Inc - Salvaee Dealers' License Renewal Albert Weinert Jr., President 1980 Route 9D Wappingers Falls, New York Tax Grid #6056-02-688723 & 6056-02-721673 Dear Supervisor Ruggiero, The ordinance addressing the licensing of salvage yards (junk yards) was adopted by the Town of Wappinger on December 29, 1960, amended in 1977, 1984, and some sections were further amended in 1999, 2003, 2004. Although the Schedule of Use Regulations makes no mention ofthis particular use, the presence of a specific Ordinance dealing with the licensing of said use indicates that junkyard(s) were in existence in the Town prior to zoning. The above referenced salvage yard was already in existence in the 1960's and a letter dated 1971 lists the name as Mid-Hudson Auto Wreckers. I have found no record of any Site Plans. A W Scrap Processors applies annually for the Salvage Dealers' License as required by Section 153-5 of the Code of the Town of Wappinger. The prepared application, plus the licensing fee, is submitted to the Town Clerk. The Town Clerk advises the Fire Inspector and myself of the application and inquires whether there are any pending issues or violations on the specific property. Although the renewal is submitted prior to the expiration ofthe license on December 31rst, the annual inspection by both Mr. Liebermann and myself usually occurs when weather conditions allow us to see what 1 would otherwise be covered by snow and ice. Both Mr. Liebermann and I inspect the site to verifY that the conditions stated in the ordinance are adhered to. We apprise the owner ifthere are items which need to be addressed and do not recommend approval of the license until such concerns are addressed. In my experience, the various issues have always been addressed within several weeks, at which time we would conduct a re- inspection to verifY compliance. . I attach a copy of Mr. Lieberrruinn's current inspection report. My concerns this year, voiced directly to Mr. AI Weinert, who accompariied me during the inspection, were these: . Fence along Route .9D is in disrepair and must be replaced or comprehensively repaired. . This is to be done within two weeks. . entry gate needs to be stabilized. . The entry to the sjte from Route 9D needs to be paved to eliminate, as much as possible, the dust generated by traffic entering and leaving the site. The owner had already planned to pave the entrance this summer. Gravel is to be put down within several weeks as a temporary measure while arrangements are being made foJ," the pavmg. The requirements of the Ordinance dealing with distances from residential boundaries are satisfied. The ac<;ess lanes are ample and the yard looks less congested and more organized than last year. There are areas where there was clearing of brush but I saw no evidence of trees being cut. An attempt at a general clean-up is evident. The hours of operation are well within the time frame allowed by the Code which restricts operations to between 7am to 7pm, and makes no mention ofthe exclusion of week-ends or holidays. This salvage yard is open weekdays and half a day on Saturday. No business is conducted on Sundays. When asked whether regular inspections were conducted by the DEe. Mr. Weinert replied that DEC inspectors had come to the yard roughly 3 times in the last 8 years, following up on complaints regarding oil spillage and soil contamination. The business was never cited or given instructions to remedy a specific situation. However, the DEC inspectors did want to see records kept on site as to the disposal of tires. I mentioned to Mr. Weinert that there had been reports of blasting or explosions from his site on weekends. He replied that he himselfhad heard the explosions last summer but could not pin-point from whence they came. His guess was somewhere to the south, possibly Fishkill, maybe Beacon. I have included photos taken recently at the site.
