As an outgrowth of our October 31, 1997 meeting, I have reviewed the
sections you requested in your October 20, 1997 letter to our office and
advise the following:
1 . Section 36 - Service Pi De, Sewer and Water:
I believe this section should be redefined and clarified
especially as to whose responsibility it is to construct
and maintain the water service and sewer lateral.
2. Section 37 - Sewers:
This section appears to be acceptable and in current
use. However, in Article 3 through Article 7, the rates
will need to be modified on yearly basis.
3. Section 40 - Solid Waste, DumDing Ground ReQulation:
This section is very confusing as Local Law No.1 of
1969 says that only the Town can dump (bury)
garbage. Local Law No.1 of 1977 says that nobody
can except private property owners. Therefore, these
statements appear to be contradictory. This should be
reviewed and straightened out by the Town Board.
Local Law No.6 of 1989 appears to be acceptable.
4. Section 41 - Streets and Sidewalks, Driveways and
Excavations, Maintenance of UnacceDted Streets and
Street SDecs:
I have checked these and recommend that the CUriem
Town Highway Specifications be included, not the old
ones.

Graham Foster should be asked if there is any
modification that he would want in the current Town
Highway Specifications. I believe there might be some
small changes.
The driveway section should be re-drafted to meet
current standards.
The excavation section appears acceptable, however,
the insurance coverage limit appears to be rather low.
The maintenance section of the unaccepted streets, I
belive is in the Highway Specifications (this section
should be reviewed and added to, if necessary) and
could be deleted. This should be verified.
5. Section 48 - Water System Construction Regulations:
In Article 2 through 8, the water rates should be
checked.
In Article 9, the Local Law regarding the installation of
water services should be checked and re-drafted with
comments from Camo Pollution Control, Inc. and
Graham Foster.
I think a meeting should be arranged with the appropriate people so that
the recommendations can be made to the Town Board for what we feel
should be re-drafted and altered.
