1982-10-04 SPMA Special Meeting of the Town Board of the Town of Wappinger was held on October 4, 1982, at the Town Hall, Mill Street, Village of Wappingers Falls, Dutchess County, New York. Supervisor Diehl opened the meeting at 7:04 P.M. Present: Louis Diehl, Supervisor Gerard McCluskey, Councilman Bernice Mills, Councilwoman Frank Versace, Councilman Elaine H. Snowden, Town Clerk Absent: Nicholas Johnson, Councilman Notice of said meeting had been sent to each Board Member on September 30, 1982, calling the meeting for October 4, 1982 at 7:00 P.M. to consider action on stream cleaning in the Rockingham Area, an addition to the Highway Garage and the Pop Warner Contract. Notices had been sent to the three news- papers, four radio stations and posted on the Town Clerk's Bulletin Board. MRS. MILLS moved that the Highway Department be authorized to do stream cleaning in the Rockingham Area, hire additional equipment, if necessary, and submit voucher to the Comptroller for payment. Seconded by Mr. Versace Motion Unanimously Carried Residents of that area questioned the Board on what portions of the streams they intended to clean out and Mr. Versace explained that every water easement would be cleaned out starting in the Angel Brook Area all the way down to the Rockingham Development. It would not include Sprout Creek. One resident later identified as Mrs. firimshaw, 29 Regency Drive, expressed concern that cleaning these easements could cause flooding of her property since the water would flow more rapidly. She also felt that they should consider cleaning farther down toward Old Hopewell Road, since water backups in that area and causes flooding in the Rockingham area when it rains heavily or for long periods. The Board agreed to address this problem if the sit uation was not relieved. The next item was to consider an addition to the Highway Garage which had previously been requested by the Highway Superintendent. MR. MCCLUSKEY moved that the Highway Superintendent be authorized to go to bid on an addition to the Highway Garage. Seconded by Mrs. Mills Motion Unanimously Carried The third item for consideration by the Board was the Pop Warner Contract. A discussion followed when Mr. Diehl commented that he had questions on the contract. Mr. Versace pointed out that this money had been allocated for football in the 1982 budget which was approved by the Board and should be utilized by this organiza- tion. Mr. Versace moved that the sum of $1,500.00 which was itemized ,in the 1982 Budget of the Recreation Commission for football, be forwarded to Pop Warner League for their use in providing football for the youth of the Town and Mr. Diehl seconded the motion. Before the vote was taken, Mrs. Schmalz was recognized by the Chair and informed the Board that the League did not need this money --all their bills were paid and the equipment had been purchased for the season. She repeated a statement made at a previous meeting that this contract or any other method used to give monies or equipment to private organizations was a violation of the Gift and Loan provision, Article 8, Section 1 of the State Constitution. Mr. Versace and Mrs. Schmalz continued the dis- cussion - he stating that the Town should support programs for the youth of the Town, and Mrs. Schmalz contending that the monies could not be given to private organizations, but could be used for Town sponsored programs. Mr. Versace also differed with Mrs. Schmalz's statement that the League did not need the money since he had spoken to the President and heard a different story. Mr. Versace concluded the discussion by rescinding his motion to forward the designated amount of money to the League and the Board agreed to invite the Board of Directors of the Pop Warner League and the Attorney to the Town to a budget work shop to discuss the financial status of the League, both present and future. There was no other business to come before the Board. Mr. Versace moved to close the Special Meeting, seconded by Mr. McCluskey and unanimously carried.
