2000-03-08 ... -.... - - - HUDSON RIVER VALLEY GREENWAY C}J~~UNITI[S (OU\-\c.\\ RESOLUTION Adoption of Dutchess County Compact Strategy Greenway Connections Hudson River Valley Greenway Communities Council March 8, 2000 Whereas, the Hudson River Valley Greenway Act (hereinafter; the "Greenway Act") Chapter 748 of the Laws of 1991, has as a legislative goal the establishment of the Greenway Compact, a process for voluntary regional cooperation and decision- making among the communities of the Hudson River Valley; and Whereas, the Greenway Council has, by resolution, designated the counties of the Greenway area as the regions within which the Compact will be developed; and Whereas, Dutchess County has, through an intensive process of public participation, created a Greenway Compact strategy for Dutchess County entitled Greenway Connections: and Whereas Greenway Connections provides for a voluntary, botto~ up process for communities in the county to address issues of growth, economy and environment in both a local and regional context and addresses the criteria set forth in the Greenway legislation; and . Whereas, Greenway Connections has been presented to the Greenway County Planners Advisory Council comprised of all of the county planning departments within the Greenway Compact area; and Whereas, the County Planning Advisory Council has recommended that the Greenway Council take favorable action on Greenway Connections; and Whereas, the Greenway Council has completed a review under the State's Environmental Qu~lity Review Act and has preliminarily determined that Greenway CAPiTOl BUilDiNG ce&mp1&~~o ltill~ns4 I AlBANY, NEW YORK 12224 I J 1 B.473-3835 I 518.426.0330 FAX I ].800.TRAllS.92 I hrgreenwoy@ool.com .... Connections warrants a "negative declaration" under Article 8 of the Environmental Conservation Law; and Whereas, the Greenway Council has notified all potentially involved state agencies of its desire to serve as lead agency and its preliminary determination of negative declaration of environmental significance; and Whereas, the Greenway Council has received no objection from any potentially involved agency to its serving as lead agency; and Whereas, information copies of the lead agency letter, environmental assessment form and a summary of Greenway Connections have been distributed to all Dutchess County municipalities; Whereas, implementation of the Greenway Connections in Dutchess County will not occur unless it is adopted by resolution and local ordinance by one or more of the communities in the county; Whereas, adoption of Greenway Connections is consistent with the strategy of developing "Quality Communities" in New York State as set forth by Gov. George E. Pataki in an executive ordered issued January 21,2000, NOW THEREFORE BE IT RESOLVED: 1- That the Greenway Council declares itself lead agency for purposes of environmental review of the proposed action and declares adoption of Greenway Connections to be a Type I action; and 2- That the Greenway Council has prepared and hereby adopts the annexed negative declaration of environmental significance for the proposed action and directs the Executive Director of the GreenwayCouncil to file and publish said negative declaration as required by the State's Environmental Quality Review Act; and 3- That the Greenway Council approves Greenway Connections as presented by Dutchess County and adopts it as the first Greenway Compact strategy in the Hudson River Valley; and 4- That the Executive Director of the Greenway Council is hereby authorized and directed to distribute Greenway Connections to all municipalities in Dutchess County with appropriate information concerning the significance and benefits of the Greenway Compact and procedures for adoption. compactresolution 2 ....
