Re: Comp Time
Dear Supervisor Smith:
The court is in receipt of your memo dated September 25th. We do feel
that there is a wrong interpretation regarding Comp'Time. Our understanding was
that when the long vacant Deputy Court Clerk position was filled, after Mrs. Hait's
promotion to Chief Court Clerk in January of 1991,that the court would cut down
on the part time hours and eliminate any part time positions where feasible. The
court now has only two part time positions which have been cut back to seventeen
hours or less per week and the third part time position has been eliminated totally.
As far as Compensatory Time is concerned the Town certainly can not expect
the staff to work a thirty-five hour daytime schedule plus the numerous evening
hours required by Judge Wolfson. We feel that the Compensatory Time is an ideal
situation at a time when all local municipalities are hard pressed-financially, since
it represents no additional monies be spent.
The court has a smooth running, efficient staff, who work diligently on
our behalf. Indeed, with the Deputy Court Clerk position remaining open for such a
long time, our part timers literally put in full time hours to keep the court
running efficiently. Many days the personnel worked right through lunch without
being compensated for it. Indeed we feel the Supervisor and the Town Board should
commend our staff for its excellent service.
The Compensatory hours are taken hour for hou~ There is no such thing

as time and a half or double time, which many people would expect in this situation.
The Town Board should be aware of the fact that with our new Deputy Court Clerk the
Compensatory Time will be drastically reduced. However, it will not be completely
eliminated.
In the event that ,there is still some question about the propriety of
Comp Time, we request a meeting with the Supervisor and the Town Board to clarify
this situation once and for all.

It has been brought to my attention by the Comptrollers
Office that your employees are still applying for comp
time. It was my understanding that once a new deputy was
hired no more comp time would be applied for.
If you feel that this is not agreeable or the wrong
interpretation and would like to meet with myself or the
Board please let me know.
