennett of Newburgh is proposing this very change. - Page Two - Attached for your review are the lettezsthat the Fire Prevention Bureau have received_in support of this request to change legislation and related articles.
